The existing dwelling will be demolished. The subject property is located east of Yonge Street and south of York Mills Road within the Hoggs Hollow Special Policy Area (SPA). All works will be sufficiently setback from the top of bank. The new dwelling will be flood proofed to TRCA engineering requirements. A letter has been submitted by a structural engineer which states that the proposed dwelling is able to withstand the flows and velocities in the event of a flood. A sediment control fence will be installed and maintained during construction to ensure that no debris enters into the adjacent watercourse. All excavated material will be removed off the site. There are no geo-technical issues associated with this project. There will be no impact on fisheries, significant natural features or riparian vegetation. Native and non-invasive species will be planted. The proposal is consistent with Section 4.2.1.(B), Development Guidelines for Development/Redevelopment within Designated Two Zone Areas or Special Policy Areas, of the Authority's Valley and Stream Corridor Management Program. All electrical and mechanical equipment will be situated above the Regional Storm Elevation. A letter will be submitted by a structural engineer which states that the structure will be able to withstand the flows and velocities in the event of a Regional Storm. Sediment controls are not necessary as the proposed works are in excess of 10 metres from the top of bank. There are no geo-technical issues associated with this project. There will be no impact on riparian vegetation, fisheries or significant natural features. are not required as part of this application. The proposal is not located within a Regional Storm Floodplain and therefore will not impact the storage or conveyance of flood waters. Sediment controls are not necessary as the proposed works are removed from significant natural features. There are no geo-technical issues associated with this project. There will be no impact on significant natural features, fisheries or riparian vegetation. Native and non-invasive species will be planted. The proposal is to excavate and place fill within a Fill Regulated Area of Rainbow Creek, a tributary of the Humber River, in order to facilitate the construction of a new two-storey single family residence on the subject property. The subject property is located on the south side of Woodbridge Avenue, east of Martingrove Road and west of Kipling Avenue, in the City of Vaughan. The subject site is approximately 0.04 ha (0.09 acres) in size. The subject property was originally part of Draft Approved Plan of Subdivision Application 19T-83067, where conditions of draft approval were issued by Authority staff in August 1996. Since that time, the subdivision application remained inactive and the approval had lapsed. It is noted that TRCA staff had identified and delineated the physical top of bank feature on the parcel of land, originally affected by the subdivision application in 1990. In August 2004, TRCA staff had been circulated a series of consent applications for the overall subject property (Consent Applications B037/04 to B041/04). At that time, the applicant proposed to sever a parcel of land which included the subject property, to create a total of seven (7) lots including an open space block (Block 5). The lot that is now the subject of this permit application is located adjacent to Open Space Block 5. TRCA staff had reviewed the subject applications and noted that the lands below top of bank, as identified in 1990, were rezoned in an appropriate open space category (under By-Law 1-88, as amended). Subsequently, conditional approval for the consent applications was provided with the stipulation that the applicant obtain a permit under Ontario Regulation 158 for Lots 6 and 7, for grade changes. The submission of this permit application now addresses the conditions provided by TRCA staff. It is noted that the permit application for Lot 6 ( 162/05/VAUG) was approved by the Executive Committee on May 4, 2005 and a permit was subsequently issued on May 11, 2005. The subject lot is located outside of the Regional Storm Flood Plain of Rainbow Creek and therefore, will not affect the storage or conveyance of flood waters. 276

Sediment and erosion control measures will be implemented for the proposed works on the subject site. Sediment fencing will be erected and maintained for the duration of construction. There are no geotechnical/slope stability issues associated with the proposed works. The adjacent valley lands (immediately to the west) were delineated by Authority staff in 1990 as part of Draft Plan of Subdivision Application 19T-83067. This area has since been rezoned in an open space designation to prevent the erection of any new structures on these lands. No tableland vegetation will be removed as part of this application. The applicant will conduct extensive plantings on the open space block which represents a net improvement given the current manicured state of the open space lands. There are no in-water works proposed as part of this application. Furthermore, no other significant