Soil Erosion & Sediment Control 1 SOIL EROSION & SEDIMENT CONTROL Boone County Code Appendix B Subdivisions ARTICLE I GENERAL PROVISIONS Section 101. Title. These regulations shall hereafter be known, cited, and referred to as the "Subdivision Regulations of Boone County, Illinois." Section 102. Purpose. These regulations are adopted for the following purposes: I. To minimize the pollution of air and surface waters; to assure the adequacy of drainage facilities; to safeguard the water table; to control erosion and sedimentation; and to encourage the wise use and management of natural resources throughout the county. ARTICLE III DECISION MAKING, ADMINISTRATION, AND ENFORCEMENT RESPONSIBILITIES Section 302. Office of the county engineer. B. Duties of the county engineer. The county engineer or his duly appointed and acting assistant shall administer and enforce these regulations. In the administration of these regulations, it shall be the duty of the county engineer to: 3. Review all permit applications for compliance with the requirements of article "Floodways, Floodplains, Storm Drainage and Erosion" of these regulations. ARTICLE IV SUBDIVISION REVIEW PROCEDURES Section 403. Subdivision plats and procedures. This article establishes the procedure to be followed by a landowner or developer who proposes to subdivide, develop, or improve any land subject to the terms and requirements of these regulations. It encourages applicants to review concept plans with county staff and consultants and planning commission before filing a preliminary plat or plan. It identifies the contents of concept plans, subdivision plans, and required supporting data. It establishes the application review process, and enumerates standards governing decision making hereunder. C.[D.] Preliminary subdivision plat. 3. Contents of a preliminary subdivision plat. Any person proposing to subdivide, develop, or improve any parcel of land shall file with the county planner a preliminary subdivision plat and application in a quantity and form as required by the county planner. The preliminary subdivision plat shall include the following: e. Preliminary engineering report. A preliminary engineering report shall be submitted along with the preliminary subdivision plat to provide supplemental engineering data regarding factors that will affect the final design of the subdivision. The preliminary engineering report may be a separate drawing. Items to be addressed specifically in the preliminary engineering report include the following: 1. A comprehensive storm water management plan for the land to be developed, including the general alignments of the proposed storm sewer system, points of connection of existing storm sewer systems, detention (or retention), stage/storage relationship of the discharge structure to identify the varying release rates due to inlet and outlet control, off-site areas of contribution, points at which off-site flows will be intercepted, and all the necessary maps, computations, and field data supporting the engineer's stormwater management plan. The proposed stormwater management plan shall identify an overland flow route to accommodate flows in excess of storm sewer design level.

Soil Erosion & Sediment Control 2 2. The location, normal and high water elevations, and outflow of proposed stormwater management facilities. 3. Proposed site grading and a statement that the subdivider will provide such temporary facilities during construction as are necessary or required to prevent soil erosion or the siltation of watercourses, and that adequate measures will be taken during construction for dust control. The subdivider shall also agree to clean and restore streams, ditches, or watercourses of any kind if protective measures prove inadequate. 4. Location and description of all proposed sanitary and storm sewers, water mains, wells, lift stations, and culverts. 5. The location, size, and inverts of all existing storm sewers, bridges, culverts, drain tiles, drainage ways, ditches, creeks, or rivers on the site or within 300 feet of the site. 6. The structural design (thickness and material types) to be used for the construction of the roadway system, projected traffic volumes, soils data, and IBR values shall be submitted to support the roadway design including widths, crown, thickness and can all be represented by a typical section which clearly identifies the streets to which it is applicable. 7. The size, dimensions, and location of miscellaneous items such as parkway trees, streetlights, sidewalks, bike paths, and driveway approaches shall be identified in the report and shown in typical section or typical plan view drawings. D.[E.] Final engineering approval. Before submitting the final subdivision plat for review, the applicant shall submit engineering plans, details, and specifications for all proposed improvements, soil erosion and sedimentation control plans, and landscaping plans regulated by article V hereof for approval of the county engineer. 1. Upon the approval of a preliminary subdivision plat, the applicant shall have prepared and certified by a licensed professional engineer engineering drawings for such improvements and soil erosion and sedimentation control plans and shall have prepared and certified by a licensed professional landscape architect landscape plans specifications and details, which shall be submitted in a form and in a number of copies as required by the county engineer. 2. Upon determination that the application is complete, the county engineer shall distribute to the Boone County Soil and Water Conservation District, and such other county staff, consultants, and other persons as may be necessary, such final engineering plans and final landscaping plans, drawings, and specifications for their review and comment. The county engineer and the Boone County Soil and Water Conservation District shall review all engineering drawings in order to determine whether such drawings are consistent with the approved preliminary subdivision plat and comply with the specifications of the County Subdivision Ordinance. Within 45 days after receipt of a complete set of the required engineering plans, details or specifications, the county engineer and the Boone County Soil and Water Conservation District shall review such plans, details, or specifications, and if they are in compliance with the preliminary subdivision plat and these regulations shall forward the same to the subdivider and the county planner with a report that they so conform and comply. In the event that the plans, details, or specifications do not so conform or comply, the county engineer shall notify the subdivider and the county planner with a report which outlines the specific manner in which they do not so conform or comply. This report shall be submitted within such 45-day review period. 3. The planning, zoning, and building committee shall not act upon a final subdivision plat until the engineering drawings have been reviewed by the county engineer and the final

