PURPOSE: The purpose of this report is to introduce to Council an updated fire bylaw which establishes and governs the Fire Department and regulates matters related to fire prevention. BACKGROUND and DISCUSSON: The District of Lillooet and Fire and Safety Regulation Bylaw No. 202, 2004 has been significantly revised, re-organized and updated, though many provisions from the 2004 bylaw continue. The proposed bylaw begins by adopting the BC Fire Code and making it applicable within the District. The BC Fire Code is prepared by the Provincial Government with the intent that municipalities would adopt the Code. Part 2 of the proposed bylaw constitutes and regulates the Lillooet Fire Department, making the Fire Chief the head of the Department by appointment of Council. The Fire Chief is then empowered as per section 66 of the Community Page 4 of 51

Charter, which powers a municipality may grant to the Fire Chief, but Council must do so by bylaw. The position of Deputy Fire Chief is clarified as well as qualifications for Members of the Department. A change from the 2004 bylaw is that a maximum age restriction of 60 years of age has been deleted. In the 2004 bylaw, Members were not remunerated for calls outside the Department s jurisdiction. This clause has been deleted on the basis that if the Department is directed to respond to an incident, the Members should be compensated, regardless of where the incident is located. A clause on False Representation has been included in the proposed bylaw, which topic was not addressed in the 2004 bylaw. A section creating a permit regime for Flammable and Combustible Liquids has been deleted. It has been a rare event to receive an application for such a permit and the subject matter is regulated by the Province through Technical Safety BC. The sections on Fireworks have been expanded, revised and clarified. The sale of low hazard fireworks will be permitted between October 24 and November 1, which is consistent with the BC Fireworks Act. The discharge of low hazard fireworks will only be permitted on October 31 or by permit of the Fire Chief. The permit provision is so that the Fire Chief may consider allowing special event fireworks such as an organized display on December 31 st. Fireworks are often discharged on Canada Day but given the climate and geography of Lillooet, staff do not support the discharge of fireworks during the dry summer months. Should Council wish to impose a complete ban on fireworks or consider other restrictions or exemptions, Council could give first reading to the proposed bylaw with direction to staff for amendments or refer to a Committee of the Whole for further discussion. Regulations for Address Identification and Private Hydrant and Water Supply Systems follow. Material changes to burning permits include expanding the maximum duration that a permit is valid from 48 hours to 72 hours. This is so that a burning permit will be valid during a long weekend. Under the 2004 bylaw the maximum area of a burning pile was 1 metre by 1 metre. This size restriction has been increased to match the Provincial Category 2 limits of 2 metres in height and 3 metres in width. The permit application form has also been updated and reorganized. Part 6 deals with inspection of premises and Parts 7 and 8 with Enforcement and Penalties respectively. Page 5 of 51

CONCLUSION: Staff recommend that Council give first three readings to the Fire Department Establishment No. 461. ALTERNATIVES TO STAFF RECOMMENDATION: 1. THAT Council decline to give first three readings and direct Staff to maintain the status quo. 2. THAT Council give first reading to the and Fire Prevention Bylaw 2018, No. 461 and refer the Bylaw to a Committee of the Whole for further study and revision. 1 DISTRICT OF LILLOOET BYLAW NO. 461 FIRE DEPARTMENT ESTABLISHMENT AND FIRE PREVENTION BYLAW A bylaw for the establishment and regulation of a fire and rescue department and to provide for the prevention of fire and the protection of persons and property in the District of Lillooet and agreement areas. WHEREAS pursuant to the Community Charter, Council may by bylaw, regulate, prohibit and impose requirements in relation to municipal services, public places, trees, firecrackers, fireworks and explosives, the health, safety or protection of persons or property in relation to matters referred to in section 63 of the Community Charter, buildings and other structures, and other subjects; NOW THEREFORE, the Council for the District of Lillooet, in open meeting assembled, enacts as follows: Citation PART 1 INTRODUCTION 1. This Bylaw may be cited as the and Fire Prevention Bylaw 2018, No. 461. Definitions 2. (1) In this Bylaw: (a) (b) (c) (d) (e) (f) Apparatus means any vehicle machinery, device, equipment or material used for fire protection or assistance response and any vehicle used to transport members or supplies; Building Code means the British Columbia Building Code, as amended or re-enacted from time to time; CAO means the Chief Administrative Officer for the District; Community Charter means the Community Charter S.B.C. 2003, c.26, as amended or replaced from time to time; construction includes a building, erection, installation, repair, alteration, addition, enlargement or reconstruction; Council means Council for the District; Page 7 of 51