natural resources will be affected by the proposed works. Extensive plantings of native, non-invasive species will be conducted on the open space block. These plantings will be carried out in accordance with TRCA's planting guidelines. The proposal is to place and excavate fill within a Fill Regulated Area, alter a watercourse and construct within the Regional Storm Flood Plain of the Lower East Branch of the East Don River, in order to facilitate the construction of a culvert crossing (Crossing B), which will contribute to the development of Planning Block 11, in the City of Vaughan. Planning Block 11 is bounded to the south by Rutherford Road, Bathurst Street to the east, Major Mackenzie Drive to the north and Dufferin Street to the west. The proposed bridge crossing is located on Street 1, north of Rutherford Road, west of Bathurst Street. The proposed works are in accordance with the approved Block 11 Master Environmental Servicing Plan (MESP) and are located within a draft approved plan of subdivision (Humbold Properties Ltd.) - 19T-95044. The proposed culvert is approximately 11 metres wide, crossing a tributary of the Don River. This permit application for servicing fulfills a condition of draft approval issued by TRCA staff. Authority staff has received and reviewed technical submissions relating to the proposed crossing and has provided comments. Schaeffers Consulting Engineers, agent for the applicant, is in the process of addressing outstanding TRCA concerns. At this time, Authority staff is satisfied that these issues can be resolved shortly, prior to the release of the permit. These issues in no way affect the location of the proposed crossing, which was determined at the MESP stage. The proposed works will occur within the Regional Storm Flood Plain of the Don River. Hydraulic analyses for the proposed crossing has been submitted by the applicant and reviewed by TRCA staff. It is noted that the proposed culvert crossing has been designed in such a manner that there will be no permanent modifications to the storage and conveyance of Regional Storm flood flows and furthermore, there will be no off-site impacts. Sediment and erosion control measures will be erected between the watercourse and the proposed works. Sediment fencing will remain in place until works are complete. Through Authority policy, it is recognized that crossings of valley corridors can be permitted to occur in order to serve new development. In this case, the proposed culvert crossing is required to service the development of Block 11, of which there is an approved MESP in place. The crossing has been located to minimize impacts to the valley corridor. Furthermore, a geomorphic assessment of this crossing was provided by the applicant and reviewed and approved by TRCA technical staff. This crossing adheres to the recommendations as outlined in the geomorphic assessment and meets the minimal sizing requirements for the crossings, as stipulated in the Authority's Valley and Stream Corridor Management Program. Further details will be submitted with respect to the Letter of Undertaking. 278

TRCA Planning Ecology staff has reviewed detailed plans relating to the proposed crossing and is satisfied that the works will not result in a Harmful Alteration, Disruption or Destruction (HADD) of fish habitat. The proposal is to place and excavate fill within a Fill Regulated Area, alter a watercourse and construct within the Regional Storm Flood Plain of the South Branch of the East Don River, in order to facilitate the construction of a culvert crossing (Crossing F), which will contribute to the development of Planning Block 11, in the City of Vaughan. Planning Block 11 is bounded to the south by Rutherford Road, Bathurst Street to the east, Major Mackenzie Drive to the north and Dufferin Street to the west. Authority staff has received and reviewed technical submissions relating to the proposed crossing and notes that the crossing is sufficiently sized from a fluvial geomorphic standpoint and facilitates the passage of terrestrial wildlife. The proposed works will be conducted in conjunction with other works in the area including the construction of Stormwater Management Pond 7 (associated permit application 042/05/VAUG) and the implementation of a natural channel design running from the aforementioned pond to Stormwater Ponds 5 & 6, located further south in the main valley corridor. It should be noted that at this time, technical staff at the TRCA is currently reviewing permit submissions for Ponds 5, 6 and 7 as well as the natural channel design. There remain outstanding issues relating to these associated permit submissions which the agent is working towards resolving. However, Authority staff do not believe that the outstanding issues for the related permits will adversely affect the location and details for Crossing F. The proposed works will occur within the Regional Storm Flood Plain of the Don River. Hydraulic analyses for the proposed crossing has been submitted by the applicant and reviewed by TRCA staff. It is noted that the proposed culvert crossing has been designed in