1 Architectural Control Committee Promulgated Rules These promulgated rules are in support of existing items in the governing documents within the Christie Ranch Declaration of Covenants, Conditions, and Restrictions (CCR). Any item listed in this document with a (CCR #.##) notation references a rule as defined in the previously listed CCR. Please refer to the original CCR documentation in addition to the following when maintaining, changing, or upgrading your residence. This list of promulgated rules is meant to be in addition to, not in replacement of, the current CCR. All questions should be sent to the Architectural Control Committee at acc@friscochristieranch.com. Maintenance (CCR 9.26, 9.34) Any owner or occupant of any Residence shall have the duty of and responsibility for keeping property they own or occupy, and the improvements thereon, in a well maintained, safe, clean and attractive condition at all times. Exterior surfaces must be kept clean of paper, pet waste, debris and refuse; dead trees and plant material must be promptly replaced. Stained front doors, shutters, wood trim, sidewalks and exterior paint must be maintained and refinished or repainted when the finish is dull and/or peeling and showing wear. An ACC application is required when a house, siding, brick, doors, shutters, or trim is to be painted a different color than the existing color. An ACC application is not required when the new paint is the same color as the original. ACC applications must include samples of all color changes, as well as a description of where on the house changes will occur. Glossy exterior paint is not allowed. Colors should be in harmony with the neighborhood and natural environment. Address plates on the front of the house must be completely visible from the street. This is a safety issue. Emergency responders must be able to see the addresses of each home. Bushes, trees and any other object must not obstruct the view of the address plate from the curb. Flowerbed edging (stone, concrete, metal, etc.) must be kept in good condition. House and landscape lighting and their fixtures need to be kept up in good condition. Vegetable gardens are to be limited to fenced back yard. Toys, bikes, wagons, lawn chairs, etc. shall not be left on front lawns, porches, sidewalks, driveways or other areas within public view after dark. 1

2 Fences (CCR 9.15) An accurate fencing plan locating all proposed fences, including elevations, is required to be submitted and approved by the ACC prior to commencing any fence work. Fencing to typically be wood, eight foot height above finish grade unless otherwise approved by the ACC. Fencing to typically be set back from adjacent residence front wall a minimum of ten feet unless otherwise approved by the ACC. Fence lines shall not exceed the front brick line of the home. No chain link or other metal fencing materials will be permitted except as noted below where it pertains to ROW or Common Areas. Only one fence is to be put on a common property line. Side and rear yards, not adjacent to ROW or Common Area, material to be #2 or better Cedar installed vertically, board on board, of rough- sawn pickets (1 x4 or 1 x6 ) and fence posts are to be galvanized steel only, on approximately six foot (6 ) centers, and shall be set in a concrete footing a minimum of two feet (2 ) deep. Ridge caps on galvanized steel posts are not to exceed the height of fence pickets. The top of the fence to step down with finish grade, no sloping tops allowed. Fences shall be erected with the fence posts inside the fence when visible from the street, but posts are permitted on the outside in the back alley ways. Fencing shall be stained on both sides, not painted, in a single natural medium brown wood palette that is in harmony with the neighborhood and its natural environment. Painting the fence or leaving it untreated is prohibited. Side and rear yards adjacent to Common Area: Fencing to be decorative wrought iron, four foot height, per standard design to be approved by the ACC. Visual privacy: If visual privacy is desired at areas restricted to wrought iron fencing only then a landscape living screen may be planted at the interior side of the wrought iron fence location. All fences must be maintained in a neat and attractive manner at all times. All damaged, rotting or missing portions of fence shall be replaced with comparable materials to the remaining portion of the fence. Fences shall not be externally braced in lieu of replacing or repairing posts, columns, pickets/boards or other structural members. No lattice work on top of fences is allowed. Gates should complement the fence material in style, color, and height. Every Lot must have a fence. The fence must comply with the above standards and cannot be avoided by failing to erect a fence or removing a fence in lieu of bringing it into compliance with the above guidelines. 2