2 (g) (h) (i) (j) (k) (l) Department means the Lillooet Fire Department; District means the District of Lillooet; Fire Chief means the person appointed by Council to be in charge of the Department and the fire fighting personnel of the District, and, where the context implies, includes a Deputy Fire Chief, and any other person authorized to act on behalf of the Fire Chief; Fire Code means the British Columbia Fire Code 2012, enacted by British Columbia Regulation 263/2012 under the Fire Services Act, as amended or replaced from time to time; Fire Hall means the fire hall located at 570 Main Street, Lillooet, British Columbia. Fire Protection Technician means a person certified under the Applied Science Technologists and Technicians Act, R.S.B.C. c.15 as a fire protection technologist, or a person having other certification, acceptable to the Fire Chief, that qualifies the person to perform inspections and testing on fire protection equipment; (m) Fire Services Act means the Fire Services Act, R.S.B.C., 1996, c.144, as amended or replaced from time to time; (n) (o) (p) (q) (r) Member means a person employed by the District and holding a position within the Department as an officer or firefighter and includes the Fire Chief and Deputy Fire Chief; occupier includes an owner or agent of the owner, a tenant, lessee, user, agent and any other person who has a right of access to, possession and control of a building or other premises to which this Bylaw applies; Officer means the Fire Chief, Deputy Fire Chief, Training Officer, a Captain and a Lieutenant and a Member designated by the Fire Chief to act in the capacity of an Officer; Officer in Command means the senior Member of the Department who is present at an incident or a Member appointed as such by the Fire Chief; Owner means a person who has ownership or control of real or personal property, and includes, without limitation: (i) the registered owner of an estate in fee simple; Page 8 of 51

3 (ii) (iii) (iv) the tenant for life under a registered life estate; the registered holder of the last registered agreement for sale; and in relation to common property and common facilities in a strata plan, the strata corporation; British Columbia Fire Code 3. (1) The Fire Code and all amendments thereto is hereby adopted and made applicable within the District. Severability (2) Any person who contravenes, violates or fails to comply with a provision of the Fire Code commits an offence under this Bylaw. 4. If any provision of this Bylaw is held to be invalid by a court of competent jurisdiction, the provision may be severed from this Bylaw and such invalidity shall not affect the remaining portions of this Bylaw. Headings 5. The headings contained in this Bylaw are for convenience only and are not to be construed as defining or in any way limiting the scope or intent of the provisions of this Bylaw. Establishment PART 2 LILLOOET FIRE DEPARTMENT 6. (1) There is hereby constituted a fire department for the District of Lillooet to be known as the Lillooet Fire Department, and the Fire Chief is the head of the Department. Fire Chief (2) In addition to the Fire Chief, the Department personnel shall consist of a Deputy Fire Chief and such number of other Officers and Members as from time to time may be determined by the Fire Chief. 7. (1) The Fire Chief shall be appointed by resolution of Council. (2) Reporting to the CAO, the Fire Chief is accountable for overseeing the provision of services for the protection of lives and property of the citizens of the District of Lillooet from fire hazards; and for the operation of the Department, including training and fire prevention. 4 (3) The Fire Chief shall take all proper measures for the prevention, control and extinguishment of fire, for the protection of life and property, and may enforce all codes and bylaws respecting fire prevention, life safety and investigations. (4) The Fire Chief has complete responsibility for the Department, subject to the direction and control of Council, to which the Fire Chief shall be responsible, and in particular, shall be required to carry out all fire protection activities and such other activities as Council directs, including but not limited to: (a) (b) (c) (d) (e) (f) (g) (h) (i) (j) (k) appointing local assistants pursuant to section 6 of the Fire Services Act. fire prevention and public education; forestry fire assistance; pre-fire planning; disaster planning; preventative patrols; rescue; mutual aid by agreement; medical assistance; fire safety inspections; and other incidents. (5) The Fire Chief may make rules, regulations, policies and committees for the organization and administration of the Department including but not limited to: (a) (b) (c) use care and protection of Department property and Apparatus; conduct and discipline of Officers and Members of the Department; and the efficient operation of the Department; and the Fire Chief may vary, alter or repeal those rules, regulations, policies or committees. 