Emily Kenyon Lewis was issued a Washington Education Certificate, No. 412959R, on December 12, 2003. That certificate currently remains valid. 2. On July 18, 2011, the Office of Professional Practices, within OSP, received information through the National Association of State Directors of Teacher Education and Certification (NASDTEC) database, that the state of Oregon had tal(en action against Emily Kenyon Lewis' Oregon Teaching Certificate. -1-

3. On or about June 1998 to July, 1998, while working in the town of Washington, W, Emily Kenyon Lewis stole several items from her place of employment and checks from a coworker that were later forged; Eau Claire County Sheriffs Case No. 1998-004565- and 1998-004535-; OPP #A01-09-0553. 5. On July 9, 1998, Eau Claire County Sheriffs Office initiated an investigation involving Emily Kenyon Lewis who was subsequently charged with, Theft-Business Setting, 943.20(1)(b), a Class A Misdemeanor, and Forgery - Writings or Objects, 943.38(1)(a), a Class H Felony, Eau Claire County Sheriffs Office Case No. 1998-004565-; OPP#A01-09-0553. 6. On August 5, 1998, Emily Kenyon Lewis admitted to committing theft by employee and theft contrary to Sections 943.20(1)(b) and 943.20(1)(a) of the Wisconsin Statutes, a Class A Misdemeanor. By pleading guilty, Emily Kenyon (Lewis) received a deferred sentence, Circuit COllt for Eau Claire COlmty, Wisconsin, Case No.. 98CM1402; OPP#A01-09-0553. 4. On July 8, 1998, Eau Claire County, Wisconsin Sheriffs Department initiated a theft investigation involving Emily Kenyon Lewis, who was subsequently arrested for Theft-Business Setting, (943.20(1)(B», a Class A Misdemeanor; Eau Claire County Sheriffs Case No. 1998-004535-; OPP#A01-09-0553. -2-

7. On September 8, 1999, Circuit Court of Eau Clair County, Wisconsin, confirmed that Emily Kenyon (Lewis) complied with the conditions specified on the Deferred Acceptance of a Guilty Plea, signed in court on August 5, 1998. Emily Kenyon's (Lewis) charges were amended to two (2) Counts Commercial Retail Theft, (Ord. 9.44); Circuit Court for Eau Claire County, Wisconsin, Case No. 98CM1402. 8. Emily Kenyon Lewis received her Oregon Teaching Certificate on August 18, 2004. Emily K. Lewis' nitial School Psychologist License was issued on August 25, 2005, and expired on hme 6, 2009. 9. On or about September 16, 2005 to September 26, 2005, while residing in Roseburg, Oregon, on more than nne occasion, Emily Kenyon Lewis attempted to obtain prescription medication (Percocet and Oxycontin) by fraudulent means. 10. On December 7, 2005, Roseburg Police Department initiated an investigation when Dr. Diane Bolduc, reported that Emily Kenyon Lewis had altered more than one prescription slip given to her, for the purpose of increasing the amount of pain medication she could obtain. Roseburg Police Department initiated an investigation; Roseburg Police Department Case No. 05-6871. 11. On March 8, 2005, while residing in Roseburg, Oregon, Emily Kenyon Lewis attempted to obtain a higher dosage of pain medication (Oxycontin) by altering her prescription; Roseburg Police Department Case No. 06-1315. -3-

12. On or about November 18,2005 to January 4,2006, while residing in Roseburg, Oregon, Emily Kenyon Lewis altered numerous prescriptions to obtain more Percocet than was prescribed by her doctor; Roseburg Police Department Case No. 06-1751. 13. On March 15, 2006, while residing in Roseburg, Oregon, Emily Kenyon Lewis attempted on several occasions, to obtain medication (Oxycontin) by altering the prescriptions; Roseburg Police Department Case No. 06-1459. 14. On April 6, 2006, Emily Kenyon Lewis was cited by the Roseburg Police Department for one (1) Count Tampering with Drug Records and released. The additional six (6) incidents were referred to the Douglas County District Attomey's Office for consideration of additional charges. 15. On or about September 2006 to and through November 11, 2006, while residing in Roseburg, Oregon, Emily Kenyon Lewis, on more than one occasion, attempted to obtain prescription drugs by altering prescriptions and using several false identities; Roseburg Police Department Case No. 06-6522. 16. On November 12, 2006, Emily Kenyon Lewis was arrested and charged with three (3) counts of Tampering with Drug, Oregon Revised Statutes (ORS) 167.22, three (3) counts Unlawful Possession Prescribed Drug S, ORS 475.840.3.B, and three (3) counts dentity Theft, ORS 165.800; Roseburg Police Department Case No. 06-6522.. -4-

