FOR THE PURCHASE AND INSTALLATION OF EQUIPMENT FOR REESE'S RETREAT I! UNIVERSALLY ACCESSIBLE PLAYGROUND AT BROOKSIDE PARK i RECOMMENDATION: It is recommended that the City Council: 1. Find that the activity described herein is consistent with the project that was analyzed in the Arroyo Seco Master Environmental Impact Report that was certified by the Council on September 26, 2005. There are no changed circumstances or new information which would trigger further environmental review; 2. Authorize the issuance of a purchase order to Landscape Structures, Inc., in an amount not to exceed $268,028.34 for the purchase of playground equipment for Reese's Retreat Playground at Brookside Park. Competitive bidding is not required pursuant to City Charter section 1002(H), contracts with other governmental entities or their contractors for labor, material, supplies or services. Grant the proposed contract an exemption from the competitive selection process of the Competitive Bidding and Purchasing Ordinance pursuant to Pasadena Municipal Code Section 4.08.049 (B), contracts for which the City's best interest are served; and 3. Accept the bid, dated June 2, 2010, submitted by Big Ben, Inc. in response to the specifications for Reese's Retreat Playground and Walkway Replacement for installation and construction of project; reject all other bids received; and authorize the City Manager to enter into a contract not to exceed $624,344.40. i [ MEETING OF 06/21/2010 4 - -. Page 2 of 5 BACKGROUND The project will provide for installation of new universally accessible playground and site amenities at Brookside Park. Reese's Retreat Playground will be located behind the Aquatic Center. Due to its location in a Citywide park and nearby amenities that are geared to serve large numbers of users, the proposed playground is a larger and more elaborate playground that those that exist at other City parks. The playground will be barrier free and will offer unique accessible features that will make this a one-of-kind facility in the City for all users. The work includes the removal of existing walls, soil, turf, curbs, walkways and the installation of new play equipment, curbs, walls, ramps, walkways, seat walls, steps, site amenities, shade structure, guard rail, drainage, irrigation, and landscaping. This project is included in the City's adopted FY 201 0 Capital Improvement Program. The playground design features a nautical and pirate ship theme. This, in conjunction with the desire to provide a variety of sensory play experiences necessitates some nonstandard equipment as provided by Landscape Structures, Inc. The City has installed Landscape Structures play equipment in 15 playgrounds. The quality of this equipment is outstanding and the customer service has been excellent. The play equipment and layout was designed specifically for the site with unique accessible features, ramps and platforms. The continuity of parts and staffs familiarity with equipment repairs provide an additional benefit. The construction documents specify Landscape Structures play equipment for use at this park. Staff has determined that the use of a "piggyback" contract to purchase this equipment would be more efficient than purchasing it as part of the construction contract. The County of Mecklenburg, North Carolina, recently completed a competitive bidding process and established a buying agreement (Contract number 040377), with Landscape Structures, Inc., to purchase playground equipment. Purchasing the playground equipment using the Mecklenburg County contract is in the City's best interest as it will enable the City to receive a discount of 8% off 201 0 list pricing (total savings $1 9,929). For the site construction portion of the project, plans and specifications were prepared by the Department of Public Works in accordance with Section 4.08.070 of the Pasadena Municipal Code, bids have been requested and received. The project was advertised in the Pasadena Journal on May 13, 2010. In addition, the Notice Inviting Bids was published in two trade publications and two websites. Bid packets were obtained by 31 contractors, 12 of whom submitted bids for the project.

Y&M Construction, Inc., Gardena, Ca. Engineer's Estimate $ 788,162.00 The total bid price of the improvements from the lowest responsive bidder was 28% lower than the Engineer's Estimate which is likely due to the competitive nature of the industry and the conservative approach in preparing the estimate. It is recommended that Big Ben, Inc. be awarded the contract for this project as they are the lowest responsive and responsible bidder and that all other bids be rejected. The proposed contract with Big Ben, Inc. fully complies with the competitive bidding ordinance and the rules and regulations promulgated thereunder as did the Contractor selection process. The Contractor has indicated that the award of this contract will result in no new hires to the present workforce. It is anticipated that construction will begin in July 2010, and will be completed by November 201 0. The proposed contracts will be as follows: Landscape Structures, Inc. June 21,201 0 Page 4 of 5 COUNCIL POLICY CONSIDERATION: This project furthers the City Council's goals to "Improve, maintain and enhance public facilities and infrastructure" and "Improve Accessibility throughout the City". It is also consistent with the Cultural and Recreational elements of the General Plan by increasing the range of recreational facilities and services as a means of improving the quality of life for Pasadena residents. This project also supports the Urban Environmental Accord action item 10 regarding providing public park space. ENVIRONMENTAL ANALYSIS: The Reese's Retreat playground was included in the Central Arroyo Seco Master Plan, Section 4: Recommendations and in the accompanying Master Environmental Impact Report (MEIR). The specific Master Plan recommendation was: Develop a new large children's play area east of the Rose Bowl Aquatics Center in the location of the abandoned play area. Remove obsolete play equipment and remove large mounds. Install medium-sized play area at the entrance to the park. Disabled access and disabled children's play equipment should be included. Consider a joint City/community-based process for design and construction of the play area. No environmental impacts related to this project were identified in the MEIR and the implementation of this project does not trigger any changes to the MEIR. All mitigation measures from the MEIR that are applicable to the project will be applied.
