1.0 Intrductin Yu are invited t ldge an Expressin f Interest fr cntract plant and labur t assist Murray Irrigatin with its chemical weed cntrl prgram fr the 2015/16 financial year. This includes weed cntrl assciated with ver 2,900km f earthen supply channels and ver 1,400km f earthen drainage channels. 2.0 Task The primary task is t supply cntract plant and labur n an hurly hire rate basis t apply chemicals t cntrl nxius, emergent and/r submergent weeds within Murray Irrigatin s Area f Operatins. Examples f Nxius Weeds include: Bathurst Burr Hrehund Galvanised Burr Patternsn s Curse Bx Thrns Examples f Emergent Weeds (i.e. abve the water) include: Sagittaria Cumbungi Phragmites Sedge Rushes Examples f Submergent Weeds (i.e. belw the water) include: Ribbn Weed Eldia Pnd Weed Examples f chemicals typically used by Murray Irrigatin include: Rundup Biactive Rundup CT Acrlein Cntractrs are als being asked t cnsider their willingness t cmplete minr pest cntrl wrks such as spraying regulatrs t cntrl spiders and/r placing baits t cntrl mice. - 2 -
3.0 Backgrund Murray Irrigatin is planning a significant Chemical Weed Cntrl Prgram (Wrks Prgram) t assist with the delivery and drainage f water during the 2015/16 irrigatin seasn. The implementatin f the Wrks Prgram requires bth internal and external cntract plant and labur. The Wrks Prgram is subject t change at any time in accrdance with Murray Irrigatin business requirements and/r budget cnstraints. This includes putting cntract plant n and ff as required thrughut 2015/16 financial year. Mre details regarding Murray Irrigatin and its Area f Operatins can be viewed at www.murrayirrigatin.cm.au This Expressin f Interest applies t the perid up t 30 June 2016 inclusive. Murray irrigatin reserves the right t extend the cntract fr a further 12 mnths if it s chses. - 3 -

5.0 Mandatry Infrmatin Expressins f Interest shall include all f the fllwing mandatry details: Cntractr s Name Cntactr s Details (address, telephne, mbile, fax, e-mail) Cnfirmatin that each Spray Unit is NSW Rad Traffic Authrity registered (r equivalent). Phtgraphs (n mre than three mnths ld) f each item f plant frm the frnt, back and side angles. Full manufacturer specificatin fr each Spray Unit. Advice regarding if the Spray Unit is capable f spt spraying. Advice regarding if the Spray Unit has a bm spray that is suitable fr minimising chemical drift n small scale wrks such as access track spraying (Nte: Large scale brad acre Spray Units are generally nt suitable fr Murray Irrigatin purpses due t the higher risk f chemical spray drift). Advice regarding if the bm spray has adjustable height spray drppers than can be cnfigured t the shape f a supply r drainage channel t minimise the risk f drift. Advice regarding if the cntractr is willing t cmplete minr pest cntrl wrks such as spraying regulatrs t cntrl spiders and/r placing baits t cntrl mice. Span (width) f the bm spray (if applicable). Chemical strage tank capacity (litres). Plant hire rate (including labur csts) ($/hr) Operatr(s) name, qualificatins and experience including References and/r Referees This refers t the staff that will be cmpleting the actual wrk. Please nte that Murray Irrigatin's assessment f all Expressins f Interest will include significant cnsideratin t prven past perfrmance, experience, prductivity, safety recrd and wrkmanship. The lwest r any qutatin may nt necessarily be accepted. Nn-cnfrming qutatins will nt be accepted. 