2 Craft Distilleries in Rural Areas Allows craft distilleries as defined in RCW in rural areas, at an appropriate rural scale and consistent with community character Requires that at least half of the raw materials used in the production are grown in the State of Washington RCW (6) states that distilling is an agricultural practice Staff supports the proposal provided the craft distilleries are designed at an appropriate rural scale as noted in the amendment text Community Plan Amendment # Craft Distilleries

3 Proposed Policy Language Land Use Element, Page 2-56 LU Allow craft distilleries as defined in RCW (12) in rural areas, at an appropriate rural scale and consistent with community character and where at least half of the raw materials used in the production are grown in the State of Washington. LU Non-agritourism craft distilleries are similar to other agricultural uses such as primary processing, packing, shipment, and cold storage plants and should be considered in the land use designations that permit these use types. LU The craft distillery building, sampling/sales building, storage buildings, and parking shall not exceed 1 acre in area and should be permitted at a rural scale. LU Limit the combined distillery production and retail sales/products sampling and sales areas to 8,000 square feet with a maximum of 1500 sq. ft. for the retail sales/sampling area. 6 LID Proposed Changes (con t) Environment Element Page 7-3 ENV-2.4 Limit the amount of protection and clearing that can be done for development. ENV Require mitigation for vegetation removal. WATER QUALITY Aquifers provide the primary source of domestic and industrial water for most of Pierce County. Aquifer recharge area soils are highly permeable and allow for the infiltration of surface waters into groundwater. Below the surface, the infiltrating water enters the aquifer, a saturated geologic layer which can yield sufficient quantities of water to be used as a source of public or private water supply. The use of low impact development is a priority in order to help protect and enhance the environment, air and water quality, and the availability of water. Require the use of low impact development principles and best management practices for stormwater drainage including use of infiltration systems, such as bioretention, rain gardens, and permeable pavement, to maintain water quality for fish and wildlife. 7 LID Proposed Changes (con t) Utilities Element Page STORM DRAINAGE AND SURFACE WATER MANAGEMENT People depend on and enjoy water but it creates real problems when there is too much or its quality is compromised. Pierce County addresses water issues including flood risk reduction, water quality, and preservation of natural drainage systems. The County promotes the use of low impact development principles and best management practices. This helps ensure Pierce County s rivers and streams are clean, healthy, and safe. Issues: Addressing nonpoint pollution in stormwater by including requiring low impact development principles and best management practices, water quality treatment features in the design and construction of facilities, requiring treatment from new development, and through public education. 12 RSR and the Open Space Corridor Rural Sensitive Resource Applicable Policy Apply a Rural Sensitive Resource (RSR) designation to open space corridors within rural residential designations to reduce impacts associated with development. Establish a RSR zone on rural residential properties located within the open space corridor that contain at least 50% of designated open space corridor area. 13 Open Space Corridor Open Space Corridor Establish an open space network linking open space areas via greenbelt corridors throughout Pierce County. Pierce County shall designate an Open Space Corridors Map which identifies the general location of open space areas and corridors in Pierce County. The map is based upon the high priority open space categories as set forth in Title 19D.170, Open Space Priorities. Open Space "Open space" means a landscape which is primarily unimproved. Open space areas may include: critical areas, wooded areas, parks, trails, privately owned natural reserves, abandoned railroad lines, utility corridors, and other vacant rights-of-way. 14 Is it Open Space Corridor? The Graham Kapowsin High School (GKHS) received an Administrative Use Permit in August of 2002, a vested building permit in April 2003, and construction began in GKHS opened in the fall of 2005, two years before the Graham Community Plan was adopted. The nine RSR parcels were already developed or vested as a school campus. All properties were included in the Bethel School District s Capital Facilities Plan. 17 Summary The Graham Kapowsin High School campus did not qualify as open space. The Open Space Corridor mapping disregarded the existing and vested development. The Open Space Corridor Map is proposed to be amended removing the Open Space designation from the GKHS campus. The parcels constituting the Campus would not meet the locational criteria for RSR. 25 ARL History 1990: Growth Management Act requires the designation of Agricultural Resource Lands The Washington State Growth Management Act (GMA) requires counties to designate Agricultural Lands (RCW 36.70A : Pierce County revises approach to designation of Agricultural Lands Establishes Agricultural Resource Land (ARL) designation for Agricultural lands ARL is based on specific criteria Natural Resource Conservation Service (NRCS) soil data is a key criterion : Comprehensive Plan Amendments and new Community Plans implement the ARL designation 2015: Comprehensive Plan Update - Criteria Change Proposal/ARL Review Proposal to Eliminate Yield Criteria Not Adopted Considerable interest expressed in amendments to ARL Criteria Text and Map Amendment # Agricultural Resource Lands

31 Exclusions The Proposal Retains none of the existing exclusions however there is reference to removing properties that are irrevocable non-farm uses Staff Recommendation LU Consider excluding properties already characterized by urban growth or characterized by more intensive rural development, such as: LU Lands designated as rural centers; LU Lands rezoned to rural centers; LU Lands that are part of a preliminary plat approved prior to February 1, 2005, or a final plat recorded prior to February 1, 2005, including any associated open space or other non-buildable tracts identified on the face of the plat; LU Lands covered by a non-residential development permit for uses other than agriculture. 32 Exclusions (Cont d) The Proposal Retains none of the existing exclusions however there is reference to removing properties that are irrevocable non-farm uses Staff Recommendation LU Lands with mobile home parks; and LU Properties owned by governmental agencies prior to the effective date of the 2015 Comprehensive Plan Update for public use as identified in a Capital Facilities Plan adopted as part of the Pierce County Comprehensive Plan or an adopted long range planning document. LU Land that is irrevocably dedicated to non-farm use. LU Designated forest and timber lands as identified by Pierce County, RCW 84.33, and RCW shall be excluded. 33 De-Designation Criteria The Proposal Proposed policies inconsistent with GMA for ARL lands if viewed independently. Staff recommends to remove from proposal: LU Expansion of the urban growth area now encompasses the subject parcel. LU The site is no longer devoted primarily to agricultural production. LU The property no longer holds longterm commercial significance for agricultural production. Staff Recommendation Add additional language to existing policy: LU The approval of a Map Amendment to correct technical errors and revert voluntarily designated ARL parcels under the timelines and procedures established for regular Comprehensive Plan Amendments. The property was designated ARL in error or voluntarily, and does not meet one or more of Pierce County s ARL designation criteria. Text and Map Amendment # Agricultural Resource Lands

34 Voluntary Designation Criteria The Proposal Staff recommends to remove from proposal: The following criteria and procedures shall be met to qualify for voluntary ARL designation: 1. Parcel must be located outside urban growth area. 2. Meet the minimum parcel size requirement. 3. Parcel must be certified for the Current Use agriculture tax exemption under RCW 84.34, or be currently devoted primarily to agricultural production, with annual farm income of at least $1,500 per year. Staff Recommendation Maintain existing policy allowing property owners to voluntarily request ARL Designation: LU-84.4 Landowner intent. While landowner intent cannot be used as a rationale for dedesignation, it can be used as a criterion for inclusion into the ARL designation. Property owners requesting inclusion into the ARL designation shall not be assessed a Comprehensive Plan Amendment processing fee. 4. Minimum 10-year period.
