RECOMMENDATIONS Planning Department: Approval for the following reasons: The proposed pool equipment, mechanical equipment, and pergola will be screened by a seven foot tall wooden fence along both the southern and eastern sides of the property, helping to mitigate their intrusion into the required side yard setbacks. The generator will be screened by an existing seven foot tall garden wall on the northern side of the property, which abuts Avenue E (Figure 3). The principal structure provides two 10-foot side yard setbacks, therefore satisfying the R-1C Rural Residential district side-yard setback requirement (Figure ). Old Metairie Commission: OMC will consider this request at its June 7, 018 Public Hearing SUMMARY OF OMC PUBLIC HEARING FINDINGS 1. The petitioned property is an undeveloped corner lot, measuring 7 feet in width, 10 feet in depth, totaling 9,000 square feet and is zoned R-1C Rural Residential district. The R-1C district requires a minimum width of 80 ft., minimum depth of 10 ft., and an area of 1,000 sq. ft.; the lot is deficient by five ft. in width, 30 ft. in depth and 3,000 sq. ft., respectively (Figure 4).. The applicant is proposing to construct a new 4,17 square foot two-story, singlefamily dwelling with a swimming pool and a 146 sq. ft. accessory pergola (Figure ). 3. Per Sec. 40-19(a)(3), the R-1C Rural Residential district requires two ten-foot sideyards. Although the principal structure provides these required side-yards, the OMC Planning Department EDC Page 1 of 4 6/7/018 Jefferson Parish, Louisiana

proposed pool equipment, mechanical equipment, and generator are within the minimum ten-foot side-yard setbacks on either side of the proposed dwelling (Figures 6 and 7). a. The proposed pool equipment and mechanical equipment each provide a six-foot side-yard setback, necessitating a variance to the side-yard requirements of 4 feet. b. The proposed generator provides a one-foot-six-inch side-yard setback, necessitating a variance to the side-yard requirements of eight-feet-sixinches. c. Per Sec. 40-19(c)(1), the side-yard setback for accessory structures less than 1,000 square feet in area shall be no less than 0% of the width of the required side yard, which necessitates a five-foot side-yard setback for the accessory pergola in the R-1C district. The proposed pergola provides a three-foot-four-inch side-yard setback, necessitating a variance to the side-yard setback requirements of 1-foot-eight inches. d. Because the proposed pool equipment, mechanical equipment, generator and pergola are all within the required side-yard setbacks, a variance to the area requirements must be considered by the Board of Zoning Adjustments. 4. Per Sec. 40-17(3)(iii), no part of a proposed structure or addition to an existing structure, except for minor or incidental projections, shall penetrate the lot s façade or side-yard massing angles, unless the gable walls penetrate at a point in which the roof has a slope between 7:1 and 1:1. The proposed structure s gable walls penetrate the lot s side yard massing angle at a slope of 7:1 and are therefore permissible (Figure 8).. Per Sec. 40-17()(D), chimneys shall be no taller than the minimum required by the applicable building codes for the termination of chimneys. Section R1003.9 of the 01 International Residential Code states that chimneys shall extend not less than two feet higher than any portion of a building within 10 feet, but shall be not less than three feet above the highest point where the chimney passes through the roof. Both proposed chimneys are in accordance with IRC R1003.9 (Figure 8). 6. The maximum height for the R-1C Rural Residential district is 3 feet. Per Sec. 40-17(1)(b) the maximum height allowance within the Old Metairie Neighborhood Conservation district shall be equal to the difference between the flood elevation measurement of 3.9 feet and 1.6 feet above the crown of the street. The proposed dwelling utilizes a 6. inch height allowance, which is below the available height allowance of.3 feet (Figure 8, 9, 10, 11). 7. The Parish Arborist approved the tree protection plan for the Bald Cyprus in the front yard (Figure 1). 8. The proposed residence, swimming pool, and accessory pergola otherwise meets all applicable R-1C/OMNCD requirements (Table ). CONSISTENCY WITH COMPREHENSIVE PLAN The proposal is consistent with Objective 1.4 of the Housing Element of the Comprehensive Plan which aims to Ensure the compatibility of in-fill development in residential neighborhoods. Engineering-Site Plan Not Opposed NOT OPPOSED to this Case but has the following Stipulations: The property owner is responsible for any damage to right of way improvements (including the existing sidewalks or driveways) during or after the construction of any new structure(s) or demolition of any existing structure(s). Any damage must be repaired, or improvements replaced in accordance to the Jefferson Parish Engineering standards. Please contact the department of Engineering at (04) 349-173 prior to beginning any sidewalk/driveway apron construction. Further comments will be made at the permit stage.