6.0 Terms, Cnditins and Cntractr Respnsibilities The Cntractr will be respnsible fr the payment f all wages, vertime, travelling expenses, wrkers cmpensatin and insurances (including public liability) incurred in the executin f the wrks. The Cntractr is required t prvide the supply f all labur, cnsumables (including fuel but excluding chemicals and chemical dye marker slutins), plant, persnal prtective equipment, supplementary plant and equipment hire assciated with the supply f a chemical Spray Unit with peratr(s) n an hurly hire rate basis t cmplete chemical weed cntrl wrks within Murray Irrigatin. Area f Operatins in accrdance with Murray Irrigatin instructins. Cntractrs are advised t cnsider pssible changes t fuel prices during the perid f the wrks when tendering their hire rates (i.e. fixed hurly hire rates). The Cntract is nt subject t rise and fall in fuel prices. Murray Irrigatin will supply the cntractr with all weed cntrl chemicals required fr applicatin t the targeted weeds. Murray Irrigatin will supply the cntractr with all chemical dye marker slutins. Transprtatin bth t the first wrksite and frm the last wrksite will be at the Cntractr s expense. Murray Irrigatin will cnsider the first wrksite t be ne f Murray Irrigatin s wrks depts lcated at Finley, Deniliquin and Wakl. Murray Irrigatin will nminate which wrks dept will be the first wrksite as part f the ntificatin prcess fr successful Cntractrs. The hurly hire rate fr the Spray Unit and Operatr will nly apply t wrks n site and travel between wrk sites. This means that travel t and frm the wrksite at the start and end f each wrking day (e.g. travel t and frm hme) and secndary activities such as shwering and plant repairs are nt included in the hurly hire rate payable by Murray Irrigatin. - 6 -
The fllwing prvisins apply where chemical spraying is nt able t ccur due t wet weather and/r unfavurable wind cnditins that wuld result in high risks f chemical drift. On days where the Cntractr has already cmmenced wrk, the Cntractr will be entitled t claim payment fr a minimum f 4hrs wrk. On days where the cntractr is ntified by telephne befre 7:00am that wrks cannt cmmence due t wet weather and/r unfavurable wind cnditins, the Cntractr will be entitled t claim payment fr 2hrs wrk fr each day up t a maximum f tw cnsecutive Murray Irrigatin wrking days. Murray Irrigatin wrking days exclude weekends, public hlidays and Murray Irrigatin rstered days ff. Examples A Cntractr cmmences wrk at 7:00am n Mnday 11 Octber n site and is required t stp wrk at 9:30am (2.5hrs) due t wet weather. The cntractr can claim 4hrs wrk fr Mnday 11 Octber. A Cntractr is advised prir t 7:00am n Wednesday 18 Octber that wrk will nt be pssible n this day due t wet weather. The cntractr can claim 2hrs wrk fr Wednesday 18 Octber. The Cntractr is advised prir t 7:00am n Thursday 19 Octber that wrk will nt be pssible n this day due t wet weather. The cntractr can claim 2hrs wrk fr Thursday 19 Octber (i.e. secnd cnsecutive Murray Irrigatin wrking day) The Cntractr is advised prir t 7:00am n Friday 20 Octber that wrk will nt be pssible n this day due t wet weather. The cntractr cannt claim any wrk fr Friday 20 Octber (i.e. third cnsecutive Murray Irrigatin wrking day). The Cntractr is required t reprt immediately t Murray Irrigatin, any damage t Murray Irrigatin and/r landhlder prperty caused by the Cntractr r any persns under their emplyment. This includes damage t infrastructure wned by service prviders such as cuncil rads, bridges, telephne cables, electricity lines, gas lines etc. - 7 -
The Cntactr will be required t make gd any damage t Murray Irrigatin and/r landhlder prperty and/r equipment at the Cntractr s wn expense caused in the executin f the wrks. This includes: Damage t Landhlder crps frm chemical spray drift. Damage t infrastructure wned by service prviders such as cuncil rads, bridges, telephne cables, electricity lines, gas lines etc. The Cntractr will be required t wrk within Murray Irrigatin Wrk Health and Safety requirements. This includes but is nt limited t: Cmplying at all times with all ccupatinal health and safety measures as stated in AS 4801 and the NSW Wrk Health and Safety Act 2011 and the NSW Wrk Health and Safety Regulatin 2011. Cmpleting a Murray Irrigatin Inductin Cmpleting Wrk Site Inductins Cmplying with Murray Irrigatin Safe Wrk Methd Statements r the Cntractrs wn Safe Wrk Methd Statement (Apprved in writing by Murray Irrigatin) The Cntractrs plant and equipment must be safe and fit fr purpse. Each plant r vehicle is t be equipped with apprpriate first Aid Equipment, suitable cmmunicatins (UHF Radi and Mbile Phnes) and