3 * For the purpose of these guidelines, specific architectural features such as step railings, driveway gates and porte- cochere gates are not considered fence or wall components. Such features must be submitted for review and approval on a case- by- case basis by the ACC. Landscape (CCR 9.14, 9.26) Front elevation to have a minimum five (5) foot wide foundation landscape planting bed with primary landscape shrubs to be minimum 3 gallon size. Planting consistent with neighborhood and surrounding homes. Typical front yards to have a minimum qty. of two (2) four inch caliper shade trees required of either Live Oak, Red Oak, or Cedar Elm species. Front yards of corner lots to have a minimum qty. of three (3) four inch caliper shade trees required of either Live Oak, Red Oak, or Cedar Elm species. All yards with street frontage to have solid sod grass. All landscaped areas to have an automated and zoned irrigation system in the front yards and side yards visible from the street. No trees to be planted between sidewalks and the street. Landscape must be continuously maintained at all times including, but not limited to: mowing, watering, fertilizing, weeding, edging replanting, and replacement of dead and/or diseased plant materials. Recreational Equipment (CCR 9.29, 9.31) Play/recreational equipment must be located in the back/fenced yard. Equipment placement (including pool pump equipment) must be screened from public view. Awnings, coverings or banners of play equipment must be maintained in a neat and attractive condition; worn awnings, coverings or banners must be replaced immediately. Awnings, coverings or banners should be in muted browns or forest green; no primary colors if visible over the fence from the front of the dwelling. Basketball goals must be stored in an upright position. They should not be stored on a street, sidewalk, or any other public right- of- way such as a cul- de- sac. All children s play equipment should be stored out of sight when not in use. 3

4 Back Yard Improvements (CCR 9.13) The addition of an outdoor patio, arbor, gazebo, fireplace, fire pit, kitchen, fountain, dog run/pen or other major permanent addition all require ACC approval. Storage Buildings (CCR 9.13) Storage buildings may be placed in any location in the rear and side yard provided they are not visible from any street or alley. Pre- manufactured or custom built building must be no taller than the fence line. Storage buildings that have shingle must match that of the same type and color as the main dwelling. The color of the building must match the main dwelling. Only one storage building per Lot. Windows (CCR 9.18) Solar screens may not be placed on any public street facing windows. The color and type of all solar screens must be approved by the ACC. No window may be tinted, filmed, lined or otherwise covered with reflective material so as to create a mirror effect when viewed from the exterior of the home. Blankets, sheets, flags, garbage bags, towels, foil, beads, rope lights, hanging lights (not including holiday lights), are prohibited. No window A/C units are permitted. Satellite Dishes (CCR 9.19) Satellite dishes may not be attached to any part of the front of the main dwelling and should be located in the least visible location. Cabling and other wires must be concealed from public view. 4

5 Flags/Flagpoles (CCR 9.22) 1 House- mounted flagpole is allowed in the front yard/front door area. It must be securely fastened according to manufacturers guidelines. Flagpole and flag must be kept in sound condition and good repair at all times. Permanent free standing flagpoles may not be erected on your lot. Garbage (CCR 9.16) Storage location of the polycart should be out of public view and may include placement against the back of the house, or against the fence at the back of the house, but not at the alley or front curb. If the house has a front facing driveway the polycart may be placed against the side of house or garage door if no other non- public option is available. Trash should be bagged before being placed in the polycart. Shall be placed for collection no earlier than 6:00 pm the day prior to the day of scheduled collection. Shall not remain at the alley- side or front curb collection point after 12:00 midnight of the scheduled collection day. Mailbox Design (CCR 9.30) Mailboxes are to be constructed of brick or stone that matches the dwelling and shall conform to the United States Postal Service regulations. Construction and reconstruction of mailboxes will be required to follow the application process. The design of such construction must be consistent with existing shape, style, and color of the corresponding dwelling. The dimensions of the mailbox shall conform to the following: CR- 1A - 18 inches to 20 inches wide and deep and 48 to 52 inches in height; CR- 1B/1C - 28 inches to 32 inches wide and deep and 55 inches to 60 inches in height. 5

6 Walkways (CCR 9.11) For all new construction the walkway from the house is required to go to the street. They are not to go to the driveway. Solar Collectors (CCR 9.32) Solar Collectors can represent a large visual impact on a structure due to their size. Therefore, it is important to properly integrate the collector into the design of the house to properly conceal it. Solar collectors should not be placed on the front side (street side) of the roof or be visible from the street. All trim should be painted to match the background color of the roof or house trim to conceal it. All pipe work must be concealed. All solar collectors require an application to the ACC that includes a site plan and elevations of the house showing the proposed location and appearance of the collector. Details must show how the collector edges will meet the roof. 6
