1 WTO TBT NOTIFICATIONS Issue No. 24 Disember 2013 Cadangan Peraturan Kerajaan Asing (Proposed Foreign Government Regulations) Maklumat mengenai cadangan keperluan peraturan dan persijilan negara asing telah diterima oleh WTO TBT Enquiry Point (Malaysia), Pusat Pengurusan dan Penyelidikan Standard, SIRIM Berhad. Notifikasi-notifikasi ini dikeluarkan oleh negara-negara ahli yang menandatangani perjanjian WTO mengenai halangan teknikal kepada perdagangan. Sebagai negara ahli, pengeksport Malaysia perlu mengkaji cadangan peraturan berkenaan dan menghantar sebarang ulasan untuk dipertimbangkan oleh negara tersebut sekiranya keperluan baru itu menghalang perdagangan secara tidak berpatutan. Ulasan yang lewat diterima masih boleh dipertimbangkan sekiranya diterima tidak lama selepas tarikh akhir untuk ulasan. Medicines Draft Resolution nº 52, 3 December Draft Resolution that establish rules to outsource production stages, quality control analysis and storage of medicines, This draft Resolution aims to establish rules to outsource stages of production, analysis of quality control and storage of medicines. It applies to manufacturers, importers, distributors and storage facilities for medicines and quality control of medicines laboratories located in Brazil. It will revoke Anvisa's Resolutions RDC n. 25, 29 March 2007 and sole paragraph of Article 8 of Resolution RDC n. 10, 21 March 2011 G/TBT/N/BRA/568 Final date for comments: 8 February 2014 Proposed date of entry into force: On the date of adoption CANADA 1. Means of containment for the transport of dangerous goods Regulations Amending the Transportation of Dangerous Goods Regulations (Update of Standards) The Transportation of Dangerous Goods Regulations (TDG Regulations) include requirements for the manufacture and use of means of containment for the handling, offering for transport and transporting dangerous goods primarily by referencing safety standards. The TDG Regulations contain references to domestic and international safety standards that are out of date or have been recently updated. The lack of these updated standards in the TDG Regulations creates a need to issue many equivalency certificates which imposes an administrative burden on industry. The following standards are either no longer current or need to be introduced in the TDG Regulations: - Several new standards in relation to new types of means of containment are not currently addressed in the Regulations. These stem from the 4 United Nations Recommendations on the Transport of Dangerous Goods (UN Recommendations), and include UN portable tanks and UN cylinders. - A number of safety standards on the manufacture, selection and use of means of containment for dangerous goods have been updated by organizations such as the Canadian Standards Association (CSA) and the Canadian General Standards Board (CGSB). These safety standards are currently referenced in the TDG Regulations and the references need to be updated. - A safety standard for small means of containment that aligns the TDG Regulations with international and United States (U.S.) requirements; this standard needs to be introduced into the TDG Regulations. - The references to the United States Code of Federal Regulations (49 CFR), the UN Recommendations, the UN Manual of Tests and Criteria, the International Maritime Dangerous Goods Code (IMDG Code), the International Civil Aviation Organization Technical Instructions for the Safe Transport of Dangerous Goods by Air (ICAO Technical Instructions) and its Supplement also require updating to facilitate understanding on the part of the users, and simplify enforcement of the TDG Regulations. The proposed Regulations Amending the Transportation of Dangerous Goods Regulations would update the references to the safety standards, to 49 CFR, to the UN Recommendations and to the UN Manual of Tests and Criteria, the IMDG Code and the ICAO Technical Instructions and its Supplement. This regulatory proposal would adopt five new standards for new types of means of containment and update nine standards on means of containment already in the TDG Regulations. Transitional provision: A person may, for a period of six months that begins on the day on

5 which these Regulations come into force, comply with the Transportation of Dangerous Goods Regulations as they read immediately before that day. To minimize the economic impact, the revised standard for the selection and use of gases (CSA B340-08) allows for a transitional period of 30 years for companies involved in the transportation of helium. This would allow nonstandardized means of containment of up to 550 L capacity and manufactured before January 2008 to be used for transportation of helium before being replaced with the standardized TC-4LM specification cylinders. This 30-year transition period would be sufficient to ensure that all existing means of containment utilized for the transportation of helium remain useable for their entire lifespan, thus ensuring no additional cost to industry. 