CALL TO ORDER The meeting was called to order at 4:06 P.M. II BOISE RIVER RANCH BOISE SYSTEM ORDINANCE PERMIT ACTIONS/PRESENTATIONS Cheyne Weston, Boise Parks & Recreation Department Planner/Designer, presented the project to the Parks & Recreation Commissioners. This project first came before the Parks & Recreation Commissioners in 2008 under the name of Villa Verona. At that point they were asking for approval for 10 lots while the current project is calling for seven (7) lots. All of the lots are placed on the west side of the project, which was one of the conditions for approval. Lots 5, 6, and 7 they have asked for 100 back from the set back and the other lots they have asked for 150. All houses and drive ways will be situated away from the perch trees. Staff received a letter from US Fish & Wildlife expressing a concern about the perch trees. They talked about the nests of bald eagles. There are no nests in those trees. We do want to mitigate human activity as much as possible and not to have manicured lawns in the set back area. Ms. Suggs, Mr. Moser and Mr. Weston went on site to measure to be sure it met the 200 setback. Commissioner Uranga noted the 200 setback is from the 6500 cfs. What we are doing is waiving the setback for just a portion of the proposed subdivision. Page 2 by the Parks & Recreation Commission. Mr. Uranga stated that two lots are in Ada County. They went to Ada County and tried to do this and our P&Z told them to deny, seek annexation then apply. Doug Stickling, Boise City Legal, noted that this will have to go through P&Z but the Parks & Recreation Commission has to approve prior to it going before P&Z. President Madigan noted that Mr. Hoyle plans to set aside nonbuildable land as a conservation easement. Commissioner Spurling noted that in the letter from Idaho Fish & Wildlife they talk a lot about making provisions for the homeowners. They talk about how the houses will be allowed but she didn t see anything about manicured lawns. Mr. Weston believes that is one of the conditions of approval. Commissioner Spurling questioned how the group is planning on dealing with things that homeowners do, such as leaf blowers, dogs off leash in the yard making noise, etc. from December 15 March 15. Mr. Weston stated there will be no construction between those dates. Commissioner Spurling asked if anything further needs to be stated in the conditions. Mr. Weston declared you could if you want to. Director Hall stated he didn t that BRSO s in the past have not had any conditions in the December March about dogs in the back yards. Nor the use of leaf blowers. The key is keeping the manicured lawn away from the perch trees. MOTION A motion was made by Commissioner Chandler THAT THE PARKS & RECREATION COMMISSION APPROVE THE BOISE RIVER RANCH REQUEST FOR A BOISE RIVER SYSTEM PERMIT WITH THE FOLLOWING CONDITIONS: 1. THE 70 GREENBELT SETBACK AREA SHALL BE INCREASED TO 200 IN SELECT LOCATIONS FOR THE PROTECTION OF BALD EAGLE PERCH

Page 3 TREES. WITH THE EXCEPTION OF THE ACCESS ROAD, RESIDENTIAL DEVELOPMENT SHOULD NOT BE LOCATED WITHIN 200 OF THE KNOWN/IDENTIFIED EAGLE PERCH TREES. FOR THE PURPOSES OF THIS RECOMMENDATION DEVELOPMENT INCLUDES STRUCTURES, DRIVEWAYS, AND MANICURED LANDSCAPING. THE RECOMMENDED GREENBELT SETBACK LINE SHALL BE SHOWN ON THE APPLICANT S PRELIMINARY PLAT, LANDSCAPE PLAN AND FINAL PLAT. 2. THE 200 WINTERING BALD EAGLE SET BACK PROVIDES PROTECTION FOR THE EXISTING PERCH TREES. THE RECOMMENDED SETBACK LINE SHALL BE SHOWN ON THE APPLICANT S PRELIMINARY PLAT, LANDSCAPE PLAN AND FINAL PLAT. 3. THE BUILDING ENVELOPES FOR THOSE LOTS LABELED 1 4 SHALL MAINTAIN A MINIMUM 150 SETBACK FROM THE 6500 CFS LINE. THE BUILDING ENVELOPE ON LOTS 5 7 SHALL MAINTAIN A MINIMUM 120 SETBACK. THE REMAINING COMMON LOT SHALL BE LANDSCAPED BY THE DEVELOPER AS DEPICTED ON THE LANDSCAPE PLAN AND CONSISTENT WITH THE PROTECTION AREA FOR WINTERING BALD EAGLES. THE EXISTING LANDSCAPE PLAN SHALL BE AMENDED TO SHOW THE ADDITIONAL BALD EAGLE HABITAT LANDSCAPING ON THE COMMON LOT (LOT 8) CONTINUE EASTWARD ANOTHER 100 ON THE NORTH OF BOISE RIVER LANE. THIS WILL SERVE TO FURTHER ENHANCE THE PROTECTION OF WINTERING BALD EAGLE HABITAT. 4. OUTDOOR CONSTRUCTION ACTIVITY SHALL BE PROHIBITED FROM DECEMBER 15 THROUGH MARCH 15 EACH YEAR TO ENHANCE THE PROTECTION OF WINTERING BALD EAGLES. IN ADDITION, NO DOGS, CATS OR OTHER DOMESTIC PETS ARE ALLOWED OFF LEASH DURING THE DESIGNATED WINTERING BALD EAGLE SEASON. CONSTRUCTION MAY BE ALLOWED TO OCCUR IF NO BIRDS ARE CITED AFTER FEBRUARY 15. HOWEVER, IF EAGLES

