CLAIMS All ware is inspected, checked and packed by experienced personnel. Precautions are taken against breakage or other damage in transit. Our responsibility ceases upon delivery of material in good order to the carrier. All claims for loss or damage in transit must be filed with the carrier by Buyer. Sayco will give all reasonable assistance to Buyer in collecting a loss or damaged claim from the carrier by furnishing duplicate invoice, affidavits showing count when loaded, method of loading, etc. Buyer should in all cases immediately report loss and/or damage to carrier and request inspection in case of damage. On a loss claim Buyer should secure all pertinent information and include it with the signed exception report. CONSENT TO PERSONAL JURISDICTION AND VENUE; GOVERNING LAW; WAIVER OF JURY TO TRIAL The Buyer hereby agrees that any action brought by the Buyer or by Sayco arising out of the sale or use of the products referred to in the Price List shall be governed and determined in accordance with the statutory and decisional law of the State of South Carolina; and the Buyer hereby agrees that any controversy which may arise out of the sale or use of the products referred to in the Price List would involve complicated and difficult factual and legal issues and that, therefore, any action brought by Sayco against the Buyer or brought by the Buyer, alone or in combination with others, against Sayco, whether arising out of sale or use of the products referred to the Price List or otherwise, shall be determined by a Judge sitting without a jury. LIMITED WARRANTY Sayco warrants its products to be free from defects in material and workmanship under normal use and service. The company's obligation under the warranty shall be to replace any products of its manufacture which are defective or at the company's option, to refund the purchase price of such products or to repair such products. The warranty set forth does not cover installation or any other labor charges and does not apply to products which have been damaged as a result of any accident, abuse, improper installation or maintenance,or modification of the original plumbing product. THE WARRANTY SET FORTH IS IN LIEU OF ANY OTHER WARRANTY, EXPRESSED OR IMPLIED, INCLUDING MERCHANTABILI- TY, FITNESS FOR A PARTICULAR PURPOSE, AND WAR- RANTIES ARISING FROM COURSE OF DEALING OR USES OF TRADE, AND SHALL APPLY ONLY TO THE ORIGINAL PURCHASER. HOW TO OBTAIN WARRANTY SERVICE The Purchaser should contact the dealer or builder from whom the product was purchased or upon written request addressed to Sayco Faucets, P.O. Box 1728, Goose Creek, SC Any shipping charges associated with warranty service must be prepaid by the consumer.
