Louth Local Authorities RENTED DWELLING REGULATIONS INSPECTION FORM NEW TENANCY LEASES COMMENCING ON OR AFTER 1st OF FEBRUARY 2009 1

These Regulations do NOT apply to: (a) House let for use as a holiday home. APPLICATIONS/EXEMPTIONS (b) House let by Health Service Executive (HSE) or an approved voluntary housing body as accommodation with sanitary, cooking or dining facilities provided for communal use within the building that contains the dwelling house. (c) Demountable house let by a Local Authority. Article 8 (Food Preparation, Storage and Laundry) of the Housing (Standards for Rented Houses) Regulations, 2008 does NOT apply to the following: (a) A house let by a Local Authority, and (b) A house let by an approved voluntary housing body. However, Article 7 of the Housing (Standards for Rented Houses) Regulations 1993 will continue to apply to these houses. 2

CHECK LIST The purpose of this checklist is to enable assessment of minimum standards for rented accommodation, as regulated by the Housing (Standards for Rented Houses) Regulations 2008 (S.I. 534/2008), and where applicable the Housing (Standards for Rented Houses) Regulations 1993 (S.I. 147/1993). It is based on minimum accommodation standards under the following headings; A B C D E F G H I STRUCTURAL CONDITION SANITARY FACILITIES HEATING FACILITIES FOOD PREPARATION, STORAGE & LAUNDRY VENTILATION LIGHTING FIRE SAFETY REFUSE FACILITIES ELECTRICITY & GAS The Assessment is made up of three parts; PART 1 - Property Details PART 2 - Property Checklist PART 3 - RAS Requirements The Inspector should complete the three parts in order to complete the assessment. IMPORTANT NOTE If, during the visual assessment, it is not possible to ascertain whether a house is in compliance with the Regulations, the landlord may be required to provide such evidence as is necessary to establish that the requirements of the Housing (Standards for Rented Houses) Regulations 2008 (S.I. 534/2008), or where applicable, the Housing (Standards for Rented Houses) Regulations 1993 (S.I. 147/1993), are being complied with. 3

Part 2 Property Checklist A- Article 5: Structural Condition 2008 Regulations (1) A house to which these regulations apply (hereinafter referred to as the house ) shall be maintained in a proper state of repair (2) for the purposes of sub-article (1) a proper state of structural repair means essentially sound, with roof, floors, ceiling, walls and stairs in good repair and not subject to serious dampness or liable to collapse because they are rotted or otherwise defective*. A1 Are the ground / walls / floor free from movement as one moves through the house A2 Does the building appear to be free from risk that is dangerous or near collapse A3 Is the house free from signs of serious dampness (the inspector may use a moisture meter to check levels of dampness) A4 Are the ceilings, walls and floors free from obvious signs of water / moisture ingress A5 Are the surfaces of the walls or floor free from serious dampness A6 Is the stairs in good repair and not liable to collapse 5

B Article 6: SANITARY FACILITIES (2008 Regulations) B1 Is there a watercloset, with a dedicated wash hand basin adjacent thereto, with a continuous supply of cold water and a facility for the piped supply of hot water, all in good working order? B2 Is there a bathroom containing either a fixed bath or a shower bath, with a continuous supply of cold water and a facility for the piped supply of hot water all in good working order? B3 Are the rooms containing items B1 or B2 within the house B4 Are the rooms containing items in B1 and B2 separated by a wall (with door) from adjacent rooms or spaces B5 Do the rooms containing items in B1 or B2 have separate means of ventilation B6 Is there adequate Hot and Cold water storage capacity B7 Do the drains serving the wash hand basins, sinks, baths, showers and toilets allow waste to flow freely 6

B Article 7 : HEATING FACILITIES (2008 Regulations) (1) Every room used, or intended for use, by the tenant of the house as a habitable room shall contain: (a) A permanently fixed appliance or appliances capable of providing effective heating (b) Suitable and adequate facilities for the safe and effective removal of fumes and other products of combustion to the external air (c) The operation of any appliance referred to in sub-article (1)(a) shall be capable of being independently manageable by the tenant C1 Is the heat producing appliance capable of being independently managed by the tenant C2 Is the heat producing appliance capable of providing effective heat C3 Is the heat producing appliance in working order C4 Does the heat producing appliance have an adequate supply of air to it for combustion and for the efficient working of any flue pipe or chimney C5 Does the heat producing appliance have adequate provision for the discharge of the products of combustion to the outside air 7

B Article : FOOD PREPARATION AND STORAGE AND LAUNDRY(2008 Regulations) This Article does NOT apply to dwelling units let by a Local Authority or Voluntary Housing Body D1 Is there a cold water supply to the sink taken directly from the service pipe supplying water to the public main or other source D2 Is there a sink with an adequate draining board D3 A Is there a 4 ring hob with Oven and Grill present in good working order and repair D3 B Are there suitable facilities for the effective and safe removal of fumes to the external air by means of a Cooker Hood or Extractor Fan in good working order and repair D4 A Is there a Fridge present in good working order and repair D4 B Is there a Freezer present in good working order and repair D4 C Is there a Microwave present in good working order and repair 8

D5 Are there a suitable and adequate number of Kitchen Presses for food storage purposes in good working order and repair D6 A Is there a Washing Machine, or access to a communal Washing Machine facility, in good working order and repair, within the cartilage of the building D6 B D6 B(a) Does the dwelling unit contain a yard or garden for the exclusive use of the property If not: Is there a Dryer Vented or Recirculation type in good working order and repair 9