a fire extinguisher. If a circumstance arises where the required wrk is nt cvered by the Safe Wrk Methd Statements, the Cntractr must cmplete a written risk assessment fr the wrk and submit this t Murray Irrigatin fr apprval befre cmmencing the wrks. Cntractrs will be required t cmplete Plant Maintenance Wrk Order sheets and Chemical Weed Cntrl Daily Reprt sheets (Nte: These are the same sheets cmpleted by Murray Irrigatin staff see attached cpies). Cntractrs will be required t apply chemicals at cncentratin rates specified by Murray Irrigatin. Cntractrs will be required t apply a chemical dye maker slutin at cncentratin rates specified by Murray Irrigatin. - 8 -
Under n circumstances are cntractrs permitted t mix chemicals within 50m f the te f Murray Irrigatin channels. Failure t cmply with this requirement may result in the Cntractr being reprted t the Envirnmental Prtectin Agency. Cntractrs are permitted t extract water frm Murray Irrigatin channels that can then be transprted at least 50m away frm the te f a Murray Irrigatin channel where chemicals can be added and mixed with this water safely (i.e. in a lcatin where there is n risk f a chemical spill ccurring in a Murray Irrigatin supply r drainage channel). Cntractrs are authrised t fill their chemical strage tanks with water frm Murray Irrigatin channels at lcatins specified by Murray Irrigatin nly. Where required, Murray Irrigatin will ntify Landhlders that chemical spraying is scheduled t ccur n their prperty. Unless therwise apprved in writing by Murray Irrigatin, Cntractrs will be required t perate n site within the hurs f 7:00am t 5:00pm between the days Mnday t Friday (excludes Public Hlidays and Murray Irrigatin Rstered Days Off). Unless therwise instructed by Murray Irrigatin, Cntactrs are t perate within Murray Irrigatin Wrks Plicy at all times. Murray Irrigatin will prvide the Cntractr with Wrk Instructins at each wrk site lcatin. Cntractrs will be required t cmply with all Wrk Instructins issued by Murray Irrigatin Limited. Successful Cntractrs must prduce all insurance papers (a Certificate f Currency ) befre wrk can cmmence. This includes: Wrkers Cmpensatin Insurance $10M Public Liability Insurance Fr cntractr s Public Liability Insurance Plicy Murray Irrigatin shuld be nted as an Interested Party. Murray Irrigatin reserves the right t terminate the Cntract at any time fr reasns including, but nt limited t: Murray Irrigatin business requirements Pr prductivity - 9 -
Pr wrkmanship Pr safety Breach f Murray Irrigatins plices r prcedures Failure t cmply with Murray Irrigatins specificatins (cntained herein) Pr envirnmental perfrmance Breach f the law while n duty, theft, dishnesty, fraud, insubrdinatin, bullying, sexual harassment r discriminatin Cntractrs wh d nt have a demnstrated perfrmance histry wrking fr Murray Irrigatin will initially be engaged n an 8 week trial basis. Murray Irrigatin may terminate the Cntract at the end f the trial perid fr any reasn and with n recurse frm the Cntractr. Murray Irrigatin will accept n respnsibility fr damage r lss t privately wned equipment, plant r tls. Murray Irrigatin will accept n respnsibility fr injury incurred by the Cntractr s staff while emplyed by Murray Irrigatin. All wrkplace injuries t Cntractr emplyees which result in medical assistance being required that ccur while engaged in Murray Irrigatin wrks will be reprted t the Wrks Supervisr as sn as pssible but n later than the end f the day the incident ccurred. A starting date will be negtiated with successful applicants as sn as pssible after ntificatin that an Expressin f Interest has been accepted. 7.0 Payment The Cntractr will be required t ldge a mnthly claim fr wrk undertaken. Murray Irrigatin will verify this claim and if satisfactry, payment will be made. All claims shall be presented with a statutry declaratin stating that any sub-cntractrs and emplyees have been paid fr the cmpleted wrks as stated in clause 23 f AS4905 2002. 8.0 Clsing Cmments Thank yu fr taking the time t cnsider this business pprtunity.
