2 BACKGROUND INFORMATION: The applicant is requesting a waiver of the Commercial Design Standards to allow a trash enclosure to be located adjacent to the public right-of-way (Deer Springs Way). The applicant intends to place the required trash enclosure, within the parking lot, and adjacent to Deer Springs Way. The proposed trash enclosure will comply with the Commercial Design Standards for Aliante. The Dairy Queen was originally approved in December 11, 2013 with UN The site plan originally had the trash enclosure within the parking lot close to the Firestone Building. However, the applicant sold the parcel containing the Firestone, prior to siting the trash enclosure. The proposed location is not acceptable to the adjacent parcel owner. Therefore, the applicant is requesting the current location as the only available alternative. Additionally, on May 13, 2015 the Planning Commission approved UN for a daycare on this same parcel. The site plan submitted with the application had the trash enclosure in adjacent to Deer Springs Way, in the currently proposed location. DEPARTMENT COMMENTS: Public Works Department: Building Department: No outstanding issues. No outstanding issues. ANALYSIS: Note: The developments in the Aliante Master Planned Community are regulated by the Aliante Development Agreement supplemented by specific development standards, design guidelines, and master sign plans. The development agreement requires developments to adhere to the versions of Title16 and Title 17 in effect on November Therefore, the analysis presented may deviate from the current standards. The code in effect for Aliante allows waivers of the design standards with approval of a Site Plan Review, while the current ordinance has an application for waivers G.4 (November 2001 Zoning Ordinance) states that refuge collection areas and dumpsters of sufficient size and number for the needs of the development shall be provided. They shall be located away from the street front and screen from view from rights-of-way, sidewalks, and abutting properties through the use of landscaping and screening to better integrate the structure to the site. The submitted site plan accurately demonstrates the problem with the siting of the trash enclosure. The parking lot is small and under development, the only space accessible for pick up by Republic Services and available, are the parking spaces adjacent to Deer Springs Way. Therefore, the best solution is to require additional landscaping to buffer the trash enclosure from the right of way and meet the intent of the Commercial Design Standards. RECOMMENDATION:
3 The Community Development and Compliance Department recommends that SPR be approved with the following conditions: PLANNING AND ZONING: 1. Unless expressly authorized through a variance, waiver or another method, development shall comply with all applicable codes and ordinances. 2. The landscaping along Deer Springs Way shall be increased to provide 80% ground coverage within two years of planting using plants from the Aliante plant list.