5 (6) Pursuant to section 66 of the Community Charter, the Fire Chief is authorized to: (a) (b) (c) (d) enter on private property and inspect premises for conditions that may cause a fire, increase the danger of a fire or increase the danger to persons or property from a fire; take measures to prevent and suppress fires, including the demolition of buildings and other structures to prevent the spreading of fire; require an owner or occupier of real property to undertake any actions directed by the Fire Chief for the purpose of removing or reducing any thing or condition that the Fire Chief considers is a fire hazard or increases the danger of fire; and exercise the powers of the fire commissioner under section 25 of the Fire Services Act. Deputy Fire Chief 8. (1) The Deputy Fire Chief shall be appointed by the CAO. (2) The Deputy Fire Chief shall: (a) (b) (c) (d) (e) (f) assist the Fire Chief in the performance of his duties and in the absence of the Fire Chief, either, assume command at all fires and emergencies, or delegate command to an Officer of the Department prior to taking leave; have thorough knowledge of the rules and regulations governing the Department; lead Members effectively, maintain discipline, promote harmony, exercise sound judgement and co-operate with other officials; deal effectively with the public and other municipal employees; ensure that any injury to any Member which occurs while on duty is reported to the Fire Chief as soon as possible; take courses and upgrade relevant skills and knowledge at the direction of the Fire Chief; and Members 9. (1) An applicant is qualified to be appointed as a Member of the Department who: Page 11 of 51

6 (a) (b) (c) (d) (e) (f) (g) is 18 years of age or older; is of good character; is medically fit to be a Member as certified by a physician designated by the Fire Chief passes such written, oral and practical examinations as may be required by the Fire Chief; completes a probationary period of a minimum six months; reside within the boundaries of the District; and is recommended for appointment by the Fire Chief. (2) Notwithstanding clause (1)(f) above, a Member may reside outside the boundaries of the District provided that: (a) (b) the Member resides within a 12 kilometre drive of the Fire Hall; and no more than 25% of the entire membership of the Department resides outside the boundaries of the District. (3) Every Member shall comply with all rules, regulations and policies established under section 7(5) and the Code of Conduct, as prescribed by Schedule A, attached to and forming part of this Bylaw. (4) The Fire Chief may terminate a probationary Member, or extend the term of probation, at any time and without cause. (5) The Fire Chief may discipline or discharge any Member for cause. (6) Every Member shall be subject to a medical examination at such time as the Fire Chief may require. False Representation 10. A person must not make false representation as to being a Member of the Department, or wear or display any Department badge, cap, button, insignia or other paraphernalia for the purpose of such false representation. Department Apparatus or Equipment 11. (1) No person shall damage or destroy Department Apparatus or equipment. Page 12 of 51

7 Evacuation (2) No person at an incident shall drive a vehicle over any Department Apparatus or equipment except at the direction of a Member. PART 3 FIRE PROTECTION AND LIFE SAFETY 12. If an emergency arising from a fire, fire hazard, toxic chemical spill, risk of explosion or other emergency causes the Officer in Command to be apprehensive of imminent and serious danger to life or property, or of a panic, the Officer in Command may immediately take the steps the Officer in Command thinks advisable to remove the hazard or risk. The Officer in Command may order the evacuation of a building or area, and may call upon the police to assist and provide security to the evacuated area. Fire Damaged or Vacant Buildings 13. (1) The owner of any fire damaged or vacant building shall ensure that the premises are guarded, or that all openings in the building are kept securely closed and fastened so as to prevent the entry of unauthorized persons. Fireworks (2) If the owner of any fire damaged or vacant building fails to comply with sub-section (1) the Fire Chief may issue an order to the owner to comply with sub-section (1) within a reasonable time frame specified in the order. (3) If an owner or occupier fails to comply with an order issued under subsection (2) within the time frame specified in the order, the District may enter onto the property and carry out such work at the cost and expense to the owner which costs and expenses may be recovered from the owner in the same manner as municipal property taxes. 14. (1) The Fireworks Act [RSBC 1996] Ch. 46 applies to the District of Lillooet. (2) The manufacture, storage, transportation and sale of fireworks shall conform to the Explosives Act and Explosives Regulations, and amendments thereto. (3) The handling and discharge of low and high hazard fireworks, as defined by the Explosives Act and Explosives Regulations, shall conform to the Fireworks Manual (Explosive Division), as published by the Department of Energy, Mines and Resources. (4) No person shall use, detonate, explode, offer for sale, sell or possess firecrackers. Page 13 of 51

