2 MEMORANDUM Date: September 21, 2017 To: Planning Commission From: Cindy Sherman, Planning Director Subj: Work Session The work session on September 27 will include a development item. The applicant ran into some communication issues with their contractor and asked if it were possible to move their Planning Commission schedule up. Staff agreed to have the commission review at the work session and the City Council will hold the public hearing on October 9. We made the decision because this site has an existing approved development plan and the buildings and site design are generally consistent with the approved plans. In addition, we do not anticipate any public concern regarding the application. In addition, I would like to discuss future work session topics. Please let me know if you have any questions or are unable to attend.

The west building is 110,700 sq. ft. and the east building is 108,070 sq. ft. both are for office/warehouse/manufacturing uses located on the northwest corner of 93rd Avenue and Winnetka Avenue. Proposed Action: MOTION SECOND TO RECOMMEND APPROVAL OF SITE PLAN REVIEW # FOR TWO BUILDINGS, 110,700 AND 108,070 SQUARE FOOT TO ACCOMMODATE OFFICE/WAREHOUSE/MANUFACTURING USES LOCATED ON THE NORTHWESTCORNER OF 93 RD AVENUE AND WINNETKA AVENUE, SUBJECT TO CONDITIONS IN THE DRAFT RESOLUTION. Staff Recommendation: Staff recommends approval of the site plan review as outlined in the draft resolution. Overview: In 2015 Capstone Quadrangle received approval to develop a business park at the northeast quadrant of 93 rd Avenue and Highway 169. The park was approved to have up to three building sites as indicated on the development plan. The first building was constructed and is home to Design Ready Controls who design and build HVAC control boards and currently employ 300 people. The two buildings now proposed for construction are being built speculatively, with flexibility in the buildout to accommodate manufacturing, office, warehousing, and other business park uses. The site has shared driveways and truck courts, and access is provided off of Winnetka Avenue. The property owner was recently successful in gaining approval for a future right-in, right-out onto 93 rd Avenue North; this will be installed when 93 rd Ave. is reconstructed in 2020/21 timeframe. Primary Issues/Alternatives to Consider: 1. Approve the Site Plan Review as presented. 2. Approve the Site Plan Review with modifications. 3. Deny the Site Plan Review based on certain findings. Budgetary/Fiscal Issues: None.

5 2A SITE PLAN RESOLUTION Page 3 RESOLUTION #2017- APPROVAL OF SITE PLAN FOR CAPSTONE QUADRANGLE BUILDINGS A AND B NORTHWEST QUADRANT OF 93 RD AVENUE AND WINNETKA AVENUE Planning Commission File # WHEREAS, Mr. Michael Faber, on behalf of Capstone Quadrangle, has made an application for Site Plan under the provisions of Chapter 152 of the City Code; WHEREAS, the development plan anticipates a coordinated development area in conformance with the Comprehensive Plan; and WHEREAS, the development will enhance the city s tax base and provide jobs; and WHEREAS, the matter has been referred to the Planning Commission who have given their advice and recommendation to the City Council; and WHEREAS, the effect of the proposed use upon the health, safety and welfare of surrounding lands, existing and anticipated traffic conditions and its effect on the neighborhood have been considered. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Brooklyn Park that the site plan for Capstone Quadrangle is hereby approved in accordance with the following: 1.00 PLANS 1.01 Per utility, grading, and landscaping plans submitted September 1, 2017 to be modified to provide additional sidewalks Per building plans submitted September 1, 2017 and approved by the City Council 2.00 BONDS, ESCROWS AND DIRECT PAYMENTS 2.01 A Development Contract and bonding shall be required in the amount of $.00 as a development bond or letter of credit, a $.00 cash bond, and a $.00 developer s escrow as required by Chapter 152. The developer's escrow must be posted with the City Treasurer to cover engineering, legal and administrative costs incurred by the City. If this account becomes deficient it shall be the developer's responsibility to deposit additional funds. This must be done before final bonding obligations are complete. This bonding must include the following:

Participation in modifications to the intersection of Winnetka Avenue and 93 rd Avenue per the Northcross EAW, including turn lanes and signal modifications (In lieu of bonding these items, an assessment agreement may be allowed based off of timing considerations for Hennepin County s reconstruction of 93 rd Avenue. This will be allowed at the discretion of the City Engineer); c. Grading and landscaping of all drainage areas, including the expansion on Outlot A; and 2.02 Payment of any special assessments on the property Park dedication has been satisfied REQUIRED DOCUMENTS 3.01 All utility construction, drainage, grading and development plans must be approved by the City Engineer prior to receiving a building permit Cross-access and maintenance agreement are required for the shared roadways, storm sewer, and utilities. These agreements must be reviewed by the City Attorney and recorded with the final plat A comprehensive search shall be performed to identify any existing wells on the property. A licensed well driller shall properly abandon any unused wells in the plat. Such abandonment shall be reviewed and approved by the Minnesota Department of Health GENERAL CONDITIONS 4.01 It shall be the developer's responsibility to keep active and up to date the developer's contract and financial surety (Letter of Credit, bonds, etc.). These documents must remain active until the developer has been released from any further obligation by City Council motion received in writing from the Engineering Department No burying of construction debris shall be permitted on the site Dust control measures must be in place to prevent for dust and erosion including, but not limited to, daily watering, silt fences, and seeding. The City Engineer may impose measures to reduce dust During construction, streets must be passable, at all times, free of debris, materials, soils, snow, and other obstructions All lighting must conform to Section through All rooftop units must be screened from public views per City Code.

7 4.07 Sidewalks shall be added in front of the buildings with connections made to the public roads. If the petitioner needs additional time to satisfy the requirements listed in this Site Plan Review, then a oneyear time extension must be requested. Time extension requests are subject to the conditions found in the Zoning Code (Section (H)). The failure on the part of the petitioner to obtain a building permit by December 31, 2018 shall deem the Site Plan Review approval to be null and void.

The buildings are to be constructed with precast panels, similar to other business park buildings in the area and the concrete panels will be painted using three different colors which will complement the existing building on site. The panels will have reveals to create different patterns on the façade. The front and sides of the building use glass and a change in plane to create visual interest. The loading docks are located between the buildings and will be screened with berming and landscaping. Several areas in the dock bay will be limited maintenance green space that could be converted to additional dock space if needed. The green areas are not included in the green space calculation provided and will have ground cover but not landscaped. Access and Parking All access and circulation will be directed to the northerly private drive via Winnetka Avenue. Hennepin County controls the access to 93 rd Avenue. They recently agreed to allow an access to the property off of 93 rd Avenue but this will not be provided until reconstruction which is anticipated in 2021/22 timeframe.

10 2A Page 8 Pedestrian Connections Both buildings should have a sidewalk running along the front of the building to allow pedestrian access from the parking lot. A sidewalk is shown along the west side of Winnetka Ave. and future trail will be built along 93 rd Ave. Consistent with other buildings constructed along 93 rd Avenue a sidewalk connection should be provided out to 93rd where a trail will be added when the roadway is reconstructed to an urban section and connection should also be provided to Winnetka. Staff will work with the developer to identify the best locations to make the connections. Landscaping The property has a landscape plan that provides a variety of plant materials including trees, shrubs and native plantings/perennials; however the code requires more plantings than are shown. Staff will work with the landscape architect to update the plan to meet the code prior to issuance of the building permit. Storm Water Management The applicant is proposing to expand a storm water basin located on the westerly parcel. In addition, the site will have rain gardens incorporated into the boulevard along Winnetka Avenue. The site is subject to the permitting process of the West Mississippi Watershed Management Commission. Utilities The site is served by all public utilities. Lighting Parking lot lighting is limited to a maximum height of 25 feet. This includes the base for the lights. All lights must be down-cast and fully shielded including those mounted on the building Signage All signs shall meet city code and are subject to a separate sign/building permit. There are currently two approved monument signs to serve the site. Building signs are permitted.

Transportation 101 presentation- Jeff Holstein, Transportation Engineer gave the Commission an overview of transportation planning and engineering.
