PERMIT TO ALLOW USE OF AN AGVET CHEMICAL PRODUCT FOR: EMERGENCY USE IN POTATOES, and MINOR USE IN SPECIFIED FRUIT AND VEGETABLE CROPS PERMIT NUMBER -PER9160 This permit is issued to the Permit Holder in response to an application granted by the APVMA under section 112 of the Agvet Codes of the jurisdictions set out below. This permit allows a person, as stipulated below, to use the product in the manner specified in this permit in the designated jurisdictions. This permit also allows any person to claim that the product can be used in the manner specified in this permit. THIS PERMIT IS IN FORCE FROM 29 NOVEMBER 2007 TO 31 DECEMBER 2010. CONDITIONS OF USE Products to be used: Table 1: CONFIDOR GUARD SOIL INSECTICIDE plus other registered products containing 350 g/l IMIDACLOPRID as its only active constituent. Directions for use: TABLE 1 EMERGENCY USE IN POTATOES WITH CONFIDOR GUARD SOIL INSECTICIDE RESTRAINTS: DO NOT apply more than one soil application of Confidor Guard Soil Insecticide to crop. DO NOT use any other group 4A insecticide as a foliar spray after soil application of this product to that crop. DO NOT apply via surface trickle irrigation or any other type of above ground irrigation system. Crop Pest Rate Critical Use Comments Potatoes SILVERLEAF WHITEFLY (Bemisia tabaci) BIOTYPE B Apply 14mL of product per 100 metre row. Soil treatment by subterrainean trickle irrigation; Apply 5-7 days after planting out. Begin injection only after water has reached the furthest drip points and soil is partially wetted up. After injection is completed, continue irrigation only until lines are flushed, not longer than 1 hour. Subsequent irrigations should occur only when soil moisture measurements indicate the need for addition of water. DO NOT over irrigate or cause run off. In situations where root development in the crop is slow, evidence of control may be delayed. State: QLD only Furrow spray pre-plant: Mix product with water and apply in at least 2 litres of spray mixture per 100m of row. Apply to an open furrow as a narrow band spray centered under the plant row, immediately prior to planting of potatoes or as part of the planting process. DO NOT spray potato seed pieces with Confidor. DO NOT leave Confidor exposed to sunlight. Sprayed soil should be covered immediately. After the final shaping of the planting bed, the treated layer of soil should be approximately 100mm below the soil surface. At planting, steps should be taken to ensure workers do not contact treated soil. Withholding Periods: NOT REQUIRED WHEN USED AS DIRECTED. PER9160 Permit Version 1 Page 2 of 5

Directions for use (continued): TABLE 2 MINOR USE IN SPECIFIED CROPS WITH CONFIDOR 200 SC INSECTICIDE RESTRAINTS: DO NOT apply more than two applications of Confidor 200 SC Insecticide to each crop. DO NOT use any other group 4A insecticides as a foliar spray after this application to that crop. Apply as a foliar application only. Apply at the first sign of infestation or at appropriate pest thresholds as recommended by the local DPI. Ensure complete coverage of all plant surfaces. Best results are obtained when applied at the start of flowering, however caution should be exercised as this product is toxic to foraging bees. See Precaution below. Withholding Periods: TROPICAL FRUITS: DO NOT harvest for 21 days after application. DO NOT graze any treated area or cut for stock food. DO NOT feed produce harvested from treated area to animals, including poultry. CELERY: DO NOT harvest for 3 days after application. CUCUMBER: DO NOT harvest for 1 day after application. ASIAN ROOT VEGETABLES, PEPPERS AND CAPE GOOSEBERRY: DO NOT harvest for 7 days after application. Additional Conditions (all uses in this permit): PROTECTION OF WILDLIFE, FISH CRUSTACEANS AND ENVIRONMENT: Imidacloprid is toxic to certain aquatic species. Application should be planned to avoid run-off within 48 hours of application. Application should not be made to wet/waterlogged soils. Application is not to be performed if heavy rains are expected to occur within 48 hours. Irrigation within 48 hours of application should be minimal. TO AVOID CROP DAMAGE: The sensitivity of some species and varieties of the crops to be treated under this permit has not been fully evaluated. It is advisable, therefore, to only treat a small number of plants to ascertain their reaction before treating the whole crop. This permit provides for the use of a product in a manner other than specified on the approved label of the product. Unless otherwise stated in this permit, the use of the product must be in accordance with instructions on its label. Persons who wish to prepare for use and/or use products for the purposes specified in this permit must read, or have read to them, the details and conditions of this permit.