E Article 9 : Ventilation (1) every room used or intended for use, by the tenant of the house as a habitable room shall have adequate ventilation (2) all means of ventilation shall be maintained in good repair and working order (3) Adequate ventilation shall be provided for the removal of water vapour from kitchens and bathrooms In a room containing a Kitchen of more than 6.5sqm in floor area is there a wall or window vent Is there an openable window section or door directly to the external air E1 Is the area of this openable section a Min 1/20 th of the floor area Is there evidence of mildew or mould growth In a Kitchen of less than 6.5sqm in area which does not contain an openable window to external air, is there a mechanical extract ventilation which includes an automatic 15 minute over run or is controlled by a humidistat E2 Is there provision for air supply via a 10mm gap under the door or equivalent Is there evidence of mildew or mould growth 10

E3 Is the room containing a Kitchen (of any size) is there Mechanical Extract Ventilation or Ceiling / Wall Vent exiting at or above roof level E4 In each Bathroom / WC, where there is an openable window or door to external air, is the opening section of min 1/20 th of the floor area (N/A is possible where there is no openable window) E5 In each Bathroom / WC, is there a Mechanical Extraction Vent visible or passive stack vent with Humidity Control E6 In each Bathroom / WC, without opening section to the external air, does the Mechanical Extraction Vent have 15 minutes over-run or is it controlled by a humidistat (N/A is a possible answer where there is an openable window) E7 In each habitable room is there an openable external Window / Door Is the area of this openable section min 1/20 th of the floor area E8 In each habitable room are there Wall / Window vents unobstructed Is the vent providing 6500sqmm of ventilation 11

F Article 10: Lighting (2008 Regulations) (1) Every room used, or intended for use, by the tenant of the house as a habitable room, shall have adequate natural lighting (2) Every hall, stairs, and landing within the house and every room used, or intended for use, by the tenant of the house shall have a suitable and adequate means of artificial lighting (3) The windows of every room containing a bath and or shower and a water closet shall be suitably and adequately screened to ensure privacy. F1 Is there adequate natural lighting in all habitable rooms F2 Is there adequate artificial lighting for the circulation routes and for all rooms used of intended for use by the tenant F3 Is any window in the room containing a bath and or shower and watercloset adequately screened 12

G Article 11: Fire Safety (2008 Regulations) (1) Subject to Sub Article (2), the house shall contain a fire blanket and either a mains-wired smoke alarm or at least two 10-year (2) Each self contained house in a multi-unit building shall contain a mains wired smoke alarm, a fire blanket and an emergency evacuation plan (3) Emergency Lighting, linked to a fire alarm system, shall be provided in all common areas within a multi-unit building *Certain wireless or radio controlled systems may be regarded as compliant with the Regulations where they comply with I.S. 3218:1989 - Code of Practice for Fire Protection and Alarm Systems for Buildings - System Design, Installation and Servicing. This standard is issued by the National Standards Authority of Ireland (NSAI). A landlord may be required to provide such evidence as is necessary to establish that any fire alarm system is in compliance with I. S. 3218. G1 In a house which is not part of a multiunit building is there a mains-wired Smoke Alarm OR a minimum of two 10 year self contained battery operated Smoke Alarms Is there a Fire Blanket in the house G2 If the house is in a multi-unit building is there emergency lighting, linked to or in addition to the Fire Alarm System, in the common areas If the house is a Multi Unit Building Is there a Mains Wired Smoke alarm in the house G3 Is there a Fire Blanket in the house Is there an Emergency Evacuation Plan displayed in the house 13

H Article 12: use Facilities (2008 Regulations) (1) The House shall have access to suitable and adequate pest and vermin proof refuse and storage facilities H1 Are there suitable and adequate pestproof refuse storage facilities available to the house Where there is more than one house in the building, these facilities can be provided individually for each house or a communal facility can be provided for the building provided it is suitable and adequate to collect and store the refuse in an appropriate manner between collections 14

I Article 13: Electricity and Gas (2008 Regulations) Installations in the house for the supply of electricity and gas shall be maintained in good repair and safe working order with provision, where necessary, for the safe and effective removal of fumes to the external air Electro Technical Council of Ireland Is there a current ETCI Periodic Inspection Report by a Registered Electrical Contractor for the electrical installation in the house I1 Does the ETCI Periodic Inspection Report show that all items inspected by the Registered Electrical Contractor achieve a standard that required NO URGENT ATTENTION in the electrical installation I2 Is there a current Declaration of Conformance Certificate for an IS 813 Annex E inspection by a Registered Gas Installer for the Gas installation in the house. Annex E of the National Standards for Domestic Gas Installation 813(IS 813). This standard is issued by the National Standards of Ireland (NSAI) 15

CC Article 7: Heating Facilities (1993 Regulations) THIS ARTICLE ONLY APPLIES TO DWELLING UNITS LET BY A LOCAL AUTHORITY OR VOLUNTARY HOUSING BODY Habitable Room means a room used for living or sleeping in, but excludes a Kitchen of less than 6.5sqm Fixed Heating Appliance includes and open fire CC1 Do all Habitable Rooms contain a fixed Heating Appliance capable of providing adequate space heating CC2 Are there facilities for the installation of cooking equipment with provision, where necessary for the safe and effective removal of fumes to the external air CC3 Are there facilities for the hygienic storage of food Inspection Carried out by: NAME: SIGNATURE: DATE: 16
