Jack Heath Richard Whitehead THE EXECUTIVE COMMITTEE RECOMMENDS THAT WHEREAS Toronto and Region Conservation Authority (TRCA) is in receipt of a request from 1321362 Ontario Inc. to remove a conservation easement in favour of TRCA affecting land owned by 1321362 Ontario Inc. in the City of Vaughan; AND WHEREAS it is in the best interests of TRCA in furthering its objectives, as set out in Section 20 of the Conservation Authorities Act to cooperate with the 1321362 Ontario Inc. in this instance; THEREFORE LET IT BE RESOLVED THAT TRCA release the conservation easement affecting a parcel of valley and valley buffer lands containing 0.85 hectares (2.10 acres), more or less, said land being Part of Lot 29, Concession 9, City of Vaughan, Regional Municipality of York; THAT consideration for the removal of the conservation easement be a nominal sum of $2.00 plus legal, survey and other costs incurred by TRCA; THAT completion of the transaction be subject to the approval of the Minister of Natural Resources in accordance with Section 2(4.3) of the Conservation Land Act, R.S.O. 1990, Chapter C.28, as amended; AND FURTHER THAT authorized TRCA officials be directed to take the necessary action to finalize the transaction including obtaining needed approvals and signing and execution of documents. BACKGROUND 131362 Ontario Inc. has requested the removal of a conservation easement (ie. restrictive covenants registered as Instrument No. YR929579 and transfer easement registered as Instrument No. YR929652). The conservation easement was a requirement for a severance application approval at the time for then owner, Argot Developments Inc. There was an understanding that the conservation easement would be a temporary measure to protect the valleylands until a subdivision application was made and the development limits were established. The subject property plus additional lands were sold to 1321362 Ontario Inc. 1321362 Ontario Inc. applied to develop a residential subdivision on the property. Through review of the residential subdivision 19T-03V02, TRCA staff established the limits of the valley and valley buffer lands. TRCA acquired these lands from 1321362 Ontario Inc. on February 15, 2013. Attached is a plan showing the location of the subject lands. RATIONALE The limits valley and valley buffer lands have been established by registration of subdivision 19T-03V002 and these lands have been conveyed to TRCA. Therefore, it is appropriate to remove the current conservation easement as 1321362 Ontario Inc. has requested. Mike Mattos Ben Cachola THAT the appointment of Coreena Smith as an Officer under the Conservation Authorities Act, as per Section 28(1)(d)(e), and as a Provincial Offences Officer be approved for the purposes of Enforcing the Development, Interference with Wetlands and Alterations to Shorelines and Watercourses Regulation (Ontario Regulation 166/06) pursuant to Section 28 of the Conservation Authorities Act. CARRIED BACKGROUND The Conservation Authorities Act provides for a conservation authority to appoint officers to enforce its regulations. Furthermore, the Minister of Natural Resources has implemented, under the authority of Subsection 1(3) of the Provincial Offences Act R.S.O. 1990, a class designation process for all conservation authorities whereby any conservation authority officer appointed under Section 28 (1)(d)(e) of the Conservation Authorities Act shall be designated by the Minister simultaneously as a Provincial Offences Officer. The prerequisite to the Minister s Provincial Offences Officer appointment is that all candidate officers: i) be adequately trained in the legislation to be enforced, including the Provincial Offences Act; ii) iii) have proof of a clean criminal record check, and; be appointed as an officer to enforce conservation authority legislation at an official board meeting. Pursuant to the approval of the above-noted appointment, the Minister s requirements will have been addressed. RATIONALE Ms. Coreena Smith is a Planner II with TRCA s Planning and Development Division, and provides ongoing support to the Enforcement and Compliance Section. She has successfully completed the Basic Law Enforcement Conservation Authority Compliance Training (Level 1) through Conservation Ontario. Her appointment as an Enforcement Officer will enable her to authorize the issuance of approvals and will allow her to assist with the enforcement of the regulation. Mike Mattos Ben Cachola THAT the contract for the HVAC Retrofit, Duct Cleaning and Air Quality Testing for the heating system at 5 Shoreham Drive, be awarded to Modern Niagara HVAC Services Inc. at a cost not to exceed $49,890.00, plus a 10% contingency, plus HST; THAT the contract be on terms and conditions satisfactory to Toronto and Region Conservation Authority (TRCA) staff including performance by the contractor satisfactory to TRCA at its sole discretion; AND FURTHER THAT authorized TRCA officials be directed to take the action necessary to implement the contract including signing and execution of documents. CARRIED BACKGROUND During the past few months staff at TRCA expressed concerns regarding small particles being emitted from some of the heating diffusers located within the building located at 5 Shoreham Drive. Requests were made by staff to undertake the cleaning of the duct work. TRCA consulted with Modern Niagara, the service provider for the heating system at this location. Modern