8 (5) No person shall sell or offer for sale fireworks except between, but not including, October 24 and November 1. (6) Except as herein provided, Class 7.2.1 low hazard fireworks, as defined by the Explosives Act and Explosives Regulations, shall not be discharged except: (a) (b) on the 31 st day of October; or with a permit issued by the Fire Chief. (7) No person shall set off or discharge fireworks on public property except with a permit issued by the Fire Chief. (8) An applicant for a permit under this section must be at least 18 years of age. (9) The sale, use or discharge of high hazard or indoor fireworks is prohibited. Address Identification 15. All buildings or structures situated on any lot or parcel of land within the municipal boundaries shall be properly identified with numbers facing the road servicing the property, indicating the civic address as designated by the District. All address numbers shall be a minimum of ten (10) centimetres in height with a 1.5 centimetre stroke in contrasting colours to the base colour of the building or structure. Address numbers shall not be obstructed by shrubs, trees, beams or any other material that would impair quick and easy identification. Private Hydrant and Water Supply Systems - General 16. (1) All firefighting water supply systems on private property shall conform to the District Subdivision and Development Servicing Bylaw and be capable of providing fire flows as determined by the latest issue of Water Supply for Public Fire Protection published by the Fire Underwriters Survey. (2) Prior to proceeding with construction of any new water system or extension to an existing system, the applicant shall submit plans or proposed fire hydrant locations and all components of the water distribution system to the Fire Chief for approval. (3) Buildings under construction shall have: (a) roads finished to a minimum standard as provided for in the Building Code, Part 3, that provides for adequate access to the building for Department Apparatus; and Page 14 of 51

9 (b) water supplies for fire protection in accordance with sub-section (1) above which shall be installed as soon as practical or as determined by the Fire Chief. The Department shall be notified of all newly installed fire hydrants. (4) All firefighting water supply systems on private property shall be designed, and construction supervised, by a professional engineer. (5) During construction, servicing, maintenance or repairs, the owner of a firefighting water supply system on private property shall ensure that all conditions affecting fire safety, such as fire hydrants temporarily out of order, low water volumes, low pressures and other conditions are immediately made known to the Department. Private Hydrant and Water Supply Systems - Maintenance 17. (1) Where a fire hydrant is located on private property the owner or occupier of the premises must: (a) (b) (c) maintain the space around the fire hydrant with stable ground cover and a clear and unobstructed area for a radius of at least one (1) metre; maintain ground cover and clearance around the hydrant so as to provide a clear view of the fire hydrant; and ensure that the hydrant is maintained in good working condition at all times and that the hydrant is inspected, serviced and tested annually by a Fire Protection Technician in accordance with the requirements of the Fire Code and without limiting the foregoing an owner or occupier must: (i) (ii) annually, have the private hydrant flushed and drained and have all threads of outlets and caps greased with waterproof grease; and provide the Fire Chief with a written report of the inspection, servicing and testing performed on the private fire hydrant during the previous twelve months. (2) If an owner or occupier fails to properly maintain the private fire hydrant pursuant to sub-section (1) the Fire Chief may issue an order to the owner or occupier to comply with sub-section (1) within a reasonable time frame specified in the order. (3) If an owner or occupier fails to comply with an order issued under sub-section (2) within the time frame specified in the order, the District may enter onto the property and carry out such work at the Page 15 of 51

10 Prohibition cost and expense to the owner which costs and expenses may be recovered from the owner in the same manner as municipal property taxes. PART 4 OUTDOOR FIRES BURNING PERMITS AND FEES 18. No open burning of any kind is permitted during any period without a permit issued by the Fire Chief. Exceptions 19. (1) Notwithstanding section 18 no permit is required for the following: (a) (b) (c) (d) fires within a natural gas, charcoal or propane fueled outdoor heater, outdoor fireplace, barbeque, or other appliance designed and used for the cooking of food; subject to draught hazard conditions, small confined fires of no more than 0.5m high by 0.5m in diameter for ceremonial purposes or the cooking of food; hazard abatement burning to prevent or mitigate the spread or risk of wildfire conducted by the Department under the supervision of the Fire Chief; and Department training exercises; Burning Permits 20. (1) Every application for a burning permit shall be made in the form as prescribed by Schedule C attached to and forming part of this Bylaw. (2) Every permit issued pursuant to sub-section (1) shall be subject to the following conditions: (a) (b) (c) (d) a permit may not be assigned or transferred to another person; a minimum of one adult shall be in attendance at all times during burning; only one burning pile is permitted, a burning pile shall not contain unnatural materials that are not indigenous to the property; (e) a burning pile shall be no larger than 2 metres in height and 3 metres in width; Page 16 of 51

