PLEASE READ THE FOLLOWING NOTES CAREFULLY: (a) Applications normally are approved, denied, or approved with modifications within 30 days of receipt by the Architectural Review Committee, or as soon thereafter depending upon the date of the regularly scheduled monthly meeting of the Architectural Review Committee. Failure to submit an application for exterior changes, or not adhering to approved applications, will result in non-approval when the Homeowner sells their property. This can cause a delay in closing, until violation is cleared by the Architectural Review Committee/Board of Directors. All associated costs will be the responsibility of the Homeowner. (b) All approvals are subject to the Town of Brookhaven s regulations. Any problem resulting from the Homeowner s change or installation will be the sole responsibility of the Homeowner. (c) Any deviation from your plan as presented and approved, will result in the final approval being denied. (d) Homeowner agrees that the responsibility to repair and maintain the (applied for) change or installation rests solely with the Homeowner, and does not and will not become the responsibility of the Homeowners Association. (e) You may begin the project upon receipt of approval from the Architectural Review Committee. (f) When the project has been completed, the Homeowner must inform the Architectural Review Committee so that a final inspection can be made. Clothes Dryer Exhaust Vent Policies In the Timber Ridge built dwellings the exhaust venting design for the two bathrooms and for the clothes dryer are connected to a common roof vent. The combined action of the bathroom exhaust systems (condensation) and the clothes dryer exhaust system (lint plus condensation) are causing the roof mounted termination device to clog. This is both a safety problem and requires the use of additional energy to dry a load of clothing. As a solution, some of the residents have had the 3 way roof mounted termination system changed. That is, they had the clothes dryer exhaust system separated from the two bathroom systems and installed a separate outdoor termination device for the clothes dryer. This additional termination device was either installed on the roof or through the side of the dwelling. In some cases this has created a problem for the adjacent neighbors. The following is now policy with regard to the installation of the second exhaust vent for a clothes dryer. This applies to either a Leisure Technology or Timber Ridge built dwelling. NOTE: An Architectural Review Committee application must be submitted before work can begin. This will result in a field inspection and ensure that our policies are observed. POLICIES a). If a second or alternative exhaust vent is going to be installed at the roof line, it must be installed to the rear of the dwelling. With regard to the unattached dwellings it may be difficult to mount the roof vent on the rear of the dwelling, therefore, exceptions may be allowed depending on field conditions. In addition, with regard to the roof mounted exhaust device, care should be given to the direction that the additional roof vent will be facing, that is it should not face a neighboring dwelling. After installation, the HOA will have the roof inspected to ensure that the integrity of the roof was not compromised. This is because the Association is responsible for the repair of your roof. b). If the exhaust vent is to be located and run through the side of a dwelling, it should not as a matter of courtesy be spewing out lint and a fabric softener odor into or onto a neighbor s dwelling, especially where there are windows and/or a main entrance door. Based on information from a professional engineer and a knowledgeable dryer vent contractor, we are informed that there are no concrete specifications to determine the allowable distance from a side mounted wall vent to a neighbor s property, therefore, approval is primarily dependent on field conditions, that is the proximity to a neighbor s door or window. If per chance you decide to use a side wall exhaust vent and your neighbor states that it is okay, then that approval must be in writing. If you don t obtain permission in writing, the Architectural Review Committee will not approve your request for the placement of a side wall mounted exhaust vent. Moreover, any ensuing disagreement between neighbors will not be settled or involve the Board. Please Note: Architectural Review Committee approval is required before work can begin. PROCEDURE FOR INSTALLATIONS TO A RESIDENTIAL ROOF & AGREEMENT REGARDING THE INSTALLATION OF ANY PENETRATION TO THE ROOF PROCEDURE: An application must be submitted to the Architectural Review Committee for permission to allow the installation of any of the following items on the roof of a dwelling: awning (roof-mounted or side mounted) attic fan (new or replacement) bath fan vent dryer vent skylight (new or replacement) solar tube lighting satellite dish/television antenna a separate additional flue for the new high efficiency furnaces and/or tankless hot water heater vents Any item that penetrates or alters the roof shingles It is mandatory that the resident must notify the Architectural Review Committee when the work is completed. AGREEMENT REGARDING THE INSTALLATION OF ANY PENETRATION TO THE ROOF In consideration of the approval of the Board of Directors of Leisure Glen Homeowners Association, Inc. for the installation of any of the following: roof dryer vent/attic fans/awnings/skylights/solar tube lighting/ a separate additional flue for the new high efficiency furnaces and/or tankless hot water heaters, any item that penetrates or alters the roof shingles, the undersigned hereby agrees as follows: 1. That no penetrations are allowed in the street facing side of the house except for allowable solar light tubes as pictured (maximum 2). 2. That the installation, maintenance, repair and replacement of the aforementioned items will be performed by the undersigned at their sole cost and expenses, to the reasonable satisfaction of the Board of Directors. 3. The undersigned hereby waives the right to make any claims against the Leisure Glen Homeowners Association, Inc. for any damages, direct or consequential, arising as a result of the installation to any of the above items. 4. The undersigned agrees to hold harmless and indemnify the Leisure Glen Homeowners Association, Inc. members of its Board of Directors, agents and employees from and against all losses, costs and damages, including reasonable attorney s fees, arising from the installation, use and/or maintenance of the above mentioned items. 5. This Agreement shall be a covenant running with the land and shall bind all successors and assigns of the undersigned.