2. Drugs and Medical Devices Bill C-17, Amendments to the Food and Drugs Act, introduced as Protecting Canadians from Unsafe Drugs Act (Vanessa's Law) The new legislation will update the laws that apply to drugs and medical devices to increase patient safety in key areas of concern and will enable the Government to: - Require strong surveillance including mandatory adverse drug reaction reporting by healthcare institutions; - Recall unsafe products; - Impose tough new penalties for unsafe products, including jail time and new fines of up to $5 million per day instead of the current $5,000; - Provide the courts with discretion to impose even stronger fines if violations were caused intentionally; - Compel drug companies to revise labels to clearly reflect health risk information, including potential updates for health warnings for children; and - Compel drug companies to do further testing on a product, including when issues are identified with certain at-risk populations such as children. G/TBT/N/CAN/405 Final date for comments: 1 March 2014 Proposed date of entry into force: On the date the measure is adopted Motor Vehicles Regulations Amending the Motor Vehicle Safety Regulations (Interpretation and Standards 108 and 131) The proposed amendment would introduce a definition of a multifunction school activity bus (MFSAB) within the Motor Vehicle Safety Regulations to address stakeholder needs. Under the Motor Vehicle Safety Regulations, a bus is a prescribed class of vehicle that has a designated seating capacity of more than 10. These vehicles include 15- passenger vans and school buses, which must meet safety standards applicable to buses in general. School buses are further defined, as they must meet additional safety standards for the transportation of children to and from school. An MFSAB is a type of school bus without the traffic/pedestrian control devices (such as the stop signal arm and flashing lights found on school buses) and that is not intended to be used to pick up and drop off students from school. The MFSAB would be required to meet several of the standards of the Canada Motor Vehicle Safety Standards (CMVSS) applicable to school buses, such as for rollover protection, body joint strength and exit requirements. This definition of an MFSAB would also harmonize with the federal requirements of the United States and is consistent with the objectives of the Canada-United States Regulatory Cooperation Council. The introduction of a definition of an MFSAB would accommodate school boards and bus service operators while providing a similar level of safety as that of school buses. The highway traffic act of each province/territory sets out the legal responsibilities for motor vehicle owners and drivers. More importantly, provinces, territories and their ministries of education decide the mode of transportation for students. Enforcement of the proper use of any vehicle is under the jurisdiction of provincial/territorial governments. (5 pages, available in English and French). Food Draft Commission Regulation amending Regulations (EC) No 983/2009 and (EU) No 384/2010 as regards the conditions of use of certain health claims related to the lowering effect of plant sterols and plant stanols on blood LDL-cholesterol This draft Commission Regulation concerns the amendment of the Regulation (EC) No 983/2009 concerning the conditions of use authorised for two health claims related to the effects of plant sterols and plant stanol esters on the lowering of the blood cholesterol, and the amendment of Regulation (EU) No 384/2010 concerning the conditions of use authorised for one health claim related to the effects of plant sterols/plant stanol esters on the lowering of the blood cholesterol, in order to reflect the magnitude of the effect. Mountain product Draft Commission Delegated Regulation supplementing Regulation (EU) No 1151/2012 of the European Parliament and of the Council with regard to conditions of use of the optional quality term "mountain product" The draft Commission Delegated Regulation with regard to conditions of use of the optional quality term "mountain product" concerns the provisions supplementing certain non-essential parts of Regulation (EU) No 1151/2012 of the European Parliament and of the Council of 21 November 2012 on quality schemes for agricultural products and foodstuffs. Fenbutatin oxide Draft Commission Implementing Regulation withdrawing the approval of the active substance fenbutatin oxide, in accordance with Regulation (EC) No 1107/2009 of the European Parliament and of the Council concerning the placing of plant protection products on the market, and amending Implementing Regulation (EU) No 540/2011 The draft provides that fenbutatin oxide ceases to be included in the positive EU list of approved active substances and that Member States have to withdraw authorisations for plant protection products containing that substance. This draft Decision only concerns the placing on the market of this substance and does not affect the Community or national Maximum Residue Levels (MRLs) for residues of the concerned pesticide. (4 G/TBT/N/EU/173 notification Proposed date of entry into force: The Regulation will enter into force 20 days after its publication. Member States have to withdraw all existing authorizations for plant protection products containing fenbutatin oxide 6 months after the date of entry into force. 