The authorized place of use is at temporary sites, in areas no~ under exclusive Federal jurisdiction, throughout Texas. 11. Radioactive material shall not be stored or used at a permanent site unless that site is specifically authorized on this license. A site is considered permanent if radioactive material is stored and/or used at that location for more than 90 days in any twelve-month period. 12. All documents and records pertinent to the operations at the sites authorized on this license and those documents and records required by this license shall be maintained for Agency review at Site The licensee shall comply with the provisions (as amended) oftitle 25 Texas Administrative Code (TAC) , , , , , , and The individual designated to perform the functions of Radiation Safety Officer (RSO) for activities covered by this license is William "Bill" I. King, Jr. 15. Radioactive material shall only be used by, or under the supervision of, individuals designated by the RSO. 16. Sealed sources containing radioactive material shall not be opened or removed from their respective source holders. 17. 3 Page 8 of 10 AMENDMENT N UMBER 18. The licensee is authorized to store radioactive material with a physical half-life of less than 270 days for decay-in-storage before being discarded as being non-radioactive provided: A. Radioactive waste to be discarded of in this manner is held for decay a minimum of 10 half-lives. B. Prior to discarding as other waste, radioactive waste is monitored to determine that the radiation levels are not distinguishable from background with appropriate survey instruments. All radiation labels will be removed or otherwise obliterated or obscured. C. Generator columns shall be segregated so that they may be monitored separately to assure decay to background levels prior to discarding. 19. The licensee shall test each device distributed under this license for leakage or contamination of radioactive material and proper operation of the "on-off" mechanism and indicator, if any, at the time of installation of the device. 20. After installation by the licensee of each device distributed to persons generally licensed pursuant to 25 TAC (f), the licensee shall conduct a radiation survey and shall assure that the levels of radiation do not exceed those specified in the license authorizing the manufacture or distribution of the installed gauge. The licensee shall furnish the general licensee a copy of the radiation survey report. 21. The licensee is hereby authorized to perform commercial radiation survey instrument calibration. 22. The licensee shall possess and use sealed sources authorized in Part A of Conditions 5, 6, 7 and 8 only after acquiring documentation from the manufacturer that a safety evaluation require<! by 25 T AC (v) has been performed. This documentation shall be maintained for inspection by the Agency. 23. Each device distributed under this license shall be accompanied by at least the following or substantially similar statements: A. Persons who receive, use, or transfer this device are subject to a general license pursuant to these rules, or equivalent regulations of the NRC or another Agreement State. B. Abandonment or disposal of the device is prohibited unless it is transferred to a person specifically licensed by the Agency, the NRC, or another Agreement State. C. Operation of this device is prohibited if there is failure of or damage to the shielding, source containment, or "on-off" mechanism. D. Dismantling, maintenance, and testing of the radioactive material shielding or containment shall be performed only by persons specifically licensed by the Agency, the NRC, or another Agreement State. E. This device shall be tested for radioactive leakage at intervals not to exceed six months. F. Loss, theft, or transfer of this device and failure or damage to the shielding, or source containment shall be reported to the Agency, the NRC, or the appropriate Agreement State. G. Removal of any label from this device is prohibited. H. This device shall be tested for proper operation of the "on-off" mechanism and indicator at intervals not to exceed six months. 24. When using radioactive material authorized in Part AG, the licensee shall determine through calculation and post the high radiation area in accordance with 25 TAC (aa).

The licensee is hereby authorized to perform smoke detector Am-241 foil recovery operations and assembly into plastic disc sources for in-house use only in accordance with letters dated February 20, 2010 and May 29, In addition to the commitments, representations and statements contained in the afore-mentioned letters, when conducting smoke detector Am-241 foil recovery and assembly of plastic disc sources, the licensee shall: A. conduct contamination surveys of the Am-241 foil source chamber (cage) prior to recovery by wiping the source chamber (cage) using a disposable paper towel or other absorbent material and counting the sample using a low energy scintillation probe or thin-end window GM tube. B. not attempt to recover a Am-241 foil source suspected of leaking or encased in a contaminated chamber. C. recover only Am-241 foil sources having an activity not exceeding 1.0 ~Ci. D. maintain direct observation of all new plastic discs containing radioactive material during all phases of assembly until newly assembled plastic sources are placed in storage. E. dispose of leaking Am-241 foil sources, associated contaminated items and contaminated absorbent work space coverings as radioactive waste. F. document all contamination surveys required by the afore-mentioned letters and as directed by this license condition. Contamination survey records shall include, as a minimum, the name of the person conducting contamination surveys and records the results, date, unique id number of chamber and/or in-house control number, survey results, and disposition of leaking sources. G. label newly assembled in-house plastic discs per 25 TAC (cc) such that, as a minimum, the label includes the words "Caution Radioactive Material," estimate of quantity of radioactive material and the in-house control number. 26. When using radioactive material authorized in Part AL, the licensee shall only use the NUMEC device with the source in the central storage position and experiment wells, when not in use, containing neutron moderating material. 27. This license does not authorize the distribution of exempt quantities of byproduct or source material. 28. The licensee is hereby authorized to perform calibration, service and repair of radiation detection instruments with incidental fixed radioactive contamination for specifically licensed nuclear service providers and nuclear power plant customers. Areas where such instruments are received, used and stored must be monitored for the presence of radioactive contamination as indicated below: A. Survey all areas where radiation detection instruments with fixed contamination are received, calibrated, serviced, repaired and prepared for shipment following each day of use; B. Survey all areas where radiation detection instruments with fixed contamination are stored at the conclusion of each week of use; C. Monitor for removable contamination all areas where radiation detection instruments with fixed contamination are received, stored, calibrated, serviced, repaired and prepared for shipment at the conclusion of each week of use; and D. The licensee shall compare survey and removable contamination analysis results with established action levels that are no less restrictive than 25 T AC (ggg)( 6). The licensee shall make arrangements for decontamination of all areas that exceed the licensee's established action levels.

Except as specifically provided otherwise by this license, the licensee shall possess and use the radioactive material authorized by this license in accordance with statements, representations, and procedures contained in the following: application dated June 21, 2004, letters dated January 27, 2005, March 8, 2005, March 15, 2005, March 28, 2005, April 12, 2005, April 11, 2006, May 19, 2006, April 1, 2008, April 22, 2008, July 22, 2008, March 26, 2009, June 1, 2009, July 24, 2009, September 15, 2009, July 6, 2010, March 22, 2011, February 14, 2012, March 7, 2013, June 3, 2013, September 6, 2013, October 30, 2013, February 25, 2014, June 13, 2014, August 3, 2015 and May 25, Title 25 TAC 289 (as amended) shall prevail over statements contained in the above documents unless such statements are more restrictive than the regulations.
