FEE SCHEDULE FOR CONSULTING L. EARLE GRAHAM Hourly Rate Case Review: $275 per hour for professional services rendered including consultation, case material review, site inspection, research, report writing, travel. Deposition: $275 per hour with payment received at time of deposition from deposing counsel. The Law Firm is responsible for notifying deposing counsel of immediate payment requirement. Arbitration & Trial: $275 per hour with payment of fees based upon anticipated services, due at or before time of testimony. Project Work: Pricing quoted following initial consultation as indicated below. Billing based on hours of engagement and invoiced weekly. Retainer $1,500; due upon first consultation. If the case/project is not accepted after being evaluated, the retainer will be refunded less the billable time spend in review. If the case/project is accepted or Consultant is designated as the law Firm s expert witness, the retainer is non-refundable and will be applied toward future billings in the case/project. Payment of retainer fee will constitute approval to designate Consultant as expert witness. Travel Auto mileage is charged at $.60 per mile. Air travel, ground transportation, and lodging cost are payable in advance or prepaid directly by law Firm. Meals and incidental expenses will be billed at cost. The hourly fee for travel is calculated portal-to-portal. Invoices Itemized invoices are due and payable upon receipt. Any unpaid balance in excess of 30 days will reflect a service charge of 1.5% per month. Work may cease on any case with a balance that is delinquent more than 45 days. Work will not resume until the balance is paid in full and advance payment is received for all future work.

Financial Agreement and Acceptance of Consultant This Financial Agreement, as specified in the Fee Schedule, is between the Law Firm and L. Earle Graham. As such, contingency agreements are not acceptable and the Law Firm, not the Law Firm s client or insurance carrier, will be responsible for, and personally guarantees, payment of all billings. The Law Firm agrees to pay all expenses incurred by Consultant, including his time, in the collection of delinquent fees and that any subsequent legal proceedings will be litigated in Orange County. If this Agreement accurately represents your understanding of the terms of this engagement, please sign and return the Agreement.
