2 1. Introduction One objective of the EC domestic market is to reduce technical trade barriers in order to permit a free flow of goods within the EC. For this reason uniform requirements for products are set forth in EC Directives within the scope of a harmonization concept designed to guarantee the health and safety of persons, domestic animals and objects. The compliance with the basic requirements for health and safety protection is absolutely necessary in order to guarantee the safety of devices and Components. These requirements have to be implemented meticulously taking into account the state-of-the-art technology attained at the time of manufacture of these devices. Objective and purpose of the Directive for equipment and protective systems intended for use in potentially explosive atmospheres Benefit for manufacturers Terms For equipment, components, and protective systems for use in potentially explosive atmosphere the Directive 94/9/EC is valid. The requirements of the Directive must be realized by the manufacturer during the design and production phase. The proper and intended application of equipment and protective systems is the basic prerequisite for their safety against explosion. This must be ensured by means of corresponding information (e.g., in the users instructions). The conformity of these devices with the requirements of this Directive and all further relevant EC Directives (e.g., EMC Directive) is made visible by means of the CE mark. In order to facilitate proof of conformity for manufacturers and in order to provide an opportunity for testing, harmonized standards describing these requirements have been published by EU members. The application of these standards is not a mandatory requirement. A list of the harmonized standards and their sources is published in the Official Journal of the European Community. Products carrying the CE mark have a so-called "passport" for EU countries, i.e. no member state may prohibit, limit or hinder the distribution and putting into operation of these products on their territories. The Directive for equipment and protective systems intended for use in potentially explosive atmospheres may be applied from March 1, 1996 onwards. Member states will allow the distribution and putting into operation of equipment and protective systems according to currently applicable national law until June 30, After the1 st of July 2003 only equipment and protective systems which are conform to the Directive 94/9/EC may be brought into the market. Legal Principles European Union Germany Directive 94/9/EC of the European Parliament and Council dated March 23 rd 1994 for the harmonization of the legal regulations of member states for equipment and protective systems intended for use in potentially explosive atmospheres published in the Official Journal of the EC Journal no. L 100 dated August 19, 1994, page 1 The Directive for equipment and protective systems intended for use in potentially explosive atmospheres was put into effect under national law via the eleventh Ordinance of the Equipment Safety Act (GSG) dated December 12, Field of Application European Union Who is affected? Devices Restrictions If basic health and safety requirements are met, distribution must not be impeded by any member state. If requirements are not met, distribution may be prohibited or the product may be recalled, respectively. All manufacturers, respectively their authorized representatives, importers and dealers distributing equipment, protective systems and components according to 94/9/EC. This directive applies to equipment, protective systems and components intended for use in potentially explosive atmospheres, as well as to safety, controlling or regulating devices for use outside of potentially explosive atmospheres (which, however, are necessary for or contribute to the safe operation of equipment and protective systems with regard to explosion hazards), with the exception of the devices and areas indicated in Chapter 1, Article 1, sentence (4) which are listed as follows: The following equipment, protective systems and areas are excluded: medical appliances designated for use in medical areas equipment and protective systems for which the explosion hazard is caused exclusively by the presence of explosives or chemically unstable substances; Summarized Information Page 3 of 21
4 equipment which is intended for use in domestic and noncommercial environments in which an explosive atmosphere forms only seldom and due to unintentional leakage of fuel; personal protective equipment in the sense of Directive 89/686/EEC; seagoing vessels and mobile off-shore installations, as well as the equipment on-board these vessels or installations; means of transport, i.e., vehicles and accompanying trailers which are designed exclusively for the transportation of persons and goods in the air, on road and railway networks or by water. Consultation of an accredited test laboratory may be helpful at this stage. 5. What must be done? CE-marking CE stands for "Communautés Européennes" (European Community). Each product which is distributed in the EC after March 1, 1996 can be provided with the CE mark according to the 94/9/EC Directive. It indicates that the manufacturer applied this directive for the product. 9 Concrete steps for EC Declaration of Conformity and the affixation of the CE mark 1st Step: Clarification of the following questions Which EC directives apply to the product? Which basic requirements result from the directives? Which standards must be observed (state-of-the-art)? Do harmonized European standards already exist? Do international (IEC) or national standards and specifications exist? Does the product meet safety requirements? 2nd Step: Distinction between electrical and non-electrical eqipment In case of electrical equipment the conformity evaluation method shown under graph 1 is relevant. In case of non-electrical equipment the conformity evaluation method under graph 2 is relevant. Depending on the product group and category as well as the distinction between electrical and non-electrical equipment quality assurance measures from internal production control up to quality assurance within the production are necessary. 3rd Step: Guarantee of the protection requirements Essential health and safety requirements must always be met. Standards If the manufacturer exclusively applies the harmonized standards published in the Official Journal of the European Community, it can be assumed that the products comply with the requirements of the Directive. If no corresponding harmonized standards are published for a product, international safety requirements (e.g., the IEC) can also be applied if these provisions have been made known within the scope of individual state procedures. If such safety requirements do not exist either, national standards may be applied if these ensure the same safety standard as required by the target country. For electrical equipment intended for use in potentially explosive gas atmosphere the series of standards EN ff is valid, for the intended use in potentially explosive dust atmosphere EN ff is applicable. For non-electrical products the standard EN ff has to be applied. For such products a risk analysis of the existing ignition sources - attributed to the taken measures is required. These are the only mandatory legal regulations. The above mentioned harmonized international and national technical standards, which merely lead to the assumption of conformity of the devices manufactured according to these standards, are not legally required. 