11 (f) (g) (h) (i) (j) (k) (l) (m) (n) a burning pile shall be not less than 15 metres from any combustible structure or material, any standing timber or surrounding bush or any watercourse; a burning pile shall be not less than 15 metres from property lines except that this distance may be reduced to not less than 5 metres at the discretion of the Fire Chief and subject to receipt of written consent from the occupier of the adjacent property; a burning pile shall not be located less than 1000 metres from schools in session, hospitals or facilities used for continuing care as defined under the Continuing Care Act; burning must not commence prior to 7:00 a.m. and no stumps, logs or other fuel may be added to the burning pile after sunset when added to a burning pile, logs, stumps and other fuel shall be placed on the pile and not dropped or pushed onto the burning pile by use of a bulldozer or similar equipment; an adequate firefighting water supply, firefighting equipment and personnel capable of deploying the water supply and equipment except that this requirement may be varied or reduced at the discretion of the Fire Chief; the burning of materials listed in Schedule A of the Open Burning Smoke Control Regulation, BC Reg 41/2016, is prohibited; standing crops shall not be burned; and all fires ignited under a burning permit must be extinguished prior to the expiry, or upon cancellation, of the permit. (2) Burning permits may not be issued for durations of longer than 72 hours. (3) Every burning permit issued by the Fire Chief is suspended when the smoke ventilation index for the Fraser Canyon is less than 34. (4) Every burning permit issued by the Fire Chief is suspended when an open burning ban, issued by the District or a fire protection agency having jurisdiction, is in effect; (5) Every owner or occupier of property who intentionally ignites or permits to be ignited any outdoor fire is responsible for such fire. If the fire is prohibited or the fire is not extinguished in accordance with the terms of the permit issued for the fire, or if in the opinion of the Fire Chief the fire presents a hazard or becomes out of control, the Fire Chief may Page 17 of 51

12 summon the Department to extinguish or control the fire and the owner or occupier shall pay the costs of the services provided by the Department as set out in Schedule B of this Bylaw owner which costs may be recovered from the owner in the same manner as municipal property taxes. PART 5 FIRE PROTECTION AGREEMENTS AND MUTUAL AID Agreements and Mutual Aid 21. The District may enter into agreements for fire protection and mutual aid and for the provision of fire protection by, for, or on behalf of the owners or occupiers or property situated within or out of the municipality, with any person, firm or corporation, or municipality, or improvement district or other properly constituted authority, and for the paying or collecting, as the case may be, of such charges therefore as may be agreed upon. Right to Inspect and Test PART 6 INSPECTION OF PREMISES 22. (1) The Fire Chief may at all reasonable hours enter into and upon any lands, premises, yards or buildings, other than single family dwellings, for the purpose of testing or inspecting: (a) (b) (c) vehicles, lands or buildings, as required or permitted by the Fire Services Act; the water supply to determine if the Department has satisfactory access to an adequate water supply for fire suppression purposes; and to determine compliance with this Bylaw. Entry for Inspection 23. No person may obstruct, hinder or prevent any authorized member of the Department from entering into or upon any lands, premises, yards or buildings, other than single family dwellings, for the purpose of inspecting or testing. Assistance in Inspection 24. The owner or occupier of a building or property or other person having knowledge or a building or property shall, upon request, give to an authorized member of the Department who is carrying out an inspection of the building or property, such assistance as may be required in carrying out the inspection. 13 Fees for Inspections 25. An inspection fee, as set out in Schedule B, shall be paid to the District by an owner to conduct a fire safety inspection at the owner s request due to the pending sale or purchase of a property or other reason. Issuance of Order PART 7 - ENFORCEMENT 26. (1) If the Fire Chief or authorized member of the Department determines that any provision of this Bylaw has been contravened or has not been complied with, or has been complied with improperly or only in part, or that conditions exist in or upon a building or property to which the Bylaw applies and which, in his opinion, constitutes a fire hazard or otherwise constitutes a hazard to life and/or property he may make such orders to ensure full and proper compliance with this Bylaw. (2) An order made under this Bylaw shall be in writing and shall be directed to either the owner or occupier of the building or property in respect of which the order is made or both. Service of Order 27. (1) An order shall be sufficiently served if: (a) (b) (c) delivered by hand to whom the order is issued; in the case of an owner, if delivered by registered mail to the address of the owner as it appears on the records of the British Columbia Assessment Authority; or if the person to whom the order is directed cannot be found, is not known or refuses to accept service of the order, by posting a copy of the order in a conspicuous place on the building, structure or thing to which the order relates. (2) An order issued under this section shall state a date by which the order must be complied with or carried out, which date shall, at the discretion of the Fire Chief, have regard to the degree of urgency involved in correcting or removing conditions which may tend to increase the hazard of fire or danger to life and property. 