RECOMMENDATION: THAT Delta Garbage Collection & Regulation Bylaw No. 4273, 1988 Amendment Bylaw No. 7435, 2015 be given first, second and third readings _ ~ PURPOSE: The purpose of this report is to provide Council with information regarding Metro Vancouver's Organics Disposal Ban and to seek Council's endorsement of Delta Garbage Collection & Regulation Bylaw 4273, 1988 Amendment Bylaw NO.7 435, 2015 (Attachment A).... BACKGROUND: Metro Vancouver's Integrated Solid Waste and Resource Management Plan was endorsed by Delta Council and approved by the Ministry of Environment in The Plan commits Metro Vancouver to ban the disposal of organics (food waste and foodsoiled paper) from regional waste facilities by At the April 28, 2014 Regular Meeting, Council received information regarding Metro Vancouver's plans to implement an Organics Disposal Ban in The ban was approved by the Greater Vancouver Sewerage & Drainage District in October 2014 and was subsequently implemented by the region on January 1, III DISCUSSION: Metro Vancouver's Organics Disposal Ban applies to all sectors in the region including single-family, multi-family, commercial, institutional, and industrial properties. As outlined in Attachment B, the ban is being phased in over three years targeting large volume food producers first (e.g. grocery stores and restaurants). Implementation will be based on a declining threshold of allowable organics in the garbage. For example, following the six-month education period, if a load of garbage delivered to a regional facility contains more than 25% organics, the entire load will be subject to a financial

2 Page 2 of 3 Delta Garbage Collection and Regulation Bylaw Amendments April 16, 2015 penalty in the form of a surcharge (50% of the total garbage tipping fee will be added to the load). The threshold will decrease to 10% in 2016 and to 5% in Single-Family Residential Properties Through Delta's Green Can program, organics collection service is available to all single-family properties in Delta. Approximately 27,000 properties receive this senice in addition to weekly curbside garbage and recycling collection. The Green Can program is funded through Delta's annual Garbage Utility. Delta Garbage Collection and Regulation Bylaw No. 4273, 1988 outlines guidelines for single-family collection senice. With the introduction of Metro Vancouver's Organics Disposal Ban, updates are required to this bylaw to accurately reflect the regional disposal bans as well as Delta's current collection programs and practices. Highlights of the proposed amendments to Delta Garbage Collection and Regulation Bylaw No. 4273, 1988 include: Adding definitions for food waste and yard waste, revising definitions for garbage and recycling, and removing definitions for bulky waste, rubbish and trade waste; It Specifying current collection guidelines; and Revising language to clarify certain clau$es. Multi-Family Residential Properties Multi-family properties in Delta (apartments, condominiums, float homes and some townhomes) arrange garbage collection senice with private waste haulers. Delta provides recycling collection senice to multi-family properties, a service funded through Delta's annual Multi-Family Recycling Utility. As multi-family properties already contract garbage collection with private waste haulers, the collection of food waste (traditionally in the garbage stream) is best suited to remain the responsibility of multi-family properties. Many private waste haulers in the region offer organics collection and can tailor their senice to individual complex needs. Although Delta provides recycling collection services, this only relates to the collection of paper, plastics, containers and glass. Metro Vancouver is encouraging properties to set-up private organics collection senice and has made relevant information available on their website: Many multi-family properties in Delta have already implemented organics collection programs and have contacted staff for information and resources. Staff will continue to assist complexes with program information as requested. Industrial, Commercial and Institutional Properties Delta does not collect or regulate solid waste collection from industrial, commercial or institutional properties. Owners and occupants are responsible to arrange private organics collection senice, in addition to existing private garbage and recycling collection. Metro Vancouver's website also includes relevant information for industrial, commercial and industrial properties.