Niagara undertook an intense investigation of the duct system and reported back that the insulation in some of the diffuser boxes has deteriorated and is in need of replacement. The black particles being emitted from diffusers is in fact the insulation. In addition to the diffuser replacement, Modern Niagara recommended the following: that the duct system be cleaned, inspected and potentially sealed; that a thorough inspection of the entire system be undertaken to ensure maximum air distribution efficiency; that air quality testing be undertaken before the work begins and upon completion of all construction for comparative results. RATIONALE Modern Niagara has worked closely with TRCA over these last 10 years. In 2002, TRCA undertook the replacement of the heating/cooling system at 5 Shoreham Drive. At this time only the mechanical equipment was replaced and not the duct work and/or diffusers. Modern Niagara was the contractor who was awarded the contract to complete this work. Since the replacement of the heating/cooling system, Modern Niagara HVAC Services was retained as the HVAC service provider for this system. Modern Niagara has extensive knowledge of TRCA's HVAC system at 5 Shoreham Drive and demonstrated ability to produce high quality work, within tight timelines and the approved budget. Based on Modern Niagara's previous involvement; knowledge of the system, design of the building and local site conditions; and provision of quick and efficient service during these last 10 years, TRCA staff recommends that their services be retained. 143

Staff therefore recommends award of the contract on a sole source basis as per Section 1.14.5 of TRCA's Purchasing Policy as follows: The required goods and services are to be supplied by a particular vendor or supplier having special knowledge, skills, expertise or experience that cannot be provided by any other supplier. FINANCIAL DETAILS The upset limit for this project is $49,890, plus 10% contingency, plus HST. Funds are identified in TRCA's 2013 Major Facilities Retrofit budget 006-01. CARRIED BACKGROUND At Executive Committee Meeting #1/13, held on March 1, 2013, Resolution #B13/13 was approved as follows THAT TRCA write letters approved by the Executive Committee to the City of Toronto outlining its concerns regarding 220 Greyabbey Trail and to the provincial government about the inability to secure public objectives during the approval process and attach these letters to the Greyabbey file. Subsequently, at Authority Meeting #3/13, held on April 26,2013, there was further discussion about the Scarborough Waterfront Trail and the following resolution was approved, in part,: 144

...AND FURTHER THAT the Authority request the City of Toronto to increase the TRCA annual capital budget contribution, beginning in 2014, by $6 million dedicated to funding projects including the Scarborough Waterfront Trail, erosion control works, and land acquisition for source water protection. Attachment 1 May 10,2013 Mr. Joe Pennachetti City Manager City of Toronto Toronto City Hall, 11th Floor, East Tower 100 Queen Street West Toronto, ON M5H 2N2 Dear Mr. Pennachetti: Toronto and Region Conservation Authority (TRCA) is writing at the request of our Authority board, to raise a recent concern about the lack of adequate funding for projects where the rehabilitation of urgent hazards on the waterfront and valley corridors is a major public priority, and where specific land acquisition opportunities in addressing source water protection need to be reinstated. TRCA is increasingly having difficulty addressing appropriate protection of the provincial and municipal interest in these areas of urban watershed resource management under current funding constraints. At Authority Meeting #3/13, held on April 26, 2013, the Resolution #A63/13 was approved as follows THAT the Authority request the City of Toronto to increase the TRCA annual capital budget contribution, beginning in 2014, by $6 million dedicated to funding projects including the Scarborough Waterfront Trail, erosion control works, and land acquisition for source water protection. This issue has recently come to the forefront of the Authority s deliberations as we have been challenged to provide a recent permit for the implementation of shoreline stabilization works along a 160 metre portion of private Lake Ontario waterfront at 220 Greyabbey Trail in Scarborough. The landowners are anxious to protect their landholdings on the Scarborough Bluffs from active erosion risk, however, after an extensive negotiation, TRCA was unable to secure the funds to construct the works as an extension of our current public shoreline projects. Nor were we able to leverage a public easement through the private proposal. In the absence of any regulatory tools to condition a public easement along the shoreline, TRCA staff and Board members reluctantly approved a construction permit to allow the private protection works on March 13, 2013. If this work is completed in the near future, the only avenues that the City and TRCA will have in the future to secure public access and ownership along this sector of the shoreline will be through acquisition, conditions of redevelopment of the property or expropriation. Unfortunately, a critical public opportunity has been lost. 146

