The Site encompasses the majority of Parcel B of the Land at Kettering South site as identified within Policy 37 of the adopted North Northamptonshire Joint Core Strategy (JCS). The Site benefits from an adopted allocation for logistics uses and on behalf of the applicant, PBA is submitting a planning application to respond to this allocation. An original outline application (Reference Number: KET/2016/0606) was submitted to Kettering Borough Council on 26 th August 2016. During the determination period of that application, we were unable to agree a further extension of time to satisfactorily resolve the outstanding highways matters identified with the application and the application was therefore withdrawn on 29 th June 2017. However, we are making good progress with the Highway Authorities and in the absence of any fundamental objection from them to the proposals, given that it is an allocated site in the adopted North Northamptonshire Joint Core Strategy, we are focusing on how the site comes forward and delivers the appropriate mitigation. As discussed with you at the meeting of 11 th July, on behalf of the applicant, PBA is now submitting a new planning application which has the same description and is in substantively the same form as the original application. As set out above, work is ongoing in respect of resolving the outstanding highways matters such that we can reach a position of acceptability in planning terms on this application, and ensure the timely delivery of sustainable economic growth and jobs from this allocated site. We understand that the only other outstanding issue with the original application was in respect of off-site connectivity. Further information in respect of this matter is detailed within the Planning Statement Addendum, which is submitted as part of this new application (see details below). In terms of consultation, we would suggest that the fact that this new planning application is substantively the same as application reference KET/2016/0606 is drawn to the attention of Statutory Consultees, as in the majority of instances we anticipate that they will be able to rely on their previous responses and advice to the proposals offered in respect of the original application. The proposed development comprises the comprehensive development of the majority of Parcel B of the Land at Kettering South and the creation of employment floorspace. The new outline planning application is being submitted with all matters reserved other than the point of access to the Site from the A509, as previously. The full description of development remains as follows: Up to 214,606 sqm gross external area (2,310,000 sqft) of buildings for class B8 Warehousing and Distribution, with ancillary class B1(a) Offices, together with associated means of access, internal estate roads, car and lorry parking, landscaping and sustainable drainage. To aid validation, at Annex 1, the application documentation is cross referenced against the Council s Local Requirements for Planning Applications (November 2015), which includes key national requirements. An application fee of 69,672 was paid in respect of application reference KET/2016/0606 submitted on 26 th August 2016. This application was subsequently withdrawn on 29 th June 2017. Under Regulation 9 of the Town and Country Planning (Fees for Applications, Deemed Applications, Requests and Site Visits) (England) Regulations 2012, no further fee is payable in respect of this new application as it has been submitted within 12 months of the original application. There is immediate market demand for the delivery of a logistics development on this site. The case for the application is set out in the Planning Statement which was submitted in support of the original planning application and the Planning Statement Addendum, which has been prepared in support of this new application. The detailed supporting material considers and addresses all the statutory planning policy tests and includes the previous Environmental Statement (ES) dated August 2016 and an Environmental Statement Addendum, dated August 2017, both of which have been prepared in accordance with the Town and Country Planning (Environmental Impact Assessment) Regulations 2011 (as amended 2015). This was agreed with you at the meeting on 11 th July, in light of the transitional arrangements set out in the Town and Country Planning (Environmental Impact Assessment) Regulations 2017. 2

The Environmental Statement Addendum, which has been prepared in support of this new application, includes updated information in respect of: Ecology; Transport; Archaeology/heritage; and Landscape design and mitigation. In each case, however, the updated information does not alter the findings of the original 2016 ES. The Planning Statement undertakes a robust analysis of the planning case and has identified the following arguments in support of the development: The principle of employment development on the Site is acceptable given that it is allocated for such uses within the adopted JCS. The market demand for employment uses in this location concerns large scale logistics uses (strategic warehousing) and this will be the first phase of the wider allocation to come forward, providing a catalyst for the remainder of the allocation to be delivered. The focus of the Site s development for logistics uses (B8 and ancillary B1) is consistent with the requirements of the JCS as a sectoral strength in the economy, and will provide about 2,800 jobs within a mix of sectors. The Site s development will be acceptable in terms of flood risk and the management strategy has been agreed with the Environment Agency. The development will include extensive strategic landscaping surrounding the Site, which will mitigate visual impact of the buildings from Isham and other surrounding areas and contribute to a network of green infrastructure that will have ecological benefits, connecting the Ise Valley Sub-Regional GI corridor and the Rothwell-Wicksteed Park Local GI corridor. A sensitive approach to the design of the development platform and maximum parameters has been applied to ensure that the development can deliver the necessary scale of development to meet the aspirations of Policy 37, whilst also minimising visual impact and maximising the provision of landscaping. The point of access to the Site has been agreed in principle with the County Council and is consistent with Policy 37 and a comprehensive transport strategy has been put forward in the ES to enhance connectivity with the Kettering urban area and encourage sustainable transport modes. There will also be a proportionate contribution towards the coherent delivery of additional vehicle capacity in the area to mitigate local development impact, including a financial contribution to the delivery of the A509 Isham Bypass. Other technical matters have been addressed in terms of noise, air quality, archaeology, agricultural land and ground conditions; there will be no unacceptable impact on these matters and any impacts that do occur can be satisfactorily mitigated through the imposition of planning conditions. The NPPF makes clear the Government's ambitions for securing economic growth in order to create jobs and prosperity, and emphasises the Government's commitment to ensuring that the planning system does everything it can to support sustainable economic growth, with 'significant weight' placed on the need to support economic growth through the planning system. With this in mind, it is clear that there are no significant and demonstrable adverse impacts arising from the proposal and so this application must be treated positively by the Council as it represents exactly the type of development encouraged by the NPPF and the Government's growth agenda. This is a significant material consideration that weighs heavily in favour of the proposal. Therefore, under Section 38(6) of the Planning and Compulsory Purchase Act 2004, the application is both consistent with the development plan and is supported by the NPPF and a range of very strong material 3

considerations. Consequently, it is requested that the Council approves this application without delay and within the statutory timescales accordingly. Whilst the application site is wholly within Kettering Borough, there has been an assessment of impacts and significant pre-application discussions with adjoining communities in Borough Council of Wellingborough, most notably Isham. We would therefore request that Isham Parish Council and residents of the village are directly notified of the application details by your Council in this instance. We have also undertaken to notify Isham Parish Council when the application has been submitted.