Soil Erosion & Sediment Control 3 landscaping plans have been reviewed by the county planner and a report of compliance thereof has been received by the planning, zoning, and building committee. E.[F.] Final subdivision plat approval. 2. Contents of the final subdivision plat. Within one year after receiving preliminary subdivision plan approval by the county board, the applicant shall file with the county planner a final subdivision plat in a quantity and form as required by the county planner. The final subdivision plat may include all or only part of the approved preliminary subdivision plat. The final subdivision plat shall include the following: c. Guarantees. The applicant shall provide in a form acceptable to the Boone County State's Attorney a performance bond of 125 percent of the estimated cost of construction of the improvements and soil erosion and sedimentation control measures in the conservation development. Such guarantee shall be submitted to the county engineer for distribution to the state's attorney, county clerk and others asmay be deemed appropriate. ARTICLE V REQUIRED IMPROVEMENTS Section 501. Minimum standards and specifications. All construction of improvements required by these regulations shall be in accordance with, and materials used shall be in compliance with, the methods and materials required in the appropriate sections of the latest editions, amendments, or revisions of the following: A. "Standard Specification for Road and Bridge Construction," Illinois Department of Transportation. B. "Design Manual," Illinois Department of Transportation. C. "Highway Standards," Illinois Department of Public Works and Building Division. D. "Culvert Manual," Illinois Department of Transportation. E. "Manual on Uniform Traffic Control Devices," U.S. Department of Transportation and Illinois Department of Transportation supplement. F. "Standard Specifications for Water and Sewer Main Construction in Illinois," Illinois Society of Professional Engineers, et al. G. "Illinois Design Standards for Sewage Works," IEPA Division of Water Pollution Control. H. "Technical Policy Statements," IEPA Division of Public Water Supply. I. "Recommended Standards for Water Works," Great Lakes Upper Mississippi River Board of Sanitary Engineers ("10 States Standards). J. "Procedures and Standards for Urban Soil Erosion and Sedimentation Control in Illinois," The Urban Committee of the Association of Illinois Soil and Water Conservation Districts (the "Green Book"). K. "Standards and Specifications for Soil Erosion and Sedimentation Control," IEPA (the "Yellow Book"). L. "US Soil Conservation Services Field Engineering Handbook." M. "Illinois Urban Manual: A Technical manual for Urban Ecosystem Protection and Enhancement." N. Municipal standards and specifications, as adopted. Where standards are not specifically set forth herein, improvements shall comply with standards established by resolution of the county board. Section 509. Grading. Requirements for grading shall be as follows: A. Roads shall be graded and improved in accordance with the specifications and construction standards approved by the county board.

Soil Erosion & Sediment Control 4 B. All grading involved shall be in accordance with the approved construction plans submitted prior to application for final plat approval. C. Grading shall be undertaken to minimize erosion and sedimentation. D. No building permit shall be issued until the final grading, including the aggregate sub-base, has been completed in accordance with the approved final engineering. E. No change of grade of the land may be effected until the soil erosion and sedimentation control plan has been approved by the Boone County Soil and Water Conservation District. Section 510. Soil erosion and sedimentation control. P.458. A. Purpose and intent. It is the purpose and intent of these regulations to control soil erosion and sediment caused by soil disturbance in connection with development activities, including, but not limited to, clearing, grading, striping, excavating, and filling of land in the county. Measures taken to control soil erosion and sedimentation shall be adequate to assure that sediment is not transported from the site by a storm event of ten year frequency or less. The following principles shall apply to all regulated development activities within the county and to the preparation of the soil erosion and sedimentation control plan required by these regulations: 1. Plan the development to fit the particular topography, soils, drainage patterns, and natural vegetation of the site. 2. Preserve and protect areas of natural vegetation on the site. 3. Take special precautions to prevent damages which could result from development activity adjacent to watercourses, lakes, and wetlands. 4. Minimize the extent and duration of the area exposed at one time. 5. Apply temporary erosion control practices as soon as possible to stabilize exposed soils and prevent on-site damage. 6. Install sediment basins or traps, filter barriers, diversions, and perimeter control practices prior to site clearing and grading to protect disturbed areas from off-site and onsite runoff and to prevent sediment damage to areas located downslope of the development site. 7. Keep runoff velocities low and provide for retention of runoff on the site. 8. Provide measures to prevent sediment from being tracked onto public or private roadways. 9. Implement final grading and install permanent vegetation on disturbed areas as soon as possible. 10. Implement through inspection, maintenance, and follow-up program. B. Soil erosion and sedimentation control plan required. Except as otherwise provided in these regulations, no person shall commence or perform any clearing, grading, stripping, excavating, or filling of land which meets any one of the following criteria without having first obtained approval for a complete set of construction plans, including a detailed soil erosion and sedimentation control plan approved by the county engineer and the Boone County Soil and Water Conservation District. 1. Any land disturbing activity, including, but not limited to, clearing, grading, stripping, excavation, fill, or any combination thereof that will affect an area in excess of 5,000 square feet. 2. Any land disturbing activity that will affect an area in excess of 500 square feet if the activity is within 100 feet of a lake, pond, stream, or wetland; or 3. Excavation, fill, or any combination thereof that will exceed 100 cubic yards. 4. The county, in consultation with the Boone County Soil and Water Conservation District, reserves the right to require any nonagricultural, construction development activity, regardless of disturbed area or type of activity, to comply with these regulations if it is determined to be the cause of or a contributor to an existing or potential erosion, sediment, or stormwater impact.

