72 72 PRIDE Seating MULTI-PURPOSE WARRANTY AND TERMS/CONDITIONS PRIDE Enterprises offers a Limited Warranty on its furniture LIMITED WARRANTY products to be free from defects in material and workmanship. PRIDE s liability under its Limited Warranty is limited to the purchase price of the defective product as evidenced by the invoice. PRIDE will replace or repair the product, in lieu of refunding the purchase price at PRIDE s option. The limited warranty extends only to the original consumer and is non-transferable. Limitations involving particular materials and components: 10 years: wood seating; 5 years: glides, casters, seating mechanisms, pneumatic cylinders, fabric damage (due to manufacturing), cushion foam; 1 year: recliner mechanism (when used in a commercial environment). This limited warranty excludes: Transportation costs or customer labor costs associated with repair of warranty claims; Damage due to normal wear and tear (includes color fade over time); Damage due to improper maintenance, abuse, fire, accidents, negligent acts or omissions of the purchaser or its agents or employees or acts of third parties; Shipping damage (covered separately); Modifications, repairs, or part replacements other than those authorized by PRIDE; Any costs or damages for down time caused by loss of product or otherwise, or any other incidental or consequential damage incurred at any time; Natural variations in color, grain, or texture (includes repairs and replacements); Customer Owned Material (COM); Products used for rental purposes; Products used more than 40 hours per week (single shift) and seating products used by persons weighing more than 225 pounds. This exclusion does not apply to the #430H1SPHAT Clarion Heavy Duty Chair, which is rated for 300 pounds, or the #430H1PPUST Clarion Intensive Use Chair and the #4DMG9982H Magnum Task Chair, which are rated for 400 pounds on a 24/7 basis. PRIDE Enterprises neither assumes nor authorizes anyone to assume for it any other obligation or liability in connection with its Furniture Products. Warranty claims must be filed within warranty period and must include a copy of the invoice or sales order. 73 PRIDE Seating 73 TERMS/ CONDITIONS Applicable State of Florida Price Agreements: P Additional Ordering Instructions: Where applicable, all options and accessories must be installed at the factory. Components that deviate from standard configuration and options shown, will require a customized quotation. Delivery and Installation Requirements The following delivery and/or installation provisions apply: a. For orders outside the State of Florida and international orders, buyer will pay actual freight for delivery; b. If items are not accepted on the day of delivery, a 10% re-delivery charge will be assessed; c. Storage spaces: whenever the merchandise arrives at the site designated, safe and adequate storage space will be provided by the buyer if installation cannot be accomplished. If transfer of items is needed to a different location at a later date after delivery is made, charges will be incurred by the buyer. If the buyer refuses or is unable to accept shipment, PRIDE will transfer that shipment to storage. Storage charges will be the responsibility of the buyer; d. Damage: after arrival at the site and sign off of delivery, any loss or damage shall be the responsibility of the buyer; e. Job site service: adequate facilities for off-loading, staging, moving and handling of merchandise shall be provided by buyer; f. Conditions on the job site: the job site shall be clean and free from debris prior to installation; g. If not purchased through a State of Florida Price Agreement, all prices shown herein are FOB factory. Delivery and installation charges will be quoted per order. If purchased through a State of Florida Price Agreement, the terms of the applicable agreement will apply. Order Change/Cancellation Policy Any changes or cancellations must be made within 7 working days from the acknowledgement date noted on the acknowledgement letter. Any changes made after 7 working days will result in a change/cancellation order fee of 50% of the purchase price for the items in question. For changes made within 7 working days from the order date: if fabric has already been cut or the item placed in production, a restocking fee of 50% of the purchase price of the item will be charged for each item changed. A change order to the purchase order must be received by PRIDE Furniture Customer Service, adding the line item restocking fee and price for each item changed. Return Policy All PRIDE furniture is made to order. Our facilities and product lines do not allow the regular inventory of furniture items. For this reason, returns or exchanges for reasons other than material or manufacturing defects will be accepted only under the following terms and conditions: Written approval is required for the return of any merchandise. Requests for returns or exchanges must be received by the PRIDE Furniture Customer Service Department in writing within 30 days after the invoice date. A 50% restocking charge will be assessed on all returns or exchanges. For return or exchange, products must be unused and in new condition. Credit issued will be based upon condition of returned items. Exchanges are subject to standard lead times at the time of re-order. Custom made (special order/non-catalog) products and orders in customers own or special order fabric may not be returned or exchanged. Refused or Postponed Orders Policy If purchase orders are completed by PRIDE in accordance with Customer Terms and Conditions after order acknowledgment and acceptance (with no modifications or changes prior to shipment date) and the buyer refuses or postpones the delivery of merchandise, then the buyer will be responsible and liable for a minimum of 80% of the selling price. In addition, the buyer will be responsible for storage and holding costs in accordance with PRIDE s policy.
