1 7 Scoping and Introduction to the Assessments 7.1 Scope of the assessments Rule 8 of the TWR makes provision for an applicant to request a scoping opinion from the SoS indicating the information which should be included in an ES for a proposed EIA development project A request for such an opinion, subject to the screening decision, was made to the SoS at the same time as the request for the screening decision The request was supported by a report comprising an initial appraisal of impacts potentially associated with the construction and future use of the proposed scheme which could have a significant effect on the environment. It also included a description of the surveys and assessments which the applicants considered should form the focus of the ES The scoping opinion was issued as part of a joint response to the screening and scoping requests in June Copies of the report submitted to the SoS and the screening and scoping opinion received from the SoS are provided in Appendices 1A and 1B Following consideration of the scoping opinion, it was concluded by the applicants and their assessment team that the surveys and assessments described in the following sections should be included in the ES With regard to the existing section of the London Overground line which will complete the link between the existing Metropolitan Line and Watford Junction Station, proposed works are limited to: the extension of existing platforms at Watford High Street Station and Watford Junction; introduction of a third rail for the power supply to the electric trains; minor modifications to an existing sub-station; signalling works; and minor modification to track alignment on the immediate approach to Watford Junction Station. Air quality Potential impacts identified during scoping related to: nuisance associated with dust arising from construction activity; potential impacts on local air quality associated with construction vehicle movements on the local road network during construction of the proposed scheme; potential impacts on local air quality associated with changes in concentrations of traffic-related pollutants where the introduction of the Mouchel

2 proposed scheme will have an effect on the volumes, patterns and characteristics of use within the local road network; and potential impacts on regional emissions associated with changes in volumes, patterns and characteristics of use within the local road network It was concluded that all four areas of likely impact should be subject to assessment The scoping opinion also made specific reference to a need to assess effects on local air quality in the vicinity of Rickmansworth Road in particular. The assessment of effects in this location has formed part of the local air quality assessment during construction and operation of the proposed scheme as reported in Chapter Consideration was given to the need for assessment of impacts on local air quality and regional emissions arising from the operation of trains on the proposed link. It was concluded that assessment would not be required as the trains would be electrically powered. Cultural heritage Studies and consultations undertaken during the preliminary planning and design of the proposed scheme established the presence of a number of known sites and features of cultural heritage importance along and close to the proposed scheme corridor For the purposes of establishing planning and design constraints a study area extending some 200m from the indicative alignment for the proposed new link was chosen. This recognised there would be no potential for direct impact on known features of cultural heritage value other than along the proposed scheme corridor whilst ensuring the potential effects on the setting of important features such as Cassiobury Park Registered Park and Garden would be captured. Description of the assets and a plan identifying their location (Figure 9A.1) in the preliminary planning study area is provided in Appendix 9A Following confirmation of the proposed scheme, receipt of the scoping opinion and further evaluation of the identified constraints within the study area, it was concluded that there were four locations within the study area where there would be a likelihood of potentially significant impact on cultural heritage assets. It was concluded that further assessment of assets outside of these four areas was not required; the preliminary evaluation having established there will be no likelihood of direct impact on known or unknown assets associated with these areas or on the setting of known assets associated with them It was recognised that the introduction of the new viaduct linking the existing Metropolitan Line and a new station at Ascot Road would involve Mouchel

