1 CITY COMMISSION BRIEFING & DOWNTOWN COCOA BEACH COMMUNITY REDEVELOPMENT AGENCY Planning Board and Landscape Committee Report For Meeting Scheduled for February 7, 2013 Minutemen Causeway Low Impact Design (LID) Stormwater Improvements and Streetscape Beautification 30% Design Documents TO: FROM: THRU: RE: Mayor Dave Netterstrom and Members of the City Commission Anthony Caravella, AICP, Director of Development Services Robert Majka, Jr., City Manager Approval of 30% Design Documents for the Minutemen Causeway Low Impact Design Stormwater Improvements and Streetscape Master Plan DATE: January 28, 2013 NOTE: This item is presented at the request of the City Manager to begin the process of proceeding with 60% design to produce plans that can be used in applications for possible grants for the stormwater portion of this project. The landscaping/streetscape component is still under review by the Landscape Committee, with a modified streetscape anticipated to be reviewed by that committee on February 12, A. Project Information On March, 2009, the Planning Board reviewed and recommended a Downtown Streetscape Master Plan and 30% Design for Orlando Avenue Landscaping. This work was part of the September 20, 2007, City Commission authorization of a contract with Miller Legg and Associates for the purpose of providing engineering, design, and landscape architecture services to develop engineering documents and landscape architectural plans for Minutemen Causeway and the downtown area. This plan was reviewed and approved by the City Commission on March 19, On May 12, 2010, the City approved a modification to the Miller Legg contract, which authorized the development of a CRA Stormwater Management Plan. This plan has been adopted as part of the Downtown Cocoa Beach Community Redevelopment Plan. On August 17, 2011, the City approved a modification with Miller Legg to prepare 30% plans for a Low Impact Design (LID) Stormwater project for Minutemen Causeway. 2 Briefing to: Mayor Dave Netterstrom and Members of the City Commission Re: 30% Design Documents Minutemen Causeway LID Stormwater Improvements and modified Streetscape Master Plan Date: January 28, 2013 for Commission meeting February 7, 2013 Page 2 Enclosed for the Commission s review are the 30% drawings for the Minutemen Causeway LID Stormwater project. Stormwater Utility Director Joanie Regan has taken the lead on this project. As part of the Stormwater improvements, modifications to the 2009 Minutemen Causeway Streetscape Plans were made increasing the amount of trees and landscaping provide additional vegetative support for the bio-swales proposed in the LID plan. A public presentation occurred on August 28 th, On September 11, 2012, the Landscape Committee reviewed the Minutemen LID Streetscape plans and after review and discussion, the Landscape Committee recommended approval subject to the following conditions: 1. No oak trees shall be installed on Minutemen Causeway between the Ocean and Orlando Avenue. 2. Irrigation shall be installed to ensure proper landscaping development and maintenance. However, the Planning Board asked to review the plans a second time (1 st review on September 10, 2012) at their October 1, 2012 meeting. At the October 1 st meeting, following discussion and public input, the Board considered and approved the following action: Motion by Cunningham/Carpenter Move to recommend to the City commission to table the Minutemen Causeway Preliminary Stormwater Plan and modified Streetscape Plan until the new City Manager and the new City Commission can review its shortcomings and it not be approved to go to the 60% phase, based on Cocoa Beach Landscape Committee did not approve the plan as drafted, the Planning Board did not approve the plan as drafted, the City Engineer listed serious discrepancies with the plan as set forth in the briefing report dated September 21, 2012, and at a meeting last week, the Cocoa Beach Merchants Association came out against the plan as drafted. Based on that Planning Board discussion and direction, the City Manager asked the Landscape Committee at their January 15, 2013 meeting to review the three conceptual streetscape plans and recommend which concept be used to proceed to the 60% design. That review resulted in use of the Original Minutemen streetscape presented as Attachment C Revision , with MINUTEMEN&ATLANTIC REVISION The Landscape Committee also provided a list of recommendations for use by the Landscape Architect to use in the modified streetscape. These recommendations are presented as Attachment D.