Soil Erosion & Sediment Control 5 C. Exemptions. The following activities are exempted from the requirements of this section: 1. Agricultural use of land, including the implementation of conservation measures included in a farm conservation plan approved by the Boone County Soil and Water Conservation District, and including the construction of agricultural structures; 2. Installation, renovation, or replacement of a septic system to serve an existing dwelling or structure. D. Contents of the soil erosion and sedimentation control plan. Each application for soil erosion and sedimentation control plan approval shall be provided in the number and form required by the county planner and include the following information: 1. General information. a. Name, address, and telephone number of the applicant, the consultant preparing the plans, and the property owner; common address and legal description of the site where the site disturbance will take place; and, the signature of the applicant or the applicant's agent. b. A vicinity map in sufficient detail to enable easy location in the field of the site for which the plan approval is sought. c. A boundary line and approximate acreage of the site. d. A legend and graphic scale, and date of preparation or revision. The legend shall describe or explain any and all map symbols, abbreviations, or acronyms used on the map. e. Certification by the applicant that any land clearing, construction, or development involving the movement of earth shall be in accordance with the approved soil erosion and sedimentation control plan. 2. Existing conditions. a. Existing topography of the site and adjacent land within approximately 300 feet of the boundaries, drawn at no greater than two-foot contour intervals and clearly portraying the conformation and drainage pattern of the area. All topographic information drawn or shown on any map shall represent elevations acquired from site specific survey work, not a reproduction of United States Geologic Survey topographic maps or similar product. The scale of such maps shall not exceed one inch of map distance equaling 100 feet of ground distance (1:100). All elevations shall be referenced to National Geodetic Vertical Datum (NGVD) 1929 adjusted. b. The location of existing buildings, structures, utilities, streams, lakes, floodplains, wetlands, depressions, drainage facilities, vegetative cover, paved areas, and other significant natural or manmade features on the site and adjacent land within 300 feet of the boundary. c. A general description of the predominant soil types on the site, their location, and their limitations for the proposed use. Such data shall be taken from the USDA Soil Survey of Boone County and/or the criteria established by local ordinance. d. Proposed use of the site, including present development and planned utilization; areas of clearing, stripping, grading, excavation, and filling; proposed contours, finished grades, and street profiles; provisions for storm drainage, including storm sewers, swales, detention basins, and any other measures to control the rate of runoff, with a drainage area map indications of flow directions and computations; kinds and locations of utilities; and areas and acreage proposed to be paved, covered, sodded or seeded, vegetatively stabilized, or left undisturbed. Any map used to portray this information shall be prepared at the same scale as the topographic map referenced above. 3. Soil erosion and sedimentation control plan. A soil erosion and sedimentation control plan, including a narrative, shall be submitted showing all measures necessary to meet the objectives of these regulations throughout all phases of construction. a. References.

Soil Erosion & Sediment Control 6 1. The preparation of a soil erosion and sediment control plan shall follow the requirements of these regulations and the procedures in the latest edition of the "Illinois Procedures and Standards for Urban Soil Erosion and Sediment Control" (commonly known as the Green Book), which is hereby incorporated into these regulations by reference. 2. Practice standards and specifications for measures outlined in the soil erosion and sedimentation control plan shall follow criteria in the latest edition of the "Illinois Urban Manual: A Technical Manual Designed for Urban Ecosystem Protection and Enhancement," which is hereby incorporated into these regulations by reference. b. Required information. The soil erosion and sediment control plan shall include: 1. Location and description, including standard details, of all sediment control measures and design specifics of sediment basins and traps, including outlet details. 2. Location and description of all soil stabilization and erosion control measures, including seeding mixtures and rates, types of sod, method of seedbed preparation (type and extent of tillage, weed control, planting equipment, etc.), expected seeding dates, type, method and rate of lime and fertilizer application (soil fertility testing required), kind and quantity of mulching for both temporary and permanent vegetative control measures, and types of nonvegetative stabilization measures. 3. Location and description of permanent soil erosion and sediment control features needed at the completion of any soil disturbance on the subject property. 4. Location and description, including standard details, of all runoff control measures, including diversions, waterways, and outlets. 5. Location and description of methods to prevent tracking of sediment off-site, including construction entrance details, as appropriate. 6. Description of dust and traffic control measures. 7. Locations of stockpiles and description of stabilization methods. 8. Description of off-site fill or borrow volumes, locations, and methods of stabilization. 9. Provisions for maintenance of control measures, including type and frequency of maintenance, easements, and estimates of the cost of maintenance. 10. Identification (name, address, and telephone) of the person(s) or entity which will have legal responsibility for maintenance of erosion control structures and measures during development activities and after development activities are completed. 11. Phasing plan. The proposed phasing of development of the site shall include stripping and clearing, rough grading, construction, and final grading and landscaping. Phasing shall identify the expected date on which clearing will begin, the estimated duration of exposure of cleared areas, and the sequence of installation of temporary sediment control measures (including perimeter controls), clearing and grading, installation of storm drainage, paving streets and parking areas, final grading and the establishment of permanent vegetative cover, and the removal of temporary measures. It shall be the responsibility of the applicant to notify the county engineer and the Boone County Soil and Water Conservation District their authorized review agent of any changes which occur in the site development schedule after the initial erosion and sediment control plan has been approved.