4. Organic production and labelling of organic products Draft Commission Implementing Regulation amending and correcting Regulation (EC) 889/2008 laying down detailed rules for the implementation of Council Regulation (EC) No 834/2007 on organic production and labelling of organic products with regard to organic production, labelling and control Commission Regulation (EC) No 889/2008 defines among other things, detailed rules on fertilisers, soil conditioners and 9 nutrients, plant protection products and feed that may be used in organic production. The proposed amendments update the correspond Annexes with those substances that may be authorised as fertilisers, soil conditioners, nutrients, plant protection products or feed materials and feed additives. (10 pages, in English). G/TBT/N/EU/174 notification Proposed date of entry into force: 3 days from publication in the Official Journal of the EU 5. Chemical substances Draft Commission Regulation amending Annex XIV to Regulation (EC) No 1907/2006 of the European Parliament and of the Council on the Registration, Evaluation, Authorisation and Restriction of Chemicals (REACH) This draft Commission Regulation aims at amending Annex XIV of the REACH Regulation. Annex XIV lists the substances which are subject to the authorisation requirement laid down in Title VII of the REACH Regulation. The draft proposes to include nine additional substances in that Annex, namely formaldehyde, oligomeric reaction products with aniline (technical MDA); arsenic acid, bis(2-methoxyethyl) ether (diglyme), 1,2-dichloroethane (EDC), 2,2 -Dichloro-4,4 - methylenedianiline (MOCA), dichromium tris(chromate), strontium chromate, potassium hydroxyoctaoxodizincatedichromate and pentazinc chromate octahydroxide. Once the draft regulation is adopted and enters into force, the placing on the market and the use of those substances in the EU will only be possible, after the date specified for each substance ("sunset date"), for those operators who have been granted an authorisation in accordance with Articles of REACH, and for those who have submitted an application for authorisation before a given date ("latest application date") but a decision has not yet been adopted. 10 notification Proposed date of entry into force: 3 days after publication in the Official Journal of the European Union. N.B. The "latest application date" (i.e. date by which an application for authorisation must be received by the European Chemicals Agency if the applicant wishes to continue using the substance or placing it on the market after the sunset date and a decision on his application has not yet been taken) shall be between 18 and 35 months from the date of entry into force (depending on the substance). ISRAEL 1. Luminaires Energy source regulations (minimal light efficiency for luminaires) New draft regulations announced by Israel's Ministry of Energy and Water Resources called "Energy source regulations (minimal light efficiency for luminaires) ". These regulations require that all luminaires imported to Israel or manufactured, sold or distributed in Israel, should be tested by the Standards Institution of Israel or by an Approved Laboratory for compliance with the requirements for light efficiency as specified in Table 8.1 of Israel Standard SI 5288 dealing with luminaire efficacy rating. This standard adopts, with a few changes, the American National Electrical Manufacturers Association document LE but expands the standard's scope to apply to all types of fixed luminaires for general purposes. G/TBT/N/ISR/727 notification Proposed date of entry into force: The entry into force of these regulations with respect to importers or manufacturers will be 3 months after publication in Israel Official Gazette and with respect to advertising, distributing or selling will be 6 months after their publication. 2. Olive oil Revision of the Mandatory Standard SI 191 dealing with olive oil. This standard adopts the International Olive Oil Council's document COI/T.15/NC No 3/ Rev.7: November 2012 called "Trade Standard Applying to Olive Oils and Olive-Pomace Oils". The major differences between the old version and this new revised draft standard are as follow: - Adds new types of olive oils (paragraph 2); - Updates the criteria for the oil's purity (paragraph 3); - Adds new requirements for organoleptic characteristics and adds references to relevant test methods (paragraph 4.1); - Amends paragraph 10 dealing with marking: removes the requirement to mark the acidity of virgin olive oil and adds new requirements such as marking the country of origin; - Changes the methods of analysis and sampling (paragraph 11).
