THE EXECUTIVE COMMITTEE RECOMMENDS THAT the Toronto and Region Conservation Authority (TRCA)-owned land located on the east side of Duffy's Lane, north of King Street, Town of Caledon, Regional Municipality of Peel, be retained for conservation purposes. CARRIED BACKGROUND A letter was received from Pat and Linda Paniccia, requesting the sale of a fragment of TRCA-owned land situated on the east side of Duffy's Lane, north of King Street for an addition to their existing rural residential property. At Executive Committee Meeting #2/08, held on April 11, 2008, Resolution #B28/08 was approved as follows: THAT the potential disposal of a fragment of land on the east side of Duffy's Lane, north of King Street, Town of Caledon, Regional Municipality of Peel, be referred to Toronto and Region Conservation Authority (TRCA) staff for review and discussion in accordance with established TRCA policies; AND FURTHER THAT a report be brought forward to the Executive Committee at a future date recommending further action. This request was circulated to Town of Caledon and Regional Municipality of Peel staff as well as TRCA staff for review and comment. The following comments have been received: Town of Caledon staff This parcel of land will be subject to a significant road widening (7 metres +/-) required for the future Bolton Arterial Route (BAR). As construction of this portion of the BAR is a Region of Peel project, Regional Municipality of Peel staff should be contacted for more detailed information. Regional Municipality of Peel staff A road widening requirement is required in connection with the future Bolton Arterial Route (BAR) project. At this point in time, only the Environmental Assessment has been completed for this project. The detailed design has not yet commenced. The Region of Peel is requesting that TRCA delay its decision regarding this property until the detailed design is complete to the point that property impact can be determined; it is anticipated that this information will be available by the end of 2008. TRCA staff The subject site has been identified in the Refined Humber Terrestrial Natural Heritage System (TNH) system as potential habitat and forms part of the land base needed for the Natural Heritage system to achieve TRCA's biodiversity targets. TRCA staff has surveyed this site and collected terrestrial information. The area has been classified as a cultural thicket and provides habitat for some open country bird species of concern (i.e. Field Sparrow, Nashville Warbler and White Throated Sparrow). In addition, the subject area is an excellent buffer for the higher quality natural habitats immediately to the east (i.e. the Humber River valley). 823

Not only has this TRCA-owned property been identified as potential natural cover for habitat and an area which could benefit from regeneration in the TNH system, it also currently provides some ecological function that should be protected. Given the fact that a substantial strip of the frontage is required for the BAR and that the property has significant potential for regeneration, staff is recommending that the parcel be retained. A plan illustrating the location of the subject lands is attached. Proposal to lease Toronto and Region Conservation Authority-owned land located south of Major Mackenzie Drive, east of Islington Avenue, City of Vaughan, Regional Municipality of York, to construct and operate a cell phone antenna and associated equipment. Jack Heath Colleen Jordan THE EXECUTIVE COMMITTEE RECOMMENDS THAT WHEREAS Toronto and Region Conservation Authority (TRCA) has been requested by TM Mobile Inc. (Telus Mobility) to enter into a lease arrangement for lands located south of Major Mackenzie Drive, east of Islington Avenue, City of Vaughan, Regional Municipality York; WHEREAS it is in the opinion of TRCA that it is in the best interests of TRCA in furthering its objectives, as set out in Section 20 of the Conservation Authorities Act, to cooperate with Telus Mobility in this instance; THAT TRCA enter into a lease with Telus Mobility of approximately 0.013 hectares, more or less, (0.032 acres) together with use of 0.385 hectares (0.951 acres) parcel of land for access and utilities for the construction and operation of a cell phone antenna and associated equipment, said land being Part of Lot 18, Concession 7, City of Vaughan, Regional Municipality of York; THAT the lease with Telus Mobility be premised on the following: (i) (ii) (iii) (iv) (v) the initial term of the lease will be for five years, with three renewal options for successive five year periods subject to the concurrence of TRCA to the renewals; the lease rate is to be $15,203.20 per annum; Telus Mobility is to be responsible for all approvals required for construction of a cell phone antenna and associated equipment; Telus Mobility shall be solely responsible for all costs associated with the construction of a cell phone antenna and associated equipment; any other terms