Staff Report Zoning Case SUP09-20 (Arkansas Lane Drill Site) City Council Meeting Date: 1-26-10 Document Being Considered: Ordinance RECOMMENDATION Approve an ordinance changing the zoning classification on property known as 3031 East Arkansas Road by the approval of Specific Use Permit (SUP) SUP09-20 for Gas Drilling. PRIOR BOARD OR COUNCIL ACTION On December 9, 2009, the Planning and Zoning Commission recommended approval, by a vote of 6-0-1, with the following stipulations: 1. Prior to issuance of the gas well permit, but no later than two years from the date of approval of this SUP, the operator shall install and maintain landscaping as a Level 1 transitional buffer on the boundary of the property except at the access point. A level one transitional buffer requires 20 feet of green space and one tree per 600-square feet of buffer area. On January 12, 2010, the City Council approved first reading of this case by a vote of 8-0-1. REQUEST The applicant requests a Specific Use Permit (SUP) for Gas Drilling on a 3.31-acre tract of land zoned IM (Industrial Manufacturing); generally located north of Arkansas Lane and west of Forum Drive with the approximate address of 3031 East Arkansas Lane. ANALYSIS The subject site is currently undeveloped. The site is surrounded by IM Industrial Manufacturing. The property to the north is developed with a warehouse development (Pioneer 360 Business Park) and properties to the immediate south, east, and west are undeveloped. According to the submitted site plan, drilling activities are not located within 600-feet of protected uses. The site is approximately 3,800 feet from the proposed SUP09-23, Carrizo Lonestar Drill Site, and proposed SUP09-21, AC-360 Drill Site. Both sites are west of this location. Transportation access to the site is proposed from South Watson Road to East Pioneer Parkway to Forum Drive. The access drive is proposed as caliche material. The drill site s specific traffic route will be reviewed with any subsequent gas well permit application. The applicant is proposing a frac pond on this site. The frac pond will be screened from the East Arkansas view with an opaque fence and landscaping. The drilling operations will be screened from the Forum Drive view with landscaping and the landscaping will be planted prior to the issuance of a drilling permit. The proposed pipeline connection is to the existing DFW Midstream North Arlington Pipeline located immediately south of the proposed pad site. After completion of all wells, a solid masonry wall with a minimum height of eight feet and landscaping must enclose all completed wells and tanks located within the operation site. Landscaping should consist of trees and shrubs which must be chosen from the Texas Smartscape List. One tree shall be provided every 35 linear feet and shrubs shall be spaced no greater than three feet on center. A detailed landscape plan and plant schedule must be provided upon drilling permit submittal. The property owner shall be responsible for the
Page 2 of 2 installation, preservation, and maintenance of all landscaping and physical features shown on this site plan. The East Sector Plan designates this area as SRAC (Super Regional Activity Center), with appropriate zoning for this designation being O (Office), CS (Community Service), or B (Business). Super Regional Activity Centers are built around three or more full-line department stores. The proposed use for gas drilling will require a Gas Well Permit and must also comply with the standards outlined in the Gas Drilling and Production Chapter of the Code. The applicant proposed to comply with the Gas Drilling and Production Ordinance. Case Information Traffic Impact: Water & Sewer: An SUP does not alter the underlying zoning and therefore will not alter the traffic generated over the life of the well. The trips generated during the drilling process are mitigated with the Road Damage Fee. The following information is needed at the time of permit to evaluate the suitability of the water distribution system to serve as the supply source for a gas well drilling site. 1. A site plan of the proposed drill site, including the location of the fire hydrant(s) proposed to supply water to the site. 2. An estimate of total volume of water desired. 3. Approximate dates water supply will be needed at the site. Based on the information provided, additional infrastructure may be required to be constructed. Drainage: Fire: The site is located in the South Cotton Wood Creek drainage basin. The site has approximately 25% within the 100-year FEMA floodplain. No significant drainage impacts are expected to result from development of this site as long as all relevant city ordinances are complied with. Fire Station Number 2, located at 1727 Sherry Street, provides protection to this site. The estimated fire response time is 3.03 minutes, which is in keeping with recommended standards.