such a manner that there will be no permanent modifications to the storage and conveyance of Regional Storm flood flows and furthermore, there will be no off-site impacts. With the proposed natural channel designs, flows will be conveyed from the northern portion of the subdivision (adjacent to the MacMillan nature reserve) towards Stormwater Pond 7 and eventually into the main valley corridor. It is not expected that the watercourse extensively given the intermittent and low flows for this natural channel corridor. TRCA Planning Ecology staff has reviewed detailed plans relating to the proposed crossing and given that there is no fish habitat associated with the watercourse, the proposed works will not be subject to Ministry of Natural Resources' fisheries timing windows. Although the flows from this area contribute to fish habitat downstream, Authority staff is satisfied that the works will not result in a Harmful Alteration, Disruption or Destruction (HADD) of fish habitat. As such, a Letter of Advice will be issued to the applicant, on behalf of Fisheries and Oceans Canada (DFO). There are no geotechnical/slope stability issues associated with the proposal. All area disturbed through the construction process will be restored and enhanced with native plantings. Furthermore, additional restorative plantings will be conducted in the area of the outfall for Stormwater Pond 7, which is located nearby. These plantings will be carried out in accordance with the TRCA s planting guidelines and the detailed plans submitted by the applicant. The valley portion where the works are proposed is in four areas along a portion of a tributary of the East Humber River, where it traverses the rear of this rural residential lot. The restoration will specifically entail removal of fill and grading to create natural 2:1 channel side slopes, installing river run stone in some areas for erosion protection, and planting the riparian zone of the watercourse with native trees and shrubs. The subject tributary drains a very small area and therefore, Water Management staff are satisfied that the restoration work will not affect the control of flooding. A sediment and erosion control plan will be in place and maintained for the duration of construction to prevent sedimentation of the watercourse. There are no geotechnical issues related to this project and no significant natural heritage features will be affected by the restoration plan. Staff will issue a Letter of Advice upon release of the permit on behalf of Fisheries and Oceans Canada; all work will take place within the Ministry of Natural Resources' timing window for cold water streams, July 1 and September 15; and the in-water work will take place "in the dry". The restoration site will be planted with several native trees and shrubs at quantities and densities satisfactory to staff. 283

To alter a waterway, construct in a flood plain (Culvert 18T at Station 14 +378 on Teston Road - 213m east of Jane Street), in the City of Vaughan, Don River Watershed as located on the property owned by Regional Municipality of York. The purpose is to construct a structure (remove existing 2000 Dia. x 19.64m L Corrugated Steel Pipe (CSP) and replace with 3.6m.W x 2.4m.H x 33.3m.L embedded Rigid Frame Concrete Box Culvert (RFCB), two oil grit separators, two storm outfalls, wingwalls, asphalt paving to widen to 5 lanes) within a Regional Storm Floodplain at Station 14+378; alter a watercourse (tributary of Don River West Branch) during the warmwater timing window (July 1 to March 31) temporarily, through a dam and pump around method in order to work in the dry, and permanently, in order to increase the length of the culvert from 19.64m to 33.3m. The subject property is not regulated for fill placement at this time. The permit will be issued for the period of June 3, 2005 to June 2, 2007 in accordance with the following documents and plans which form part of this permit: Letter of Undertaking (to provide revisions to hydraulic analysis, engineering and restoration drawings); dated November 21, 2003; received November 21, 2003; prepared by the Region of York. The entire proposal consists of the installation of the 1800mm diameter York Peel Feedermain from the intersection of Queen Street and Airport Road, northwards along Airport Road, eastwards along Castlemore Road, in Peel, then eastwards along Rutherford Road, northwards along Weston Road and eastwards on Teston Road to the Teston/Keele intersection in York. Along this route, there have been road and culvert upgrades proposed. Of the 19 permit applications in total for this York Peel Feedermain Project, these are the last 3 permits applications (34729, 34734, 34736) dealing with the road works to appear before the Executive Committee. All permit applications dealing with the Feedermain component have been previously issued. 284

