Location of Site CROFTWAYS, 48/50, LONG STREET, WILLITON, TAUNTON, TA4 4QU Planning Permission is granted for the following reasons 1 In the opinion of the Local Planning Authority the proposed development is considered to be in scale with the surroundings and does not adversely affect the character of the existing listed building, site, area and/or surrounding landscape. The proposal is therefore in accordance with the relevant policies and proposals of, respectively, the West Somerset District Local Plan and the Somerset & Exmoor National Park Joint Structure Plan Review (April 2000). Planning Permission is subject to the following conditions 1 The development hereby permitted shall be begun not later than the expiration of three years beginning with the date of this permission. To comply with the requirements of Section 91 of the Town and Country Planning Act, 1990 (As amended). 2 The access to the Memorial Ground from Long Street shall not be used as a vehicular access to the hereby approved recreation land unless otherwise agreed in writing by the Local Planning Authority. In the interest of highway safety, in accordance with Policy(ies) 48 & 49.

2 3 4 No development shall take place until a detailed written and drawn scheme for hard and soft landscaping of the site (incorporating existing flora) and including all means of enclosure, plant species and materials to be used, has been submitted to and approved in writing by the Local Planning Authority. The scheme thereby approved shall be completed not later than the first planting season following the completion of the building(s) ready for use. If at any time during the subsequent five years any tree, shrub or hedge forming part of the scheme shall die, be removed or felled it shall be replaced with another tree, shrub or hedge of the same species during the next planting season unless the Local Planning Authority gives prior written consent to any alternative species. To ensure proper proision and maintenace of open space facilities to serve the area and to accord with Policy(ies) BD/2. The stone features shown on the drawings shall be in local natural stone laid in a traditional manner with flush or recessed pointing iwht lime based mortar. Prior to the features being constructed, representative sample of the stone to be used and a one metre square sample panel shall be agreed in writing with the Local Planning Authority. To ensure that the appearance of the stonework will be in harmony with the traditional character of development in the area in the interest of visual amenity, in accordance with Policy(ies) BD/2. The following policies from the Somerset and Exmoor National Park Joint Structure Plan Review and the West Somerset District Local Plan were taken into account when arriving at this decision: West Somerset District Local Plan POLICY AD/1 The Local Planning Authority will require that planning applications in respect of buildings to which the public are admitted or which contain an employment use make provision for access to meet the needs of disabled people in the design and layout and the relationship between buildings, their car parks and other public access points. POLICY PC/2 NOISE POLLUTION Proposals for developments involving potential noise nuisance to existing occupiers of land and/or buildings will only be permitted where measures are incorporated, as part of the development, to minimise the impact of noise generated to the satisfactions of the Local Planning Authority. POLICY PO/1 PLANNING OBLIGATIONS The Local Planning Authority in determining planning applications for significant forms of residential, commercial or industrial development may seek to negotiate appropriate planning obligations with developers to provide or contribute to infrastructure or community facilities directly related to the proposed development and commensurate with the development proposals. POLICY R/3(a) The development of a playing pitch or extensions or improvements to existing facilities will be permitted where: (i) The development is located within or adjacent to an existing settlement; (ii A degree of use of the provision by the wider community is secured; and (iii) It would not be visually intrusive when the development is located outside development limits only small-scale buildings and hard-surfaced areas ancillary to the primary open recreational use of the land will be permitted.

3 POLICY SP/1 SETTLEMENT HIERARCHY 'The Local Planning Authority recognises the following Settlement Hierarchy for development purposes: - Minehead will be regarded as a Town. - Watchet and Williton will be regarded as Rural Centres - Brushford, Carhampton, Crowcombe, Dunster Marsh, Kilve, Stogumber, Stogursey and Washford will be regarded as Villages. - Bicknoller, Brompton Ralph, Holford, Huish Champflower, Monksilver, Old Cleeve, Sampford Brett, Skilgate, Upton, West Quantoxhead and Withycombe will be regarded as Small Villages. In all cases development will be considered in accordance with their size and function, individual characteristics and constraints.' POLICY SP/2 DEVELOPMENT IN MINEHEAD AND RURAL CENTRES 'Within the Development Limits of Minehead, Watchet and Williton commercial or residential development will be permitted where: (i) It does not result in the loss of land specifically identified for other uses. (ii) There is safe and convenient access by bus, cycle or on foot to facilities or employment (iii) It involves infilling or small groups of dwellings, conversion, sub-division or redevelopment of an existing building or buildings or the redevelopment of previously used land. POLICY W/7 FLOOD PLAIN PROTECTION Development on flood plains or that which would result in increased flood risk of water courses, land and property, whether on the site or elsewhere will only be permitted where satisfactory environmentally acceptable measures are undertaken to mitigate these risks. POLICY AH/3 AREAS OF HIGH ARCHAEOLOGICAL POTENTIAL Within areas of high archaeological potential planning permission will not be granted unless an evaluation has been carried out to determine whether archaeological remains of local or national value exist on the site. POLICY LB/1 ALTERATIONS AND EXTENSIONS TO LISTED BUILDINGS Development which involves alteration or extension to a listed building, or is within the curtilage of a listed building, will only be permitted where its features and setting are preserved and where: (i) The essential form, scale and appearance of the building is not adversely affected, (ii) Any new details are designed so as to respect the character or appearance of the building, (iii) Materials for the extension or alteration are in harmony with the existing building, (iv) Features of architectural or historic interest are retained unaltered including those in the interior of the building. POLICY BD/1 SITING, LAYOUT AND FORM OF NEW DEVELOPMENT New development will only be permitted which is sympathetic to the scale and layout of existing buildings and spaces within a distinct neighbourhood or street or in the countryside which respect local land form, field patterns and tree and hedgerow cover.