Soil Erosion & Sediment Control 7 E. Procedures for review of soil erosion and sedimentation control plans. Each application for a soil erosion and sediment control plan shall be reviewed and acted upon according to the following procedures: 1. Conditions for review. a. In order to achieve the objectives of this section, the county shall consult with the Boone County Soil and Water Conservation District on soil erosion and sedimentation control plans. b. No approval for a soil erosion and sedimentation control plan shall be issued for soil disturbance on a tract of land unless one or more of the following have been obtained: 1. The soil disturbance will occur in a development, including, but not limited to, subdivisions and planned unit development, that has been approved by the county; or 2. The soil erosion and sedimentation control plan is accompanied by or combined with a valid building permit issued by the county building department; or 3. The proposed soil disturbance is coordinated with an overall development program previously approved by the county for the area in which the site is situated; and 4. All relevant federal and state permits including, but not limited to, NPDES, section 404, section 401, and NRI have been received for the portion of the site subject to soil disturbance. 2. Staff review. a. Within five days of receipt of a soil erosion and sedimentation control plan, the county planner shall distribute the plans to the Boone County Soil and Water Conservation District and the county engineer for review and comment. Within 30 days of receipt of the soil erosion and sedimentation control plan the Boone County Soil and Water Conservation District and the county engineer shall review of the application and required submissions and approve the soil erosion and sedimentation control plan in writing if it is found to be in conformance with the provisions of these regulations. Such written approval shall be construed as the soil erosion and sedimentation control permit. b. The Boone County Soil and Water Conservation District and the county engineer may approve the soil erosion and sedimentation control plan subject to such reasonable conditions as may be necessary to secure the objectives of these regulations, and issue the approval in writing subject to these conditions. Such written approval shall be construed as the soil erosion and sedimentation control permit. c. The Boone County Soil and Water Conservation District and the county engineer may reject the soil erosion and sedimentation control plan, indicating in writing the specific deficiencies and the procedure for submitting a revised application and/or submission. 3. Expiration of permit. A soil erosion and sedimentation control permit shall expire after 180 days after the date of approval unless soil disturbance activities have commenced in a workmanlike manner in accordance with the approved final engineering plans. F. Soil erosion and sedimentation control specifications. 1. All clearing, grading, stripping, excavating, and filling which is subject to the approval requirements of these regulations shall be subject to the applicable standards and requirements set forth and/or referenced in these regulations. 2. Site design requirements. On-site soil erosion and sedimentation control measures, as specified by the following criteria, shall be constructed and functional prior to initiating clearing, grading, stripping, excavating, or fill activities on the site.

For disturbed areas draining less than one acre filter barriers, including filter fences (heavy duty fabric only), or equivalent control measures shall be constructed to control all off-site runoff as specified in the referenced handbooks. Vegetated filter strips, having a minimum width of 35 feet, may be used as an alternative only where runoff is expected to be sheet flow (vegetated filter strips must be established prior to land disturbing activities). b. Filter barriers are appropriate sediment control measures for small drainage areas where concentrated flow is not present or expected. c. For disturbed areas draining more than one but less than five acres, a sediment trap or equivalent control measure shall be constructed at the downslope point(s) of the disturbed area(s). Sediment barriers such as silt fences are ineffective an unreliable in such situations. In particular, they are subject to undercutting and blowout due to high water velocities. d. For disturbed areas draining more than five acres, a sediment basin or equivalent control measure shall be constructed at the downslope point(s) of the disturbed area(s). e. Sediment basins and sediment traps designs shall provide for both detention storage and sediment storage. The detention storage shall be composed of equal volumes of "wet" detention storage and "dry" detention storage and each shall be sized for 25- year, 24-hour runoff from the site under maximum runoff conditions during construction. The release rate of the basin shall be that rate required to achieve minimum detention times of at least ten hours. The elevation of the outlet structure shall be placed such that it only drains the dry detention storage. f. The sediment storage shall be sized to store the estimated sediment load generated from the site over the duration of the construction period with a minimum storage equivalent to the volume of sediment generated in one year. For construction periods exceeding one year, the one-year sediment load and a sediment removal schedule may be substituted. g. Stormwater conveyance channels, including ditches, swales, and diversions, and the outlets of all channels and pipes shall be designed to withstand the expected flow velocity from the 100-year frequency storm without erosion. All constructed or modified channels shall be stabilized within 48 hours, consistent with the following standards: 1. For grades up to of [sic] two percent to four percent, seeding in combination with mulch, erosion blanket, or an equivalent control measure shall be applied. Sod or erosion blanket or mat shall be applied to the bottom of the channel. 2. For grades of four percent to eight percent, sod or an equivalent control measure shall be applied in the channel. 3. For grades greater than eight percent, rock, riprap, or an equivalent control measure shall be applied, or the grade shall be effectively reduced using drop structures. h. Disturbed areas shall be stabilized with temporary or permanent measures within ten days following the end of active disturbance, or redisturbance, consistent with the following criteria: 1. Temporary or permanent stabilization measures shall include seeding, mulching, sodding, and/or nonvegetativemeasures. 2. Areas having slopes greater than 12 percent shall be stabilized with sod, mat, or blanket in combination with seeding. The use of any stabilizationmat, blanket, or sod shall require the implementation of approved standards and specifications for installation procedures.

