In the 2006 and 2009 fire code adoption, section IV was created in our local fire code amendments called fees. This section provides the establishment of fees for inspections, re-inspections for non-compliance, plans review, acceptance testing, permits and other services related to the enforcement of the fire code. The fee schedule is required to be adopted by resolution by the North Liberty Council. The fee schedule has a section for operational permits, construction permits, fire inspection fees, hazardous material response reimbursement & standby-by rates and other fees. The fee schedule is not intended to add an extra burden or a tax to local businesses but rather help the city recover some of the costs associated with the permitting process such as plans review, site visits, the testing of new fire protection and fire detection equipment, fire inspections and other services that are provided by the fire department. The fees established in this document are very similar if not the same as the fees charged by the Coralville Fire Department, as they were consulted throughout the development of this fee schedule. The fee schedule only applies to commercial and multi-family dwelling and it excludes one and two-family dwellings. The Home Builders Association was given a chance to review this fee schedule and they did not have any objections for the establishment of the fee schedule nor did they have any recommendations for changes. The fee schedule does not apply to routine emergency and non-emergency responses, such as fire and medical responses, fire alarms, public assist, calls for service, etc. The first section of the fee schedule is Operational Permits. Section 105 of the 2009 International Fire Code establishes a list of operational permits that are required for the handling, storage or use of substances, materials or devices regulated by the fire code. Typically the operational permits relate to higher hazard or higher risk operations, such cryogenic fluids, explosives (including fireworks), hazardous materials, high piled storage and waste handling. Typically the operational permits are renewed on an annual basis which allows the fire department to inspect these operations to ensure that they are being conducted in a safe and proper manner. We currently do not have the staffing to actively enforce all of the operational permits listed in the fire code and the fee schedule but we would like to establish them now for future enforcement. It will take some time to review the current businesses in North Liberty and identity if any of them fall under this section. We anticipate only a few businesses being required to comply with the operational permits.

The next section of the fee schedule is Construction Permits. Section 105 of the 2009 International Fire Code also establishes a list of construction permits that are required for new construction. As stated before, this only applies to commercial and multi-family dwellings and excludes one & two-family dwellings. Some of the construction permits established by the fire code and the fee schedule are for the installation of fire sprinkler systems, fire alarm, special agent suppression systems and other special hazard installations. Included in the permit fee are the permit, a detailed plans review, site visit and final inspection/acceptance testing. The next section of the fee schedule is for fire inspections. We will not charge for the initial fire inspection and the first re-inspection that is conducted by the fire department. The establishment of this fee schedule allows us to fine businesses that do not fix or do not comply with the correction of fire and life safety items found during repeated fire inspections. Currently our only option for non-compliancy is a municipal infraction. The next section of the fee schedule is the establishment for hazardous materials response reimbursement and stand-by rates. The State of Iowa has granted fire departments the ability to recuperate expenditures associated with the response to a hazardous material incident. The fees were determined using the Hazardous Materials Response Billing Protocol for Iowa Fire Department (2002 edition) and also the standard FEMA schedule reimburse rate (2010 edition). The second part of the section relates to stand-by requests for special events and functions, such as fireworks standbys that are required by the fire code. The last section of the fee schedule is other fees. The Fire Protection & Alarm Company License Fee is a small annual fee charged to fire protection and fire alarm companies conducting work in the City of North Liberty. One license covers all employees for that company. By requiring these companies to apply for an annual license, we are able to ensure that they are registered by the State of Iowa and that conduct their work in accordance to the adopted fire code. Required to use open flames or candles in connection with assembly areas, dining areas of restaurants, or drinking establishments. 105.6.36 Pyrotechnic special effects material Required Operational Permit same as found under Explosives section. 105.6.37 Pyroxylin plastics Required for storage and handling of more than 25 pounds of cellulose nitrate plastics and for the assemble or manufacture of articles involving Pyroxylin plastics. 105.6.41 Spraying or dipping 105.6.42 Storage of scrap tires and tire byproducts Required to conduct a spraying or dipping operation utilizing flammable or combustible liquids or the application of combustible powders regulated by Chapter 15 of the 2009 NC Fire Code. RESOLUTION 11-60 RESOLUTION ESTABLISHING THE FIRE DEPARTMENT FEE SCHEDULE IN THE CITY OF NORTH LIBERTY, IOWA. WHEREAS, the North Liberty Code of Ordinances authorizes the City Council to determine and set by resolution Fire Department Fee Schedules; and WHEREAS, the City Council has established what appropriate fees for each service are. BE IT THEREFORE NOW RESOLVED BY THE CITY COUNCIL OF NORTH LIBERTY, IOWA, that the City of North Liberty, Iowa, hereby approves the Fire Department Fee Schedule as in the attached document.
