Twenty seven (27) villas on 3.79 acres is excessive. Keller already has too many apartments, villas and patio homes and the location of the proposed development will damage the hike/bike trails and natural area along Bear Creek Parkway. The property in question is heavily wooded and in order to build this number of villas, the developer will essentially have to clear cut the mature trees and that will do away with the greenbelt area along Bear Creek Parkway between Town Hall and Keller Smithfield Road. While the City has a tree preservation code and/or a code to provide mitigation for protected trees the existing mature trees will end up being replaced by toothpick sized small tree plantings that will take numerous years to grow. These villas will add to the already congested multi family residential developments and villas that currently exist in Town Center the Conservatory, the Dominion Apts, the Villas of Town Center and the apartments at the Arthouse. In addition, this proposed development will create a horrendous drainage problem plus add to the already congested traffic in this area. We would like to see the City purchase this property either at a reasonable price as part of the expansion of the Parks and Recreation and/or via eminent domain and leave it as a wooded natural greenbelt area connected to Bear Creek Park and the Park/Lake at Town Hall. We respectfully request that the P & Z Commission and the City Council deny the SUP for the Brownstone Villas. While this request is the newest in a long line of recent requests before the P&Z Committee, it creates exactly the same issues as those that have come before it: Keller will become a city populated with a transient citizenship which carries no pride of ownership or community responsibility Keller residents will become responsible for a greater tax burden to support this transient citizenship (utilities, schools, law enforcement, etc.) Keller traffic will increase and create an additional burden on the city to manage the traffic flow Keller loses the opportunity to utilize these areas for commercial/retail purposes which provides profit for the city and tax relief for its citizens Our family has been a resident of Keller for 3+ years. We moved to Keller because of its hometown atmosphere and its commitment to community. The sense of community is quickly eroding with each consideration of these high density requests. As a resident of Keller who lives just a little bit south of the proposed area of development, I want to express my opposition to this high density residential development. My objection is not merely a "not in my back yard" knee jerk reaction. I have recently become aware of the high number of variances that have been requested and approved. This concerns me because of the pressure that it places on our city's infrastructure. The land use guidelines and development restrictions are in place for solid reasons. They are not just default restrictions as one developer claimed at a meeting I attended. If the city leaders continue to grant these variances, the city plan fails, not because it is a bad plan, but because it keeps being ignored for the benefit of the few ignoring the greater benefit of the many. Let's stand our ground and encourage development that is more beneficial to our city and residents. Commercial development appropriate to this particular area seems to make more sense. I do not know why the Planning and Zoning Commission keeps approving high density housing especially of late in the North Keller area. The traffic is getting much more congested and there is not ample infrastructure in order to handle the amount of high density housing that is being approved. I am not a person that is anti development (actually the opposite), but I did buy in North Keller due to the large lots and country feel. I bought my house due to the larger lot requirements and now it seems every time I turn around, the Commission is trying to shrink the lot sizes or put in high density housing. One reason that we moved to this home in 2006 was the lovely park and open spaces surrounding Keller Town Center. A few years ago, a senior housing facility (the Legacy at Bear Creek Assisted Living & Memory Care) changed it's location to Keller-Smithfied due to the water retention issues. 33 FW: Brownstone Villas of Town Center - opposition From: Kristy Murdock Sent: Friday, March 2, 204 2:44 PM To: David Hawkins Brownstone Villas of Town Center - opposition Mr. Hawkins, I previously had provided a letter regarding the proposed Brownstone Villas development. Before Monday's Planning and Zoning meeting, in response to the additional information we received at the meeting on 3/0, I wanted to again voice my strong opposition to this project (my house is within that 200' zone). While I am anxious to hear the applicant's presentation, I already know enough to be gravely concerned about several things. As of yet, I have seen or heard no mention of addressing the flood plain and/or water issue. The site plan we have seen to date is very full, therefore leading me to wonder how they propose to deal with what appears to be a creek or source of water (there is water there even when it has not rained). I hear the previous applicant for that property (when an Assisted Living Facility was proposed) was told he had to provide a retention pond of some kind. Will this applicant be required to do something similar? Surely just filling that land is not the best solution or it would have been permitted the last time. Obviously this concerns me in terms of potential flooding. I am also concerned about the traffic. As you know, the street light proposed for Bear Creek and Keller Smithfield did not pass in the last bond election. While I do hope we get that light eventually, whether with or without it, this development is a concern. We heard at the last meeting on 3/0 that 2 entrances are proposed on Bear Creek, but no new breaks will be added to the median. That means anyone coming from the west to get into that neighborhood would probably come right to the entrance of our neighborhood and do a u-turn to get to their entrance. With our close proximity to the Bear Creek/Keller Smithfield intersection, this is a safety issue whether or not that street light is ever added. We will also be getting increased traffic from the new movie theatre down the street. As it is, without that street light, myself and most of my neighbors try to avoid that intersection and instead go down to Country Brook and get over to 709/Keller Parkway that way. There is just too much traffic and too many pedestrians to use that intersection safely during peak traffic times. This would only add to the people having to do that. This would also mean that anyone wishing to go south on Keller Smithfield would probably be making a u- turn at Country Brook and Bear Creek. Bear Creak is a heavily travelled curved road - both with cars and pedestrians. Adding a bunch of u-turn traffic would be dangerous. I'm also concerned about the future for my home. Those 2 story structures that I believe are being proposed (with no barrier between us) would virtually block any sky I currently see - as I currently back up to woods, that would certainly change one of the most attractive features of my home when it comes to my quality of life here, or the quality of life for potential home buyers. If they are built, I will also find myself spending a lot of money trying to figure out privacy screening for myself between my property and theirs, and so would my neighbors. While I am realistic that the land in question is permitted to be built on, I strongly believe that these structures are NOT the right answer. I appreciate your time and hope that the Planning and Zoning Commission agrees with me and most of my neighbors that this type of development is NOT appropriate for that plot of land.