17. On November 13, 2006, Emily Kenyon Lewis was charged with five counts of Tampering With Drug Records (ORS 167.212), one comt of Theft of dentity (ORS 165.800), and two counts of Possession of Controlled Substance 2 (ORS 475.840(3)(B»; Roseburg Police Department Case No. 06-6522; Douglas Comty Circuit Court No. 06CR2743FE. 18. On November 16, 2006, Emily Kenyon Lewis was indicted in Douglas County Circuit Court on the following counts: 1) dentity Theft, ORS 165.800 (occurred 10262006), 2) Unlawful Possession of a Controlled Substance, ORS 475.840 (occurred 102612006), 3) dentity theft, ORS 165.800 (occurred 111012006), 4) Unlawful Possession of a Controlled Substance, ORS475.840 (Occurred 111102006, 5) dentity Theft, ORS 165.800 (occurred 111122006), 6) Tampering with Drug Records, ORS 167.212 (occurred 10262006), 7) Tampering with Drug Records, ORS 167.212 (occurred 111612006), 8) Tampering with Drug Records, ORS 167.212 (occurred 1111212006); Douglas County Circuit Court No. 06CR2743FE; Roseburg Police Department Case No. 06-6522. 19. On January 3, 2007, Douglas Comty Circuit Court dismissed Count No.8 only, of the ndictment against Emily Kenyon Lewis, dated 111162006; Douglas County Circuit Court No. 06CR2743FE. 20. On August 2, 2007, Douglas COlmty Circuit Court issued a Stipulated Order Amending Release Agreement, allowing Emily Kenyon Lewis to go to Wisconsin to reside, but returu to Oregon for any court appearances; Douglas County Circuit Court Nos. 06CR1076FE and 06CR2743FE. -5-

21. On July 2007, Eau Claire Police Department was contacted by Emily Kenyon Lewis' roommates to report the theft of money, items and prescription medication (Vicodin) by Emily Kenyon Lewis. Emily Kenyon Lewis was arrested for theft and felony bail jumping; Eau Claire Police Case No. 11-013402. 22. Prior to January 12, 2008, on more than one occasion while residing in Wisconsin, Emily Kenyon Lewis, obtained controlled substances and prescription drugs by fraudulent means. 23. On or about January 12, 2008, Emily Kenyon Lewis did obtain possession ofa controlled substance (EndocetlPercocet) by fraud, contrary to sec. 961.43(1)(a), 939.50(3)(h) Wis. Stats., a Class H Felony. Eau Claire Police Case No. 08-1002; Eau Claire Circuit Court Case No. 2008EC000339. 24. On January 14, 2008, Emily Kenyon Lewis attempted to obtain possession ofa controlled substance (Oxycodone), by fraud, contrary to sec. 961.43(1)(a), 939.50(3)(h), 939.32 Wis Stats., an attempt to commit a Class H Felony; Eau Claire Police Case No. 08-1002; Eau Clair Circuit Court Case No. 2008EC000339. -6-

25. On January 15, 2008, phannacists at Midelfort Pharmacy in Eau Claire slunmoned Eau Claire Police Department to report that Emily Kenyon Lewis attempted to obtain prescription medication by using an alias and a forged prescription. n an interview with the Eau Claire Police Department, Emily Kenyon Lewis admitted to using numerous pharmacies, aliases and alteredforged prescriptions to obtain prescription pain medication; Eau Claire Police Case No. 08-1002; Eau Claire County Circuit Court No. 2008EC000339. 26. On January 15, 2008, Emily Kenyon Lewis was arrested and charged with one () count of Obtaining a Controlled Substance by Fraud (Wisconsin 961.43(1)(a)), a felony, and one () count of Obtaining a Prescription Dmg with Fraud (Wisconsin 11(7)(a)), a misdemeanor Eau Claire Police Case No. 08-1002; Eau Clair County Circuit Court Case No. 2008EC000339. 27. On January 17, 2008, Eau Claire detectives issued a "Phannacy Alert" flier, which was sent out to various phannacies and hospitals in the Eau Claire, W, area with information in regards to Emily Kenyon Lewis and the alias names she had been using; Eau Claire Police Case No. 08-1002. 28. On January 23, 2008, a Criminal Complaint was filed in Eau Claire Circuit Court charging Emily Kenyon Lewis with: ) Obtaining a Controlled Substance by Fraud, contrary to sec. 961.43(1)(a), 939.50(3)(h), a Class H Felony, 2) Attempt obtaining a Controlled Substance by Fraud, contrary to sec. 961.43(1)(a), 939.50(3)(h), 93932, an attempt to colmnit a Class H Felony, 3); Eau Claire Circuit Court Case No. 08CF51; Eau Claire Police Case Nos. 061063PD and 081002PD -7-

