1 Heritage Palms Golf & Country Club Architectural Review Committee (ARC) Amended Guidelines for All ARC Applications (Approved by the HPGCC Board of Directors, Resolution #190, on May 19, 2014) Introduction The ARC is authorized to perform responsibilities for the HPGCC as identified in the Section 6 of the Amended and Restated Declaration of Covenants and Restrictions for Heritage Palms Golf and Country Club, and dated March 27, In general, the purpose of the ARC s responsibilities is to provide architectural and aesthetic control regarding the exterior appearance of any Lot, Living Area, Neighborhood Common Area or other non-club owned property within the HPGCC community. Included within the scope of Section 6 as part of the Declaration of Covenants, the following information describes the amended ARC Guidelines, which serve the ARC as standards to evaluate projects for approval or denial. These amended Guidelines were approved by the HPGCC Board of Directors on May 19, Please note the complete version of the Amended and Restated Declaration of Covenants and Restrictions for Heritage Palms Golf and Country Club, including all sections, can be viewed in the most recent copy of the HPGCC Member Directory or online at the following website: When reviewing an application, the ARC will utilize the following Guidelines: Section I. The Process to submit an ARC Application : a. In order for any project(s) to be approved as noted above in the Introduction, an owner or neighborhood association must first submit an application to the ARC. The ARC will then review the application for the project and make a decision to approve or deny approval for the typical project. b. To obtain an ARC Application, log on to the HPGCC website at then click on Member Resources, and then click on Forms. Copies of the ARC Application Form can also be obtained at the HP Administration Office in the HP Clubhouse. Owners are especially requested to note the communication processes with neighboring owners for project approvals as found on page 1 of the application. c. It is especially important that an application be signed by a single family residence owner or by a neighborhood association, and the application must provide complete requested contractor information such as a copy of the contractor s license, a contractor s insurance certificate and a contractor s certificate of workman s compensation must be completed before an application is included on a typical agenda for any ARC meeting. d. An owner of a single family residence or a neighborhood association can serve as their own contractor for minor projects; however, landscape pruning/trimming, structural, electrical and plumbing projects must be performed by a licensed contractor according to standards set by local government authorities. e. Please note that the ARC approval of any applications requiring structural, electrical and plumbing work to the exterior of a residential building or site will require a Building Permit from the City of Fort Myers. An ARC approval is not valid until an owner has received City of Fort Myers approval to commence work and provided a copy of the Building Permit to the HP Administration Office as record copy. 2 f. The ARC typically meets on the last Thursday of every month at 4:00 p.m. in the Heritage Palms Library. For an application to be part of the ARC s agenda for a given month, the application must be received in HP Administrative Office no later than 4:00 p.m. on the Friday prior to the regular meeting date. There are no exceptions to this procedure. Section II The Process for Approval to Paint the Exterior of a Single Family Living Unit: a. See Section I in order to submit an application for the exterior painting of this type of Living Unit. b. To select paint colors, owners are requested to review ARC preferred color schemes as shown in the Book of Colors, which is located in HP Administration Office. Once colors are selected by an owner, please submit sample color chips as noted in the Application, and be sure to identify the colors specifically selected for the main house color, trim color and other special items such as the garage door and the front door of the residence. The application should include a minimum of (1) photo each of the front view and side view of the existing Living Unit. c. ARC approval of alternative color chips similar to those shown in the Book will be considered. Blues, oranges, strong yellows, or excessively dark colors (such as those found in Tuscany Communities ) are not considered appropriate for the HP color schemes. d. At times, the ARC may request that an owner provide a 2 x 2 color sample to be actually painted on an exterior wall for better visualization of such colors prior to approving such a color(s). In situations where an owner has selected colors not in the Book of Colors, a 2 x 2 painted color sample on the building is required before approval will be given. e. Garage doors should be painted the same color as the base color for the house; however, exceptions may be approved to use alternative trim colors or a shade variation of the base color. The use of faux paint color on garages doors is allowed, but the owner must be made aware that this type of paint fades easily, and the owner must agree to keep the garage door well maintained. Front doors may express the individuality of the owner, and may be a bright color that is not objectionable to the ARC. f. Owners are encouraged to select a complimentary paint color for the house trim (gutters and downspouts) that appears to blend with the base paint color of the residence. Section III. The Process for Approval to Paint the Exterior of a Villa, Veranda or Terrace Living Unit: a. See Section I in order to submit an application for the exterior painting of this type of Living Unit. b. Section II, b. thru Section II, f. are also applicable to Section III. c. For those building types belonging to a neighborhood association, all painting applications must be approved by the neighborhood association s governing authority before submitting an application to the ARC. Without neighborhood association approval, the ARC will not review a painting application. Section IV. The Process for Approval Regarding Landscaping Changes: a. See Section I in order to submit an application for all landscaping changes, except the changing of shrubs. b. The Process for maintenance of trees is suggested as follows: The intent of tree maintenance is to allow trees to grow into normal and mature landscape features which promote healthy, uniform and natural growth of the trees. A deciduous tree s canopy can be pruned or trimmed only at the discretion and direction of a State certified arborist. It is suggested that deciduous trees be reviewed for such pruning, trimming or thinning at a minimum of every two years by the single family residence owner or the neighborhood association as applicable. A palm tree s canopy can be trimmed up to 25% once every six months. All pruning and trimming shall also be done under the supervision of a State certified arborist. ARC Guidelines--Page 2 of 5