All current TRCA capital funding for shoreline hazard works is being allocated to community priorities at the Guild Inn and Meadowcliffe Drive Environmental Assessment sites. No additional funding exists for conducting an Environmental Assessment project to complete the final shoreline management vision, for negotiation of purchase of key properties or construction of shoreline works. A funding source needs to be established that does not allow these opportunities for securing public access on the shoreline to slip away. An appropriate Environmental Assessment project needs to be funded which captures the strategy for completing the final shoreline protection works and the trail/access road provisions as a future linkage between Bluffers Park and East Point Park. Attached is the April 12, 2013 report to the TRCA Executive Committee entitled Scarborough Waterfront Access Plan, City of Toronto, which outlines the vision for the Scarborough Waterfront and the requirements for acquiring funding to conduct an Individual Environmental Assessment. We suggest that this request for funding be incorporated into our 2014 discussions on capital funding for risk assessments and hazard remediation along the shoreline. The City of Toronto has been supportive in the past in providing funding for the acquisition of key properties related to source water protection, as well. We need to continue to secure these funds as contributions to the regional landscape, and those for urgent hazard rehabilitation and shoreline protection works across the City of Toronto. The TRCA has identified to the City of Toronto during previous budget cycles the critical unfunded needs in erosion and flood control works. Some additional funding has been discussed with Toronto Water to commence in 2015. This requests seeks to advance additional funding commencing in 2014 or if at all possible, at least sufficient funds in 2013 to commence the environmental assessments. Attachment 2 May 10, 2013 The Honourable David Orazietti Minister of Natural Resources Suite 6522, 6th Floor, Whitney Block 99 Wellesley Street West Toronto, ON M7A 1W3 Dear Minister Orazietti: Toronto and Region Conservation Authority (TRCA) is writing at the request of our Authority board, to raise a recent concern about the lack of adequate funding for projects where the rehabilitation of urgent erosion hazards on the waterfront is a major public priority. TRCA is increasingly having difficulty addressing appropriate protection of the provincial interests in these areas of urban watershed resource management under current funding constraints. At Executive Committee Meeting #1/13, held on March 1, 2013, Resolution #B13/13 was approved as follows THAT TRCA write letters approved by the Executive Committee to the City of Toronto outlining its concerns regarding 220 Greyabbey Trail and to the provincial government about the inability to secure public objectives during the approval process and attach these letters to the Greyabbey file. This issue has recently come to the forefront of the Authority s deliberations as we have been challenged to provide a permit for the implementation of shoreline stabilization works along a 160 metre portion of private Lake Ontario waterfront at 220 Greyabbey Trail in Scarborough. The landowners are anxious to protect their landholdings on the Scarborough Bluffs from active erosion risk, however, after an extensive negotiation, TRCA was unable to secure the funds to construct the works as an extension of our current public shoreline projects. Nor were we able to leverage a public easement through the private proposal. In the absence of any regulatory tools to condition a public easement along the shoreline, TRCA staff and Board members reluctantly approved a construction permit to allow the private protection works on March 13, 2013. If this work is completed in the near future, the only avenues that the City and TRCA will have in the future to secure public access and ownership along this sector of the shoreline will be through acquisition, as conditions of redevelopment or expropriation. Unfortunately, a critical public opportunity has been lost. 148

All current TRCA capital funding for shoreline hazard works is being provided by the City of Toronto. Historically, the Province of Ontario did provide a capital contribution to conservation authorities for works of this type. All available funding is allocated to community priorities at the Guild Inn and Meadowcliffe Drive Environmental Assessment sites. No additional funding exists for conducting an Environmental Assessment project to complete the final shoreline management vision for Scarborough, for negotiation of purchase of key properties or construction of shoreline works. A funding source needs to be established that does not allow these opportunities for securing public access on the shoreline to slip away. An appropriate Environmental Assessment project needs to be funded which captures the strategy for completing the final shoreline protection works and the trail/access road provisions as a future linkage between Bluffers Park and East Point Park. We need to continue to secure these funds through municipal and provincial sources, for urgent hazard rehabilitation, shoreline protection works and land acquisition with a view to the importance of these regional issues. We request that consideration be given to re-establishing a funding program similar to past provincial support for natural hazard management and land acquisition to address urgent matters of public objective within TRCA s jurisdiction.
