TxDOT Experience with Long-Term Private Maintenance Agreements June 2, 2015 Beau B. Buchanan, P.E. Project Manager TxDOT South Central Strategic Projects Office San Antonio, Texas
Maintenance Agreements Comprehensive Maintenance Agreements and Capital Maintenance Agreements Option for maintenance agreements if pricing acceptable Achieves price certainty Efficient for projects with unique features Beneficial to achieving long-term ownership of design by the developer Non-compliance handled through Non-compliance Points or Liquidated Damages
O&M Agreement Examples Concession (50 Year Term of Contract) SH 130 Segments 5 & 6 North Tarrant Expressway (NTE) Segments 1 & 2 NTE 3A I-635 LBJ Freeway SH 288 Design/Build (three-5 year Capital Maintenance Agreements): SH 130 Segments 1-4 DFW Connector Dallas Dallas Horseshoe SH 99 (Grand Parkway) Segments F1, F2, and G IH 35E Managed Lanes Project US 77
O&M Agreement Examples Design-Build Extended Comprehensive Maintenance Agreements (COMA) SH 183 Managed Lanes 25 year maintenance responsibility (also includes five year extended construction financing) US 181 Harbor Bridge - 25 year maintenance agreement Loop 375 Border Highway West 15 year maintenance responsibility
SH 130 Seg 1-6 Bypass of Austin 90 mile reliever route for I-35 Toll Road All Electronic Tolling (Transponder & Video)
SH 130 Provides a bypass of Austin Southern Sections (5 & 6) Comprehensive Developer Agreement (CDA) 41 miles, two lanes in each direction Non-tolled Discontinuous Frontage Roads Asphalt 85 mph speed limit Cadillac CTS-V hits record 220.5 mph during toll equipment testing on Texas SH 130
Terms of the Concession O & M is part of the Design-Build Concession Facility Concession Agreement Executed March 2007 Construction began April 2009 50-Year Length of Contract The project opened to traffic in Oct 2012
What does it cover? Comprehensive ROW to ROW Includes Routine Maintenance Renewal and Replacement Longer term maintenance Overlays Painting bridge structures Paving (Biggest Asset) Ride Quality Cracking Friction/Wearing Surface Signing/Striping Drainage Interchanges/Structures
What does it cover? Routine Maintenance Mowing Litter Guardrail/Attenuator Repairs Lighting Graffiti
Performance Standards Condition Ratings are Applied on an Quarterly Basis A scale of 1 through 5 is used (5 being the best) Non-compliance points if any asset goes below a 3 Performance and Measurement Table Baseline 905 Auditable Sections Developer Audits 45 Sections per Quarter IE inspects 9 Sections per Quarter
Performance Standards Performance and Measurement Table Structure Categories Elements Response to Defects Cat 1 Defects Most critical, Safety related issues, shortest cure periods Cat 2 Defects Less critical, longer cure period, typically not safety related issues Cure Periods Defined Specific to element
O&M Contract Enforcement TxDOT Oversight - Role of Independent Engineer Concessionaire Reports Monthly, Quarterly and Annual Quarterly Condition Ratings Audit Random sampling Safety Plan Unscheduled TxDOT drive-bys Enforcement of standards if conditions fall below thresholds
Incident Management Monitoring System ITS CCTV in place covering most of the facility Incidents have been detected before they are reported on-site Work with TxDOT on messaging and emergency notices Courtesy Patrols
Hand Back Requirements In 2062, the Concession will turn back the assets of SH 130 to TxDOT Residual life of pavement defined in the Agreement Major items such as bridges also have residual life requirements Bridges Drainage Culverts How will this be decided?
Lessons Learned We re three years into the 50 year O&M portion of the contract Need to look at the O&M more as a separate phase of the life of the project. Having staff (from both sides) transition from the Design/Construction phases into the O&M phases helps bring historical perspective to things. Developing O&M Procedures document during construction phase - defining roles & responsibilities. Including GIS system for accident tracking in the Agreement.
Texas O&M Contracts Going Forward Most of the larger TxDOT projects are incorporating some form of Design-Build with an O&M Component This represents over 22 projects State-wide
Texas O&M Contracts Going Forward
Conclusion TxDOT is committed to utilizing the private sector, in long-term agreements, to operate and maintain portions of the state s network of highways. This is being done to ensure the highest levels of safety and mobility are in place well into the future of State s ever growing roadway network.
