Address: 564 Emerald Street, Burlington Ontario.. Site: 720, 726 and 740 Spring Gardens Road The subject properties are located on the south side of Spring Gardens Road, south of Botanical Drive. The properties known as 720 and 726 Spring Gardens Road are currently being used together as a parking lot. This lot provides parking for an existing cemetery property (including a mausoleum, columbaria, crematorium and administrative offices) located at 740 Spring Gardens Road (adjacent to the parking lot See Sketch No. 1). In the spring of 2010, the City of Burlington received a request to approve a cemetery consent application for these properties. Specifically, the consent application requests the recognition of the existing parking lots as a formal part of the existing cemetery use at 740 Spring Gardens Road. Adding the parking lot to the overall cemetery use constitutes an expansion under the Cemeteries Act (Revised). No new development is proposed. Discussion: Staff Considerations The properties known as 720 and 726 Spring Gardens Road are currently zoned R3.1 (Residential) under the City s Comprehensive Zoning By-law 2020. This zoning designation permits a Cemetery Use as well as a Parking Lot Use. In 2002, a Committee of Adjustment Minor Variance was approved to permit parking for the cemetery use to be located at 720 and 726 Spring Gardens Road (File: 540- A231/2002). Under file 535-10/03, Site Plan Approval was granted to permit the expansion of the cemetery use at 740 Spring Gardens Road to include the parking lots at 720 and 726 Spring Gardens Road, in accordance with the variance approval. Staff supported these applications as they facilitated the orderly and co-ordinated development of these lands. Although the three properties have not been formally assembled, they are all owned by Bayview Cemetery and Crematorium and have functioned as one property since 2003. This cemetery expansion proposal serves only to recognize the existing cemetery use over these three subject properties. On this basis, the City of Burlington does not object to the issuance of cemetery consent for the parking lot properties as a formal addition to

Page 3 of Report the cemetery use at 740 Spring Gardens Road under the Cemeteries Act (Revised). The expansion is in keeping with all existing municipal approvals. Agency Comments: The City s Engineering and Zoning Sections circulated the subject application and their comments considered during the preparation of the subject report. Financial Matters: Environmental Matters: Communication Matters: In accordance with the requirements of the Cemeteries Act (Revised), an advertisement to the public was made in the August 12, 2010 edition of the Burlington Post newspaper. The advertisement detailed the proposal to add the existing parking lot to the cemetery use at 740 Spring Gardens Road. The public was requested to submit comments to the City of Burlington Planning staff by September 2, 2010. No public comments were received. A further Notice of Municipal Decision will be advertised to the public following Council s consideration of this matter. Conclusion: In accordance with the Cemeteries Act, staff recommend approval of an application to expand the existing cemetery use to include an existing parking lot currently located on two seperate properties.