II CONCLUSION: A regional Organics Disposal Ban was implemented on January 1, Delta's Garbage Collection and Requirement Bylaw No. 4273, 1988 requires updating to reflect current material banned and prohibited from disposal as garbage. Definitions and current practices have been updated in the bylaw. Multi-family residential, industrial, commercial and institutional properties can arrange organics collection service with private waste haulers similar to garbage collection service. This bylaw may be cited for all purposes as "Delta Garbage Collection & Regulation Bylaw No. 4273,1988 Amendment Bylaw No. 7435, 2015". 2. "Delta Garbage Collection & Regulation Bylaw No. 4273, 1988", as amended, is hereby further amended by: i. adding the following definitions in Section 1: ""food waste" means waste that originates from residential sources including cooked and uncooked meat, fish, bones, dairy products, bread, baking products, fruits and vegetables, egg shells, nutshells, coffee grinds, tea bags, and food -soiled papers including pizza boxes, paper plates, napkins, and coffee filters; "yard waste" means plant waste that originates from residential sources including grass and tree clippings, leaves, prunings, plants, and flowers but does not include sod, dirt, stumps, logs, wood, or any item exceeding 15 cm in diameter;" ii. deleting the "garbage" and "recyclable material" definitions in Section 1 and replacing them with the following definitions: "garbage" "recycling" means all rejected, abandoned or discarded waste that originates from residential sources but does not include food waste, yard waste, construction, demolition or home renovation waste or any banned or prohibited material identified under the Greater Vancouver 'Sewerage and Drainage District's Tipping Fee and Solid Waste Disposal Regulation Bylaw; means clean material intended to be recycled including: (a) newspapers or other paper printed on newsprint; (b) paper products, not including wax paper; (c) glass household bottles and jars; (d) metal household cans and foil trays; (e) plastic household containers with The Society of Plastics Industry, Inc. symbols "1 ", "2", "3", "4", "5", "6", or "7";

5 Bylaw No ATIACHMENT A Page 2 of 3 (f) paper household containers including disposable coffee cups and dairy carton containers;" iii. deleting the following definitions from Section 1: ''''bulky waste" means large auto parts, tires, furniture, large appliances, large crates & boxes, trees, roots and stumps; "rubbish" "trade waste" means any garden refuse, remains of fuel after burning, metal, tins, bottles and crockery not having contained food; means all waste resulting from processing, manufacturing or other business or industrial operations;" iv. deleting Section 3 in its entirety and replacing it with the following: "3. Every owner or occupier of land or Dwelling Unit served by the garbage collection system of The Corporation of Delta shall: (a) Place all garbage for collection in a maximum of two containers designed as garbage cans, each container to be a maximum of 25 kg in weight and 100 L in volume and provided with a water tight cover, and/or in plastic garbage bags securely tied; (b) Place food waste and yard waste for collection in a container or containers designed as a garbage can, each container to be a maximum of 25 kg in weight and 100 L in volume and provided with a water tight cover, labeled with a Corporation of Delta Green Can sticker or place yard waste only in Kraft paper bags; (c) Contain yard waste consisting of branches or prunings up to 15 cm in diameter for collection in tied bundles to be a maximum of 25 kg in weight and 1 meter in length; (d) Place all sorted recyclable material for collection in designated receptacles which include a Blue Box, to be a maximum of 55 L, a Yellow Bag for mixed paper, and a Blue Bag, for newspaper and newsprint; (e) Place excess cardboard intended for recycling in tied bundles to be a maximum of 1.0 m x 1.0 m x 0.1m; (f) Place all material intended for collection on the designated collection in full view of and beside the travelled highway serving the dwelling unit by 7:00 a.m."

Every owner of a dwelling unit to which service is made available by the garbage collection and/or recycling system of The Corporation of Delta shall pay for such services as follows: (a) For each dwelling unit contained in a single family dwelling, or in a multi-family dwelling receiving single family dwelling collection service, $123 for garbage and $55 for recycling. (b) For each dwelling unit contained in a multi-family dwelling receiving multi-family recycling collection service, $45." ix. deleting Section 11 in its entirety.