The Process for ARC approval to remove a tree(s), must include one of the following : If a tree poses a safety hazard to pedestrian or vehicular traffic or threatens to cause disruption to public and/or private utility services. If a tree poses a safety hazard to existing buildings or structures. If a tree is diseased and is a hazard to people, buildings, other improvements or other trees. If a tree has been weakened by age, storm, fire or other injury as to jeopardize the safety of people, or cause a hazard to a property as noted above. If a tree prevents the development of another tree, and attempts at trimming the tree have been unsuccessful. If a tree causes unusual maintenance problems to an owner s property. A tree cannot be removed to improve the view from a residence; however, trees can be pruned, trimmed or thinned according to the maintenance guidelines noted in Section IV, b. d. The Process to remove a tree after ARC approval: Remove the applicable tree within 30 days of the ARC approval. After a tree has been removed, the tree stump shall be ground down to a minimum depth of 4 below the existing grade within 48 hours of such tree removal. Once the tree stump has been removed, the remaining opening in the ground should be filled with dirt within 24 hours of such stump removal and covered with sod immediately within an additional 24 hours. Unless ARC approved otherwise, a replacement tree must be planted in a nearby area of the original tree location. See Section 4.5 for more information. A replacement tree shall be installed within (30) days of the stump removal. All replacement trees must be installed a minimum of 10 feet away from existing underground utility lines and a minimum of 5 feet away from existing utility easements or right-of-ways. The mature tree height of replacement trees should be considered regarding overhead utility lines presumed to be a potential future hazard. Note: Violations of ARC tree approvals or denials shall be as enforced as indicated in the HPGCC By-Laws, Section 6.4, Enforcement. Such enforcement will also apply to trees that have been severely pruned and where such excessive pruning has been verified by an independent State of Florida certified arborist. If a palm tree is removed due to a disease, the replacement tree selection will be determined by the ARC. Generally, a diseased palm cannot be replaced by another palm. e. The Process for tree replacement after ARC approved tree removal: A deciduous tree must be replaced by another type of deciduous tree unless approved otherwise by the ARC. A palm tree must be replaced by another type of palm tree unless approved otherwise by the ARC. The replacement tree shall meet the plant materials standards for Florida No.1 or better, as described in the Grades and for Nursery Plants, Parts I & II, Department of Agriculture, State of Florida (as amended). Trees shall have a minimum trunk height of 10 feet above grade after installation. Replacement trees must have a minimum 4 diameter at 4 feet above finish grade. Replacement trees shall have a minimum canopy of 4 feet wide. Trees planted adjacent to walk or bikeways shall be a minimum of at least five feet away. The replacement tree shall be guy wired or braced according to best landscaping practices for Lee County. The guy wiring or bracing shall remain in place for a minimum of 12 months and then removed. Examples of suggested replacement trees can be found in a reference book titled Florida s Fabulous Trees that can be reviewed in the HP Administration Office. f. The Process for the maintenance of hedges: Hedges shall be allowed up to a maximum of 6 feet in height within residential areas. Hedges between residences shall be allowed no closer to the street than the front face of the house or garage, whichever is closest to the street.\hedges between residences shall be allowed to a point no further than the rearmost point of the house, lanai or pool enclosure whichever is closest to the rear property line. The Process to approve or deny Fences, Walls and Other Structures: Landscaping enhancements such as fences, walls or similar structures are not allowed to be constructed on residential properties except as approved in writing by the ARC where unusual circumstances may occur. h. The Process for maintenance of shrubs: The ARC does not review changes to shrubbery; however, please see Section 5.7 of the HP Covenants for governing regulations regarding maintenance of such shrubs. The ARC suggests that native shrubs to Florida are utilized for new plantings. Section V. - The Process to Enclose a Lanai: a. See Section I in order to submit an application for the enclosure of a lanai or related changes. b. ARC approval is required, and a permit from the City of Fort Myers is also required. The owner must submit a copy of the City of Fort Myers building permit to the HP Administration Office before the start of construction. c. If a fire sprinkler head does not exist in the area to be enclosed, one must be provided. Glass sliders must remain in place. d. An owner must make provisions to remove plexiglass sliders prior to a hurricane if the unit is not certified as hurricane resistant. Section VI. - The Process for Construction of a Swimming Pool and/or Pool Cage Enclosures: a. See Section I in order to submit an application for swimming pool additions and for pool cage enclosures. Please also see ARC Guidelines--Appendix A, which state additional requirements. b. ARC approval is required, and a permit from the City of Fort Myers is also required. The owner must submit a copy of the City of Fort Myers building permit to the HP Administration Office before the start of construction. c. All pool cages must be a hip roof type of roof cover. Gable roof types are not allowed. No flat, solid roof sections, providing shade or shelter, shall be