1 Architecture and Landscaping Introduction This Guidebook is a supporting document to the Covenants and By-Laws that you received when you purchased your home. The primary objective of these is to maintain the original, overall, harmonious blend of Architecture and Landscaping in our Community. The Board has developed these rules and regulations to fulfill the intent of the Covenants and By-Laws. Compliance with the Rules and Regulations maintains and enhances the value and high standards of our Community. Getting acquainted with the contents of this Guidebook is essential. It clarifies and simplifies what may seem like daunting reading of the Henderson Reserve Townhomes Association, Inc. governing documents. Observing these policies enhances the enjoyment of living in our Community. Be sure to refer to this Guidebook BEFORE requesting to modify the appearance or use of your town home. Page 1 of 6

2 Architectural Architectural Review Board (ARB) approval is required before any additions or changes to the exterior of a unit are started or made. Such alterations may not affect the structural integrity of the building, its real or perceived value or disturb the rights of other owners. To request a change: Complete the Architectural Change Request Form available at or ask the Architectural Committee Chairman or any Board member Submit the completed form to the Architectural Review Board and wait for its written decision. Any declined requests can be appealed to the HOA Board of Directors. Please follow the written procedure for requesting changes. ANY variation to these must be submitted for approval prior to installation. Any alterations considered by the ARB not to conform to existing standards must be removed and returned to the original standard at the Homeowner's expense. Front door hardware may be replaced only with traditionally styled silver chrome (not nickel) matching the style already in use. House Jiumbers must not exceed three inches and should match in font and style and color (black) to other existing house numbers. Replacement of front and back exterior light fixtures must be approved. It is recommended that all exterior light bulbs be either white or dear. Installation of security floodlights is not permitted. Mail boxes (solid black only) must exactly match boxes in the Community meet U.S. Postal Service regulations. and Front entrance handrails must be black wrought iron and match the style already in use. Owners are responsible for maintaining the paint and safety of these handrails. The ARB must approve installation of storm windows or doors. Tinted windows are prohibited in the Community, and no film should be applied to windows without written approval. Page 2 of 6

3 Afchitsctural & Landscaping To maintain a uniform appearance, it is recommended that the external-facing side of window-treatments be white or wood stained. All fabric or cloth window treatments should be lined with white, so that the external view does not detract from the uniform external appearance of the buildings. Burglar bars are not permitted. All homes are pre-wired for security systems. Please contact any home monitoring service for activation. Sidewalks must be kept free of obstruction. No personal property can be stored or installed on sidewalks or any common areas. Signage, yard art, garden lighting, and garden statuary (in the common flower beds) are not permitted. Political signage is not allowed. Birth, wedding, graduation or other such announcement signage is permitted for no more than seven consecutive days. Security decals and signs are permitted. Real estate open house signage is allowed on the day of activity only. A "Home for Sale" sign has been placed at the front entrance to advertise homes in the Community. Additional restrictions on signage are covered in the Covenants, Section 9.4. Patio area fences and decks may only be sealed with clear sealant. Patio changes that do not require approval: installation of potted plants tables and chairo neutral umbrellas and fountains no higher than the fence. Children's toys should be no larger than fence height. Deck changes that do not require approval: installation of potted plants, tables and chairs, neutral umbrellas and fountains that do not exceed the manufacturers' weight guidelines or the height of the division wall. Children's toys should be no higher than rail height. Hot tubs and spas are not allowed on the exterior of any building. An approved style of deck awning, hood and hardware has been covered in a separate resolution. Written approval from the ARB is required prior to any installation. Please see a Board member for details. Unapproved awnings will be removed by the Board at the Owner's expense. Charcoal or wood burning stoves, smokers, chimenea, and BBQ pits are not permitted, as they do not meet Covenant noxious odor guidelines and pose a risk of fire. LP, eiectric, charcoal and gas grills are permitted on all patios and balconies; however, smoke from these can violate these same guidelines. Owners should take care to supervise grill cooking to prevent unintended fires and to ensure proper ventilation to keep smoke from invading neighboring homes. Page 3 of 6

