2 Garbage Collection Bylaw 244, 2007 Page 2 of 7 CITY OF POWELL RIVER BYLAW 244, 2007 A bylaw to provide for the control, collection and removal of garbage within the City of Powell River The Council of the City of Powell River in open meeting assembled enacts the following:. This Bylaw may be cited as the "Garbage Collection Bylaw 244, 2007". 2. For the purposes of this bylaw: (a) Acceptable Waste means mixed waste from households and small businesses within the boundaries of the City of Powell River and non-industrial waste from industrial sites, including putrescible and non-putrescible waste such as, but not limited to garbage, rubbish, refuse, ashes (excluding incinerator ashes) and small quantities of paper; but the term does not include unacceptable waste as defined herein. (b) "Business Premise" means any strata apartments, condominiums and municipal facilities. (c) Collector means the person appointed by Council as the Director of Financial Services/Collector for the City of Powell River. (d) "Council" means the Council of the City of Powell River. (e) Corrugated Cardboard means any containers and packaging constructed with a layer of rippled paper material sandwiched between two or more sheets of smooth paper. (f) City means City of Powell River. (g) Engineer means the City Engineer of the City of Powell River or his delegate. (h) "Garbage means any waste material or Acceptable Waste from a residential or business premise but does not include Unacceptable Waste. (i) "Garbage Bin" means a mechanically dumped garbage container, the capacity of which does not exceed four cubic meters (4 m³). (j) "Occupant" means any person occupying any residential premise or business premise but does not include any person who is a boarder, roomer or lodger or a person living in an apartment house. (k) "Owner" means the owner of any residential premise, business premise, or apartment house. (l) "Residential Premise means any single family or two family dwelling. 3 Garbage Collection Bylaw 244, 2007 Page 3 of 7 (m) "Single Family Dwelling" means a detached building occupied exclusively by one family. (n) "Two Family Dwelling" means a building occupied exclusively by two families living independently of each other. (o) Unacceptable Waste means prohibited wastes as defined in the Ministry of Environment Landfill Criteria for Municipal Solid Waste dated June 993 (Schedule 2) as amended from time to time, and includes but is not limited to: (i) (ii) corrugated cardboard; yard waste and land clearing debris including stumps; (iii) construction/demolition waste, including lumber, roofing, gypsum wallboard, flooring tiles and asbestos; (iv) rubble, including soil, rocks, concrete and asphalt; (v) scrap metal or white goods; (vi) tires; (vii) waste oil and vehicle batteries; (viii) biomedical waste; (ix) incinerator ashes; (x) contaminated soils as defined by the applicable law; (xi) wastes not included in the definition of Acceptable Waste under this bylaw. 3. The Owners or Occupants of all premises shall place all garbage for collection in garbage bags measuring approximately 66 centimeters (26 inches) in width and 9 centimeters (36 inches) in length and shall ensure that each bag is securely fastened. Garbage bags shall be of heavy duty construction and not easily torn, punctured or stretched and as necessary shall be placed out for collection in a fashion that prevents disturbances of the garbage by animals. No garbage bag shall be filled so that the gross weight of the bag and its contents exceed 2 kilograms (26.5 pounds). 4. (a) Where an open lane adjoins any premises, any garbage bag for collection shall be put at the edge of the lane so that it is readily accessible to the garbage collectors from the lane. (b) Where there is no lane adjoining a premise, any garbage bag for collection shall be put on the boulevard at the back edge of the sidewalk or at the edge of the road so that it is readily accessible to the garbage collectors from the street. 5. Where the receptacle for garbage collection is a mechanically dumped garbage bin, the owner or occupant of the premises shall cause the bin to be placed in a location that in the opinion of the Engineer is readily accessible to any City garbage truck. No garbage shall be collected by the City garbage collectors from the interior of any building on any premise. 7 (a) The garbage collectors shall remove from any single family occupying a premise, only those garbage bags with an affixed City garbage tag. (b) Removal of excessive amounts of garbage may be made at the discretion of a City garbage collector and the removal is subject to the charges set out in Schedule "A" attached hereto and forming part of this bylaw. 8. No liquids or free water shall be put or placed in, or allowed to accumulate in any garbage bin and all bins shall be securely covered. 