EX10.57 TOWN OF MARKHAM To construct, reconstruct, erect or place a building or structure on Bayview Avenue, south of Laureleaf Road to Proctor Avenue, in the Town of Markham, Don River Watershed as located on the property owned by Town of Markham and the Regional Municipality of York. The purpose is to permit the replacement of the existing sanitary sewer connection servicing 7326, 7328, and 7340 Bayview Avenue via Horizontal Directional Drill and excavation to replace the existing manhole connection to prevent failure of the pipe and sewage backup. A letter of advice will be prepared by TRCA staff on behalf Fisheries and Oceans Canada, and an extension to the cold water fisheries timing window has been granted until November 30, 2011. 131

RATIONALE The application was reviewed by staff on the basis of the following information: Proposal: The purpose of this application is to develop within a TRCA Regulated Area of the Don River watershed in order to facilitate the construction of a second storey addition above a proposed cantilevered car port to the front/side of the existing single family detached dwelling at 66 Lewis Street. The subject property is located within the Lower Don Special Policy Area and is location east of Broadview Avenue and south of Queen Street East 128

Control of Flooding: The proposed works are located in a highly urbanized area far removed from the watercourse and is removed from the Regional Floodplain. There will be no impact on the storage or conveyance of floodwaters and floodproofing measures are not required. Pollution: The site is within the developed Lower Don community and far removed from any natural areas, including the Don River. Sediment controls are not necessary as the proposed works are removed from any significant natural features. Dynamic Beaches: Not applicable Erosion: There are no slope stability/geotechnical concerns associated with this application. Conservation of Land: The proposed works are located no further than the existing limit of development. There are no significant features on, or adjacent to, the site that would be negatively impacted by the project. Plantings Plantings are not required as part of this application Policy Guidelines: The proposal is consistent with Section 4.2.1(B)3.iii. - Development Guidelines for Development/Redevelopment within Designated Two Zone/Special Policy Areas - of the Authority's Valley and Stream Corridor Management Program. The permit will be issued for the period of November 4, 2011 to November 3, 2013 in accordance with the following documents and plans which form part of this permit: Letter of undertaking to provide revisions to the engineering plans and provide landowner authorization to the satisfaction of TRCA staff, dated October 24, 2011, received October 24, 2011 RATIONALE The application was reviewed by staff on the basis of the following information: Proposal: The proposal is to improve the conveyance of a watercourse (approximately 15m in length) and then a driveway culvert (approximately 20m in length) that outlets to Beaver Creek southeast of Highway 7 and Woodbine Avenue. The watercourse and culvert have become filled with silt, reducing their conveyance. The driveway culvert and watercourse section will be isolated from Beaver Creek and the driveway culvert removed as the property is undeveloped and the driveway unused. The silt from the watercourse will be removed with a vac-truck and the watercourse re-graded and lined with river run stone. Control of Flooding: The proposed project will not have significant impacts to the storage or conveyance of floodwaters. Pollution: Standard erosion and sediment control measures will be implemented prior to construction and maintained for the duration of construction, and until the site is stabilized and restored, in order to prevent construction generated sediments from entering the watercourse. RATIONALE The application was reviewed by staff on the basis of the following information: 132

Proposal: The proposal is to permit the replacement of the existing sanitary sewer connection servicing 7326, 7328, and 7340 Bayview Avenue via Horizontal Directional Drill and excavation to replace the existing manhole connection to prevent failure of the pipe and sewage backup on west side of Bayview Avenue, between Laureleaf Road and Proctor Avenue, in the Don River Watershed,Town of Markham, Regional Municipality of York. The installation work is being undertaken to replace a section of sewer that has required emergency work in the past and the proposed work will provide a permanent solution. This application seeks to formalize works that have already been approved through the Emergency Works process. The proposed works are classified as "Emergency Works" because the potential for a sewer back up similar to that which has been experienced in the past represented an immediate hazard to public safety, and as such represented a threat of injury to persons, loss of life, or loss of property (Conservation Authorities Act). An extension to the The Ministry of Natural Resources cold-water fisheries timing window was applied to these works (all work to be completed by November 30, 2011) and a Letter of Advice will be written by TRCA staff on behalf of Fisheries and Oceans Canada (DFO). Control of Flooding: A portion of the proposed work is located within the Regional Storm Flood Plain. The work will not permanently alter the existing grades and no new above ground structures are proposed. Therefore, the project will not affect the conveyance or storage of flood waters. Pollution: Standard erosion and sediment control measures (sediment control fence) will be implemented prior to construction, maintained for the duration, and removed only after the site is stabilized and restored in order to isolate the work area from the watercourse. Erosion and sediment control measures have been provided in accordance with the TRCA Erosion and Sediment Control Guidelines for Urban Construction. Dynamic Beaches: Not applicable. An extension The MNR cold-water timing window (all work to be completed before November 30, 2011) has been provided to ensure adequate time to undertake the work and provide appropriate restoration and stabilization measures.
