Number: DFC 105.6 Effective Date: March 1, 2015 Page 1 of 5 This policy is meant to provide basic information for most common conditions and situations. In any given occupancy, all other Fire Code requirements will be enforced. The Fire Inspector will address these during a premises inspection. Questions can be addressed by contacting the Fire Prevention Division between 6:30 a.m. and 4:30 p.m. at 720-913-3474 or at DFDMARIJUANAENFORCEMENT@DENVERGOV.ORG I. SCOPE This policy shall apply to all marijuana establishments or businesses licensed by the Denver Excise and License including but not limited to marijuana infused product operations, marijuana cultivation, testing labs, and marijuana sales occupancies located within the City & County of Denver. These establishments or businesses involve unique operations which create significant life safety and fire hazards. As such, all establishments or businesses engaging in these activities shall be required to obtain all applicable annual operational permits from the Denver Fire Department Fire Prevention Division. New and/or existing unpermitted/non-compliant marijuana related establishments or businesses may require construction permits or a change of occupancy; this may include access control systems, electrical modifications, addition or deletions of walls, modification to mechanical systems (exhaust hood systems), etc. Please see the Denver Fire Department Guideline for Construction Permitting for Marijuana Establishments / Businesses Located in Commercial Buildings for further information during the construction permitting process. II. DEFINITIONS For the purposes of this policy, all marijuana related terms are defined per the State of Colorado Marijuana Code 1 CCR 212. III. PERMITS Upon Approval by Denver Fire Prevention Division personnel, Annual Operational Permit(s) may be obtained from the Denver Fire Department. To obtain permits, contact the MARIJUANA ENFORCEMENT GROUP at the Denver Fire Department Fire Prevention Division located on the first floor of 745 West Colfax Avenue, Denver, Co. 80204 or by telephone 720-913-3474 or via email at DFDMARIJUANAENFORCEMENT@DENVERGOV.ORGPermit hours are from 6:30 AM to 9:00 AM, Monday through Friday (Holidays excepted). Checks should be made payable to: Denver Manager of Finance. MasterCard, Visa and Discover also accepted. The following are the most common annual operational permits that may be needed at these establishments or businesses: Annual Marijuana Establishment or Business Permit - (commercial occupancies)

Number: DFC 105.6 Effective Date: March 1, 2015 Page 2 of 5 Annual LPG Use & Storage Permit- required for 1 pound or more of propane or butane (i.e. extractions) Annual CO2 Enrichment System Permit Including natural gas generators and for any system containing more than 100 lbs of CO2 Annual Compressed Gas Use & Storage Permit Annual Fumigation / Thermal Insecticide Fogging Annual Extraction Process Permit Annual Flammable and Combustible Liquids Use & Storage Permit IV. SPECIFIC REQUIREMENTS 1. Exiting & Security Required minimum exit access shall be provided. Enhanced building security measures shall by no means impede egress for the facilities occupants or firefighters in the event of an emergency. Fire Department Key Access (Knox Box) shall be provided near the main entrance to the facility. Where electronic access control is in use, a Denver Building Department 3B permit is required for the installation of the access control system. See Denver Building Code Appendix L. Locking hardware on doors (interior or exterior) shall be in accordance with Building Code Policy 1008.1.9. Clear aisles shall be maintained through grow rooms in accordance with Denver Fire Code Chapter 10. 2. Fire extinguishers Portable fire extinguishers shall be provided within the facility, near exits. Travel distance to extinguishers shall not exceed seventy-five (75) feet of travel. Minimum extinguisher size permitted is 2A10BC. (IFC 906 & 906.1) 3. Graphic Map An 8 ½ x 11 map displaying a general floor plan of the facility shall be provided near the main entrance in a clear protective cover for the cultivation facilities or where the floor plan of the building is complex or may be confusing to first responders in the event of an emergency. 4. Interior Finishes / Building Construction Hanging plastic films shall not be used to create walls, ceilings, or rooms. Where plastic films are applied to the walls or ceiling as an interior finish material, the

A Building Department construction permit maybe required for installation. 5. Premise Identification Address numbers shall be posted per Denver Fire Code 505; minimum 6 numbers with minimum 0.75 stroke width on contrasting background 6. Electrical Extension cords, power strips, or multi-outlet assemblies etc. are prohibited from being used as permanent wiring. All electrical modifications require review and approval; permanent wiring (new circuits etc) require an electrical permit from the Denver Building Department. Electrical panel load schedules (from engineered electrical permit drawings) shall be posted at each panel. Emergency generators shall only be operated after obtaining permits from the Denver Building and Fire Departments. 7. Hazardous Materials/Conditions/Processes All hazardous materials shall be properly stored, used & labeled. Fumigation, Pesticides, Fungicides, Miticides use, storage & inventory statement shall not be performed without proper permits and advance notification including submittal of a Pesticide inventory statement. Pesticides, Fungicides, Herbicides and Fertilizers shall be properly stored and used in strict accordance with manufactures recommendations and product label.. Extraction processes shall not be conducted until all rooms, solvents and equipment have been reviewed/approved and permitted by Denver Fire Prevention Division. V. SITE INSPECTION Upon approval of permit from the Denver Fire Department Fire Prevention Division, a Fire Inspector will conduct a field inspection of the site. Compliance with all Fire Code requirements shall be maintained at all times. Permit shall be kept on site and posted. Permit is valid only for the owner, time frame and site address indicated on the permit. A permit may be revoked when:

Compliance with written orders has not been achieved. 3. False statements or misrepresentations of information are provided in the permit application or inventory statement. 4. The permit is issued in error or in violation of any city ordinance/ regulation or the Fire Code. Any and all occupancies discovered operating marijuana establishments or businesses (including but not limited to marijuana infused product operations, marijuana cultivation, testing labs, and marijuana sales occupancies) not in compliance with all requirements of the of the City & County of Denver and the requirements of this policy may result in the issuance of a Stop Work Order and a summons being issued to all offending parties.