9. No person shall place out for removal as garbage any Unacceptable Waste. Only that garbage conforming to the definition of Acceptable Waste will be removed by the City garbage collectors. 0. (a) Where there is a dog loose on a premise, no garbage collector shall be required to collect garbage from that premise. (b) Where the garbage collector requests the Occupant or Owner of a premise to tie up or confine any dog that interferes with the removal of garbage, the Occupant or Owner shall comply with the collector's request.. Any cart, wagon or vehicle that is used for the purpose of conveying swill, offal or garbage shall have a securely fitting cover and shall be free from leaks and shall be of a pattern and designation approved by the Medical Health Officer for Powell River Community Health. 2. (a) Any Occupant or Owner shall pay to the City the fees and charges for the collection and removal of garbage as set out in Schedules A and B attached hereto and forming part of this bylaw. (b) Where the Owner or Occupant of any premise does not utilize the City service for garbage collection and removal, he shall be charged the minimum applicable rate for the premise as set out in Schedule A. (c) Any fees or charges that remain unpaid on 3 December in any year shall be added to and form part of the taxes payable in respect of the premises from which the garbage was collected and shall be entered upon the Collector's Roll as taxes in arrears. (d) In the event of any legal work stoppage caused by a labour dispute, Council may, by resolution, authorize a refund of garbage collection fees for any period of time where garbage collection service was not available. 3. If any section, subsection, clause or phrase of this Bylaw is for any reason held to be invalid by the decision of a Court of competent jurisdiction, the invalid portion shall be severed and the decision that it is invalid shall not affect the validity of the remainder. 4. Any person who contravenes any of the provisions of this Bylaw commits an offence and shall be liable to prosecution under, and the penalties imposed pursuant to, the Offence Act (BC). 6 Garbage Collection Bylaw 244, 2007 Page 6 of 7 SCHEDULE "A" GARBAGE COLLECTION Domestic - Collection and Disposal. Collection of domestic waste will be on a scheduled basis as per the City garbage collection calendar. There shall be raised, levied and collected commencing in the year 207 an annual charge of $76.50 for domestic collection, which will be billed on property tax notices. The annual payment will be due on or before the first working day after 0 July of each year. 2. Annual rates shall be subject to a ten percent (0%) penalty on any portion that is not paid on or before the due date stipulated in Section above. 3. Domestic properties that come into existence part way through a calendar year will be charged a prorated amount, if they come into existence after 0 January of any calendar year. 4. A garbage tag indicating payment of the $2.00 disposal fee must be affixed to each bag of Acceptable Waste. 5. Property owners who are not assessed for garbage collection on their property tax notices will be sent a separate billing for their garbage collection fees, which will become due and payable within thirty (30) days after the billing date. Any fees or charges that remain unpaid and outstanding after ninety (90) days will be subject to additional collection fees levied against the strata organization or persons responsible for payment of disposal fees. 7 Garbage Collection Bylaw 244, 2007 Page 7 of 7 SCHEDULE "B" GARBAGE COLLECTION Commercial - Collection and Disposal. Commercial collection shall apply to strata apartments, condominiums and City facilities. 2. Collection only of Acceptable Waste shall be in accordance with a City route schedule and the collection rates are as follows: Garbage Bags and Barrels: - 5 bags $2.30 per pickup 6 or more bags $5.40 per pickup or more barrels $5.40 per pickup Municipal Mechanical Bin: bin $.85 per pickup 2 or more bins situated at the same location $.85 per pickup for first bin and $ 6.20 per pickup of each additional bin Bin Rental: Rental of the 2 cubic yard bin Rental of the 4 cubic yard bin $7.00 per month $34.00 per month 3. A garbage tag indicating payment of the $2.00 disposal fee must be affixed to each bag of Acceptable Waste. 4. The disposal fee for the Acceptable Waste in the City's mechanical bins will be the current mixed waste tipping fee as established by the Powell River Regional District. 5. The Director of Financial Services is authorized to adjust the disposal fee described in Item 4. above, upon receipt of written notification from the Powell River Regional District of their current mixed waste tipping fee. 6. By written request from individual Strata Councils, the annual disposal fees for strata condominiums will be calculated by using the monthly volumes collected in Bylaw Amendment No Consolidated November 27, 207
