1 YARMOUTH PLANNING BOARD MINUTES REGULAR MEETING March 27, 2019 I. CALL TO ORDER Tom Federle called the meeting to order at 7:00 PM. II. APPROVAL OF MINUTES Upon a motion duly made by Judy Colby-George, seconded by Michael Dubois and carried 6-0 minutes of the February 27 and March 13, 2019 meetings were approved. COMMUNICATION None V. PUBLIC HEARING ITEMS There were 6 +/- people from the public in attendance A. OLD BUSINESS: None B. NEW BUSINESS: 1. Stormwater Training Steve Johnson, Town Engineer Town Engineer Steve Johnson provided training on stormwater management under the National Pollution Discharge Elimination System (NPDES) MS4 mandated water quality improvement program. The program requires the Town to implement a Stormwater Program Management Plan ( Plan ) implementing six minimum control measures which are designed to reduce the discharge of pollutants from its regulated small MS4 to the maximum extent practicable, to protect water quality, and to satisfy the appropriate water quality requirements of the Clean Water Act. Public outreach and education are required components of the Plan. The Planning Board reviews projects for 1

2 stormwater management and receives periodic training to assist in this critical role in the Plan and program. Steve Johnson, Town Engineer gave a training on stormwater and how it impacts the Town and our responsibilities. The Town of Yarmouth is a member of Interlocal Stormwater Working Group (ISWG) which is a network of towns in Cumberland County working together on Stormwater management. The town must have a permit to direct runoff into appropriate places and minimize contamination. The Town is audited every 5 years for compliance including in-house record keeping and on-site inspections. Our next permit cycle begins July of 2020 and with each passing cycle there are more requirements to be met. There are 6 areas the State looks at: 1. Public Education; 2. Public Participation; 3. Illicit discharge, detection & elimination; 4. Construction site runoff control (track out); 5. Stormwater management and continued maintenance after construction; 6. Good housekeeping and pollution prevention. The most common deficiencies around the State are: 1. Clear follow up procedures after things are documented; 2. Consistent site inspections for illicit discharge and 3. Staff training. The Town did well in our most recent audit which was in January of this year, and there are only minor items we could improve upon. Judy Colby-George questioned if there is anything the Planning Board can do to help. S. Johnson Anything that can be captured during redevelopment projects such as low impact development and being aware of runoff areas. JCG With climate change and increased storms should ordinance modifications be considered? S. Johnson Changes have already been made to the Subdivision ordinance regarding storm protocol from years. It may need to be revised in the future as needed. Rainfall levels built into the TR-55 stormwater model are updated to account for changes in rainfall events. No further modifications are needed at this time. Tom Federle questioned what is the greatest impact on the Royal River? S. Johnson pet waste and pesticides. There are many suggestions and resources on the website on how to maintain clean water and stormwater runoff. Matt Schumacher questioned how rain gardens expectations are carried on as ownership of properties change and time passes. S. Johnson rain garden maintenance and upkeep should be addressed in owner s deeds. Part of his job is to inspect raingardens on a regular basis to ensure their maintenance. Andrew Bertocci What are the issues in Brickyard Hollow? Every town needs to indicate their priority watershed which for Yarmouth is the 2

3 Brickyard Hollow area. It encompasses a large area of downtown, the Village area and up to Route 1. This is also our most urban and oldest area of the Town. S. Johnson went and inspected all existing septic systems in the area as part of compliance and the Town ensures the area is kept clean. Yarmouth holds the same standards to all areas of the town and not just the Brickyard Hollow area. 2. Action Item: Major Site Plan and Shoreland Review Harbormaster Building, Vicinity of 209 Old Shipyard Road, Map 33 Lot 127, Town of Yarmouth, Applicant. Replace the existing 360 SF Harbormaster building with a 960 SF building housing office space, washroom, anteroom, garage workshop and storage space. No additional parking or public restrooms are proposed. Steve Johnson, Town Engineer gave an overview of the project on behalf of the Harbor and Waterfront Committee. The harbormaster building was a key component of the Harbor Master Plan of The current building is at the end of its life. The proposed building is New England cottage style architecture to fit into its surroundings and will provide a quality work environment for the harbormaster. The building is slightly larger; but will sit on the same footprint as the existing building. It is oriented to give the Harbormaster the maximum view of the harbor. It will have a receiving area for the public, an office, restroom for the Harbormaster and a garage/workshop. Police Chief Mike Morrill The building will mainly be used April November; but the Harbormaster still has shellfish enforcement responsibilities throughout the winter and will use the building as his office space all year round. Chair Federle opened to public comment No comments Public comment closed Andrew Schaefer questioned the purpose of the garage. Police Chief Mike Morrill Intended to be a small workshop and used for winter storage. It is not large enough to fit the boat or a car. TF asked about exterior lighting. S. Johnson there will be exterior security lighting on motion sensor and the building will be on an alarm and monitored like all municipal buildings. Michael Dubois asked if the Town will be responsible for a monetary contribution to the sidewalk fund as other applicants are in order to reconnect the waterfront to the town and make it more walkable. Alex Jaegerman this has been discussed with town staff and there are some 3

4 ideas being explored to improve pedestrian connections to the Town. Yes, the town will contribute to the sidewalk improvements, but it is not a condition of approval. MS asked for clarification on the non-conforming building. Nick Ciarimboli, Code Enforcement Officer The non-conformance is with respect to a setback only. The old building can be torn down and the new building rebuilt with the same non-conforming setback; the setback cannot be made any more non-conforming and in this case the building will be moved slightly giving an even larger setback than currently exists. The following motion was made: On the basis of the application, plans, reports and other information submitted by the applicant, findings and recommendations contained in Planning Board Report dated March 20, 2019 relevant to Yarmouth Harbormaster s Building, Major Site Plan & Shoreland Zone Review, 209 Old Shipyard Rd., and the testimony presented at the Planning Board hearing, the Planning Board finds the following: A. Regarding WOC I Special Performance Standards Chapter 701 Article IV.P.3, that the plan is in conformance with the standards for review of this section, and is approved. B. Regarding Shoreland Permit Review Chapter 701 Article IV.R.11 a & b, that the plan is in conformance with the standards for review of this section, and is approved. C. Regarding Site Plan Permit Review Chapter 702 Article I. H., that the plan is in conformance with the standards for review of this section, and is approved subject to the following condition of approval: 1. A locking cover be provided on the proposed holding tank. VI. ADJOURNMENT With no objection, the meeting adjourned at 7:55 PM 4
