2 GeneralProvisions Section.21: Landscaping and Buffering These requirements apply to all uses for which site plan review is required in the B1 and I Districtsaswellnonresidentialusesinresidentialdistricts. A. INTENT:Itistheintentofthissectiontoprotectandmanagevegetationto: 1. Contribute to air purification, oxygen regeneration, groundwater protection and rechargeandthecontrolofstormwaterrunoff. 2. Safeguard and enhance private and public property values and encourage continued investmentinthecommunity.. Enhance community appearance, identify unique natural beauty, and promote quality developmentatasuitablescale. 4. Providevisualscreensbetweenlandusesofdifferingcharacteranduseintensities. 5. Provideforthepreservationofnativetreesandvegetation. B. FLEXIBLEDESIGNSTANDARDS: 1. It is recognized that alternative design concepts exist which, if adopted, could exceed the results envisioned using these development standards. It is intended that the requirementsofthischapterbeflexibleandpermitlatitudeinsitedesignandtheuseof plantmaterialswhenitcanbeshownthatvariationfromtherequirementswillprovide adevelopmentsubstantiallybetterthanthatachievableusingtheminimumstandards of this section. The provisions of this section shall be considered the minimum developmentstandardsandnotadesigngoal. 2. The Planning Commission may approve variations from strict compliance with this sectionwhenanapplicantcandemonstratethatanyofthefollowingapplytoaspecific developmentsite: a. When topography, shape, size or other natural features make full compliance impracticalorimpossible. b. When space limitations or prevailing development patterns in the surrounding neighborhoodjustifyalternativecomplianceforinfillprojectsandredevelopment inolderestablishedareasofthecommunity. c. Whensafetyconsiderationswarrantalternativecompliance. d. Whenthereisnotanalternativeinthepracticalsitingofabuilding,locationofsite access,orthelocationofundergroundutilitiestoservicethesite. 3 e. Whenthealternativecomplianceplanisequaltoorsuperiorinitsabilitytofulfill theintentofthissection. C. LANDSCAPINGSTANDARDS: 1. Unlessotherwisespecified,materialssuchasriverrock,cobble,boulders,pavingstone, patternedconcrete,barkandwoodchipsshallbelimitedtosmallareasandshallnot exceed25percentoftherequiredlandscapearea.allsuchgroundcoversshallbeat leastsix(6)inchesdeep.loosegravellessthanthree()inchminimumaggregatesize shallnotbeusedinareasabuttingpublicstreetsorsidewalks. 2. Grassorotherlivingplantsshallbeprimarygroundcoverinrequiredlandscapeareas. Groundcoversotherthangrassshallbeplantedinrequiredareastoprovidecomplete coveragewithintwo(2)growingseasons.vinesshallnotbeusedadjacenttopedestrian areas.. Thegeneralsitetopographyandanynaturallandformsuniquetothepropertyshallbe maintainedandmadepartofthedevelopmentwheneverpossible. 4. Thesubstitutionofnaturalvegetationinlieuoflandscapingmaybeapprovedonacase bycasebasis. 5. Nosyntheticplantmaterialshallbeusedtofulfillanylandscapingrequirement. 6. Alltreesshallbelocatedtoallowsufficientroomforgrowth. 7. Therequiredlandscapingshallbeplantedwithpermanentlivingplantmaterialswithin thirty (0) days from the date of occupancy and shall thereafter be maintained in presentablecondition,andshallbekeptfreefromrefuseanddebris;providedfurther that all plant materials shall be continuously maintained in a sound, healthy and vigorousgrowingcondition,andshallbekeptfreeofplantdiseasesandinsectpests.all unhealthyanddeadmaterialshallbereplacedwithinone(1)yearofdamageordeath or the next appropriate planting period, whichever comes first.all landscaped areas shall be provided with a readily available and acceptable water supply. The Zoning Administrator may extend the time period for planting when seasonal conditions are suchthatplantingcannotbeundertaken. 8. Alllandscapematerialsshallbeinstalledinsuchamannersoasnottoalterdrainage patternsonsiteoradjacentpropertiesorobstructvisionforreasonsofsafety,ingressor egress. GeneralProvisions 9. Allplantmaterialshallbeplantedinamannersoasnottoobstructaccesstoorviewof firehydrantsorotherfireconnections,notinterferewithutilitylines(aboveandbelow ground) and public roadways. Existing Vegetation: Existing plant material, which complies with the standards and intentoftheordinance,shallbecreditedtowardmeetingthelandscaperequirements. a. Existinghealthytreesandshrubsinareasnotrequiredfordevelopmentshallbe preservedandincorporatedintothefinaldevelopmentplanwherepossible. b. Treestobepreservedshallbeprunedtoremovedead,diseasedorirregular branching,butthecrownformcharacteristicoftherespectivespeciesshallbe maintained. c. Preservedtreesshallbeprotectedwithsturdy,highlyvisiblebarriersaroundthe treeorgroupoftrees,atapproximatelythecriticalrootzoneordripline. d. Thecriticalrootzoneofthetreeshallremainundisturbedbycutting,fillingor storageofmaterialsandequipmentduringthedevelopmentprocess. e. Healthy,youngertreesondevelopmentsitesshallbepreservedwhereverpossible toallownormalsuccessionasoldertreesarelost. 