This permit deals with the removal and replacement of Culvert 18T on Teston Road, east of Jane Street. The width of the culvert will increase by approximately 1.6m, the height by 0.4m and the length by 13.6m. As part of the York Peel Feedermain works, certain sections of the route including this Teston Road section have plans for road upgrades. The existing 2 lane road will be widened to 5 lanes, which requires the removal and lengthening of the existing culvert. As well, storm sewers, two outfalls and two oil grit separators will be installed. The proposed culvert location is within a Regional Storm Floodplain of the Don River West Branch. The site is not within a Fill Regulated Area. The Teston Road project was reviewed by TRCA staff during the Environmental Assessment (EA) process in file 31537, and the York Peel Feedermain EA Project was reviewed in file 33125. The Region of York has submitted a Letter of Undertaking to provide revisions to the hydraulic analysis and accompanying drawings. At the time of writing this report the hydraulic analysis was under review, however, staff does not anticipate any negative upstream flooding impacts since the proposed culvert will be larger than the existing. Fill placement will be minimized within the Regional Storm Floodplain with this infrastructure project and staff does not anticipate concerns with loss of storage or conveyance. Standard erosion control measures (silt fence, coffer dam, dewatering pump, conduit, filter bag) will be implemented to ensure that the construction-generated sediments do not enter the watercourse. Water quality will be addressed by the installation of the Oil Grit Separators. There will be in stream works associated with this project. The existing tributary of the Don River West Branch will be altered temporarily in order for the existing culvert to be removed and replaced in the dry. The watercourse will be altered permanently with the increase in length of 13.6 m from the existing to the proposed. This watercourse has direct fish habitat. The permanent enclosure and watercourse relocation within the new culvert constitutes a Harmful Alteration, Disruption or Destruction (HADD) of fish habitat and will require an authorization from Fisheries and Oceans Canada (DFO). The Region has submitted a Letter of Intent which identifies that the HADD will be compensated with riparian plantings. When the DFO authorization has been received, TRCA staff will be in a position to issue a Fill, Construction, Alteration to Waterways permit. All disturbed areas will be restored with native/non-invasive species following construction. 8.1.15 DUFFERIN CONSTRUCTION CO. To alter a waterway, construct in a flood plain (Culvert 20T at Station 15+089 on Teston Road - 837m east of Jane Street), in the City of Vaughan, Don River Watershed as located on the property owned by Regional Municipality of York. The purpose is to construct structures (remove existing 2.35m. W x 1.85m. H x 38.48m. L Corrugated Steel Pipe Arch (CSPA) replace with 6.0m.W x 1.8m.H x 48.67m.L embedded Rigid Frame Box Culvert (RFCB), oil grit separator, storm outfall, asphalt paving to widen to 5 lanes, wingwalls) within a Regional Storm Floodplain at Station 15+089; alter a watercourse (tributary of Don River West Branch) during the warmwater timing window (July 1 to March 31) temporarily, through a dam and pump around method in order to work in the dry, and permanently, in order to increase the length of the culvert from 38.48m to 48.67m. The subject property is not regulated for fill placement at this time. The permit will be issued for the period of June 3, 2005 to June 2, 2007 in accordance with the following documents and plans which form part of this permit: Letter of Undertaking (to provide revisions to hydraulic analysis, engineering and restoration drawings); dated November 21, 2003; received November 21, 2003; prepared by the Region of York. The entire proposal consists of the installation of the 1800mm diameter York Peel Feedermain from the intersection of Queen Street and Airport Road, northwards along Airport Road, eastwards along Castlemore Road, in Peel, then eastwards along Rutherford Road, northwards along Weston Road and eastwards on Teston Road to the Teston/Keele intersection in York. Along this route, there have been road and culvert upgrades. Of the 19 permit applications in total for this York Peel Feedermain Project, these are the last 3 permits applications (34729, 34734, 34736) dealing with the road works to appear before the Executive Committee. All permit applications dealing with the Feedermain component have been previously issued. This permit deals with the removal and replacement of Culvert 20T on Teston Road, east of Jane Street. The width of the culvert will increase by 4.65m, the height will decrease by 0.05m and the length will increase by 10.19m. As part of the York Peel Feedermain works, certain sections of the route including this Teston Road section, have plans for road upgrades. The existing 2 lane road will be widened to 5 lanes, which would require a lengthening of the existing culvert. As well, wingwalls, storm sewers, an outfall and an oil grit separator will be installed. The Teston Road project was reviewed by TRCA staff during the Environmental Assessment (EA) process in file 31537, and the York Peel Feedermain EA Project was reviewed in file 33125. 286
