2 BRENTWOOD DESIGN GUIDELINES APPLICATION INFORMATION 1. The following exterior modifications, and only these modifications, do not require a Request for Modification Review Form [ Form ] to be submitted if certain conditions are met: Patios (Guideline No. 1) Exterior Lighting and Flag Poles (Guideline No.2) Garden Plots (Guideline No. 3) Play Equipment (Guideline No. 4) Basketball Goals (Guideline No. 5) Children s Wading Pools (Guideline No. 6) Ornamental Trees and Shrubbery (Guideline No. 8) Repainting with the same color (Guideline No. 12) 2. A complete Form must be submitted through the Covenant Committee for all other types of modifications. The verbal approval of sales agent, John Weiland Homes employee, or Association representative is not sufficient. All modifications must be in writing and must be signed by a member of the Board of Directors. When plans are required, they must be submitted with the Form. A Form is attached to these Guidelines. Additional Forms are available from the Covenant Committee. 3. The Covenant Committee ordinarily meets at 7:00 p.m. at the cabana on the first Monday of each month, except when a holiday postpones a meeting. Meetings will also be held on an as-needed basis. COVENANT ENFORCEMENT PROCEDURES A. Apparent covenant violations, as reported from any source, must be submitted in writing to the Covenant Committee to be referred for appropriate action. B. The Modification Review Process will be as follows: A. The Homeowner is cited for a violation and decides to apply for a review or the Homeowner requests a review for a future modification. B. The Homeowner fills out a Request for Modification Form and submits it to the Covenant Committee for its review and recommendation. The Homeowner is encouraged to address the Covenant Committee personally to explain his Request for Modification. C. The Covenant Committee will decide those covenant violation issues which are noncontroversial. Those requests which are not of a clear-cut nature will be referred to the Board of Directors, with a recommendation for approval or denial. D. The Board of Directors will vote on the covenant issue at the next monthly meeting (held the third Thursday of each month.) The Homeowner is encouraged to appear before the Board at this time and, again, present his request. -2-

3 GUIDELINE 1: Patios and Walkways Patios and walkways do not require approval if all of the following guidelines are met: 1. The patio must not extend beyond the sidelines of the house and must not extend to within 10 feet of the side property lines. 2. The patio must not exceed 6 inches above ground level at any point. 3. The walkway must be located in the rear yard. 4. The walkway must not extend beyond the sidelines of the house and must not extend to within 10 feet of the side property lines. 5. The walkway must not exceed 4 inches above ground level at any point. 6. Patio covers, trellises, permanent seating, railings and other items not enumerated above in conjunction with any patio or walkway require approval. GUIDELINE 2: Exterior Decorative Objects, Porch Flower Pots, Benches, Lighting, Etc. These items do not require approval if all of the following guidelines are met: 1. All decorative objects, both natural and manmade, must be located in the rear yard within the sidelines of the house. 2. A single flag pole may be attached to the front portion or the garage side of the house. 3. Front door decorations must be tasteful and in keeping with the style and colors of the house. 4. Front porch and entryway decorations will be limited to neatly-maintained flower pots (maximum number of 4, not more than 2 feet in height) that match the exterior color and contain live evergreens or flowers. Plants and flowers must always be neat and healthy. 5. Benches, swings or rocking chairs may be located on the front porch. Seating must be tasteful and in keeping with the style and colors of the house. 6. Lighting must not exceed 12 inches in height; the number of lights may not exceed All lights must not exceed 100 watts, must be white or clear non-glare-type, and must be located to cause minimal visual impact on adjacent properties and streets. 8. Lights must follow the perimeter of sidewalk, patio or driveway. All façade and landscape lighting require approval. -3-