Soil Erosion & Sediment Control 9 3. Channel relocation is discouraged. However, in instances where channel relocation is necessary, the new channel shall be constructed in the dry and be fully stabilized before flow is diverted. i. Stormsewer inlets and culverts shall be protected by sediment traps or filter barriers meeting accepted design standards and specifications. j. Soil storage piles containing more than ten cubic yards of material shall not be located with a downslope drainage length of less than 25 feet to a roadway or drainage channel. Filter barriers, including silt fence, or equivalent, shall be installed immediately around the perimeter of the soil storage pile(s). k. If dewatering devices are used, discharge locations shall be protected from erosion. All pumped discharges, including discharge water from basement sump pumps, shall be routed through appropriately designed sediment traps or basins or equivalent. l. Each site shall have graveled (or equivalent) entrance roads, access drives, and parking areas of sufficient length and width to prevent sediment from being tracked onto public or private roadways. Any sediment reaching a public or private roadway shall be removed by shoveling or street cleaning before the end of each workday and transported to a controlled sediment disposal area. Flushing with water is not an acceptable method of sediment removal. m. All temporary and permanent erosion and sediment control practices shall be maintained and repaired as needed to assure effective performance of their intended function. n. All temporary erosion and sediment control measures shall be disposed of within 30 days of final site stabilization is achieved with permanent soil stabilization measures. Trapped sediment and other disturbed soils resulting from the disposition of temporary measures shall be permanently stabilized to prevent further erosion and sedimentation. G. Maintenance of control measures. All soil erosion and sedimentation control measures installed to meet the requirements of these regulations shall be maintained by the applicant or subsequent land owner during the period of land disturbance and development of the site in a satisfactory manner to ensure adequate performance. The applicant or the contractor responsible for maintaining the erosion and sediment control practices shall inspect all such practices at least once every seven days or immediately following a precipitation event equal to or exceeding onehalf inch of rainfall in a 24-hour period of time. H. Responsibility. The permittee shall not be relieved of responsibility for damage to persons or property otherwise imposed by law, and the county or its officers or agents, including the directors and staff of the Boone County Soil and Water Conservation District, shall not be made liable for such damage by the issuance of a permit under these regulations, compliance with the provisions of that permit or with conditions attached to it bythe county, failure of the county officials to observe or recognize hazardous or unsightly conditions, failure of the county officials to recommend denial of or to deny a permit, or exemptions from the permit requirements of these regulations. I. Special precautions. 1. If at any stage of the grading of any development site the county determines by inspection that the nature of the site is such that further work authorized by an existing permit is likely to imperil any property, publicway, stream, lake, wetland, or drainage structure, the county may require, as a condition of allowing the work to be done, that such reasonable special precautions to be taken as are considered advisable to avoid the likelihood of such peril. "Special precautions" may include, but are not limited to, a more level exposed slope; construction of additional drainage facilities, berms, terracing, compaction, or cribbing; installation of plant materials for erosion control; and recommendations of a registered soils engineer, certified

Soil Erosion & Sediment Control 10 professional erosion and sediment control specialist, or licensed professional geologist which may be made requirements for further work. 2. Where it appears that storm damage may result because the grading on any development site is not complete, work may be stopped and the permittee required to install temporary structures or take such other measures as may be required to protect adjoining property or the public safety. On large developments or where unusual site conditions prevail, the county may specify the time of starting or completing grading of or may require that the operations be conducted in specific stages so as to insure completion of protective measures or devices prior to the advent of seasonal rains. J. Amendments of plans. Major amendments of the site development or soil erosion and sedimentation control plans shall be submitted to the county planner and shall be processed and approved or disapproved in the same manner as the original plans. Field modifications of a minor nature may be authorized by the county planner, in writing, after consulting with the Boone County Soil and Water Conservation District and the county engineer. K. Removal of control measures. The maintenance bond required by these regulations shall not be released until all temporary control measures have been removed after a report of completion has been issued by the county engineer and the Boone County Soil and Water Conservation District specifically indicating control measures may be removed. Section 511. Landscaping. B. Landscape plan required. A landscape plan shall be required for landscaping required to screen the subdivision from perimeter public roads or other public lands, public open spaces, common areas, entry or gateway features, off-road trails, conservation areas, and stormwater management facilities in the subdivision. Landscape plans required by these regulations shall be prepared by an Illinois licensed landscape architect. Requests for relief or revisions to these requirements of this ordinance may be submitted to the county planner for his consideration. 