1 SOUTH METRO/CUNNINGHAM FIRE RESCUE AUTHORITY RESOLUTION NO A RESOLUTION ADOPTING A FEE SCHEDULE WHEREAS, the South Metro/Cunningham Fire Rescue Authority (the "Authority") is a separate governmental entity created pursuant to Section , C.R.S., by the South Metro/Cunningham Fire Rescue Authority Creation and Pre- Unification Agreement dated November 16, 2017, as amended (the "Creation Agreement"), by and between Cunningham Fire Protection District and South Metro Fire Rescue Fire Protection District; and WHEREAS, the Authority is organized and operated with all the authorities of, and to provide the services authorized to, a fire protection district organized and operated pursuant to Article 1, Title 32, C.R.S.; and WHEREAS, Section 32-l-1002(e), C.R.S. authorizes fire protection districts to fix and, from time to time, increase or decrease fees and charges for fire code inspections; and WHEREAS, pursuant to Section II.G. of the Creation Agreement, the Authority has the power to fix, maintain and revise fees, rates and charges for functions, services or facilities provided by the Authority in the manner provided by law; and WHEREAS, the Board of Directors of the Authority (the "Board") hereby finds and determines that adoption of a fee schedule establishing fees and charges for inspection and plan reviews pursuant to the fire code, as well as payment processing fees, is appropriate and necessary to the function and operation of the Authority. NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of the South Metro/Cunningham Fire Rescue Authority, as follows: 1. Adoption of Fee Schedule. The Board hereby adopts the fee schedule attached hereto as Exhibit A (the "Fee Schedule"). 2. Payment Processing Fees. The Board hereby authorizes the Fire Chief to approve the collection of fees associated with the processing of credit card transactions and/or checks, which the Authority expects to implement on or about April 1, 2019, provided that such fees do not exceed 4.5% of each transaction. 3. Fire Chief to Annually Adjust Fees. The Fire Chief shall adjust the Fee Schedule annually without further Board action, in accordance with the compensation model adopted by the Authority's Human Resources Department. { DOCX/ }

The Fire Marshal shall be authorized to reduce or waive the fees in the Fee Schedule based upon the circumstances of specific projects which are determined, in his or her sole discretion, to result in reduced or nominal costs to the Authority for the services provided. 5. Waiver for Governmental Entities. The Fire Chief shall be authorized to reduce or waive the fees in the Fee Schedule, except punitive fees, for governmental entities, including, but not limited to counties, municipalities, schools and special districts, when determined by the Fire Chief in his sole discretion that either (i) the governmental entity provides reciprocal services or benefits to be of approximately equal benefit to the Authority, or (ii) the governmental entity's project or special event will result in reduced or nominal costs to the Authority for the services provided. Punitive fees include re-inspection, after hours inspection, and re-submittals after the first resubmittal. 6. Severability. If any part, section, subsection, sentence, clause or phrase of this Resolution is for any reason held to be invalid, such invalidity shall not affect the validity of the remaining provisions. 7.