14 PART 8 PENALTIES Penalties 28. (1) Every person who contravenes or violates any of the provisions of this Bylaw or any permit or order issued pursuant to this Bylaw, or who suffers or permits any act or thing to be done in contravention or in violation of any of the provisions of this Bylaw or any permit or order issued pursuant to this Bylaw, or who neglects to do or who refrains from doing anything required by this Bylaw or any permit or order issued pursuant to this Bylaw, commits an offence and is subject to prosecution in accordance with the Offence Act. (2) Every contravention or violation of this Bylaw or any permit or order issued pursuant to this Bylaw that continues for more than one day constitutes a separate offence for each day that it continues. PART 9 GENERAL 29. If any section, subsection or clause of this bylaw is for any reason held to be invalid by the decision of a court of competent jurisdiction, such decision will not affect the validity of the remaining portions of this bylaw. 30. 15 SCHEDULE "A" CODE OF CONDUCT All Officers and Members of the Lillooet Fire Department shall: 1. at all times are governed by the ordinary and responsible rules of behaviour observed by law-abiding and self-respecting citizens, and no member shall commit any act tending to bring discredit upon the department or its members. Furthermore, when representing the department, all members shall be expected to be courteous and respectful in their contacts with the public; 2. operate through the Fire Chief in the transactions of the department business; 3. attend all fires or emergencies to which they may be dispatched and to perform to the best of their ability. Neglect, inefficiency or indifference of members in the performance of their duties is not acceptable; 4. exercise precaution and good judgment in order to avoid injury to themselves and to other members; 5. familiarize themselves with, and be obedient to the regulations, practices and procedures of the department; 6. accord obedience, proper respect and courtesy to Officers and acting Officers; 7. make truthful and accurate reports, and not make statements with intent to deceive; 8. not willfully mutilate any useful department record, book paper or document; 9. promptly notify the Fire Chief of all matters coming to their attention affecting the interest of the department; 10. notify the Fire Chief of any inability to report for duty and the reason for such inability; 11. exercise caution to avoid unnecessary damage or loss of department property, and be responsible for the safekeeping and proper care of all department property; 12. not remain on duty if his ability is impaired by the use of a mind altering substance(s); 13. not use or take in any form a mind altering substance(s) while on duty; 14. not indulge in obscene or uncivil language, altercations or conduct while on duty which might cause adverse public reaction or injury to any person; 15. refrain from engaging in any activity which reduces the member s effectiveness; 16. abstain from promoting their names, in the context as a member of the department, for any commercial or business purposes, or for countenancing the use of the name and/or prestige of the department for such purposes; and 17. accept no reward, fee or gift from any person for services incidental to the performance of duty, except with permission of the Fire Chief. 18 SCHEDULE "C" (page 2) BURNING PERMIT - NOTES 1. Open burning is only permitted on private property. No District property may be used other than by the District of Lillooet or its agent. 2. Open burning is to be carried out by the property owner, tenant or an agent acting on behalf of the property owner. The owner/occupant or agent accepts all responsibility for any liability as a result of the fire. 3. Any person who causes or through inadvertence, allows a fire to get beyond control and requires the assistance of the Lillooet Fire Department personnel, shall be liable to a charge at cost for such assistance as specified in Schedule "B". 4. A competent person shall be in control of the fire until the fire is extinguished. 5. Adequate appliances, equipment and personnel shall be provided by the permit holder so as to prevent the fire from getting beyond control. 6. Fires are to be extinguished or not started when wind and weather conditions are such that the fire becomes a hazard or creates a nuisance to surrounding properties. 