and conditions deemed appropriate by the TRCA's solicitor; THAT an archaeological review is to be completed at the expense of Telus Mobility with any mitigative measures being carried out to the satisfaction of the TRCA; AND FURTHER THAT the authorized TRCA officials be directed to take whatever action may be required to implement the lease, including the obtaining of necessary approvals and the signing and execution of any documents. BACKGROUND TRCA has been approached by Telus Mobility to locate a cell phone antenna and associated equipment on TRCA-owned land in the vicinity of TRCA's Restoration Services Centre. Telus Mobility's equipment requirement for this proposal includes a 40 metre high tower with a shelter, which would be housed in a 10.67 metre x 12.19 metre compound. The access right-of-way will be approximately 6-12 metres in width which will include connection to existing utilities. Telus Mobility has indicated that they will work with TRCA to develop an aesthetically pleasing design for the top of the tower. Lease Agreement The area subject to this lease consists of approximately 0.013 hectares of land (0.032 acres) all of which is tableland. A sketch showing the lands subject to this lease is attached. The following are the key terms of the proposed lease arrangement: 1. Lease Payment: $15,203.20 (present rate for the Boyd Conservation Area and Lake St. George Field Centre Telus towers excluding any sub-let revenue) plus GST per annum to be increased by 2% per year; 2. Initial Term: 5 years; 3. Renewals: 3 successive 5 year terms subject to TRCA concurrence; 4. Access: Telus Mobility will be provided with access to the antenna and shelter at all times; 5. Insurance: Telus Mobility will provide $5,000,000 in commercial general liability; 6. Realty Taxes: Telus Mobility will pay all taxes levied against the property; 7. Hydro: Telus Mobility will be responsible for electrical connections and charges relating to this use; 8. Approvals: Telus Mobility will comply will all required laws, directions, rules and regulations; 9. Equipment Removal: Telus will remove all equipment and restore the site to the satisfaction of TRCA within 90 days of termination of the lease. DETAILS OF WORK TO BE DONE Upon TRCA approval, the necessary other approvals required to bring the lease into effect will be pursued. FINANCIAL DETAILS The $15,203.20 per year in revenues generated from this lease will be used for TRCA purposes. BACKGROUND The Regional Municipality of York has formally requested a permanent easement for the extension of the Bathurst Street Sanitary Trunk Sewer to Langstaff Road, north of Regional Road 7, west of Bathurst Street, in the City of Vaughan. The project has been reviewed by TRCA Planning and Development staff through the Environmental Assessment (EA) Act process. The proposed easement crosses the southeast corner of the Baker Sugar Bush; the subject site is not regulated pursuant to Ontario Regulation 166/06. The proposed works are being completed by subsurface drilling and boring; therefore, no surface disturbance will occur during construction. In addition, a temporary construction easement will not be required as part of the proposed works. The subject TRCA lands were acquired from Sugarbush Developments Limited on January 21, 2000 under the Greenspace Protection and Acquisition Project, 1996-2000, Flood Plain and Conservation Component/Don River Watershed. The property is jointly owned by the City of Vaughan, Regional Municipality of York and TRCA. RATIONALE The application was reviewed by staff on the basis of the following information: Proposal: The purpose of this application is to develop within a TRCA Regulated Area of the Humber River Watershed in order to facilitate the installation of a portable classroom on the site of an existing junior public school. The subject property is located east of Albion Road and north of Highway 401 in the City of Toronto (Etobicoke York Community Council Area). Control of Flooding: The site is located within a Regional Storm Floodplain of the Humber River Watershed. The depth of flooding is minimal (less than 0.4 metres) at the location where the proposed portable classroom is to be erected. The classroom will be floodproofed to the level of the Regulatory Flood (131.08 masl). As such, the proposal will have no impact on the storage or conveyance of floodwaters. Pollution: Sediment fencing is not required as the proposed works are adequately setback from the watercourse. Dynamic Beaches: Not applicable. Erosion: There are no geotechnical concerns associated with this application. Conservation of Land: No significant vegetation will be removed as a result of construction. There are no fisheries concerns as the watercourse was not impacted by the works. There are no other significant natural features on, or adjacent to, the site that were negatively impacted by the project. Plantings Plantings are not required for the purpose of this application.