12. Berms: a. Bermsshallbeconstructedsoastomaintainasideslopenottoexceedaonefoot (1 )risetoathreefeet( )runratio. b. Berms not containing planting beds shall be covered with grass or vegetative groundcovermaintainedinahealthygrowingcondition. c. Bermsshallbeconstructedinawaythatdoesnotalterdrainagepatternsonsiteor adjacentpropertiesorobstructvisionforreasonsofsafety,ingressoregress. d. Treesshallbeallowedtobeplacedonberms. 5 GeneralProvisions D. GREENBELTSANDBUFFERS 1. For nonresidential uses which abut a residential use or which are adjacent to a Residential District boundary, there shall be provided and maintained greenbelts or buffers. 2. Theselection,spacingandsizeofplantmaterialshallbesuchastocreateahorizontal obscuring effect for the entire length of the required greenbelt area, and a vertical obscuringeffectofsuchheightasisdeterminedadequatebytheplanningcommission forproperscreeningbetweenlanduses.. Therelationshipbetweendeciduousandevergreenplantmaterialsshallinsurethata maximumobscuringeffectwillbemaintainedthroughoutthevariousseasonalperiods. 4. GreenbeltsshallbereviewedbythePlanningCommissiontodetermineadequatewidth, length,andmaterialsforscreeningpurposes. 5. Required screening may be interrupted to provide reasonable pedestrian, bicycle, or vehicularaccesstoapropertyfromapublicrightofway. 6. Requiredscreeningofparkingareasshallbeachievedthroughtheuseofadecorative masonry/brick wall, decorative fencing, earth berms and landscape plant materials, eitherincombinationorindependently. 7. ThePlanningCommissionmayrequireorallowthesubstitutionoffences,wallsand/or earth berms in those instances where a greenbelt or planting screen will not appropriatelyprovidenecessaryscreeningtoabuttingproperties. 7 GeneralProvisions Section.22: Circulation and Parking A. PURPOSE: The purpose of parking regulations is to make the community safe for and accessible by pedestrians, cyclists, and drivers. Equal consideration should be given to pedestrians, cyclistsanddriversinthedesignofallpublicandprivateparkingareas.sitedesignshould helptoreducethenumberofconflictsbetweentheparkingareausers.publicrightsofway shall be designed to ensure the movement of people safely. Design of parking areas and rightsofwayshallcontributetothewalkabilityofthevillageoflincoln. B. PEDESTRIANTRAVELWAYS 1. REQUIREMENTS: All developments except for one and twofamily dwellings shall provide clearly defined pedestrian travelways from the public sidewalk to main entrancesofthebuildingsorusesofthelandortothesidewalkfrontingthebuildingin thecaseofamultientrancebuilding. 2. NOEXISTINGPUBLICSIDEWALK:Whenapublicsidewalkdoesnotexist,thefollowing shallapply: a. Fornewconstructiononvacantland,bothapublicsidewalkaspervillagestandards andtherequireddesignatedpedestrianconnectionsshallbeinstalled.thesidewalk must be constructed with a minimum five (5) foot landscaped green space (tree lawn)betweenthecurbandtheoutsideedgeofthesidewalk.streettreesmustbe planted at intervals of not less than forty (40) feet apart. If an existing public sidewalk is present, sidewalk design and green space shall be consistent with the designandgreenspaceoftheexistingsidewalk. b. Forreconstructiononanexistingdevelopment,apublicsidewalkshallbeinstalledif atleastforty(40)percentofthepropertiesonbothsidesofthestreetinthesame blockhavepublicsidewalks,aswellastherequireddesignatedpedestrianroutes. C. MOTORVEHICLEPARKING:SINGLEFAMILYRESIDENTIALUSES 1. Theoffstreetparkingfacilitiesrequiredforresidentialdwellingsshallbelocatedonthe samelotorplotofgroundasthedwellingstheyareintendedtoserveandshallconsist ofaparkingstrip,parkingapron,driveway,carport,and/orgarageorsomecombination thereof. 2. Parkingareasmaybelocatedinthefront,sideorrearyardbutmaynotoccupymore than fifty (50) percent of any yard. Such parking area shall provide two (2) parking spacesperdwellingunitwherenogarageisprovided.
