In accordance with Sections 57.04.12, Subsection C of the Los Angeles Municipal Code (L.A.M.C.), which authorizes the Board to modify fees based on the cost of services, these recommendations have been reviewed and concurred by the Office of the City Administrative Officer. It is proposed that the Hourly Rate for Cost of Special Services be reduced to $145 per hour due to a reduction in the Controller's official approved Cost Allocation Plan (CAP) 29 rates. It is recommended that the Board: 1. Reduce the fees charged for Continuing Permits Activities (L.A.M.C., Section 57.04.12C) by 8.2 percent as listed in Attachment A. 2. Reduce the fees charged for Non-Continuing Permit Activities and Emergency Inspections (L.A.M.C., Sections 57.05.31 and 57.05.32) by 8.2 percent as listed in Attachment B. 3. Reduce the Miscellaneous Fees (L.A.M.C., Sections 57.01.28, 57.01.30, 57.05.14, 57.05.1 5, and 57.06.1 5) by 8.2 percent as listed in Attachment C.

The Board's Executive Assistant be authorized to make any modifications to the Resolution as necessary, and be directed to publish the required notice of public hearing on the proposed fee increase at. a regularly scheduled meeting of the Board. 5. The attached Resolution (Attachment D) adjusting the Board cor~trolled fees be adopted after the required public hearing, and notice of this action be transmitted by the Board's Executive Assistant to the Mayor and City Council at the conclusion of the public hearing. 6. The Board's Executive Assistant be directed to publish the Resolution based on Mayor and City Council action. On August 7, 2007, the Board of Fire Commissioners approved the Fiscal Year 2007-2008 Annual Cost of Special Services Report dated July 19, 2007, increasing the Hourly Rate for Cost of Special Services to $1 58 per hour. The report was approved by the City Council and the Mayor and became effective on October 16,2007. The Hourly Rate for Cost of Special Services is deterrr~ined based on direct and indirect staff costs and expenses to perform these services. The proposed Fiscal Year 2007-2008 Salaries and the latest available draft CAP 29 were used in the computation of the overall costs. The Office of the Controller generates a draft CAP rate yearly to be used for computing indirect costs of special services. The draft CAP rate is approved by the designated federal agency prior to being distributed as the official CAP rate. The process to approve the CAP rate usually takes about a year. There is seldom a difference between the draft CAP version and the official CAP version - CAP 29 is the exception. On September 13, 2007, the Office of the Controller issued the official approved CAP 29. The approved CAP 29 rate for Fire sworn dropped from 96.44 percent to 79.97 percent and for Fire civilian dropped froni 66.29 percent to 64.66 percent. The Hourly Rate for Cost of Special Services was recalculated and determined to be $145 per hour (a reduction of 8.2 percent from the current $158 per hour). Due to the reduction in the official approved CAP 29 rate, it is proposed that the Hourly Rate Cost of Special Services be reduced to $145 per hour to compensate for the reduction in overhead costs. The following sections of the L.A.M.C. pertain to the recommended fee adjustments: 1. Continuing Permit Activities - L.A.M.C., Section 57.04.12 - Permit Processing and Annual Permit Inspection.

Miscellaneous Divisions 1, 5, and 6 Activities (L.A.M.C., Sections 57.01.28, 57.01.30, 57.05.14, 57.05.15, and 57.06.15). Conclusion: An adjustment in the Hourly Rate is consistent with the City's financial policy of full cost recovery for specialized services. Based on the time required to obtain City approvals, it is anticipated that the proposed reduction in the Hourly Rate to $145 per hour would take effect in April 2008.