3 potentially direct impacts on known sites, features and structures including the Grand Union Canal and indirect impacts on sites such as Cassiobury Park. It was also recognised that excavation and piling required in relation to the viaduct and associted structures could potentially have an impact on buried assets. It was accordingly concluded that these potential impacts should be assessed and reported in the ES It was further recognised that for the section of the proposed scheme corridor between the proposed Ascot Road Station and the merging with the existing Watford to Euston Line works, will generally be contained within the existing railway boundary, the sole exception being at the proposed Watford Hospital Station. Other than for the new station the principal works will involve modification to existing cutting slopes and embankments. These are works which will occur in a context where the original substantial earthworks undertaken during the construction of the now disused line will have compromised the survival of any sites or features of earlier cultural heritage value. It was concluded that, other than at the proposed Watford Hospital Station, the likelihood of there being significant impact and effect was negligible and that further assessment would not be appropriate. It was also concluded that consideration should be given to the proposed removal of the remains of the former Watford West Station and Watford Stadium Station With regard to the existing section of the Watford to Euston line which will complete the link between the existing Metropolitan Line and Watford Junction, proposed works are limited to: the extension of existing platforms at Watford High Street Station and Watford Junction; introduction of a third rail for the power supply to the electric trains; minor modifications to an existing sub-station; signalling works; and minor modification to track alignment on the immediate approach to Watford Junction Station Whilst these are minor works which would not indicate a requirement for assessment, Watford High Street Station is a locally listed building which the scoping opinion indicated should be subject to assessment of the impact of the proposed scheme on the station buildings In both cases the proposed works at the two existing stations will be wholly contained within the confines of the station environs. In both cases the extension will be small and will not require modification to the existing buildings, including those which are listed at Watford High Street Station. There will accordingly be no impact on the buildings or their setting in the context of the station and the existing line or their setting more widely Mouchel

4 within the local townscape. It was concluded that further assessment would not be required The scoping opinion indicated that some intrusive archaeological investigation should be undertaken and reported in the ES with particular reference to the river valleys. Data for trial pits excavated as part of the geotechnical investigations at the pier locations for the proposed viaduct has been reviewed and no evidence of potential interest found. Intrusive archaeological investigation has not, however, been undertaken. This would have required access and disturbance to land not in the ownership of HCC and LUL and additional disturbance to owners and existing activities beyond that associated with the geotechnical investigations. It was concluded that intrusive archaeological investigation should be undertaken but that it would be more appropriate to undertake the work in advance of construction should powers to proceed with the proposed scheme be approved. The form and extent of the investigations will be agreed with the County archaeologist as part of an overarching mitigation strategy for archaeological assets. Measures which will be considered are described in Chapter 9. Ecology and nature conservation Desk-based studies and habitat surveys undertaken during the preliminary planning and design stages of the proposed scheme established the presence of statutorily designated sites and non-statutory sites designated for their nature conservation value within an initial study area of 1km. The studies established there are no European designated sites in the vicinity of the proposed scheme which could be potentially affected Where it was established that the proximity of the proposed scheme and associated working areas to such sites could potentially have a direct impact on the identified sites, they were subject to detailed assessment as described in this ES. Sites were also assessed and are described in this statement where there was an identifiable link between the proposed scheme working areas and such sites by virtue of a pathway such as a common watercourse Two statutorily designated and four non-statutory wildlife sites meeting these criteria were identified and have been subject to detailed assessment as listed below. Croxley Common Moor SSSI and LNR Lairage Land LNR Grand Union Canal - Rousbarn Lane N. to Ironbridge Lock Wildlife Site Ascot Road Scrub Wildlife Site Mouchel

5 Holywell Farm Allotments Wildlife Site Croxley Green Junction Sidings Wildlife Site Preliminary habitat surveys further demonstrated that all but two of the habitats associated with the proposed scheme corridor are of lower than local biodiversity value. As such it was concluded that impacts on all but these two habitats (woodland and running water) would not be significant in relation to biodiversity value and that detailed assessment should be limited to the two higher value habitats as indicated below. Semi-natural broadleaved woodland Running water The studies and surveys established the presence of a number of faunal species some of which are either statutorily protected and some of which are at least of local biodiversity value. It was concluded that those which are subject to statutory protection and those with a biodiversity value of local or greater should be subject to detailed assessment as listed below. Widespread reptiles (slow worm and grass snake) Breeding birds Badger Bats Other flora and fauna identified during the preliminary studies and surveys and which it was concluded should be subject to assessment, and the identification of design and management measures where appropriate, comprised: Invasive plant species (japanese knotweed and virginia creeper); and BAP habitats associated with the Croxley Common Moor SSSI (lowland dry acid grassland, lowland heath, fen and undetermined grassland) Detailed explanation of the resources identified and findings arising from the studies and surveys undertaken to establish those which should be subject to assessment as reported in the ES is available in Appendix 10A - Designated Sites and Habitats The scoping opinion indicated that relevant surveys should be undertaken to establish the impacts of the proposed scheme on river banks and that these should be reported in the ES. The habitat surveys undertaken during the preliminary planning and design of the proposed scheme identified running water, marginal habitat and wet woodland as the principal habitats associated with river banks. The surveys indicated that marginal habitats are of interest within the zone of influence only and that it would accordingly not be likely that the proposed scheme will have a significant effect on the habitat type. Running water and wet woodland Mouchel