4 GUIDELINE 3: Garden Plots Garden plots do not require approval if all of the following guidelines are met: 1. The plot must be located in the back yard within the extended sidelines of the house. 2. The size of the plot is limited to 150 square feet or 1/4 of the rear lot, whichever is smaller. 3. The maximum height of plants is less than 4 feet. GUIDELINE 4: Play Equipment, Toys, Play Houses and Tree Houses Play equipment does not require approval if all of the following guidelines are met: 1. Play equipment and toys must be located within the extended sidelines of the house and in the back yard. Toys used in all other areas must be removed when not in use. 2. Play equipment may be within a screened fenced area of the rear of the house. 3. Play equipment must be wooden, exclusive of wearing surfaces. 4. Metal play equipment requires approval. 5. A baseball backstop or similar item is not play equipment and requires approval. 6. All equipment must be placed for minimal impact on adjacent properties. GUIDELINE 5: Regulation Basketball Goals Basketball goals do not require approval if all of the following guidelines are met: 1. The backboard must be perpendicular to the primary street, with pole placement on the side, rear half of the driveway. 2. The backboard must be white, beige, clear or light gray. 3. Written approval must be obtained from any neighbor who might be impacted by play. 4. Portable goals must meet criteria #2, #3, and when not in use, #1 as stated above. -4-

5 GUIDELINE 6: Private Pools, Spas, Hot-Tubs: 1. All swimming pools are prohibited. 2. Children s wading pools (those that can be emptied at night) must not exceed 18 inches in depth, and the surface area must not exceed 36 square feet. These pools must be removed from the front yard or driveway at night. 3. Exterior hot-tubs require approval. GUIDELINE 7: Fences: 1. The original design concept of a John Weiland Community promotes a feeling of open space. Therefore, fencing is not generally encouraged. All fencing requires approval. 2. Chain-link fences are prohibited. 3. All requests must include the following information: A. Picture or drawing of fence-type. Fence types should be privacy- or split-rail design. B. Dimensions: The Maximum height may not exceed 6 feet. The maximum span between posts shall be 10 feet. The minimum post size shall be 4x4 inches. Railings must be 2x8 inch, or have three 2x6 inch rails per section. C. Color: The fence must be natural or painted white. D. Site Plan: A site plan denoting the location of the fence must accompany the Form. Fences shall not be located closer to any street than the rear edge of the home. However, on corner lots, the fence shall not be closer to any side street than the building-line of the lot. Fencing must follow property boundary lines. E. Crossbeam: Crossbeam structure shall not be visible from the street. The crossbeams must face the inside, toward the yard. -5-

6 GUIDELINE 8: Exterior Landscaping and Maintenance: I. Screen planting (row or cluster-style) and property-line planting require approval. Forms must include a description, types and sizes of trees and shrubs to be planted, and a site plan showing the relationship of plants to the house and to adjacent dwellings. 2. Each owner is responsible for removal of debris, clippings, etc., from the property line to the center of the street. 3. All planted areas should be properly maintained at all times and, after the first frost, all affected material should be removed. It is suggested that the bare earth be covered with straw, mulch or a similar material to prevent soil erosion. 4. The removal of trees, except diseased or dead trees and trees needing to be removed to promote the healthy growth of other trees, requires approval. All tree stumps must be ground to below ground level. 5. Landscaping should relate to the existing terrain and natural features of the lot, utilizing plant materials native to the Southeastern United States. The amount and character of the landscaping must conform to the precedent set in the surrounding community. 6. All mulched landscape beds must be covered with natural pine straw, chopped pine bark mulch or wood shavings. 7. The preferred landscape bed edging is a neat 4-6 inch trench. Other edging, if used, must be flush with the ground and be of uniform type. 8. Each owner shall keep his lot and all improvements thereon in good order and repair, including, but not limited to: seeding, watering, mowing, pruning and cutting of trees and shrubbery, and the painting or other appropriate external care of all buildings and improvements. This should be done in a manner and with such frequency as is consistent with good property management and with the precedent set in the surrounding community. 9. Outdoor storage of garden tools and hoses must be screened from view and kept behind shrubs. Any tools or items stored under a back deck or porch must also be screened from view. 10. All retention structures (e.g., raised edging) require approval. Approval will be based on property erosion issues. GUIDELINE 9: Firewood: 1. Firewood piles are to be maintained in good order and must be located in the rear yard, within the sidelines of the house, in order to maintain the open-space vistas. 2. Woodpile coverings are allowed only if the cover is an earth-tone color and the woodpile is screened from the view of the street. -6-

