2 BACKGROUND Hazardous Waste (Management & Handling) Rules, 1989 and amendments. Inventories and studies on status and potential for e-waste management carried out by various agencies like - CPCB, GTZ and ELCINA.

5 Basic elements of the modified draft Rules. Objective is to ensure the environmentally sound management of e-waste. Rules are based on the concept of Extended Producers Responsibility. There are Six Chapters, three schedules and seven Forms.

6 Chapter- I (some important definitions) (i) E-waste - EEE whole or in part but not confined to equipment listed in Schedule-I and scraps or rejects from the manufacturing process which is intended for discarding. (ii) Consumer any person using EEE. (iii) Distributers (iv) Historical waste & orphaned products. (v) Refurbisher

7 Chapter II (Responsibilities of ) (i) Producers; (ii) Distributers; (iii) Refurbisher; (iv) Collection centre; (v) Consumer or bulk consumer; (vi) Dismantler & or Recycler/reprocessor

8 Chapter-III Procedure for seeking authorisation & registration for handling Distributers and refurbisher shall seek one time registration from concerned SPCB/PCC. Every producer, collection centre, dismantler and recycler of e-waste required to obtain authorization for handling e-waste from concerned SPCB.

9 Chapter-IV Procedure for storage Storage of e-waste - every producer, distributer, collection centre, dismantler or recycler may store e- waste for a period not exceeding 120 days. SPCB may extend the period for (i) Dismantler and recycler up to six months of their annual capacity; (ii) Collection centre ; (iii) Waste which needs to be stored for development of a process for its re-use, recycling.

10 Chapter-V REDUCTION IN THE USE OF HAZARDOUS SUBSTANCES (RoHS) Every producer of EEE shall ensure that new EEE does not contain lead, mercury, cadmium, hexavalent chromium, polybrominated biphenyls or polybrominated diphenyl ethers within a period of three years. Imports of EEE shall be permitted for those, which are RoHS compliant.

11 Chapter-VI (Misc.) Prohibits import of used EEE for use. Liability of Producer, Collection Centre, Transporter, Dismantler & Recycler shall be liable for any damages caused to the environment or human health due to improper handling and disposal of e-waste..

12 Schedule I (categories of e-waste covered) IT and telecommunication equipment : Centralised data processing: Mainframes, Minicomputers Personal computing: Personal Computers (CPU with input and output devices) Laptop (CPU with input and output devices) Notebook, Notepad etc., Printers including cartridges Copying equipment Electrical and electronic typewriters Pocket and desk calculators

13 Contd./- And other products and equipment for the collection, storage, processing, presentation or communication of information by electronic means User terminals and systems Facsimile Telex Telephones Pay telephones Cordless telephones Cellular telephones Answering systems And other products or equipment of transmitting sound, images or other information by telecommunications Consumer electrical and electronics: Television sets (including LCD & LED), Refrigerator, Washing Machine, Airconditioners

14 SCHEDULE -II 23 Applications are exempted from the requirements of reduction in use of hazardous substances.

E-Waste Management. Existing Scenario E-Waste Management E-waste is one of the fastest growing waste streams in our country. It ranges from 0.01% to 1% of the total household waste generation. E-waste contain toxic constituents such as lead,