4th Step: Activities up to the EC declaration of conformity The corresponding activities according to group and category are to be taken from the schemes graph 1 and 2. EC Type Examination The conformity of a representative type to the Directive and the harmonized standards will be assessed during the EC Type Examination. For this examination the manufacturer or his authorized representative or the person who is responsible for bringing the product into the market may submit a technical documentation (according to annex III chapter 3. of the Directive) as well as at least one test sample to a notified body. The documentation shall permit the assessment of conformity of the product with the requirements of the Directive. The records shall include a general description, the applicable standards and the technical realization of the requirements listed in the standards. Additional documents such as calculations, product drawings, circuit diagrams, layout and the user manual are necessary. The notified body assesses the submitted documents and the type and in case of conformity with the Directive delivers an EC Type Examination certificate. Summarized Information Page 10 of 21
11 Quality assurance The established QA system shall ensure the compliance of the product with the type described in the EC Type Examination certificate, the technical documentation and the requirements of the Directive. The notified body verifies the QA system on the basis of the submitted documents and an audit on the manufacturer s side. Focal points of the assessment are the product related policies of the Management, the training of employees, the document control for product documents and as such, the nomination of an authorized person to act according to the Directive 94/4/EC, the regularly carried out management reviews as well as the internal audits. Furthermore the purchasing process and the control of customer supplied products are evaluated in order to check the conformity with the requirements. Also the process control including inspection and testing as well as the control of inspection, measuring and test equipment and the control of nonconforming products, i.e. products which are not conform to the EC Type Examination, will be assessed. In case of a positive assessment the QA-system will be certified by a notified body for a period of 3 years. A complete process of a possible conformity assessment procedure is shown in graph 3. 13 For this procedure each single device is tested regarding its conformity with the Directive respectively the applicable harmonized standards. In case of a positive result of this test the EC Declaration of Conformity is issued. Storage of a dossier For non electrical equipment of category M2 or 2 the manufacturer communicate under his own responsibility a dossier to a notified body accredited therefore. The documentation extent is characterized in annex VIII chapter 3 of the Directive. The notified body acknowledges the receipt of documentation and retains it. The body assesses neither the completeness nor the technical content. 5th Step: EC Declaration of Conformity Ensurance must be given in the EC Declaration of Conformity that a product meets the requirements of the Directive 94/9/EC and, thus, all basic protection requirements. Integral parts of this declaration include: Name or identification tag and address of the manufacturer or his authorized agent residing in the Community Description of the device, the protective system or component in the sense of article 1, section 2 All relevant provisions which the device, the protection system or the component is subject to in the sense of article 1, sect. 2 When necessary, name, identification number and address of the notified body, as well as number of the EC Type Examination Certificate When necessary, reference to the harmonized standards When necessary, the applied standards and technical specifications When necessary, reference to the other applied Community directives Identity of the signatory authorized by the manufacturer or his authorized agent residing in the Community 6th Step: CE Marking The CE-mark is always affixed by the manufacturer on the basis of the EC Declaration of Conformity. The identification number of the notified body assessing quality assurance is added to the CE mark. The minimum vertical dimension of the CE mark is 5 mm. The proportions of the CE mark must be exactly adhered to (see grid on page 1). The affixing of similar marks on products which could be confused with the CE mark is prohibited. 14 7th Step: Storage period The technical documents together with certificates from the notified body must be made available for inspection by national authorities for a period of at least 10 years after the last manufacturing of the product. 6. General Questions CE marking and advertising CE marking and quality management All devices must be provided with the CE mark from July, 7th, 2003 onwards. However, CE marking is possible from March,1st, 1996 onwards and documents the conformity with laws which are valid throughout Europe. A certified QM system according to Annex IV, resp. VII, simplifies the conformity assessment procedure for all groups and, thus, represents a clear advantage in comparison to Unit Verification and in comparison to Annex VI (conformity to type). Additionally, a QM system according to DIN ISO 9001 facilitates the preparation of the Declaration of Conformity by the manufacturer, e.g., as far as documentation and proof that all requirements were met are concerned. Moreover, a QM system is already very often required by customers. It is recommendable on the basis of product liability. Quality assurance production, resp. product Period of validity of QM certificates Fulfillment of the general requirements is assumed if a certificate according to ISO 9001 is available. Additionally equipment-specific requirements must be evaluated. The notified body issues a certificate for a product category (e.g., MSR devices). Upon submission of a TÜV-CERT certificate according to ISO 9001, we will try to obtain an adequate period of validity. The main objective of the scheme is the national acceptance of the internet based Certificate of Conformity (CoC) instead of different national certification procedures. In general an IECExTL will test the equipment and issue an IECEx test report. The IECExCB will issue an internet based certificate of conformity (IECExCoC) if an IECExTR is supplied and if the manufacture of the product is under surveillance which is proof in a Quality Assessment Report (IECExQAR).