29. On February, 2008, Karl Lewis, filed a report with Eau Claire County Sheriffs Office, reporting fraudulent use of his credit cards by his granddaughter Emily Kenyon Lewis. On February 7,2008, Emily Kenyon Lewis was ordered to appear in court for Theft on February 21, 2008. 30. On April, 2008, Emily Kenyon Lewis pled guilty and was convicted of both offenses; Eau Claire Police Case No. 08-1002; Eau Clair County Circuit Court Case No. 2008EC000339. 31. On July 19, 2010, a State's Motion and Judgment of Dismissal was filed in Douglas County, Oregon Circuit Court, after Emily Kenyon Lewis' successfiji completion of drug court. The dismissal was granted on July 22,2010; Douglas County Circuit Court No. 06CR2743FE. 32. On February 10, 2011, the Teacher Standards and Practices Commission of the State of Oregon issued Emily Kenyon Lewis a Notice of Opportunity for Hearing, in which the Commission charged her with Gross Neglect of Duty. 33. On May 16, 2011, Emily Kenyon Lewis' right to apply for licensure in the state of Oregon was revoked by the Teacher Standards and Practices Commission. 34. On May 24, 2011, Rebecca Gunnes, Emily Lewis' mother, contacted Eau Claire, W Police regarding unauthorized usage of her credit card by Emily Kenyon Lewis. The unauthorized usage occurred on several occasions; Eall Claire Police Case No. 1-11-9634. -8-

36. On or about May 2011 through July 10,2011, Emily Kenyon Lewis stole numerous items from her roommates, to include, but not limited to, prescription medication (Vicodin), money, baseball memorabilia and Harley Davidson attire; Eau Claire, W Police Case No. 11-13402. 37. On July 11, 2011, Emily Kenyon Lewis was interviewed by Eau Claire Police regarding the thefts from her roommates and was subsequently arrested for being. in unlawful possession of a prescription medication (Tramadol), 450.11(7)(h), Theft, 943.20, and Bail Jumping, 946.49; Eau Claire, W Police Case No. 11-13402. 35. On June 20, 2011, Rebecca Gunnes notified Eau Claire, W Police that Emily Kenyon Lewis had agreed to pay back the money she used off the card and she (Rebecca Gunnes) no longer wanted to pursue criminal charges against her daughter; Eau Claire Police Case No. 1-11- 9634. -9-

38. On July 13, 2011, a Criminal Complaint was filed in Eau Claire County, W Circuit Court charging Emily Kenyon Lewis with, ) Felony Bail Jumping, Repeater, contrary to sec. 946.49(1)(b), 939.50(3)(h), 939.62(1)(b), a Class H Felony, 2) Felony Bail Jumping, Repeater, contrary to sec. 946.49(1)(b), 939.50(3)(h), 939.62(1)(b), a Class H Felony, 3) Possession of Non-Narcotic Controlled Substance, Repeater, contrary to sec. 961.41(3g)(b), 939.62(1)(a) Wis. Stats., a Misdemeanor, 4) Misdemeanor Theft, Repeater, contrary to sec. 943.20(1)(a) and (3)(a), 939.51(3)(a), 939.62(1)(a) Wis. Stats., a Class A Misdemeanor, 5) Three (3) Counts Receiving Stolen Property «$2500), Repeater, contrary to sec. 943.34(1)(a), 939.51(3)(a), 939.62(1)(a), a Class A Misdemeanor, 6) Possessillegally Obtained prescription, Repeater, contrary to sec. 450.1 (7)(h), 450.1 1 (9)(a), 939.62(1)(a), a Misdemeanor; Eau Clair Circuit Court No. CF466; Eau Claire Police Case No. 1-113402. 39. Emily Kenyon Lewis did not interview with OPP but indicated via email that she did not plan on working in Washington again. 40. Good moral character and personal fitness is a continuing requirement to maintain a Washington Education Certificate. -10-

CONCLUSONS OF LAW 1. OSP has jurisdiction over Emily Kenyon Lewis and over the subject matter of this action. 2. OSP has shown by clear and convincing evidence, that the Washington Education Certificate, No. 412959R, of Emily Kenyon Lewis, should be revoked as provided for in WAC 181-86-075. 3. Emily Kenyon Lewis has violated: RCW 28A.41O.090, WAC 181-86-013, andor WAC 181-86-014. -11-