7. Neighbours of adjoining properties are to be notified by the permit holder as to the times of the burn. 8. Permits will not be issued for burning within 1000 metres of a school in session, hospital or facility used for continuing care as defined under the Continuing Care Act. 9. Conditions of fire: a) Fire pile to be no larger than 2 metres high by 3 metres wide; b) Fire to be kept a minimum of 15 metres away from any house, tree, shrub or other combustible material or structure; c) All combustible ground material, within one metre of the burn piles must be removed; d) No contaminated materials may be burned; e) All fires must be extinguished by nightfall except fires for warmth, ceremonial or cooking purposes. The fire department shall be limited to five (5) junior members. Member means any Member of the Lillooet Fire Department and includes an Officer. "Multiple Family shall mean single family dwellings joined by a common wall, up to two (2) Row Housing stories in height, occupied by one family, with each house having an individual ground floor entrance/exit directly to the exterior of the building. "Occupancy" "Occupant or Occupier means the use, or intended use, of a building, or part thereof for the shelter or support of persons, animals or property. means any owner, tenant, lessee, agent, and any ether person who has access to, and control of, any building or premises to which this bylaw applies. "Officer" "Private Fire Hydrant" means any Member appointed to a position of Fire Chief, Deputy Fire Chief, Captain, Lieutenant, Chief Training, Training Officer or Safety Officer, and includes any employee of the Ministry of Forests (while enforcing this bylaw). means any fire hydrant located on private property. "Public Fire means any fire hydrant located on: Hydrant (i) a public highway or right-of-way; (ii) municipal owned property; (iii) an easement held in favour of the City of Lillooet for the purpose of installing and maintaining a water distribution system. "Smoke Alarm" "Sprinkler System means a combined smoke detector and audible alarm device designed to sound an alarm within the dwelling unit, or room in which it is located, upon time detection of smoke within that room. means any sprinkler system installed in compliance with the National Fire Protection Association's Standards for Fire Protection purposes, as an integrated system of underground and overhead piping designed in accordance with good fire protection engineering practices. Weather Indexing means the accepted method of Environment Canada, whereby the inversion of atmosphere is determined to provide proper venting for all airborne particulates. The Environment Canada website can provide this information daily. 201 ESTABLISHMENT PART li LILLOOET FIRE DEPARTMENT 1. There is hereby constituted a fire department for the District of Lillooet to be known as the Lillooet Fire Department", and the head of the department shall be known as the "Fire Chief". 2. In addition to the Fire Chief, the Lillooet Fire Department personnel shall consist of a Deputy Fire Chief, and such number of other Officers and Members as from time to time may be determined by Council. 202 FIRE CHIEF 1. The Fire Chief shall be appointed by resolution of Council. 2. Reporting to the Administrator, the Fire Chief is accountable for overseeing the provision of services for the protection of lives and property of the citizens of District of Lillooet from fire hazards; and for the operation of the Lillooet Fire Department, including training and fire prevention. 3. The Fire Chief shall take all proper measures for the prevention, control, and extinguishment of fire, for the protection of life and property, and may enforce all codes and bylaws respecting fire prevention, life safety and investigations. 4. The Fire Chief has complete responsibility for the Lillooet Fire Department, subject to the direction and control of the Council, to which the Fire Chief shall be responsible, and in particular shall be required to carry out all fire protection activities and such other activities as Page 4 Page 28 of 51

Council directs, including but not limited to: a) Fire prevention and public education; b) Forestry fire assistance; c) Pre-fire planning; d) Disaster planning; e) Preventative patrols; f) Rescue; g) Mutual Aid where agreement exists; h) Medical assistance i) Fire safety inspections j) Other incidents 5. The Fire Chief shall establish rules, regulations, policies and committees necessary for the proper organization and administration of the Lillooet Fire Department including, but not limited to the: a) Use, care and protection of property; b) Conduct and discipline of Officers and Members of the department; and c) Efficient operation of the department. 203 DEPUTY CHIEF 1. The Deputy Fire Chief shall be appointed by resolution of Council. 2. The Deputy Fire Chief shall: a) Assist the Fire Chief in the performance of his duties and in the absence of the Fire Chief, either, assume charge at all fires and emergencies, or delegate the authority to another Officer of the Lillooet Fire Department, prior to taking leave. b) Have a thorough knowledge of the rules and regulations governing Lillooet Fire Department and of the standing orders of the department. c) Have the ability to lead Members effectively, maintain discipline, promote harmony, exercise sound judgment and co-operate with other officials. d) Have the ability to deal effectively with the public and other municipal employees. e) Ensure any injury of any Member that occurs while on duty is reported to the Fire Chief as soon as possible. f) Be willing to take courses and upgrade self as opportunities arise. g) Be appointed Local Assistant to the Fire Commissioner, to take over in the absence of the Fire Chief. 