allowed. Only bronze or white colors for the cage structure may be used. d. Note: Pool cage extensions may not block the view from a neighboring unit. Written approval from the adjoining neighbors is a requirement for this approval including drawings of the pool cage as stated in Appendix A, and a signed and dated approval letter is required from the adjacent owner(s). Section VII. The Process for Tear-Downs, Rebuilding or Changing the Height or Footprint of Living Units: a. See Section I in order to submit an application for these types of projects. b. Note: The process for any tear-downs, rebuilding or changing the height or footprint as part of any living unit must follow the process outlined in Appendix A. c. ARC approval is required, and a permit from the City of Fort Myers is also required. The owner must submit a copy of the City of Fort Myers building permit to the HP Administration Office before the start of construction. d. Likewise if any of the projects in this section require repainting of a building exterior or pool deck, the submittal should include information regarding the painting of the building exterior as noted in Section II above. e. If any of the projects in this section require re-landscaping, please follow the requirements in Section IV, and submit a site plan for landscaping the property. Such a site plan should be submitted at a recognizable scale, and identify the type, size and quantity of tree or hedge plantings to be utilized. ARC Guidelines Page 4 of 5
5 Section VIII. The Processes for Miscellaneous Projects Affecting the Exterior Appearance of a Living Unit: a. Exterior Window and/or Door Replacement Submit an ARC Application as shown in Section I. Provide a least (2) photos of the existing windows/doors being replaced. Include catalog cut sheets describing the intended window /door replacement. A City of Fort Myers building permit is required prior to the commencement of the replacement project. A copy of the City of Fort Myers building permit must also be provided to the HP Administration Office prior to the commencement of the work. b. Roof Replacement Submit an ARC Application as shown in Section I. ARC approval is required, and a City of Fort Myers permit is also required. Color selection of the new shingles or concrete tiles must be submitted to the ARC as similar color information noted for Section II. A copy of the City permit must be submitted to the HP Administration Office before commencement of any project work. c. Electrical and/or plumbing changes to the exterior of a building or a building site Submit an ARC Application as shown in Section I. See the items in Section VIII, a., for similar requirements in this Section. A detailed sketch at a recognizable scale of the intended electrical and plumbing changes as shown in immediate area of the building must accompany the application. d. Painting a Driveway Follow similar procedures as shown in Section II regarding the painting exterior of a single family home. Section IX. - The Process for the Addition or Replacement of Hurricane Shutters: a. See Section I for application requirements to add or replace storm shutters. b. The ARC utilizes the requirements found in Appendix B, when reviewing projects in this section. c. ARC approval is required, and a permit from the City of Fort Myers is also required. The owner must submit a copy of the Fort Myers building permit to the HP Administration Office before the start of construction. d. Neighborhood associations are requested to monitor compliance with the seasonal requirements regarding the deployment of such storm shutters. Section X. The Process for Enforcement of ARC Decisions: In general, compliance with ARC decisions and approvals will be the responsibility of the HPGCC management team to follow-up and insure the timely and satisfactory completion of an approved ARC project decision. 6 ARC NOTICE MARCH 21, 2015 In order to clarify various issues, the ARC Committee is made changes to the ARC Application and have developed a new form to notify neighbors of a pending project. These changes are effective with any and all applications submitted after 4:00 PM on Friday, March 20, 2015 for any projects to be discussed at the April 23, 2015 meeting and future meetings. There are two changes in the ARC Application. First, there is clarifying language on Page 1 Notification by Applicant to Neighbor(s) of Pending Project Form that replaces language indicating that the neighbor is approving an applicant s application for a project. The By-Laws only indicate that adjacent neighbors be NOTIFIED of the project. This change provides advice to the Applicant of the means by which such notification can be made. Also, this change clarifies which neighbor(s) are to be notified by type of living unit. Second, there is new language on Page 3 immediately below the Applicant s Signature stating the that Applicant has read the appropriate Guidelines relating to the type of project, is agreeing to fully abide by such Guidelines, and that all of the requirements of the guidelines must be completed before any work on the project may begin. The new form, Notification by Applicant to Neighbor(s) of Pending Project Form, advises the neighbor(s) that there is a pending project and how they can raise any issues regarding the project with the ARC Committee. This document allows the Applicant to notify up to four neighbors of the pending project.

8 2.0 All projects must include: A minimum of two 4 x 6 photographs of existing conditions as noted below to better describe the following project(s) for the ARC s review. Additional photographs are acceptable as necessary to better explain the intent of your project(s). 3.0 Guidelines for Tear-Downs, Rebuilding or Changing the Height or Footprint of Living Units: All applications for this type of project, including pool cages, should be completed and submitted for approval according to the ARC Guidelines as referenced in Appendix A, which is attached for additional requirements. 4.0 Painting of the Exterior of a Living Unit: 4.1 Provide a 4 x 6 photo of the existing front and one side elevation of the house. 4.2 Select a color scheme from the color book of paint suggestions from the HP Administration Office and provide a color sample from the paint manufacturer for each in the rectangles below. 4.3 The ARC may approve alternative colors on a project by project basis if there is a slight variation from the colors shown in approved color book.