Page 4 PERSIST AT THIS LOCATION PAST THIS DATE, THE PLANNING & DEVELOPMENT SERVICES SHALL EXTEND THE CLOSURE DATE. 5. EXISTING VEGETATION WITHIN THE 70 GREENBELT SETBACK AND WINTERING BALD EAGLE SETBACK SHALL BE PROTECTED USING TEMPORARY WIRE CONSTRUCTION FENCING ATTACHED TO STANDARD ORANGE CONSTRUCTION FENCING AT THE TOP OF THE RIVER SLOPE. FENCING SHALL BE MAINTAINED THROUGHOUT CONSTRUCTION OF THE SUBDIVISION AND COMPLETION OF INDIVIDUAL HOME SITES. 6. A 20 IRRIGATED LANDSCAPE SCREEN/BUFFER ZONE SHALL BE DESIGNED, CONSTRUCTED AND MAINTAINED WITHIN THE WINTERING BALD EAGLE SETBACK AREA. a. THE LANDSCAPE PLAN SHALL BE DESIGNED BY A LANDSCAPE ARCHITECT. b. A VARIETY OF TREES AND SHRUBS WILL BE INCLUDED IN THE PLAN TO MEET BSRO SCREENING REQUIREMENTS. c. THE LANDSCAPE PLAN SHALL BE SUBMITTED FOR REVIEW TO IDF&G AND BE APPROVED BY PARKS DEPARTMENT AND PDS STAFF IN CONJUNCTION WITH THE SUBDIVISION S FINAL PLAT. IF THE PROJECT IS TO BE FINAL PLATTED PRIOR TO CONSTRUCTION, A PERFORMANCE BOND SHALL BE ESTABLISHED AND HELD UNTIL DEVELOPMENT OF ALL RESIDENTIAL LOTS HAS BEEN COMPLETED. d. ALL LANDSCAPE BUFFER IMPROVEMENTS SHALL BE MAINTAINED IN GOOD CONDITION BY THE HOA. 7. INDIVIDUAL RESIDENCES SHALL BE DESIGNED AND CONSTRUCTED SO THAT GARAGE DOORS AND PATIO SPACES ARE ORIENTED IN A MANNER THAT IS NOT IN THE DIRECT LINE OF SIGHT OF ANY PERCH TREES IDENTIFIED BY

THE FINAL PLAT SHALL SHOW BUILDING ENVELOPES ON ALL DEVELOPABLE PARCELS TO PROTECT AGAINST ENCROACHMENTS INTO THE APPROVED GREENBELT SETBACK, seconded by Commissioner Neef. Motion approved by all members present. OTHER BUSINESS Some letters have come in to Director Hall and Jamie Heinzerling, Admin. Asst. regarding the dog off leash pilot program. Staff and some of the Commissioners did discuss perhaps a letter coming from the Commission that we will stand our ground with the pilot program. Commission President Madigan believes the Commissioners and staff have worked very hard to accommodate citizens. Meeting adjourned at 4:45 P.M. Respectfully submitted, Margaret C. Lancaster CPS/CAP Commissioner Chandler suggested that a letter come from the President of the Commission and that it include that this is a pilot and the pilot program can be pulled at any time. Director Hall suggested to be sure we don t leave any one out, send to the entire Commission. Commissioner McGown noted the Boise River is to be a 6500 cfs tomorrow or Friday. The river could stay at that level or go higher. Staff noted Marianne Williams Park is already under water. It is doing exactly what it is supposed to do On May 17 th Larry and Marianne Williams will be the honorees at the Saint Alphonsus Distinguished Citizen Dinner. /mcl