Limited Staff Review Development Services staff reviewed the plans and provided the consultant the following comments that require review: Because of changes to the landscaping a revised cost (from that originally prepared in January of 2012) of the project is presented as Attachment C. There are changes to the landscaping which may affect the functionality of the pedestrian corridors along Minutemen Causeway. There are changes to the landscaping which may affect intersection design and traffic functionality. The City Engineer reviewed the plans and provided the consultant the following comments that require review during development of 60% plans: The removal of the right turn lane at the Orlando intersection. I am firmly against this. The limits of the project are undefined and improvements outside/impacting adjacent properties haven t been properly identified I have significant concerns regarding the type of landscaping proposed and their future potential maintenance issues as well as their impact on existing and proposed utilities (no utilities shown on the 30% plan) The tabled intersections I do not think they re appropriate for this area considering the traffic volumes The area east of Atlantic needs to be completely thought out regarding beach access, emergency vehicle access, impacts to existing commercial buildings, maintenance, etc. Southbound Brevard Ave needs to be exclusive right and thru/left instead of thru/right and exclusive left. Need more detail regarding type of stormwater improvements proposed (it seems really up in the air at this moment). Lack of bicycle lanes C. Planning Board Review and Recommendation Staff presented this item to the Planning Board at their September 10, 2012 public meeting as part of the consultant s public participation component of the contract, and as if it were a City capital improvement project. As such, Planning Board recommendation and City Commission action on this preliminary (30%) plan is required pursuant to City Resolution The applicable provision of this Resolution (Section 1(2)) reads: Prior to proceeding with final design on public improvement projects with a capital cost in excess of $50,000, the Planning Board will review and make recommendations before final design proceeds. Such recommendation shall be forwarded to the City Commission for consideration as a Site Plan Consent Agenda Item. If the City is to pursue any grant or outside monies for a capital project, this process of Planning Board and City Commission review of a Concept Plan, shall be followed.

That review resulted in use of the Original Minutemen streetscape presented as Attachment C Revision with MINUTEMEN&ATLANTIC REVISION The Landscape Committee also provided a list of recommendations for use by the Landscape Architect to use in the modified streetscape. These recommendations are presented as Attachment D. At the request of the City Manager, a more detailed streetscape/landscaping plan is being prepared to act as the final 30% design for the streetscape/landscaping component for this project. This revised landscaping plan will be submitted for Planning Board and City Commission final approval at a later date. 1. Key Facts/Issues Requiring Discussion Key issues are identified in this briefing paper. The Planning Board reviewed this request at their September 10, 2012 meeting. The Board recommended approval with conditions. The Board asked to review the plans a second time at their October 1, 2012 meeting. The Planning Board also discussed this item at their January 7, 2013 meeting. The Landscape Committee reviewed this request at their September 11, 2012 meeting and recommended approval with conditions. At the recommendation of the Planning Board, the Committee reviewed the streetscape plans a second time at their January 15, 2013 meeting to discuss which concept should be used to proceed to the 60% design. Authorize proceeding with 60% stormwater design with landscaping/streetscape to be authorized at a later date following Landscape Committee final approval. 2. Costs The costs associated with this request include staff and Planning Board review times, and time associated with preparing reports for these boards and the City Commission. Preliminary project construction costs are identified in this briefing Attachment B. 3. Savings Not applicable. 4. Source of Funds Stormwater will use these plans in a grant application. Streetscape will be a Downtown Cocoa Beach Community Redevelopment Agency (CRA) project or a City/CRA/Stormwater Utility joint project.

Communications Three public meetings occurred before the Planning Board and two public meetings occurred before the Landscape Committee. A public workshop also occurred. There exists no local or statutory requirement to advertise/notice public hearing for capital improvement plans. 6. Environmental Impact Not applicable. 7. Recommendations The Planning Board recommends approval, with conditions, as written in the briefing paper. The Landscape Committee recommends approval, with conditions, as written in the briefing paper. Development Services staff supports both the Board and Committee recommendations. The City Manager recommends authorizing proceeding with 60% stormwater design with landscaping/streetscape to be authorized at a later date following Landscape Committee final recommendation. 9. Recommended Motion: Approval of 30% Design City of Cocoa Beach Downtown Minutemen Causeway Stormwater and Preliminary Streetscape Plan, with conditions identified in the briefing memorandum and Planning Board and Landscape Committee Report dated January 28, 2013, and authorize development of 60% design plans for stormwater with landscaping/streetscape to be authorized at a later date following Landscape Committee final recommendation.
