Chapter 95 FENCING 19.95.001: Purpose 19.95.002: Applicability and Definitions 19.95.003: Residential Fencing 19.95.004: Building Permit Required 19.95.005: Fencing Materials 19.95.006: Visual Obstructions 19.95.007: Fencing Between Incompatible Uses 19.95.008: Fencing For All Uses Along Collector And Arterial Streets 19.95.009: Fences For Recreational Use 19.95.010: Double Fencing 19.95.011: Fence Maintenance 19.95.012: Fence Height Measurement 19.95.001: PURPOSE: The purpose of this chapter is to promote architectural compatibility, individual property safety, sound attenuation, and vehicular and pedestrian safety through fence/wall, design, height, and placement. 19.95.002: APPLICABILITY and DEFINITIONS: Fence/wall means any tangible barrier, an obstruction of any material, a line of obstacles, latticework, screening material, wall, hedge, or continuous growth of shrubs or trees with the purpose of or having the effect of preventing passage or view across the fence line. The provisions of this ordinance may be superseded by specific regulations found in other chapters. Where conflicts exist the goal of safety shall prevail. Double fencing means fences running parallel with each other, which are located with a separation distance less than six feet. Properly gated or accessible fences running parallel with each other with separation distances greater than six feet shall not be considered a double fence. 19.95.003: RESIDENTIAL FENCING: A. Applicability: Except as provided below the requirements of this section shall apply to any fence located on a lot or parcel in a residential zone. The requirements of this section do not apply to any fence located on a lot or parcel in the Foothill & Canyon Overlay Zone, sections 19.32.040(C)(11), 19.66.050(4), 19.77.050, 19.80.030(E), and 19.80.035(B) and (C). The requirements set forth in the Foothill & Canyon Overlay Zone shall apply to any fence located on a lot or parcel in the Foothill & Canyon Overlay Zone. B. Front Yard Setback: Within a front yard setback or along a front lot line: 1. A solid fence shall not exceed three feet in height; 2. An open type fence, e.g., wrought iron, shall not exceed four feet in height;

3. If a front yard is adjacent to a street considered a major collector or arterial street, generally defined with a right-of-way greater than or equal to 66, a solid or open fence may be erected no closer than five feet from the streetside property line. Such fences may be erected to a height of 6 feet and the five foot setback from the property line shall be permanently landscaped and maintained by the property owner with a combination of low maintenance live and inert materials including trees or decorative shrubs (one per 150 square feet of that area). Xeriscape may be substituted but shall include the shrubs and/or trees required. Drip irrigation is required for all low maintenance landscapes. C. Side and/or Rear Yard Setback: A fence which exceeds eight feet in height shall not be constructed: 1. Within a side yard and/or rear yard, or 2. Along a side yard or rear yard lot line. 3. Where a rear yard lies adjacent to a street considered a major collector or arterial street, generally defined with a right-of-way greater than or equal to 66, a solid or open fence may be erected no closer than five feet from the streetside property line. Such fences may be erected to a height of 6 feet and the five foot setback from the property line shall be permanently landscaped and maintained by the property owner with a xeriscape theme but include live trees or shrubs every 100 square feet. Drip irrigation is required for all low maintenance/xeriscape landscapes. 19.95.004: BUILDING PERMIT REQUIRED: A building permit may be required for any fence/r wall., as required by the current version of the International Building Code or International Residential Code.. 19.95.005: FENCING MATERIALS: A. Fences and walls shall be made of high quality, durable materials that require minimal maintenance. The following fencing materials shall be allowed in all zones, except as otherwise provided in subsection A-2 or by a more restrictive provision in this chapter: 1. Architecturally designed brick, stone, or block, or pre-cast concrete. 2. Decorative precast concrete or integrally colored and textured block, brick, stone, or other masonry materials, solid or private heavy gauge beige and/or white vinyl, polyethylene, or similar materials composite materials, chain link, chain link with slats, cement, stucco, corrugated metal with wood or contrasting posts, wood, and 3. Hedges or vines on fences/walls. B. The following fencing materials shall be prohibited in all zones:

1. Materials not typically used or designated/manufactured for fencing such as used metal roofing panels, pallets, tarps, chip board, or plywood; 2. Scrap materials such as scrap lumber and scrap metal; 3. Barb wire; 4. No fence shall be permitted east of I-215 which has points that could impair wild animals and/or is over 4 feet in height 19.95.006: VISUAL OBSTRUCTIONS: A. Corner Lot Visual Obstruction: No obstruction to view which exceeds three feet (3') in height shall be placed in the clear view area as set forth in sections 14.12.040 and 19.76.160 B. Driveway Visual Obstruction: No obstruction to view in excess of three feet in height shall be placed at any driveway or automobile accessway within the triangular area formed by connecting the points of intersection of the side driveway or accessway line and the property or side street line with points 12 feet along the property line and 12 feet along the driveway line. 19.95.007: FENCING BETWEEN INCOMPATIBLE USES: Whenever a lot is developed with a use that is different than a use located on an abutting lot or parcel, the new development shall include installation of a fence/wall along the property line between the different uses as provided in this section. A. Residential and Commercial Uses: A minimum six foot high decorative precast or integrally colored and textured block, brick, stone, or other masonry fence and/or wall shall be installed between residential uses and commercial uses. C. Commercial or Office and Agricultural or Residential Zones: A minimum six foot high decorative masonry wall is required between commercial or office zones and agricultural or residential zones. Other fencing or landscaping techniques may be used to buffer waterways, trails, parks, open spaces or other uses. D. Warehousing or Manufacturing and Residential, Commercial, or Professional Office Uses: A minimum six foot high solid vinyl, simulated or composite wood, wrought iron or masonry fence is required between warehousing or manufacturing uses and residential, commercial, or professional office uses. Other fencing or landscaping techniques may be used to buffer waterways, trails, parks, open spaces or other uses. E. Higher Fence or Wall: Notwithstanding the foregoing provisions, the planning commission may require a higher fence or wall if anticipated detrimental effects are considered greater than standard requirements can mitigate for such conflicts as slope, height, or noise. 1. Where the use includes outside storage or activities that would be insufficiently buffered by a lower fence or a fence that allows too much light penetration or offers insufficient sound attenuation

2. Slopes/grades change from one property to the next so that a taller wall or fence is required on the lower side 19.95.008: FENCING FOR ALL USES ALONG COLLECTOR AND ARTERIAL STREETS: A. Applicability: Unless otherwise allowed by the planning commission, whenever a lot or parcel is proposed to be developed which abuts a public right-of- way major or generally having a right-of-way greater than or equal to 66, a minimum six foot high fence/wall shall be installed a distance of 5 from the street right-of-way line adjoining the lot or parcel as provided in this section. The five foot setback area shall be permanently landscaped and maintained by the property owner with a combination of low maintenance live and inert materials including trees or decorative shrubs (one per 150 square feet of that area). Xeriscape may be substituted but shall include the shrubs and/or trees required. Drip irrigation is required for all low maintenance landscapes. B. Materials: A wall located 5 from the right-of-way line shall be constructed of masonry or precast concrete in a style and color consistent with existing walls already installed along the length of the street. If no other fence/wall has been constructed along the street, the fence shall have a style and color consistent with other fences in the vicinity. C. I-15 and I-215 Noise Walls: Any development abutting the I-215 Corridor shall include construction of a noise wall along the corridor right-of-way line if the Utah Department of Transportation determines such wall is necessary pursuant to an environmental study. Noise walls may be erected in violation of the height and location requirement of this Chapter. 19.95.090: FENCES FOR RECREATIONAL USE: On interior of residential uses, side and rear lot lines, fences for uses such as tennis court enclosures, sport courts, hot tubs/jacuzzis, and ball diamond backstops, may be erected to a height greater than eight feet, but shall not exceed a height of 18 feet and shall be located at least 10 from the property line 19.95.010: DOUBLE FENCING: Double fences shall be prohibited except when located adjacent to an existing active agricultural use. This requirement means that owners who wish to construct a fence may need to tie their fence into an existing fence located on an adjacent lot or parcel unless the fence is not deemed a double fence19.95.020. 1 19.95.011 FENCE MAINTENANCE. All fencing shall be properly maintained in good condition by the property owners adjacent to the fence. 19.95.012: FENCE HEIGHT MEASUREMENT: When a difference in grade exists on either side of a fence/ wall, the height of the fence or wall shall be measured from the height of the higher property within 5 of the property line but shall not exceed 12 in total height for the combination of the two properties. Retaining walls are considered a part of the fence height.