4 POLICY BD/2 DESIGN OF NEW DEVELOPMENT Proposals for new development should respect the scale and character of their surroundings. Planning applications for new buildings will only be permitted where: (i) The siting of the building(s) has regard to its relationship with adjoining buildings and open spaces. (ii) The building materials and detailing are appropriate to the area and sympathetic to adjoining buildings. (iii) The design of the building(s) is in scale and harmony with adjoining buildings and the area as a whole. (iv) Walls, fences and outbuildings are appropriate to the area and will respect the character predominating in the locality. (v) The siting and design of the building(s) together with walls and fences are determined having regard to the interests of crime prevention. (vi) Hard and soft landscaping (as appropriate) forms an integral part of the development including the retention of existing trees and hedgerows where their removal would significantly harm the character of the area. Somerset and Exmoor National Park Joint Structure Plan Review POLICY 9 THE BUILT HISTORIC ENVIRONMENT The setting, local distinctiveness and variety of buildings and structures of architectural or historic interest should be maintained and where possible be enhanced. The character or appearance of Conservation Areas should be preserved or enhanced. POLICY STR1 SUSTAINABLE DEVELOPMENT Development in Somerset and the Exmoor National Park should: * be of high quality, good design and reflect local distinctiveness; * develop a pattern of land use and transport which minimises the length of journeys and the need to travel and maximises the potential for the use of public transport, cycling and walking; * minimise the use of non-renewable resources; * conserve biodiversity and environmental assets, particularly nationally and internationally designated areas; * ensure access to housing, employment and services; * give priority to the continued use of previously developed land and buildings; * enable access for people with disabilities.

5 POLICY 49 TRANSPORT REQUIREMENTS OF NEW DEVELOPMENT Proposals for development should be compatible with the existing transport infrastructure, or, if not, provision should be made for improvements to infrastructure to enable development to proceed. In particular development should: * provide access for pedestrians, people with disabilities, cyclists and public transport; * provide safe access to roads of adequate standard within the route hierarchy and, unless the special need for and benefit of a particular development would warrant an exception, not derive access directly from a National Primary or County Route; and, * in the case of development which will generate significant freight traffic, be located close to rail facilities and/or National Primary Routes or suitable County Routes subject to satisfying other Structure Plan policy requirements. POLICY STR5 DEVELOPMENT IN RURAL CENTRES AND VILLAGES Development in rural centres and villages should be such as will sustain and enhance their role and will be commensurate with their size and accessibility, and appropriate to their character and physical identity. POLICY STR3 RURAL CENTRES AND VILLAGES Settlements which act as focal points for local employment and shopping, social and community activity in their areas should be identified as Rural Centres. Settlements which provide limited local services should be identified as Villages. POLICY 19 EMPLOYMENT AND COMMUNITY PROVISION IN RURAL AREAS In rural areas provision should be made for development which creates or enhances local employment, shopping or community facilities, including development necessary for the purposes of agriculture and development associated with the diversification of agricultural units. POLICY 37 FACILITIES FOR SPORT AND RECREATION WITHIN SETTLEMENTS Provision should be made for the protection, maintenance and improvement of the range of facilities for sport and recreation, where they are compatible with the size and function of the settlement involved. New developments which would generate substantial transport movements should be accessible by public transport. POLICY 11 AREAS OF HIGH ARCHAEOLOGICAL POTENTIAL Development proposals should take account of identified Areas of High Archaeological Potential or, elsewhere where there is reason to believe that important remains exist, so that appropriate assessment and necessary protection can be afforded to any archaeological remains identified.

6 POLICY 48 ACCESS AND PARKING Developments which generate significant transport movements should be located where provision may be made for access by walking, cycling and public transport. The level of parking provision in settlements should reflect their functions, the potential for the use of alternatives to the private car and the need to prevent harmful competitive provision of parking. The level of car parking provision associated with new development should: * first, take account of the potential for access and provide for alternatives to the private car, and then, * should be no more than is necessary to enable development to proceed. Notes Notwithstanding the comment contained in the applicant's supporting statement regarding future aspirations to construct a village hall on the site, any grant of permission in respect of the current planning application would not establish a precedent for any such building or any requirements for vehicular access to same.