6 were identified as being of local value and have been assessed further as reported in Chapter Two further topics were identified in the scoping opinion as matters which should be addressed in the ES. These relate to management opportunities in respect of existing or future management resources and proposals for maintaining the existing role and functions of the used and disused railway lines as green corridors. Both topics have been addressed and are discussed in Chapter 10. Geology, soils and contaminated land The preliminary studies undertaken during the gathering of environmental data to inform the planning and design of the proposed scheme demonstrated there are no sites of geological importance located along or in the vicinity of the proposed scheme corridor and that further assessment would not be required The studies indicated that likely significant effects could occur by virtue of construction relative to parts of the proposed scheme corridor which are known to be contaminated It was concluded this was the case in relation to: contamination along the corridor as a result of the former use and transport of materials along the now disused line; the presence of two former landfill sites adjacent to the proposed scheme, one at Riverside Park to the south of the disused railway and one at Waterfields Recreation Ground to the east of the Euston to Watford Line; and the site of the proposed Ascot Road car park which has previously been used as a waste transfer station It was concluded that assessments should accordingly be completed and reported in the ES to establish the likelihood of impact on human and natural resources, it being likely that contaminated materials could be disturbed / released during construction, and that the assessments should include: the risk that construction such as piling could introduce contaminated material into underlying bedrock and associated aquifers; and the risk to the workforce as a result of contaminated materials being handled during construction. Townscape and visual impacts It was recognised during the early planning and design of the proposed scheme that construction of a viaduct linking the Metropolitan Line with the disused link would involve the introduction of a substantial new component into the townscape local to Croxley Green and West Watford. Mouchel

7 It was also recognised that construction involving the modification of existing cutting and embankment slopes and introduction of two new stations would require the removal of established tree planting and fragment what is a distinctive linear planting feature within the local townscape It was accordingly concluded that associated impacts on the composition and character of the townscape would be potentially significant and that a detailed assessment should be undertaken to evaluate impacts which could result in a likely significant effect It was also recognised that these key components of the proposed scheme would have an impact on views experienced by residents and users of communal facilities, open space and rights of way within the vicinity of the proposed scheme. It was concluded that individual impacts would be likely to be significant in some instances and that a detailed visual impact assessment should be undertaken to evaluate the number of such receptors who would be likely to be affected and the order of impacts likely to be experienced. Noise and vibration There are a number of sources of noise and vibration associated with the proposed scheme which will have an effect on noise levels experienced by residents and users of communal facilities, including schools, play areas and public open space Construction, including operations such as breaking out, piling, excavation and transport of materials will involve varying levels of noise and potential vibration both in terms of magnitude and duration. Detailed proposals concerning the choice of construction plant and its operation in any specific location along the proposed scheme corridor is not available in advance of determination of the orders being sought and subsequent appointment of a contractor. BS 5228 Parts 1 and 2, do, however, provide guidance on the establishment of appropriate construction-related noise levels, based on existing noise levels at any specific location and on vibration levels which evoke concern. It was concluded, therefore, that it would be appropriate to undertake assessments based on the guidance in the BS for residential and other sensitive receptors located close to the proposed working areas The re-instatement of the disused line as an operational part of the underground network will result in the introduction of a new source of noise and potential vibration close to existing areas of housing and a number of communal facilities, including schools, play areas and public open space. In relation to noise, it was concluded that an assessment of predicted noise levels should be undertaken to establish likely train- Mouchel

