AGENDA REPORT Meeting of the San Marcos City Council MEETING DATE: November 12, 2013 SUBJECT: Accept Borden Road Bridge Improvement (CIP No. 88165) Recommendation Staff recommends the City Council adopt the attached resolution accepting the improvements included in CIP No. 88165 at Borden Road between Twin Oaks Valley Road and Woodward Street, order the recording by the County Recorder a Notice of Completion authorizing the release of the construction bonds required per the contract between the City of San Marcos and Flatiron Inc. providing no valid claims for labor and materials are filed prior to that date. The City Clerk is to release the Faithful Performance Bond one (1) year after the Notice of Completion has been recorded. Introduction The Borden Road Bridge Improvement project included construction of a two-span bridge over San Marcos Creek and associated improvements on Borden Road between Twin Oaks Valley Road and Woodward Street. The improvements enhance the east-west traffic flow in the area while providing reduced response times by Fire and Law Enforcement. The project included construction of a bridge and roadway segment that completed an important east-west traffic circulation linkage north of Mission Road pursuant to the General Plan Circulation Element. The General Plan identifies this segment of Borden Road as a secondary (four lane) arterial. Additionally, the bridge project included construction of a segment of the missing link of the trail system pursuant to the City of San Marcos Trails Master Plan. The project will also effectively reduce the existing flood area during a major storm event, up to and including a FEMA 100-year storm, through the construction of the roadway bridge and grading within the main channel. Discussion The improvements of the Borden Road Bridge Improvement Project have been installed and constructed and are in substantial conformance with the approved plans and specifications for CIP No. 88165. Original Engineer s Estimate of Cost: $ 6,759,993.00 Contract Award Amount: $ 5,606,693.60 Final Amount Paid to Contractor: $ 5,683,611.23 The attached Report of Completion provides more detailed information regarding this project. Cost of contract change orders was 3.48% of the original bid, which meets the Department goal to avoid contract change orders from increasing the contract amount by more than 5%. Most of the change order costs were to achieve enhanced wetland mitigation area within the project site to satisfy regulatory agency permit conditions. Fiscal Impact The final project costs were within the amount budgeted. The capital costs were fully funded through TransNet Bond Funds. The City funded the design and provided staff for project management and construction management. Ongoing costs will include monitoring and maintenance of a conservation easement established to mitigate the wetland and habitat impacts of the project. Annual maintenance costs are estimated at about $9,800 per year for a period not to exceed five years. Following the five year period an endowment payment of $281,966.00 is to be made to a third party money manager to provide a yearly maintenance allocation. This will need to be budgeted for future monitoring and maintenance costs associated with the conservation easement. The bridge/roadway maintenance and capital replacement costs will be approximately $50,000 per year. # 8.2

RESOLUTION NO. 2013- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, CALIFORNIA ACCEPTING THE BORDEN ROAD BRIDGE IMPROVEMENTS. (CIP NO.88165) WHEREAS, on July 23, 2012, the City Council of the City of San Marcos, California entered into an agreement with Flatiron Construction Corporation ( Contractor ) for the construction of capital improvements at Borden Road between Twin Oaks Valley Road and Woodward Street and the surrounding vicinities; and WHEREAS, the Contractor has completed said improvements in substantial conformance to the project s plans and specifications; and WHEREAS, the Contractor has requested that the improvements be accepted and the bonds filed with the City for said improvements be released. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of San Marcos does hereby accept the improvements as set forth in the project s Construction Plans and Specifications for the Borden Road Bridge Improvement Project. BE IT FURTHER RESOLVED that the City Council orders the Labor and Materials Bond to be released six (6) months plus thirty-five (35) days from the recording of a Notice of Completion by the County Recorder, providing no valid claims for labor and materials are filed prior to that date. The City Clerk is hereby ordered to release the Faithful Performance Bond one (1) year after the Notice of Completion has been recorded. Location of Project The project area is along Borden Road, between Twin Oaks Valley Road and Woodward Street in the City of San Marcos. 2. Description of Project The Borden Road Bridge improvement project included the construction of a two-span pre-cast, pre-stressed bridge over the San Marcos, asphalt pavement, curb, gutter, sidewalk, pavement striping and signing, landscape and irrigation, traffic signals and signal interconnect, storm water erosion control and all related appurtenant work. B. Construction Details 1. Changes from the Plans and Specifications The project was constructed in general accordance with the Plans and Specifications with the exception of an additional channel added to the mitigation portion of the project. This channel was added as a part of a water quality treatment vital to the approval of a maintenance permit application by the Public Work Operations. 2. Working Days.
