4 MS-4 Permit Financial Requirements Part I, Section A.2 Permittee Responsibilities: The failure to provide adequate program funding, staffing or equipment maintenance shall not be an acceptable explanation for failure to meet permit conditions Part I, Section A.4 MS4 Program Resources: The permittee shall submit to the Department a copy of each fiscal year s budget including its proposed capital and operation and maintenance expenditures necessary to accomplish the activities required by this state permit. The permittee shall describe its method of funding the stormwater program with the copy of the fiscal year budget. Part II, Section Q Proper Operation and Maintenance: Proper operation and maintenance also includes adequate funding, adequate staffing, and adequate laboratory and process controls, including appropriate quality assurance procedures

9 Stormwater Utility - Definition A fair and equitable way to pay for stormwater costs Based on analysis that demonstrates relationship between amount charged and program costs (services) Similar to water or electric utility Typically set up as an enterprise fund Enabling legislation: of the Code of Virginia The intent of legislation is to provide a reliable funding source, other than taxes, to support the stormwater management program

The stormwater management fee is based on: The extent to which each property contributes to stormwater runoff Based on amount of impervious area/pollutant load of each property The cost of the program: projects and services Policy decisions (credits, waivers, rate structure, etc.)