Exterior grade plastic trashcans with lids must be used for placing all household trash on the curb for pickup. Please see Covenants Section for additional information. Bird feeders and birdhouses are not permitted in any Common area. Additionally, wind chimes can violate HOA noise nuisance covenants and discouraged. be are American and official State flags may be displayed in accordance with federal or state regulations. Homeowners should not attach anything to the exterior of their unit that modifies the appearance or function of their home. Organizational, sports, seasonal flags and other decorative banners/signs are not permitted. Traditional holiday decorations are permissible only on front doors, stoops, front handrails and bushes in front of units. All externally-facing holiday lighting must be non-flashing or non-blinking. The preferred color is clear bulbs. Holiday decorations should be removed after the standard holiday period. Exterior color schemes may not be changed. This includes painting, siding, trim, door colors and roofing shingles. Roof or siding repair requires ARB approval. Homeowners should not attach anything to the exterior of their Unit that modifies the appearance or function of their home without first obtaining ARB approval. Vehicle parking is addressed in a separate resolution. In summary: Homeowners' cars should be parked in their garages or driveways with no part protruding into the street. Campers, boats and trailers must be at all times parked in garages with no part protruding beyond the confines of the garage. No parking on or along curbs. Guest parking is strictly monitored. Guests who park more than seven nights in guest parking are asked to park in driveways. Broken-down or immobile cars may not be stored in driveways. Car repair activities may not be done in driveways or streets. Please follow DeKalb County Ordinances for proper engine oil disposal. Car washing is permitted in driveways only. Driving over the curbs or sidewalks is never allowed. Page 4 of 6

5 Landscaping These rules pertain to the grounds of the Community. Any other change to any property at Henderson Reserve not a part of the grounds is under the jurisdiction of the ARB. While the Landscape Committee recognizes that we live In a fee simple Community where the grounds are professionally maintained, we would like to afford each Homeowner a level of personal expression around their residence. With that goal in mind, the Landscape Committee has adopted the following guidelines to ensure that Henderson Reserve maintains a uniform and attractive landscape plan: The grounds around Henderson Reserve are entirely maintained by the Association. The Landscape Committee has the authority to approve and disapprove all plantings and changes to the landscaping in the Community. Homeowners who do not approve of a decision made by the Landscape Committee may appeal in writing to the Board, according to the provisions of Covenants Section 9.3(b). Homeowners shall not alter the original plantings In the front or sides of their units. Any plantings that are not authorized in writing by the Landscaping Committee will be removed at the Owner's expense. Homeowners who wish to plant in the area behind the unit (around the mailbox areas of the St. lves/3-level units and inside the fenced area of the Charleston 12- level units) may do so after receiving written approval from the Landscape Committee of their requested plantings. To receive approval for plantings, the homeowner must make a written request to the Board or Landscaping Committee. The request must include a description of the proposed plantings and a general description of where the plantings will be placed. The homeowner will then be responsible for installing and maintaining the plantings. The Landscape Committee retains the authority to require proper maintenance and reduction in size or removal of the plantings if they become deprived or overgrown. Only smaller ornamental plantings will be approved. Larger plants and vine type plantings are not consistent with the limited space in these areas will not be approved for planting by the Landscaping Committee. most and Homeowners are not allowed to cut or remove any Association plantings. 6 Pets are a privilege and the personal responsibility of their owner. All pet owners are required to pick up after their pets in all areas of the Community. All animals are to be under leash or direct voice control at all times when on Common property. The DeKalb County Code relating to animals is: It shall be unlawful for any person who possesses harbors or is in charge of any animal not to immediately remove droppings by the animal on any street, right-of-way, public or private property. All violations of this ordinance should be reported to the Police, who will write a citation for the offense. The Home Owners Association Covenants mirror this code. Page 6 of 6