8 related noise levels and these should be compared to ambient noise levels and evaluated against the insulation criteria for residential property specified in the Noise Insulation (Railways and other Guided Transport Systems) Regulations The use of the proposed stations will involve noise associated with loudspeaker announcements and, in the case of Ascot Road, car parking. There will also be passenger noise, particularly when crowds using the Watford Hospital Station emerge and return to the station during home games for Watford FC at Vicarage Road. It was concluded that an assessment of noise from new station buildings should be undertaken in accordance with BS Method for rating industrial noise affecting mixed residential and industrial noise areas. Further consideration of the nature of crowd-related noise and the use of the public address system recognised that detailed assessment of these diverse and difficult to define events could not be appropriately represented by the methodology in the BS and that it would be more appropriate to identify measures to address potential noise-related nuisance associated with the identified activities It was noted in the scoping report submitted in support of the request for a scoping opinion that the proposed scheme would result in changes in traffic flows within the local road network. It was indicated that the need for detailed assessment would be dependant on the changes in volumes of traffic and flow characteristics on those sections of the road network that would be subject to change Information derived from the transport and traffic modelling for the proposed scheme has indicated that traffic flows on affected sections of road would increase or reduce by no more than 19% and 14% respectively whilst changes in speed would be negligible. It requires an increase of 25% or reduction of 20% to effect a change of 1 decibel in existing traffic-related noise. It was concluded that impacts would accordingly be negligible and that further assessment would not be required. Details of the traffic data and analysis of the data are provided in Appendix 13A. Water environment and drainage Implementation of the proposed scheme would involve construction in close proximity to the Grand Union Canal and River Gade and modification of existing structures in the form of bridges on the River Colne and a culvert in the vicinity of the Fisher Industrial Estate. An assessment has accordingly been undertaken to establish to what extent construction would be likely to have a significant effect on surface water quality and flow characteristics. The findings of the assessment are described in Chapter 14. Mouchel

9 The drainage proposals provide for piped collection of surface water drainage via collector drains across the viaduct and along the toe of cutting and embankment slopes. Discharge of the run-off is via direct connection to the existing foul water drainage network at Ascot Road and Stripling Way and via four outfalls to the local watercourses, three into the River Colne and one into the small watercourse at the Fisher s Industrial Estate. An assessment has been undertaken in relation to the four outfalls to watercourses to establish the likelihood of there being an impact on water quality and flow characteristics. The findings are reported in Chapter Construction of the proposed scheme will involve the introduction of piled foundations for the proposed viaduct and stations, sections of sheet piling at the foot of cutting slopes and excavation to establish footings for gabion retention at points along existing embankment slopes. These are activities which will pose a potential risk to groundwater and a vulnerable aquifer associated with the chalk that underlies the area. An assessment of the likelihood that such risk could have a significant effect on the quality and utilisation of the aquifer has been undertaken and is reported in Chapter The section of the proposed scheme between Stripling Way and the merge with the Euston to Watford Line is located within the floodplain of the River Colne. There is also a small floodplain associated with the River Gade, the ordinary watercourse and Beggars Bush Land Drain. In light of these relationships, a Flood Risk Assessment (FRA) has been prepared. Reference to flood risk and the findings of the assessment are included in Chapter 14. Land use and community effects There are a number of land uses and community facilities in the vicinity of the proposed scheme which could be affected during construction or the presence of the operational line once open to use. These include private properties, community facilities, recreational and amenity areas, open space and educational facilities and Public Rights of Way (PRoW) including canal tow paths and waterways Following discussion with Watford Borough Council (WBC) and Three Rivers District Council (TRDC) during the preliminary planning of the proposed scheme it was agreed that such facilities should be identified and the potential for impact addressed within a study area extending 250m either side of the proposed scheme corridor A total of 51 such uses and facilities were identified. The assessment of these established that the likelihood of the construction or operation of the proposed scheme having a significant effect on them is limited to some 7 Mouchel

