The vessel had I believe clearded out for the Thames but I am informed by several persons that the intention of McLiven after going there is to clear for the Bay of Islands and from hence to the South Sea Islands. Should this be his intention I have every reason to think he does not mean returning to this port in which case the vessel would be lost to the Native owner. I would beg respectfully to request that under these circumstances you would advise the Collector of Customs at the Bay of Islands not to clear out the William & Julia for the South Seas but endeavour by all means in your power from trading to any port or ports save those mentioned in his agreement. I am further informed that other Native vessels have been taken away under similar circumstances and the amount of evil done id very great. I enclose a letter for the Collectors at the Bay of Islands I have the honour to be Sir Your most obedt Servant Rich de Thierry (Reference Archives NZ Auckland Office agency BBAO series 5544 item 172a record 1868/417 Customer inward letters) High Street Auckland 28 th April 1869 Hon-ble D Pollen Sir The Native Chief Honatana te Irianga had requested me to collect relative to the amount of 190 made him by the Government out of which said he says he had received 60 leaving a balance of 130 still due to him. It appears Mr De Thierry about 5.30 p.m. was in company with two gentlemen Messrs. W.H. and Thomas Clarke proceeding from Ellerslie to Newmarket designing at the latter place to take a bus for town. When about half a mile this side of the race course an express cart with lights burning and full of pleasure seekers dashed past them city wards; close in its rear came a buggy at racing speed without lights with from six to eight people in it all more or less intoxicated endevoring to come up to and pas the express. The shaft of the buggy caught Mr de Thierry by the shoulder perced his coat which being a strong one held on for a time causing him to be dragged along 3

the road some yards. At length the garment gave way and the unfortunate gentleman was flung heavily on his face. The buggy with its heavy load of occupants went right over him commencing at his right hip crossing back and over his left shoulder. The Messrs Clarke shouted to the driver of the buggy to stop that he had killed a man the answer was a peal of drunken laughter Mr Clarke chased them for six or seven chains but the vehicle was too fleet for him. At this junction Captain Isaacs came up and with his troops alter the buggy but was unable to over take it. Mr De Thierry was found lying senseless on the ground with blood issuing from his mouth and ears. Mr De Thierry had in his right hand pocket within its case a valuable meerchaum pipe which the wheel passing over completely smashed and to which fortunate circumstance he attributed the fact of his hip-bone escaping fracture.
