CITY OF SURREY BY-LAW NO. 2076 A By-law to exempt certain defined classes of shops in the City from the Shop Closing Provisions of the "Municipal Act".................................................... As amended by By-law No. 12268; 04/25/94 THIS IS A CONSOLIDATED BY-LAW PREPARED BY THE CITY OF SURREY FOR CONVENIENCE ONLY. THE CITY DOES NOT WARRANT THAT THE INFORMATION CONTAINED IN THIS CONSOLIDATION IS CURRENT. IT IS THE RESPONSIBILITY OF THE PERSON USING THIS CONSOLIDATION TO ENSURE THAT IT ACCURATELY REFLECTS CURRENT BY-LAW PROVISIONS. THE CITY COUNCIL of the City of Surrey, in open meeting assembled, ENACTS AS FOLLOWS: l. For the local convenience and well-being of the residents of the City, the classes of shops as set forth and defined in Schedule "A", which is hereunto annexed and made a part of this by-law, are hereby completely exempted from the provisions of Section 858 and 859 of the "Municipal Act", being Chapter 255, of the Revised Statutes of British Columbia, 1960. 2. Where the term "shop" is used in this By-law or the Schedule hereto it shall have the meaning assigned to it by Section 857(1) of the "Municipal Act", being Chapter 255, of the Revised Statutes of British Columbia, 1960. 3. "Surrey Shops Regulation & Exemption By-law 1963, No. 2045", and "Surrey Shops Regulation & Exemption By-law, 1963, No. 2045, Amendment By-law, 1963, No. 2062", and "Surrey Shops Regulation & Exemption By-law, 1963, No. 2045, Amendment By-law, 1963, No. 2063", are hereby repealed. 4. This By-law may be cited for all purposes as the "Surrey Shops Exemption By-law, 1963, No. 2076".

SCHEDULE "A" Class 1. Automobile Dealers - new new automobiles. 2. Automobile Dealers - used used automobiles. 3. Automobile Supply Stores equipment or supplies for automobiles. 4. Battery and Tire Shops automobile tires and batteries or either of them. 5. Bicycle Shops bicycles and parts therefor or the renting of bicycles. - 3 -
6. Book Stores books and magazines or either of them. 7. Builders' Supply Houses builders' supplies including lumber, hardware, bricks, cement, sand, gravel and miscellaneous items to be used in the construction, repair or alteration of buildings and associated structures. 8. Butcher Shops meats and poultry whether cooked or uncooked. 9. Children's Stores clothing or furnishings for children. 10. Clothing Stores clothing. 11. Delicatessen Stores prepared foods, including cooked meats, preserves, pickles, relishes and salads. - 4 -

Department Stores Shop where any five (5) or more of the following lines or classes of goods are offered for sale by retail; that is to say, Automobile supplies and accessories; Builders' supplies; Clothing, furnishings (men's and boys'); Confectionery; Fruit or vegetable dealer; Dry goods, ladies' clothing, fancy goods; Millinery; Druggist; Electrical Supplies; Restaurant, cafe, public dining room or eating house; Dairy, retail; Photographer or dealer in photographic supplies; Hardware; Paint; Books; Plumbing Supplies; Heating Supplies; Musical Instruments; Sheet Music; Bakery Goods; Furniture; Baby's wear; Carpets; Chinaware; Cosmetics; Hats; - 5 -
Jewelry; Garden Supplies; Leather Goods; Shoes; Sporting Goods; Toys; 13. Drug Stores Shop where a licensed pharmaceutical chemist is in attendance at all times when such shop is open for the serving of customers and where the principal or only trade or business carried on is the sale by retail of drugs, proprietary or patent medicines and surgical and first-aid supplies, whether or not other items of merchandise are sold in the shop in addition thereto. The terms "drugs", "proprietary or patent medicines" and "licensed pharmaceutical chemist" shall bear the respective interpretations assigned to them by the "Pharmacy Act", being Chapter 282, Revised Statutes of British Columbia, 1960, as amended. 14. Dry Goods Stores staples and fancy dry goods or either of them. 15. Electrical Appliance Stores electrical appliances and electrical fixtures, or either of them. 16. Farm Implements implements or machinery to be used for agricultural purposes. - 6 -
17. Feed Stores feed, including hay, straw, grain, flour and fertilizer. 18. Fish Stores fresh fish, cooked fish, cured fish or other sea foods. 19. Fuel Dealers fuels for domestic use. 20. Furniture Stores new or used home furnishings, including furniture, carpets, carpeting and electrical appliances. 21. Furriers furs or items manufactured from furs. 22. Grocery Stores food for human consumption, to be taken out of the shop, whether or not other items of merchandise are sold therein, in addition to such food. - 7 -

Hairdressers' Shops Shop where the principal or only trade or business carried on is that of a hairdresser as defined in the "Hairdressers Act", Revised Statutes of British Columbia, 1960, Chapter 169. 24. Hardware Stores hardware, including garden implements, electrical supplies, glass, crockery and stoves. 25. Implement Stores implements, including tools, power saws and parts, and air compressors and equipment. 26. Jewellery Stores jewellery, including watches and clocks. 27. Marine Sales Stores marine supplies, including boats, marine engines and ship chandlery. 28. Millinery Stores hats for women or girls. - 8 -
29. Motor Cycle Stores motorcycles, including parts and equipment therefor. 30. Music Stores radios, phonographs, tape recorders, records, musical instruments and sheet music, or any one or more of them. 31. Office Supply Stores office supplies including office machines, office furniture and office stationery and supplies. 32. Paint Stores decorating materials, including paint, varnish, paint solvents, tile, wall paper, and plastic decorating materials. 33. Pet Stores animals or birds for domestic pets. 34. 35. Second Hand Stores second hand or used goods. 36. Sewing Machine Stores sewing machines, including parts and supplies therefor. 37. Shoe Repair Shops Shop where the principal trade or business is the repairing or dyeing of shoes. 38. Shoe Stores shoes or footwear. 39. Blankets and Wool Products Chinaware 40. Sporting Goods Stores goods and equipment for engaging in sports and recreational activities and including firearms and ammunition and bicycles. 41. Stationery Stores stationery for office or home. 42. Stove Dealers stoves, including furnaces or heaters and equipment therefor. 43. Toy Stores toys and games, or either of them. 44. Hobby Shop materials and supplies for or in connection with the carrying on by any person of a hobby or similar recreational pastime. - 11 -