10 land uses and facilities. The assessment relative to these is described in detail in Chapter 16. The details of the assessments for all 51 uses and facilities are available in Appendix 16A. Traffic and transport During scoping it was recognised that a study of the effects on traffic and transport should form part of the assessment, that reference should be made to the Transport Assessment for the proposed scheme, and that consequential environmental considerations should be assessed and reported in the ES An explanation of the effects the proposed scheme will have on traffic and transport movements during construction and operation is provided in Chapter 15. Detailed explanation of the impacts and their effects on traffic is provided in the Transport Assessment for the project which is available in Appendix 15A Assessment of likely consequential environmental impacts and effects is provided in the relevant environmental assessment chapters as indicated below: Local Air Quality - Chapter 8, Air Quality Access and Severance - Chapter 16, Land Use and Community Effects 7.2 Format of the assessment chapters A common format has been adopted for the reporting of the assessments undertaken in relation to each of the environmental aspects investigated. Scope of the assessments This section introduces the surveys and assessments which have been undertaken specific to the aspects reported in the chapter and describes the study areas adopted for each of the assessments and the timescales considered. Study areas The extent of the study area for the assessments varies according to the environmental aspect being considered. These have been determined in light of an initial review of the relationship of the proposed scheme to sensitive receptors (people, environmental features or fauna) and the likelihood of consequential impacts. For some aspects, the area is identified as being relatively localised to the proposed site. For others it may extend for a considerable distance across the areas surrounding the site, along watercourses or include more distant communities and environmentally sensitive areas. Mouchel

11 Timescales Similarly, the timescales adopted for the assessments vary according to the environmental aspect being considered. The specific timescale for each aspect is described in each assessment chapter. Statutory and planning context This section identifies statutes, guidance, policies and plans which are relevant to the aspect addressed in the chapter and which have been taken into account during the conduct of the assessments. Method of assessment This section details the methodology adopted for the various assessments. It explains the nature of the data relied on and the surveys, models and calculations used and undertaken to validate: the baseline environment, with particular reference to environmental resources and receptors; and predicted impacts associated with the introduction of the proposed scheme into the baseline environment There is an explanation of the quantitative and qualitative criteria adopted to evaluate impacts and determine the order of beneficial and adverse impacts. Resources and receptors Environmental resources are defined as those aspects of the environment that support and are essential to natural or human systems. These include areas or elements of population, ecosystems, soil, water, air and climatic factors, material assets, landscape, watercourses, community facilities etc Environmental receptors are defined as people (occupiers of dwellings and users of recreational areas, places of employment and community facilities) and elements within the environment (flora and fauna), that rely on resources. Impacts Impacts comprise identifiable changes in the existing environment (the baseline environment) which would occur or be likely to occur as a consequence of implementation of the proposed scheme (e.g. the loss of a habitat or the pollution of a watercourse). Impacts may be referred to either prior to or following mitigation Each of the assessments evaluates and describes the nature of impacts predicted to result from the construction and operation of the proposed scheme. Each defines ratings (thresholds) appropriate to the nature of Mouchel

12 the environmental aspect and in accordance with accepted terminology where standardised methodologies are used Impacts may be direct (e.g. the loss of woodland to accommodate the new route) or indirect (e.g. pollution downstream arising from silt deposition during earthworks). They may be short-term / temporary (e.g. dust associated with construction) medium-term (e.g. cutting back of planting subsequently allowed to regenerate) or long-term / permanent (e.g. improvement in local air quality). They may be beneficial (e.g. screening of an existing eyesore) or adverse (e.g. loss of an attractive landscape component) The prediction of impacts has been based on: the known or likely presence of environmental receptors / resources; the environmental value of the resources / receptors, as determined through their designated status along with qualitative criteria such as rarity, status and condition; the vulnerability or sensitivity of affected resources; the number and sensitivity of affected receptors; the extent, nature and duration of physical change resulting from the construction or operation of the proposed scheme; the ability of the resource / receptor to respond to change; and the adaptability, and thus effectiveness, of the resource / receptor to controlled change (i.e. mitigation) All of the assessments are based on comparisons between the environment immediately prior to the assumed construction of the proposed scheme and the predicted environment, assuming the proposed scheme is built and open to use. Baseline environment This section includes a description of the key components and characteristics of the baseline environment and their status individually and collectively. Predicted impacts This section describes the predicted beneficial and adverse impacts and evaluates their significance in accordance with the criteria detailed in the Methods of Assessment. The assessment considers impacts during construction and once the proposed scheme is open to use. Mitigation This section describes the mitigation measures which have been identified in light of the evaluation of predicted impacts. The principles adopted during the identification of mitigation measures is one of avoidance if possible, reduction where avoidance cannot be achieved or compensation Mouchel

13 where reduction cannot be achieved or would not achieve practicable levels of mitigation. Conclusions and effects This section describes the likely significant environmental effects in light of the identified impacts taking into account proposed mitigation measures. Mouchel