7 GUIDELINE 10: Decks 1. All decks require approval. 2. The Form must include all of the following: A. A site plan denoting location, dimensions, materials and color. B. In most cases, the deck may not extend past the sides of the house. C. Materials must be cedar, cypress or No. 2-grade or better pressure-treated pine. D. Color must be natural or painted to match the exterior of the house. 3. Vertical supports for wood decks must be a minimum of 6x6 inch wood posts or painted metal poles, preferably boxed-in as to appear to be 6x6 inch wood posts. 4. The following, without limitation, will be reviewed: A. Location, B. Size, C. Conformity with the design of the house, D. Relationship to neighboring dwellings, and E. Proposed use. 5. Owners are advised that a building permit may be required for a deck. GUIDELINE 11: Exterior Building Alternations 1. All exterior building alterations require approval. Building alterations include, but are not limited to: storms doors and screens, construction of driveways, garages, carports, porches and room additions to the house. 2. The original architectural character or theme of any home must be consistent for all components of the home. Once the character is established (traditional, contemporary, etc.), no change may alter that character. 3. Repainting requires written approval only if the color is changed. -7-

8 4. A change in paint color requires the following information: A. Paint sample or picture of paint color that is currently in use or approved for this or another John Weiland Community in Rockdale County. The address of the home and Community where the color has been approved must be included. B. Description of the area of the home to be repainted. C. Photograph of your home and the homes on either side (in most cases, adjacent homes cannot be painted the same color.) 5. Storm windows and doors must be made of anodized bronze or anodized aluminum with a baked-enamel finish that is compatible with the primary and trim colors of the home. Plain-glass, full view storms door do not require approval. The Form must contain the following information: A. Picture or drawing of all windows/doors on which storm windows/doors will be installed. B. Picture depicting style of storm window/door to be installed. C. Color. 6. If County authorities make any changes to the plans as approved by the Covenant Committee, the owner must submit such changes for approval prior to commencing construction. 7. Tennis courts and basketball courts are prohibited. 8. Detached buildings are prohibited. Only attached buildings will be considered and require approval. 9. Owners are advised that a building permit is required for certain exterior building alterations. 10. All dog houses require approval. Dog houses must be located where they will have minimal visual impact on adjacent properties. -8-

9 GUIDELINE 12: Vehicles and Parking: 1. No boat, trailer, camper or other recreational-type vehicle may be parked or stored in open view on residential property for longer than a 24-hour period. 2. All cars parked in open view and not in a garage must be operable and may not be unsightly. Car covers of any kind are prohibited. 3. No vehicle may be parked on any yard. As a general rule, parking of vehicles on the street is discouraged. Temporary parking (4 hours or less) is allowed if not a nuisance to neighbors and not an impediment to traffic flow. Homeowners are responsible for guest parking and must ensure that guests park in a safe manner and do not impede access to other driveways and traffic. GUIDELINE 13: Satellite Dishes Satellite dishes do not require a Form if all of the following guidelines are met: 1. Satellite dishes must be no larger than 18 inches. 2. If ground-mounted, dishes must be screened from view by natural landscaping, not lattice. Any cables must be buried. 3. No front yard mounting is allowed. 4. If mounted on the home, dish must be mounted on the rear of the home and within the sidelines of the home so it is not visible from the street. 5. Color of satellite dish must be black, gray, white or tan. Guidelines amended and approved August 1,

11 I agree that the Association Board of Directors, its directors and officers, and the Association s respective members, successors, assigns, agents, representatives or employees shall not be liable for damages or otherwise to anyone requesting approval of an architectural alteration by reason of mistake in judgment, negligence or non-feasance, arising out of any action with respect to any submission. I acknowledge that none of the foregoing assume any responsibility regarding design or construction including, without limitation, the structural integrity, mechanical or electrical design, methods of construction, or technical suitability of materials. I hereby release and covenant not to sue all of the foregoing from/for any claims or damages regarding this request or the approval or denial thereof. Further, I agree that no work on this request shall commence until written approval has been received by me and shall be completed in accordance with the Covenants. I represent and warrant that the requested changes strictly conform to the Covenants for Brentwood and Brentwood's Design Guidelines and that these changes shall be made in strict conformance with the Covenants, City, County, State and Federal guidelines and ordinances and the Design Guidelines. I understand that I am responsible for complying with all City, County and State regulations and that approval of this application is in no way a guarantee that the exterior modification complies with City, County, State and Federal guidelines and ordinances.