2. General design criteria. t. Ground cover. All drainage swales and slopes having a slope of three vertical units to one horizontal unit (3:1) or greater shall be sodded. All other ground areas not covered by buildings, parking, driveways, sidewalks or other impervious surfaces, or occupied by planting beds shall be graded smooth with a minimum of four inches of black dirt after compacting and removing stumps, rocks, and other debris and shall be seeded or sodded to prevent soil erosion and sedimentation of public drainage systems, creeks, streams, rivers, and wetlands. ARTICLE VII PUBLIC IMPROVEMENT GUARANTEES AND ACCEPTANCE PROCEDURES Section 700. Purpose and intent. In order to guarantee the completion of public improvements, including parks and common areas, and the performance of all other obligations required by these regulations, no final plat of subdivision shall be approved, no plat of subdivision shall be recorded, and no installation or construction of such improvements shall commence until the requirements of this article have been satisfactorily provided. Section 701. Guarantee amount. The amount of the performance guarantee shall cover all construction costs for public improvements, including, but not limited to, soil erosion and sedimentation control measures, parks and common areas, and stormwater management facilities, landscaping, and all costs for performing the obligations for which financial security is required by these regulations. The guarantee shall be in the amounts of 125 percent of the estimated construction cost of all public improvements and 125 percent of the performance of all other obligations which may be secured to be approved by the county engineer unless the subdivider can show that certain costs have

Soil Erosion & Sediment Control 11 already been paid or construction has been satisfactorily completed. Estimates of cost for public improvements shall be provided by the project engineer. Public improvement guarantees shall be submitted to the county planner. Section 702. Subdivider responsibilities. In addition to the construction and completion of all public improvements, the subdivider shall be responsible for the maintenance of all land improvements until the release of the performance guarantee. Where a subdivision has been improved in phases, the subdivider shall be responsible for the proper functioning of drainage improvements for the entire subdivision site. The subdivider shall be responsible for the following until acceptance of the public improvements by the county board: A. Snow removal. The subdivider shall be required to provide snow removal on all roads and sidewalks until the final acceptance of said improvements. B. Erosion control. All exposed or disturbed earth surfaces resulting from the required improvements shall be properly protected in accordance with the approved soil erosion and sedimentation control plan or as directed by the Boone County Soil and Water Conservation District. Erosion control measures shall be maintained until such exposed or disturbed earth surface is stabilized and approved by the county engineer and the Boone County Soil and Water Conservation District. C. Debris removal. The subdivider shall clean and maintain or cause to be cleaned and maintained all improvements until the final acceptance of such improvements. The improvements shall be kept free from debris, sediment deposits, trash, and extraneous material prior to acceptance and at such other times during construction as the county may deem necessary to prevent the creation of a public nuisance. Section 712. Acceptance procedures. A. Completion of public improvements. 3. Grading and implementation of measures to control erosion and ponding of water shall be accomplished at the subdivider's expense in accordance with these regulations and the Boone County Soil and Water Conservation District prior to filing with the county engineer the certificate of completion required by these regulations or the expiration of 12 months from the approval of the final plat, whichever is earlier. The county engineer shall prepare or cause to be prepare such minimum specifications for grading, location of earth stockpiles, drainage and erosion control which specifications shall be kept on file with the county clerk for public review and inspection. Amended Zoning Ordinance Chapter 3 Districts and General Provisions 3.3. AGRICULTURAL RESIDENCE DISTRICT (A-2) 3.3.3. Conditions to be Applied to Non-Farm Single Family Residences. The applicant shall present clear and concise evidence that the property is: C. Not suitable for farming (not limited to row crops; see agriculture definition). In making such determination, the following criteria shall be used: 2. TOPOGRAPHY. A lot with a score of less than 76 for the LESA System may be considered for the A-2 District if the slope of the lot is greater than nine percent (9%). An Erosion and Sediment Control Plan for construction sites with its schedule for completion prepared by the applicant and the SWCD shall accompany applications using this criterion. 3.13. FLOODPLAIN OVERLAY DISTRICT (FPO) 3.13.17. Protecting Buildings.

