THE MAIN DIFFERENCES BETWEEN THE RULEBOOK AND DIRECTIVE MANUFACTURER TECHNICAL DOCUMENTATION DECLARATION OF CONFORMITY CONFIRMATION OF CONFORMITY CONFIRMATION OF CONFORMITY Confirmation of Conformity is a document certifying the compliance of the product in subject with the requirements of the Rulebook. Who issues Confirmation of conformity? Designated body on the basis of the request of different economic operators and enclosed documentation, which is: - declaration of conformity and - appropriate technical documentation reviews the technical documentation and if the conformity of the electrical equipment is confirmed, issues the Confirmation of conformity. It accompanying the product during placing on the market of the Republic of Serbia Shall be applied in the legal system of the R.of Serbia until entry into force of ACAA, and not later than the accession of RoS to the EU. SERBIAN CONFORMITY MARKING Serbian marking is the only label certifying that the product being placed on the market and/or put into use in the Republic of Serbia, is in compliance with the requirements of Serbian technical regulation, if such regulation provides its affixing. The conformity marking shall affix: - manufacturer, or - his authorised representative, or - importer (if the manufacturer or his representative is not registered in the Republic of Serbia) Shall be applied in the legal system of the RoS until entry into force of ACAA, and not later than the accession of Serbia to the EU.

CONFIRMATION OF CONFORMITY- EXAMPLE

QUALITY INFRASTRUCTURE I. STANDARDISATION Harmonized standards in the field of el. equipment are transposed and adopted as Serbian standards by the Institute for Standardization of Serbia (ISS). Presumption of conformity on the basis of Serbian standards in the field of electrical equipment which transposed appropriate harmonized standards. The Rulebook is accompanied with a list of Serbian standards in the field of electrical equipment (published on Jun 5 th 2014 in the Official Gazette of RS No 59/14). The list of Serbian standards in the field of LVD - 745 standards (the list of harmonized standards in the field of LVD published on November 28 th 2013 in the Official Journal of the EU - 764 standards). Number of standards that are not adopted : 19 thereof: 6- will not be adopted (old edition) 13- will be adopted in 2014

QUALITY INFRASTRUCTURE II. DESIGNATED BODY Two conformity assessment bodies that have been designated for conformity assessment of products in accordance with the Rulebook. QUALITY INFRASTRUCTURE III. ACCREDITATION I. Designated body Designated body proved the qualification for conformity assessment accreditation certificate. Designated bodies under the Rulebook, have been accreditting as: the certification body operating certification of products (SRPS EN 45011) the testing laboratory (SRPS ISO/IEC 17025) II. QUALITY INFRASTRUCTURE IV. MARKET SURVEILLANCE Responsible authority in charge of market surveillance for LVD : Ministry of Trade, Tourism and Telecommunication Sector for market inspection Administrative capacity: The total number of employees in the Sector for market Inspection - 464. In charge of inspection supervision in the field of compliance and safety of non food products (electrical equipment, machinery, etc..) - 100 Legal basis for the implementation of market surveillance: Law on Market Surveillance (Official Gazette of RS, No. 92/11) and Law on Technical Requirements for Products and Conformity Assessment

QUALITY INFRASTRUCTURE IV. MARKET SURVEILLANCE Methods of enforcement Market surveillance is carried out during or after placing electrical products on the Serbian market and/or into their intended use. The activities of market surveillance authorities are divided in the two types of activities: 1. PROACTIVE - based on financial and human resources, taking in to consideration the results from previous years, state of play on the market, the new risk recognized, risk assessment etc. (Market surveillance of electrical equipment is largely carried out in a proactive manner) and 2. REACTIVE - is mostly initiated in response to complaints made by consumers and other users or to RAPEX notifications, NEPRO) The primary form of surveillance is visual inspection. Compliance with administrative requirements (Documentary check) is also checked. If there are grounds for suspicion, further laboratory readings (Laboratory testing on the base of an appropriate sample) are taken.

QUALITY INFRASTRUCTURE IV. MARKET SURVEILLANCE THE POWERS OF THE AUTHORITY The measures taken by the market inspectors, during the period of 2012: I. been passed the 91 decisions of: II. elimination of established non-conformity products sales bans of non-conformity or products temporary sales bans of products without the adequate documentation filed the 70 minor offences against the offenders III. was ordered to the withdrawal or recalling of products that are not in conformity with the prescribed requirements IV. instruct destroying of 16,068 non-conforming products if they present a serious risk to the safety, life and health of humans, animals and plants, as well as the environment protection, in the amount of 835,609.00 RSD (Importer conducted the recycling)

QUALITY INFRASTRUCTURE V. ECONOMIC OPERATORS The industry sector, upon which the implementation of the LVD/Rulebook has an impact is the Sector for METAL and ELECTRO INDUSTRY. This sector shows the trade deficit in the period 2008 2010 with a tendency to fall down. The import records a drop, while the export fluctuate because of the global crisis. A certain subsectors records a constant growth in the export value such are electric household devices.

IMPLEMENTED ACTIVITIES IN THE PERIOD 2010-2014 Implemented activities in the period 2010-2014 Upgrade the Quality Infrastructure in all fields important for the implementation of Rulebook. Handbook for implementation of Rulebook published. Several cycles of seminars, conferences were organized, in cooperation with the chambers of commerce, ISS, ATS, for the industry and other economic operators. Several cycles of training were organized for the inspectors, CABs. Training of Trainers programme for market inspectors and training courses for inspectors on the EU s New Approach Directive as well as supplying standards, information materials, guidelines and checklists for inspectors to help with the implementation of selected new technical regulations.