204 OFFICERS 1. The Captains and Lieutenants shall be appointed by the Fire Chief and Deputy Fire Chief, through a fair and equal process based on exams, conduct, experience, interpersonal skills and an interview. a) Every member may apply for any position. b) Members will have the right, to recommend to the Fire Chief, to have any Captain or Lieutenant removed from rank, for just cause. Upon recommendation being given to the Fire Chief, the Fire Chief may decide to place the Captain or Lieutenant on probation for a period of not more than six (6) months to correct the cause. Either, at the end of the probation period or at an earlier date, the Officer may be removed or have his position reconfirmed by the Fire Chief. c) An Officer on call may assume charge at any fire or emergency in the absence of the Chief and Deputy Chief. 2. The Training Office and Safety Officer shall be appointed by the Fire Chief. 3. The Lillooet Fire Department Fire Chief, Deputy Fire Chief, and Officers will make up the Department's Executive Committee. The Secretary/Treasurer at large shall be elected annually. 205 MEMBERS A person is qualified to be appointed as a Member of the Department who: a) is 18 years of age or older to a maximum of up 60 years of age based on annual medical evaluation; b) passes such aptitude and other tests as may be required by Council; and, c) resides within the municipal boundaries of the District of Lillooet. 2. Subject to clause 205(I)(d), a person may reside outside of the municipal boundaries of the District of Lillooet provided: a) the person lives within 12 kilometres of the Fire Hall; b) no more than 25% of the entire membership of the Department reside outside the municipal boundaries of the District of Lillooet; and; 3. Every Member and Officer shall be required to comply with the Code of Conduct as per Schedule "A", attached to and forming part of this bylaw. 4. The Fire Chief may terminate a probationary Member, or extend probation, at any time, without cause. 5. The Fire Chief may discipline or discharge any Officer or Member for cause. 6. Every Member is subject to a medical examination at such time as the Fire Chief may require. 7. Every new applicant will be subject to a criminal background check before they complete their probationary period. If accepted for active duty this expense will be reimbursed to the member. Existence of a criminal record or a poor driver's profile will be grounds for nonacceptance. 8. An individual who has been with the department less than six (6) months shall be deemed a probationary Member. As part of the application process, a probationary evaluation will be conducted. If satisfactory and approved by the Fire Chief, the individual will be accepted as a full member. Page 6 Page 30 of 51

206 REMUNERATION 1. The remuneration of all Members shall be as specified in Schedule "B", attached to and forming part of this bylaw. 2. Payments for calls are paid as per Schedule "B" of this bylaw, with the exception of medical and rescue calls outside municipal boundaries, which are at no cost to the District, with all responding Members donating their personal time. 207 ADMINISTRATION 1. The limits of the jurisdiction of the Fire Chief, and the Officers and Members of the department will extend to the area and boundaries of the District of Lillooet, and fire protection agreement areas as determined by Council, and no part of the fire apparatus shall be used beyond the limits of the municipality without: a) the express authorization of a written contract or agreement providing for the supply of fire fighting services outside the municipal boundaries or; b) the approval of Mayor or Acting Mayor. 2. The Fire Chief shall submit to the Administrator, for inclusion with the overall District budget submitted to Council for approval, the annual budget for the Lillooet Fire Department. 3. If the Members or a Member is unable to agree with a disciplinary decision of the Fire Chief, the Member may appeal to the Executive Committee. The Executive Committee shall either uphold the Fire Chief's decision or appeal the decision of the Fire Chief. If the Executive Committee and the Fire Chief are unable to reach agreement on the issue, both sides shall submit a report to the Administrator for consideration. If the Administrator is unable to bring about a consensus, the two reports shall be submitted to Council for a final resolution of the issue. 4. Honorary Members are entitled to attend social functions only. 301 EVACUATION PART III - FIRE PROTECTION AND LIFE SAFETY 1. If an emergency arising from a fire, fire hazard, toxic chemical spill or from a risk of explosion causes the Officer in command to be apprehensive of imminent and serious danger to life or property, or of a panic, the Officer may immediately take the steps the Officer thinks advisable to remove the hazard or risk, or may cause the people to be removed. The Officer may order the evacuation of a building or area, and may call upon the police to assist and provide security to the evacuated area. 302 FIRE SUPPRESSION 1. The Fire Chief, or in his absence, the senior ranking Member present, shall have control direction and management of all Lillooet Fire Department apparatus, equipment or manpower assigned to an incident and, where a Member is in charge, shall continue to act until relieved by a senior Officer.