Soil Erosion & Sediment Control 12 B. This building protection requirement may be met by one (1) of the following methods. The Zoning Enforcement Officer shall maintain a record of compliance with these building protection standards as required in Section 3.13.9. 1. A residential or non-residential building may be constructed on permanent land fill in accordance with the following: c. The fill shall be protected against erosion and scour during flooding by vegetative covers, rip rap, or bulk heading. If vegetative cover is used, the slopes shall be no steeper than three-(3) horizontal to one (1) vertical. 4.6. MOBILE HOME PARKS. In addition to the standards and criteria established in Section 2.7, herein, no Special Use Permit shall be granted for the use(s) listed below unless evidence is presented to establish the standards and criteria set forth herein. 4.6.2. General Standards. The following are general requirements that must be met before the Special Use Permit can be granted: B. The park shall not be subject to hazards such as objectionable smoke, noxious odors, unusual noise, the probability of flood or erosion or the possibility of insect or rodent infestations. In no event shall any Special Use Permit be granted where the mobile home park, or any part thereof where mobile homes are to be placed, is located within a Special Flood Hazard Area. Chapter 4 Design Criteria for Specific Uses 4.7. EARTH MATERIALS EXTRACTION. 4.7.9. Mining Operation Requirements. Each person, firm, or corporation to whom a mining operation permit is issued may engage in mining upon the lands described in the permit, subject to the following requirements: N. Upon the completion of operations, the land shall be left in a condition so that sufficient drainage is provided in order to prevent water pockets or undue erosion with all grading and drainage such that natural storm water leaves the entire property at the original, natural, drainage points and that the area drainage to any one such point is not increased. In the event the reclamation plan shall provide for the permanent establishment of a lake, the grading and drainage may be altered, but not in such a manner as to cause damage or inconvenience to surrounding or abutting properties. P. Upon replacement of the topsoil; trees, shrubs, legumes, grasses, or groundcover shall be plated upon such area in order to avoid erosion, in accordance with approved reclamation plan. Chapter 5 Development and Design Standards 5.3. TRADITIONAL NEIGHBORHOOD DEVELOPMENT DESIGN GUIDELINES 5.3.6. Stormwater Management Guidelines. Site design should use Best Management Practices (BMPs) to minimize off-site stormwater runoff, increase on-site filtration, and minimize the discharge of pollutants to ground and surface water. Natural topography and existing land cover should be incorporated into stormwater management systems to the maximum extent practicable. Please refer to the Subdivision Code for a full list of BMPs and Stormwater treatment requirements. New TND development and redevelopment shall meet the following requirements C. Developers must remove eighty-percent (80%) of the average annual load of total suspended solids from new developments. Erosion and sediment controls must be implemented to mitigate impacts during construction or other land disturbing activities. 5.4. LANDSCAPING AND TREE PRESERVATION.

Soil Erosion & Sediment Control 13 5.4.1. Purpose. This Article is established to create uniform landscape, screening and tree preservation standards for development of property in the County and review of plans therefore, in order to ensure that the County remains attractive, safe and comfortable. Landscaping required by this Section shall be a condition to the issuance of a Certificate of Occupancy for any improvements built on a lot in the County. The landscape standards herein are established: B. To conserve soil and reduce soil erosion, reduce storm water run-off, to provide oxygen regeneration to enhance air quality, and to reduce the effects of urban heat islands; 5.4.2. Landscaping and Screening Regulations. A landscape plan prepared in accordance with the standards set forth in this Article shall be required for any land development or use permit requiring a Site Plan Review. Landscaping and screening required by this Article shall be a condition to the issuance of a Certificate of Occupancy for any improvements built on a zoning lot in the County. C. GENERAL DESIGN CRITERIA 7. DETENTION/RETENTION BASINS AND PONDS. Detention/ retention basins and ponds areas shall be planted. Such plantings shall include shade and ornamental trees, evergreens, shrubbery, hedges and/or other live planting materials. Plants must be able to tolerate wet conditions if planted within the basin. Native grasses and tall native vegetation shall be planted along the edges of detention/retention basins as a means to control the local geese population and to reduce erosion around the basin. 20. GROUND COVER. All drainage swales and slopes having a slope of three vertical units to one horizontal unit (3:1) or greater shall be sodded. All other ground areas not covered by buildings, parking, sidewalks or other impervious surfaces, or occupied by planting beds shall be graded smooth with a minimum of six (6) inches of black dirt after compacting and removing stumps, rocks and other debris, and shall be seeded or sodded to prevent soil erosion and sedimentation of public drainage systems, creeks, streams, rivers and wetlands. City of Belvidere Chapter 50 FLOODS ARTICLE III. DEVELOPMENT Sec. 50-74. Protecting buildings. (a) In addition to the damage prevention requirements of section 50-73, all buildings to be located in the SFHA shall be protected from flood damage below the FPE. This building protection requirement applies to the following situations: (1) Construction or placement of a new building valued at more than $1,000.00; (2) Structural alterations made to an existing building that increase the floor area by more than 20 percent, or the market value of the building by more than 50 percent; (3) Reconstruction or repairs made to a damaged building that are valued at more than 50 percent of the market value of the building before the damage occurred; (4) Installing a manufactured home on a new site or a new manufactured home on an existing site; this chapter does not apply to returning a manufactured home to the same site it lawfully occupied before it was removed to avoid flood damage; and (5) Installing a travel trailer on a site for more than 180 days. (b) This building protection requirement may be met by one of the following methods. The building official shall maintain a record of compliance with these building protection standards as required in section 50-36. (1) A residential or nonresidential building may be constructed on permanent landfill in accordance with the following:

Soil Erosion & Sediment Control 14 a. The fill shall be placed in layers no greater than one foot deep before compaction. b. The lowest floor (including basement) shall be at or above the FPE. The fill should extend at least ten feet beyond the foundation of the building before sloping below the FPE. c. The fill shall be protected against erosion and scour during flooding by vegetative cover, riprap, or bulkheading. If vegetative cover is used, the slopes shall be no steeper than three horizontal to one vertical. d. The fill shall not adversely affect the flow of surface drainage from or onto neighboring properties. Chapter 150 ZONING ARTICLE 0. INTRODUCTION AND DEFINITIONS Sec. 150.013. Definitions. Drainage: The removal of surface water or groundwater from land by drains, grading, or other means. Drainage includes the control of runoff, to minimize erosion and sedimentation during and after development, and the means necessary for water supply preservation or prevention or alleviation of flooding. Erosion: The detachment and movement of soil or rock fragments by water, wind, ice, and/or gravity. Ordinary high water mark: The point on the bank or shore of a body of water up to which the presence and action of surface water is so continuous as to leave a distinctive mark such as by erosion, destruction or prevention of terrestrial vegetation, predominance of aquatic vegetation, or other easily recognized characteristics. Sedimentation: The deposition of soil that has been transported from its site of origin by water, ice, wind, gravity, or other natural means as a result of erosion. ARTICLE 2. LAND USE REGULATIONS Sec. 150.204. Detailed land use descriptions and regulations. The land use categories employed by this chapter are defined in this section. All regulations and requirements identified in this section are in addition to and complimentary to any regulations or requirements pertaining to a particular zoning district (i.e. bulk requirements). Land uses that are not listed in this chapter are not necessarily excluded from locating within any given zoning district. Section 150.911 empowers the zoning administrator to make interpretations on matters regarding specific land use proposals which are not addressed by this chapter. (J) Natural resource disruption mitigation standards. In all developments, certain areas may be required to be set-aside as permanently protected natural resource area for the purpose of natural resource protection, to meet a minimum landscape surface ratio (LSR) requirement. Where such permanently protected natural resource area is required, and where the land use is also permitted per the land use regulations of the applicable conventional zoning district (see 150.204, detailed land use descriptions and regulations), the following regulations shall also be employed to establish land use regulations. All land uses listed in 150.204 but not listed in this section are prohibited in permanently protected natural resource areas. For all land uses, disruption to natural resource areas shall comply with the requirements of article 5 and the subdivision ordinance pertaining to drainage, grading and erosion control. All land uses located within permanently protected natural resource areas shall comply with the following: (1) Cultivation. A. Permitted by right. 1. Permitted only if designated on the submitted site plan, and/or the recorded plat as an "area that may be used for cultivation".

Soil Erosion & Sediment Control 15 (2) Passive outdoor public recreational area. A. Permitted by right. 1. Limited to a 20-foot wide area in permanently protected natural resource areas. Permitted in other permanently protected areas without restriction. 2. Non-native vegetation shall not be permitted to spread into permanently protected natural resource areas beyond said 20-foot wide area. (3) Active outdoor public recreational area. A. Permitted by right. 1. Non-native vegetation shall not be permitted to spread into permanently protected natural resource areas. (4) Outdoor institutional. A. Permitted by right. 1. Non-native vegetation shall not be permitted to spread into permanently protected natural resource areas. (5) Lawn care. A. Permitted by right. 1. Non-native ground cover shall not be permitted to spread into permanently protected natural resource areas. Clearance of understory growth shall be permitted. 2. Only disturbance associated with the care of native vegetation is permitted, with the exception of a 20-foot wide access path, which may be cleared for passive recreation purposes. 3. Each property abutting a natural resource area shall be limited to one such access path. 4. Non-native vegetation (such as domestic lawn grasses) shall not be introduced into natural resource areas beyond said 20-foot wide access path. (6) Golf course. A. Permitted by right. 1. Non-native vegetation shall not be permitted to spread into permanently protected natural resource areas. 2. Only disturbance associated with the care of native vegetation is permitted. Green space areas located within or adjacent to golf play areas shall be incorporated into the course design as out-of-bounds play hazards, and shall be maintained in their natural state. (7) Any permitted temporary use. A. Permitted by right. 1. Activity shall in no manner encroach upon permanently protected natural resources areas. Party securing the temporary use permit shall be responsible for restoring all such natural resource areas to an undamaged state, or shall be considered in violation of the provisions of this chapter. (8) Drainage structure. A. Permitted as a special use. 1. Structure shall be deemed necessary by the city. 2. Natural vegetation shall be restored in disturbed areas. (9) Filling. A. Permitted by right. 1. Filling in the floodway shall be done only as required by a necessary road, bridge, utility, or other infrastructure facility, which has been deemed necessary by the department of public works. 2. Natural vegetation shall be restored in disturbed areas. 3. In no instance shall filling raise the base flood elevation.
